Right to leave - R10

• Permission granted by competent authority at it discretion

• Not to be claim as a matter of right• May be refused or revoked by competent

authority.

Consideration for sanctioning: R11

• Who can be spared• Amount of leave due to the various applicants• Last returned from leave• Whether compulsorily re-called from his last

leave• Whether leave refused in the public interest

Commutation of one kind of leave into another: R14

• At the request of the employee• Leave may commute it retrospectively into

leave of a different kind• Which due and admissible to him at the time

the leave was granted• Not matter of right• Subject to adjustment of leave salary

Combination of different kinds of leave: R15

• May granted• Except casual leave. Which is not recognized

as leave under these rules

Maximum period of continuous leave: R16

• No employee shall be granted leave of any kind for a continuous period exceeding five years

• Unless government in view of the exception

Formal joining of duty at the end of leave with the intention of taking leave again not permitted:R17

• Joining duty at the end of leave with the intention of taking leave again within a few days should not be permitted.

• Discretion of competent authority to grant or refuse the leave.

Temporary transfer or foreign service: R18

• Rules should apply while on temporary transfer to the central government or other state government or while on foreign service in India.

• Foreign employer grant leave not exceeding 120 days.

• If exceed the days, same should be submitted to competent authority through his present employer.

Carry forward of leave balance of temporary employee :R21

• Temporary employee with at least one year’s of continuous service is appointed to another permanent or temporary post under government

• interruption in service not exceed 6 days between two service.

• All kind of leave at his credit in the previous service shall be credited to his leave account in the new service.

Leave at credit to cease on removal or resignation: R22

• Any claim to leave to the credit of a employee who is dismissed or removed or who resigns form service, ceases from the date of such dismissal or removal or resignation.

• Temporary employee, who discharged due to reduction of establishment and re employed, leave balance shall be carry forward

• provided no break in service or break in service not more than 30 days is converted in to joining time with or without pay.
