any specialised operation, commercial or not, where the aircraft is used for specialised activities such as agriculture, construction, photography, surveying, observation and patrol, aerial advertisement.

criteria to determine whether an activity falls within the scope of specialised operations:
the aircraft is flown close to the surface to fulfil the mission;
abnormal manoeuvres are performed;
special equipment is necessary to fulfil the mission and which affects the manoeuvrability of the aircraft;
substances are released from the aircraft during the flight where these substances are either harmful or affect the manoeuvrability of the aircraft;
external loads or goods are lifted or towed; or
persons enter or leave the aircraft during flight

• An authorisation for “High risk commercial specialised operations”
High risk commercial specialised operation” means any commercial specialised aircraft operation carried out over an area where the safety of third parties on the ground is likely to be endangered in the event of an emergency, or, as determined by the competent authority of the place where the operation is conducted, any commercial specialised aircraft operation that, due to its specific nature and the local environment in which it is conducted, poses a high risk, in particular to third parties on the ground.

However:
non-commercial specialised operations with other than complex motor-powered aircraft shall comply with Part-NCO
the following commercial specialised operations with other than complex motor-powered aircraft may be conducted in accordance with Part-NCO:

• competition flights or flying displays, on the condition that the remuneration or any valuable consideration given for such flights is limited to recovery of direct costs and a proportionate contribution to annual costs, as well as prizes of no more than a value specified by the competent authority.
• parachute dropping, sailplane towing or aerobatic flights performed either by a training organisation having its principal place of business in a Member State and approved in accordance with Regulation (EU) No 1178/2011, or by an organisation created with the aim of promoting aerial sport or leisure aviation, on the condition that the aircraft is operated by the organisation on the basis of ownership or dry lease, that the flight does not generate profits distributed outside of the organisation, and that whenever non-members of the organisation are involved, such flights represent only a marginal activity of the organisation.

Standard Operating Procedures (SOP)
SPO.OP.230
Before commencing a specialised operation, the operator shall conduct a risk assessment, assessing the complexity of the activity to determine the hazards and associated risks inherent in the operation and establish mitigating measures.
Based on the risk assessment, the operator shall establish standard operating procedures (SOP) appropriate to the specialised activity and aircraft used taking account of the requirements of subpart E. The SOP shall be part of the operations manual or a separate document. SOP shall be regularly reviewed and updated, as appropriate.
The operator shall ensure that specialised operations are performed in accordance with SOP.

Q&A
Are there examples for the interpretation of commercial operations in the area of SPO glider towing, parachute jumping operations in particular when operated by non-commercial aerocblubs?
Answer
For the time being, a majority view has been that activities of an aeroclub for its members do not constitute a commercial activity. If operations are provided for non-members against remuneration, this may constitute a commercial activity.
Currently the EASA Committee is also discussing the possibility to exempt commercial activities of aeroclubs from applying Part-CAT under specific conditions.

How should the distinction between commercial and non-commercial SPO operations be drawn?
Answer
In the same way as between CAT operations and non-commercial (non-SPO) operations. The key question is, if the operation is provided against remuneration or if it can be classified as a “cooperate” type of operation, e.g., the farmer sprays his own land, or the power transmission company uses its own flight department to inspect power transmission lines.

How should operations be treated which swap flexible between commercial and non-commercial operations.
Answer
Reg. 965 contains a new requirement (compared to EU-OPS) for such operations:
ORO.AOC.125 Non-commercial operations of aircraft listed in the operations specifications by the holder of an AOC
The holder of an AOC may conduct non-commercial operations with an aircraft otherwise used for commercial air transport operations that is listed in the operations specifications of its AOC, provided that the operator:
(a) describes such operations in detail in the operations manual, including:
(1) identification of the applicable requirements;
(2) a clear identification of any differences between operating procedures used when conducting commercial and non-commercial operations;
(3) a means of ensuring that all personnel involved in the operation are fully familiar with the associated procedures;
(b) submits the identified between the operating procedures referred to in (a)(2) to the competent authority for prior approval.
RMT.0352, 0353 non-revenue flights, starting this year, is tasked to provide further rules including criteria for granting the operational approval.
