Other Activities Including Risk Management Measures
Constructed works that prior to the certification date for the purpose of submitting the RSC for filing, were required to control or otherwise mitigate the release or movement of known existing contaminants at the RSC property.

Constructed works that after the certification date, are required to control or otherwise mitigate the release or movement of known existing contaminants at the RSC property.
As per Parts 4.1 and 4.2 of CPU Number 1027-9NKP9Y, the Property shall be covered by a barrier to site soils designed, installed and maintained in accordance with the Risk Assessment so as to prevent exposure to the Contaminants of Concern. The barrier to site soils shall consist of a hard cap and soil/fill cap as specified below:
The hard cap shall consist of the following:Asphalt or concrete surfaces (includes building foundation, building slab or floor slab) underlain by granular fill to a minimum depth of 225 mm; or Asphalt or concrete surfaces (includes building foundation, building slab or floor slab) to a minimum depth of 150 mm.
The soil/fill cap shall consist of the following:Granular fill and/or soil to a minimum depth of 1.0 m meeting the Unimpacted Soil concentrations for the Contaminants of Concern as set out in Schedule A of the CPU, with plants having a rooting depth no greater than 1.0 m; or Soil to a minimum depth of 1.5 m meeting the Unimpacted Soil concentrations for the Contaminants of Concerns for a radius of at least 2.4 m surrounding any plant with rooting depths greater than 1.0 m.
Monitoring or Maintenance
Soil Management Measures
Soil monitoring requirements or any requirements for care, maintenance or replacement or any monitoring or control works for known existing contaminants, if any, on the RSC property, after the certification date.
As per Part 4.2 of CPU Number 1027-9NKP9Y,
An inspection and maintenance program shall be prepared and implemented to ensure the continuing integrity of the Risk Management Measure barriers. The inspection program shall include at a minimum semi-annually inspections (spring and fall), and any barrier deficiencies shall be repaired forthwith. Results of all inspections, including analytical test results if applicable, and any maintenance performed shall be recorded in a log book maintained by the Owner and made available upon request by a Provincial Officer.
A soil management plan shall be prepared for the Property and implemented during any activities potentially coming in contact with or exposing site soils. Implementation of the plan shall be overseen by a Qualified Person. A copy of the plan shall be kept by the Owner and made available for review by a Provincial Officer upon request.
A site specific health and safety plan shall be developed for the Property and implemented during all intrusive, below-grade construction activities potentially coming in contact with or exposing site soil or ground water. The health and safety plan shall be prepared in accordance with applicable Ministry of Labour health and safety regulations, shall address any potential risks identified in the Risk Assessment, and shall include, but not be limited to, occupational hygiene requirements, requirements for personal protective equipment, and contingency plan requirements including site contact information. Implementation of the health and safety plan shall be overseen by persons qualified to review the provisions of the plan with respect to the proposed site work and conduct daily inspections. The Owner shall retain a copy of the plan, which shall be made available for review by the Ministry upon request.
Prior to initiation of any project (as defined in the Occupational Health and Safety Act, as amended) on the Property, the local Ministry of Labour office shall be notified on the proposed activities and that the Property contains contaminated soil.
Ground Water Management Measures
Ground water monitoring requirements or requirements for care, maintenance or replacement of any monitoring or control works or known existing contaminants, if any, on the RSC property, after the certification date.

Qualified Person’s Statements and CertificationsAs the qualified person, I certify that:
A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.
A phase two environmental site assessment of the RSC property, which includes the evaluation of the information gathered from planning and conducting a site investigation, a report, and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.
The information represents the site conditions at the sampling points at the time of sampling only and the conditions between and beyond the sampling points may vary.
As of 2015/02/11, in my opinion, based on the phase one environmental site assessment and the phase two environmental site assessment, and any confirmatory sampling, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that would interfere with the type of property use to which the RSC property will be put, as specified in the RSC.
Ground water sampling has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.
I have, within the six months immediately before the submission of this record of site condition, given written notice of intention to apply non-potable ground water site condition standards to the clerk of the local municipality in which the property is located and the clerk of any upper-tier municipality in which the property is located.
As of 2015/02/11, in my opinion, based on the phase one and phase two environmental site assessments and any confirmatory sampling, the RSC property meets the applicable full depth generic site condition standards prescribed by section 37 of the regulation for all contaminants prescribed by the regulation in relation to the type of property use for which this RSC is filed, except for those contaminants (if any) specified in this RSC at Table 2, Maximum Contaminant Concentrations Compared to Standards Specified in a Risk Assessment.
As of 2015/02/11, the maximum known concentration of each contaminant in soil, sediment and ground water at the RSC property for which sampling and analysis has been performed is specified in this RSC at Table 1, Maximum Contaminant Concentrations Compared to Applicable Site Condition Standards.
In relation to any contaminant excepted from the certification mentioned above as specified in the RSC at Table 2, Maximum Contaminant Concentrations Compared to Standards Specified in a Risk Assessment, or in relation to any other contaminant that in my opinion is likely to cause an adverse effect:

PHASE TWO CONCEPTUAL SITE MODEL A preliminary conceptual site model was developed as part of the Phase One ESA. Following the completion of the Phase Two ESA field program, the conceptual site model was updated to present the current Site characteristics and identify actual or potential sources of contamination, pathways, release mechanisms, receptors, and exposure routes. Additional inputs to the conceptual site model include:
Stratigraphy observed during the Phase Two ESA work program;
Results of chemical testing for the current soil and groundwater conditions at the Site; and,
Groundwater levels and interpreted groundwater flow direction. Site Overview: The site is located on the southwest corner of the intersection of Richmond Street West and Brant Street. It is currently developed with a brick building divided into a 2 storey (eastern part) and a 2 ½ storey (western part) portion, attached to a larger west adjacent building. The building footprint occupies the entire property. The attached building to the west comprises lands known by several municipal addresses, including 497, 505 and 511 Richmond Street West, and 17 Maud Street, which is also associated with former addresses of 23, 35 to 45 Maud Street.
The site is currently being utilized as a City of Toronto stores supply facility. Supplies include cleaning supplies, general office supplies (paper, printer cartridges, ect.), uniforms, health and safety supplies and clothing, etc. Vehicular access to the Site is obtained from Brant Street in the shipping and receiving area locates south of the building. Based on information obtained from the Phase One ESA, it was determined that the first developed land use at the site was for commercial use as a public market in 1837. In 1932, the site was redeveloped with its current onsite building complex, occupied by various City of Toronto departments. The general site layout is shown on Figure 2. The Phase One study area, illustrating the site and surrounding land use, is shown on Figure 3. Assessment Criteria: The generic MOE Site Condition Standards which are currently applicable to the Site are those for residential/parkland/institutional land use, medium and fine-textured soil, in a non-potable groundwater situation (MOE Table 3 Site Condition Standards). The Site is not environmentally sensitive per the definition of O. Reg. 153/04. Potentially Contaminating Activity: During the Phase I ESA, 189 Potentially Contaminating Activities (PCAs) were identified within the Phase I Study Area. The approximate locations of the PCAs are shown on Figure 3 and are summarized in Table 1, below.

Subsurface Structures and Utilities Affecting Contaminant Distribution and Transport: As the footprint of the existing building occupies the entirety of the Site, the only subsurface structures and utilites located at the RA property are associated with the building. The building does not have a basement, but is equipped with a shallow (less than 30 cm deep) elevator pit for a cable-operated lift. In addition, potable water and sanitary sewer drains are located beneath the building floor slab (other utility services enter the building through exterior walls). None of the features extend significantly below the floor slab. In general, potential preferential migration pathways for sub-surface contaminants at a site comprise buried utilities, naturally occurring sand seams, or other subsurface areas of increased

permeability. However, as the contaminants of concern largely reflect the environmental quality of historical fill materials at the time they were imported to the site (rather than contaminant releases at the site or contaminant releases on nearby properties that have migrated onto the site), the contaminants are essentially immobile. Consequently, no concerns regarding contaminant migration along preferential migration pathways are anticipated. Physical Setting of the Phase Two Property:
Stratigraphy The site is located in a physiographic region known as the Iroqouis Plain, consisting of bevelled till plains. Quaternary geology mapping confirms that the site is located in an area of lower drift deposits consisting of till comprising of fine to medium sand, laminated with clay and silt. Bedrock geology in western Toronto generally consists of Upper Ordovician shale, limestone, dolostone, and siltstone of the Georgian Bay, Blue Mountain, and Billings Formation; and the Collingwood and Eastview Members (OGS, 1991). Based on the Google Earth on-line images the elevation at the site is considered to be approximately 91 m above sea level. Based on the findings of the Phase Two ESA work program, the site is surfaced with a layer of concrete (the building floor slab) ranging in thickness from 160 to 250 mm. Beneath the surface layer lies sandy silt and/or clayey silt fill, with trace to some construction debris (cinders, brick fragments, gravel, ceramics etc.) to a depth ranging from 1.8 to 3.7 m below ground surface. (A significant portion of the fill materials appears to be reworked native materials.) Underlying the fill layer is native clayey silt till with traces to some gravel and sand. Possible bedrock was encountered at a depth of approximately 11 m below ground surface. Bedrock was potentially encountered at an approximately depth of 11.3 m (BH7) bg during the drilling program. Soils from other properties brought to the Site Soil brought from another property to the Site (fill materials) has been encountered over the entrety of the Site, ranging in thickness between approximately 1.8 m (borehole MW414) and 3.6 m (borehole BH409). Fill materials are believed to have been imported to the site for general site grading purposes, as well as use as sub-base materials beneath the building floor slab and foundation elements.

Hydrology Groundwater monitoring conducted by Terrapex in May 2013 indicated the water table was generally located in native silty clay at depths ranging from approximately 3.52 m to 4.65 m below ground surface. Calculated relative water table elevations indicated an average horizontal gradient of approximately 0.03 m/m to the southwest. Grain size analyses of four representative soil samples of the dominant stratigraphy encountered (clayey silt and sandy clayey silt) were used to estimate hydraulic conductivity at the site. The results indicated the native soils have a hydraulic conductivity of approximately 10-6 cm/s, which is consistent with 'typical' hydraulic conductivities published in literature silty clay strata (Freeze and Cherry, 1979; Domenico and Schwartz, 1990). Cross sections of the site are shown on Figures 5A and 5B. Interpreted groundwater elevation contours are shown on Figure 6. Because the footprint of the existing building occupies the entirety of the Site, and because of physical constraints associated with intrusive investigation within the building, nested or multi-level monitoring wells have not been established at the Site. However, nested monitoring wells have been established at the immediately adjacent 505 Richmond Street West property in the court yard and loading bay areas (refer to Figure 4E or Figure 4F) as part of geotechnical investigations at that property. Terrapex accessed the nested monitoring wells on July 28, 2014 and determined the following:

Although the wells identified above are, strictly speaking, off-site, they are considered to be representative of the hydraulic regime at 60 Brant Street due to their proximity to the Site. Based on the data above, it appears that vertical gradients in shallower soils at the Site are minimal, with relatively minor well elevation differences observed between wells screened over depths between approximately 1 m and 4 m and those screened over depths between approximately 4 m and 7 m. However, significant negative (descending) gradients of approximately - 0.7 m/m to - 0.8 m/m were observed between the wells screened over approximately 4 m to 7 m intervals and deeper intervals of approximately 10 m and 13 m and 12 m and 15 m, respectively. Mapping available on the Toronto and Region Conservation Authority (TRCA) website (http://trca.on.ca/the-living-city/watersheds/) indicates that the Site is located in a waterfront watershed (i.e., rain and snow drain into Lake Ontario, located approximately 1.2 km south of the Site at its closest point). The Site does not include and is not adjacent to or within 30 m of a water body. The nearest water body to the Site is Lake Ontario. Applicability of Section 41 or 43.1 of O. Reg. 153/04 The site:
is not located within an area of natural significance;
does not include and is not adjacent to an area of natural significance or part of such an area;
does not include land that is within 30 m of an area of natural significance or part of such an area;
is not a “shallow soil property” as defined in O. Reg. 153/04 (there is greater than 2 m of soil across the Site); and,
does not include all or part of a water body and does not include land that is within 30 m of a water body.
Analyses of soil samples from the site consistently indicated a pH greater than 5 and less than 9 with the single exception of sample HA415-1. However, this sample was collected from a boring advanced beneath a concrete floor slab, and it was suspected that concrete coring residue may have inadvertently been transferred to the sample. To evaluate the potential impact of concrete coring residue on the pH analysis, two duplicates of this sample (samples HA415-1A and HA415-1B) were subsequently subjected to pH

analyses, with the additional results falling within the range of greater than 5 and less than 9. Moreover, the average of all three pH analyses for sample location HA415-1 also fell within the range of greater than 5 and less than 9. As a result of the above, Sections 41 and 41.3 of O. Reg. 153/04 are not considered to apply to this site and the applicable full-depth generic Site Condition Standards may be used in the submission of a Record of Site Condition for the site. Proposed Structures The Site is currently developed with a brick building divided into a 2 storey (eastern part) and a 2 ½ storey (western part) portion, attached to a larger west adjacent building. The building footprint occupies the entire property. As the Site is listed in the City of Toronto’s inventory of Heritage Properties, the existing roof and exterior walls of the building, including walls that are coincident with the adjoining building to the west, will be retained as part of the proposed development. Notwithstanding the expectation that the existing building configuration (i.e., a building footprint that occupies the entirety of the property, and therefore the absence of landscaped areas), the Risk Assessment does include an evaluation of potential ecological receptors in the event that some future commercial development of the property may involve landscaping or similar features.

Each of the parameters listed above is being retained as a contaminant within soil for the purposes of the Risk Assessment. The locations at which contaminants have been identified at concentrations in excess of the applicable Site Condition Standards are illustrated in plan view on Figures 4A and 4C, and in profile view (cross sectional view) on Figures 5A and 5B. Identification of COCs in Groundwater Contaminants of concern were not identified in groundwater at the site, and no groundwater parameters are being retained as a contaminant for the purposes of the Risk Assessment. Origin, Extent and Distribution of Contaminants The identified impacts are considered to be related to the historical importation and placement at the site of fill materials of poor environmental quality. The impacts are not associated with a spill or leak at the site, nor are they associated with a release at a neighbouring property that has subsequently migrated to the site. Since the impacts reflect the environmental quality of fill materials imported to the Site, the identified contaminants are ubiquitous within the fill materials (refer to Figures 4A and 4C for the lateral distribution of PAHs and metallic/inorganic parameters, respectively, and Figures 5A and 5B for the vertical distribution of contaminants in Site soils). However, the impacts are confined to the fill materials themselves and do not extend to native soils (Figures 4B and 4D). Consequently, the extent of the identified soil contaminants is coincident with the extent of fill materials at the Site. Migration of Contaminants The identified impacts are considered to be effectively immobile and intrusive investigation by Terrapex has not identified any evidence that contaminants within the fill materials have migrated to other soils (e.g., native soils), or have leached and adversely impacted the environmental quality of groundwater. Climatic or Meteorological Impacts on Contaminant Migration While slight fluctuations in water table elevation have undoubtedly occurred over time due to climatic or meteorological changes, it is expected that these fluctuations would have

been regional in nature. Given the lack of identified contaminants of concern within groundwater at the site and the effectively immobile nature of the identified soil contaminants, it is not expected that climatic changes would have significantly impacted migration of contaminants at the site. Vapour Intrusion of Contaminants Into Buildings As noted previously, the site is currently developed with a brick building divided into a 2 storey (eastern part) and a 2 ½ storey (western part) portion, attached to a larger west adjacent building, with a building footprint that occupies the entirety of the property. This structure will be retained as part of the proposed redevelopment of the site. As the identified contaminants of concern at the site are effectively non-volatile (PAH and metallic and inorganic parameters associated with the environmental quality of fill materials historically imported to and placed at the site), no concerns with respect to soil vapour intrusion into buildings are anticipated.
Risk Analysis: Risk assessment, in the context of properties potentially impacted by contaminants, is the process of estimating the likelihood of undesirable effects on human and ecological health resulting from exposure to chemical contaminants. Three components must be present for risks to human or ecological health to exist at sites impacted by contaminants:
the contaminant must be present at concentrations sufficient to cause a possible adverse effect;
a receptor (human or ecological) must be present; and,
there must be a complete exposure pathway by which the receptor can come into contact with the contaminant.
Human and ecological conceptual exposure models have been developed for the site by considering the potential receptors, contaminant release and transport mechanisms, and exposure pathways. The Phase Two human health conceptual exposure model is illustrated in Figure 8A, and the Phase Two ecological conceptual exposure model is illustrated in Figure 8B.
