NOVA SHRM PULSE DECEMBER 2014
Well the weather outside may not be frightful yet, but it has definitely been a chilly winter in
the Northern Virginia area!
It has been such a successful year for the Northern Virginia Society for Human Resource
Management (NOVA SHRM) Chapter. A recap of what was accomplished in 2014 includes the
following:
The presence of the SHRM Foundation was brought to the forefront for many of our
members, who contributed over $2K in total;
Our Special Interest Group (SIGs) attendance records increased by 20% over the past 12 months;
We added another educational affiliate to our list this year Virginia Tech's MBA Program, located in t
Ballston area;Hosting our first March Madness, Summer Ice Cream Social and Membership Summer promotion wer
incredible ways to engage and connect with our current members as well as atlarge members;
Two successful Members in Transition (MITs) events, serving the population of our Chapter who are in
between roles were well attended and the number of MITs is decreasing;
Our 1st Annual Joint Chapter Career Fair (HiRe Expo) for HR and Administrative professionals had 16
employers and approx. 175+ attendees. We are planning our 2nd Annual Fair for the spring season of
2015;
We are in the final stages of launching our new website, which should be going live in early January 20
NOVA SHRM celebrated its 35th anniversary this year at the Artisphere Gallery in Arlington. Past
Presidents', members and family reminisced the last three and half decades of this incredible Chapter
achievements!

If Marijuana is Legal Where I Work, I Can't Be Fired for OffDuty Use, Right?
Wrong!
More and more cities and states are legalizing the use of marijuana for medical andrecreational use, including the District of Columbia. The good news is that means in those
jurisdictions the local and state police will not arrest you if your use conforms to the local/state lawmedical
states require a prescription and recreational use laws usually limit the amount of marijuana one can possess
In addition, federal prosecutors, at least under the current administration, will not prosecute you for use wh
is legal under state and local laws.
Now the bad news. Marijuana use is still illegal under federal law, 21 U.S.C. 801 et seq., since it is listed as
schedule 1 controlled substance. That means its use is not protected by the Americans With Disabilities Act,
U.S.C. 12101 et seq., ("ADA") because the ADA does not protect the current use of an illegal drug. Moreov
most employees are atwill employees, so they can be fired for good cause, bad cause, or no cause. Thus, if
employer wants to fire employees who use marijuana away from work, it is likely that the employer can legado so.
That said, time often proves that the law is not always as clear as it seems, and courts can apply unexpected
interpretations to statutes. Most lawyers know never to say never. So employers may be cautious at the
beginning of this new stage in the history of marijuana use and the law. We have come a long wayfrom the
days when marijuana use resulted in 25year prison sentence, to now its use is actually legal under some loca
and state laws. Where the future will take use remains to be seen.

Experts: Personal Data Not Secure on Health Insurance Exchanges
Hackers could gain access to the personal data of Americans who use the federal and state health
insurance exchanges, according to two government reports and experts on electronic data security.
The exchanges, created under the federal Affordable Care Act (ACA), are working to improve the
protection of personal data provided by individuals as they apply for insurance coverage, according
to the reports and experts. However, much remains to be done, and some experts say that the

"One hundred percent security is impossible," said Kenneth K. Dort, a partner in law firm Drinker
Biddle's Intellectual Property Practice Group in Chicago. "The name of the game is risk
minimization."
There has already been one reported breach of the federal Healthcare.gov website. On Sept. 4,
2014, the Centers for Medicare & Medicaid Services (CMS), which runs the exchange, said that a
hacker or hackers uploaded malware on a server that supports the exchange website but does notcontain users' personal information.
Some states operate their own insurance exchanges; others allow the federal government to run
theirs. All exchanges that receive federal funds are bound to stringent data security rules. However,
compliance remains a massive challenge.

When Workers Won't Retire, Workforce Challenges Arise
Organizations can face unintended consequences when retirementeligible employees remain in
place because their total rewards packages contains incentives not to retire.
"If 4 percent of your population is retirement eligible and half of those people choose to delay
retirement, the effect could be that 10 percent of your employees experience promotion blockage,"
said Arthur L Noonan, a senior partner and actuary at Mercer. "This means 1,000 employees would
experience promotion delays in a 10,000 employee firm."
Noonan spoke at the Employee Benefit Research Institute's winter policy forum, held recently in
Washington, D.C.
Decisions about benefits design typically are made around financial metrics such as the cost for
employers. That could be shortsighted, said Noonan, because "at the end of the day, it is labor
productivity that drives true labor costs."
When people don't advance through the ranks because older workers are staying put, they become
frustrated. And despite many predictions of boomers retiring at high rates and draining talent and
expertise from their organizations, in many cases they seem locked down, as if proclaiming, "We
won't go."
The resulting low "velocity" of talent movement can have negative consequencesespecially for
businesses whose strategy calls for attracting and promoting new talent. In these instance, "a
business that provides incentives for retirementeligible employees to leave would outperform one
whose incentives are disconnected from tenure," said Noonan.
To be sure, there can be negative consequences when employees do retire in large numbers. The
wellknown downsides of having an older working population include greater labor costs (due to
higher compensation and increased health and disability claims). But on the plus side, older workers
may be more productive than lessexperienced new hires. How the positives and negatives weigh
against each other will differ from company to company and from industry to industry. As a result,
the optimal workforce management and total rewards strategies will differ among organizations.
