COURSE: CYBERSECURITY (PROJECT LEAD THE WAY) Approve the new regular status general CTE concentration course outline for CAMS and Beach Academy at Polytechnic High School, entitled Cybersecurity (PLTW). The new course outline reflects the Linked Learning guiding principles and the LBUSD Strategic Plan’s goals and objectives PLTW Cybersecurity gives students a broad exposure to the many aspects of digital and information security, while encouraging socially responsible choices and ethical behavior. Approve participation in the California State University, Long Beach’s Science Education Experience to Help Underserved Students Succeed (SEE US Succeed) summer program. In addition to providing homeless and under-represented students with rich, hands-on science experiences, students will also be exposed instruction that addresses career awareness, the importance of education, and college readiness. Participating students will receive lab books, simple school supplies/simple science equipment, and a camp shirt. Teams of prospective science teachers from CSULB plan the curriculum, implement lessons, and gather the equipment

and supplies needed for inquiry-based science projects. The summer program will be held at CSULB science labs and lunch and transportation to and from camp will be provided. RESOLUTION NO. 022019-A
BOARD OF EDUCATION OF THE LONG BEACH UNIFIED SCHOOL DISTRICT
NON-REELECTION OF TEMPORARY CERTIFICATED EMPLOYEES
A. General Recitals
1. WHEREAS, the Board of Education employs temporary certificated employees pursuant to Sections 44909, 44918, and 44920 of the Education Code; and
2. WHEREAS, Education Code Section 44916 requires a temporary certificated employee to receive notice, prior to the first day of paid service, of the temporary nature of the employment and the anticipated length of service; and
3. WHEREAS, each employee classified as a temporary certificated employee pursuant to Sections of 44909, 44918, and 44920 of the Education Code received notice, prior to their first day of paid service, of the temporary nature of the employment and anticipated length of their service; and
4. WHEREAS, Education Code Section 44954 provides that the Board of Education shall notify temporary employees in a position requiring certification qualification of the District’s decision to release the employees from such a position prior to the next succeeding school year; and
5. WHEREAS, through this resolution, it is the intent of the Board of Education to release each temporary certificated employee employed for the 2018-2019 school year effective no later than the last school day of the school year.
B. Employment of Temporary Employees as Leave Replacements Pursuant to Education Code Section 44920
1. WHEREAS, Education Code Section 44920 permits the Board of Education to “employ as a teacher ... any person holding appropriate certification documents, and may classify such person as a temporary employee” “based upon the need for additional certificated employees during a particular semester or year because a certificated employee has been granted leave for a semester or year, or is experiencing long-term illness”; and

3. WHEREAS, the above-listed employees may be released pursuant to Education Code Section 44918 and 44954 regardless of any expiration of a contract or a specially funded project; and
4. WHEREAS, the Board of Education of the Long Beach Unified School District has determined to release the above-listed employees at the conclusion of the current 2018-2019 school year and not to re-elect the above-listed employees for the 2019-2020 school year.

WHEREAS, Education Code Section 44909 permits the Board of Education to “employ persons possessing an appropriate credential as certificated employees in programs and projects to perform services conducted under contract with public or private agencies, or categorically funded projects which are not required by federal or state statutes”; and
2. WHEREAS, Education Code Section 44909 provides, “Such persons may be employed for periods which are less than a full school year and may be terminated at the expiration of the contract or specially funded project without regard to other requirements of this code respecting the termination of probationary or permanent employees other than Section 44918”; and

WHEREAS, Education Code Section 44909 requires the “terms and conditions under which such persons are employed shall be mutually agreed upon by the employee and the Board of Education and such agreement shall be reduced in writing”; and
4. WHEREAS, each of the above-listed individuals was employed pursuant to a mutually agreed-upon contract between the employee and the Board of Education and for the term of the contract or project; and
5. WHEREAS, the employees were hired to perform services conducted under contract with public or private agencies or categorically funded projects which are not required by federal or state statutes; and
6. WHEREAS, the term for each specifically fund project or contract has expired, or will expire by the termination date of each employee’s contract; and
7. WHEREAS, all categorical funds used to justify the above-listed employees’ classification as temporary under Education Code Section 44909 will be expended and therefore will expire at the end of the 2018-2019 school year; and
8. WHEREAS, no categorical funding used to justify the above-listed employees’ classification as temporary under Education Code Section 44909 has a duration beyond the 2018-2019 school year; and
9. WHEREAS, accordingly, each of the above-listed employees designated as temporary by the District under Education Code Section 44909 may be released at the end of the 2018-2019 school year without the procedural requirements applicable to probationary and permanent employees; and
10. WHEREAS, the Board of Education has determined to release the above-listed employees, whether their lawful status is considered to be temporary or probationary, at the end of the current 2018-2019 school year, and not to re-elect these employees for the 2018-2019 school year, consistent with the terms of Education Code Sections 44909, and 44954.
D. Employment of Temporary Employees to Replace Regular Employees Assigned to Categorically Funded Programs Pursuant to Education Code Section 44909
1. WHEREAS, Education Code Section 44909 further provides, “Whenever any certificated employee in the regular educational program is assigned to a categorically funded project not required by federal or state statute and the district employs an additional credentialed person to replace that certificated employee, the replacement certificated employee shall be subject to the provisions of Section 44918”; and
2. WHEREAS, the lawful status of certificated employees employed pursuant to this provision of Education Code Section 44909 is temporary; and

BACKGROUND:
On June 20, 2018, the Board of Education awarded agreement #8363.01 to PaveWest, Inc. for the replacement of asphalt paving at Grant Elementary School. During the performance of this work, several unforeseen underground conditions were found requiring the work to be delayed until solutions could be determined. These changes required approval from the Division of the State Architect (DSA) before work could resume. These changes included:
• Removal, disposed of, and replacement of unstable soil.• Fire Department requirement was to increase fire accessibility to the site. This required
the design and installation of additional underground material and asphalt to ensurelarge fire equipment could safely access the site.
In order to complete the original approved work and not unnecessarily delay completion of the project, PaveWest was directed to make these changes.
The original contract amount is $1,871,633.00. Change Order No.1 will increase the amount by $309,759.72 for a new total contract amount of $2,181,392.72. This change exceeds the limitations set forth in Public Contract Code Section 20118.4.

WHEREAS, On June 20, 2018, the Governing Board of the LONG BEACH UNIFED SCHOOL DISTRICT ("District") awarded agreement #8363.01 to PAVEWEST, INC., (“Contractor”) for PAVEMENT IMPROVEMENTS (“Project”) at GRANT ELEMENTARY SCHOOL;
WHEREAS, subsequent to the award of the contract for the Project, unacceptable base materials were found on the project site during demolition activities requiring work to be delayed until solutions could be determined;
WHEREAS, the cost for the additional work is estimated to be Three Hundred Nine Thousand Seven Hundred Fifty-Nine Dollars and Seventy-Two Cents ($309,759.72) ("Estimated Cost");
WHEREAS, the Estimated Cost is comprised of additional work due to unacceptable base materials and a requirement by the Fire Department to increase fire accessibility to the site, not identified in the contract;
WHEREAS, the Estimated Cost exceeds the limitations set forth in Public Contract Code Section 20118.4;
WHEREAS, the Contractor is intimately familiar with the Project and is ready, willing and able to perform the additional work set forth in the Change Order;
WHEREAS, it would be more costly and time-consuming to bid this additional work since it is integral to the Project and the work being performed by the Contractor;
WHEREAS, competitive bidding the additional work covered by the Change Order would result in the delay of the completion of the Project, PaveWest was directed to make these changes;
WHEREAS, the additional work must be performed before the Project can be completed and failure to complete the Project will disrupt education, and services provided to the students, staff and the public;
WHEREAS, Meakin v. Steveland (1977) 68 Cai.App.3d 490 and Los Angeles Dredging v. Long Beach (1930) 210 Cal. 348 holds that statutes requiring competitive bidding do notapply when competitive bidding would work an incongruity or not produce any advantage.

NOW, THEREFORE, THE BOARD DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That the above recitals are all true and correct, and the Board so finds and determines;
Section 2. That it would work incongruity and not produce any advantage to the District to competitively bid the completion of the additional work set forth in the Change Order.
Section 3. That the Board approved the immediate completion of the additional work stated in the Change Order without competitively bidding such work and approved the District payment to the Contractor in accordance with the terms and conditions set forth in the Change Order.
Section 4. That the additional work stated in the Change Order is necessary to ensure completion of the use of the facilities by students, staff and the public.
Section 5. The Governing Board delegates its authority to Purchasing and Contracts Director to execute all agreements and complete all necessary documents for the additional work and to otherwise fulfill the intent of this Resolution.

BACKGROUND:
The double check detector valve and associated water line, used to protect water supply from contamination, feeding Renaissance High School was upgraded to serve the new Fire Department Connection located at Renaissance High School in Long Beach. The City of Long Beach requires the dedication of existing water line easements on the school site, as described in Exhibit A. This will allow the City to service and maintain these water lines while limiting the District’s liability during the use of the area. The new easements are located in areas that are not used for classroom buildings.
Education Code Section 17557 provides that the District may dedicate easements if the Board first adopts a resolution declaring its intent to dedicate the easement in a regular open meeting by a two-thirds vote. This resolution is the first of two resolutions that the Board will consider for approval in the granting of these easements. The current resolution is only the notice of intent to grant such easements to the City of Long Beach. The second resolution will be for granting of the easements, and will be brought to the Board for consideration on March 6, 2019, at which time the Board will also be required to conduct a public hearing on the matter.

A RESOLUTION BY THE GOVERNING BOARD OF EDUCATION OF THE LONG BEACH UNIFIED SCHOOL DISTRICT GIVING NOTICE OF INTENT TO DEDICATE EASEMENTS TO
THE CITY OF LONG BEACH AT RENAISSANCE HIGH SCHOOL LOCATED AT 235 E. 8TH STREET, LONG BEACH, CA 90813
FOR DOUBLE CHECK DETECTOR VALVE PURPOSES
WHEREAS, the Long Beach Unified School District (“School District”) currently owns and operates Renaissance High School, located at 235 E. 8th Street, Long Beach, CA 90813 (“Site”);
WHEREAS, the City of Long Beach (“City”) former double check detector valves and associated water line were located within easements on portions of the Renaissance High School property and were moved during construction;
WHEREAS, new easements need to be dedicated by the School District to the City
reflecting the new locations of the easements and water lines;
WHEREAS, the School District seeks to dedicate that certain area to the City in the form of perpetual and nonexclusive easements on the Renaissance High School campus as set forth in Exhibit A, “Legal Description” of proposed easements to be dedicated, and is attached hereto and incorporated herein by this reference;
WHEREAS, the School District desires continual access to Renaissance High School for its students, parents, teachers, staff, and invitees with the least exposure to liability;
WHEREAS, pursuant to Education Code section 17556 et seq., the governing board of a
school district may convey to any public corporation, or private corporation engaged in the public utility business, any real property belonging to such School District upon such terms and conditions as the parties thereto may agree;
WHEREAS, the School District desires to provide easements to the City for the
installation, operation, maintenance and repair of, and access to, water lines and meters;
WHEREAS, pursuant to Education Code section 17557, the School District’s governing board must, prior to dedicating the easement(s), adopt a resolution declaring its intention to dedicate such easement(s) in a regular open meeting by two-thirds (2/3) vote of all of its members;
WHEREAS, pursuant to Education Code section 17557, the School District’s governing board must hold a public hearing, at its regular place of meeting, upon considering making the dedication of the easement(s); and
WHEREAS, pursuant to Education Code section 17558, the School District is required to post copies of this Resolution, signed by the board, in three (3) public places within the School District’s boundaries not less than ten (10) days before the public hearing, and publish a notice once, not less than five (5) days before the public hearing in a newspaper of general circulation published in the School District, if there is one, or, if there is no such newspaper published in the School District, then in a newspaper published in the county which has a general circulation in the School District.

NOW, THEREFORE, THE BOARD DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That the above recitals are all true and correct.
Section 2. That the School District’s governing board (“Board”) declares its intent to dedicate the easements to the City upon the terms and conditions set forth in the recitals.
Section 3. That the Board establishes March 6, 2019 for a public hearing on the question of the School District’s intent to dedicate the easements to the City.
Section 4. The School District staff shall post this resolution in three (3) public places within the School District’s boundaries and publish a notice of the adoption of this resolution in compliance with Education Code section 17558.
