A coalition of south Louisiana activists posted up in front of a
secluded Benton office Friday morning wheeled out 180 feet of cord
to make a point
The cordage stretched longwise the same comfortable height that
State Sen Robert Adleyrsquos office sits above sea level Quite a
difference from the people in New Orleans and on the statersquos Gulf
Coast who the group said Adley is shunning in favor of his oil and gas
buddies

hersquos running these bills on behalf of the oil
industry at the expense of the peoplerdquo
The legislation in question mdash Louisiana
Senate Bill No 553 mdash would affect state law
broadly but is aimed specifically at a lawsuit
from the Southeast Louisiana Flood
Protection Authority-East filed last July The
lawsuit seeks to hold nearly 100 oil and gas
firms financially accountable for damage done
to the statersquos wetlands through exploration and transportation efforts
The bill adds regional flood protection authorities to an existing law
which defines the use of special attorneys and makes using
contingency fee agreements allowable only if authorized by the Joint
Legislative Committee on the Budget The law if enacted would be
effective retroactively
The controversial Southeast Louisiana Flood Protection Authority-
East lawsuit would be dead in the water because the agency used
external counsel without such authority and wrote contingency fees
into those contracts
ldquoMy bill clarifies the Southeast Louisiana Flood Protection Authority is
an agency of Louisiana and cannot go out on its own without
approvalrdquo Adley said ldquoTheyrsquove done a good job talking about the
coast but thatrsquos not what this is aboutrdquo
The lawsuit was legally improper Adley said not because of its
content but because they only sought approval from the state attorney
general and not the governor who supports Adleyrsquos bill or the
legislature He also claims important details particularly contingency
fees for those special attorneys were kept hidden from the attorney
general
Adley does however take personal issue with the content of the
lawsuit Itrsquos bad policy he said
He said the oil and gas companies under fire in the legal battle did not
violate the law even if their activities were part of coastal erosion He
said the science presented as potential healing for the coast is bad
science and the wetlands are receding because of diversion and
flood protection efforts along with a naturally rising Gulf of Mexico
ldquoWe canrsquot do anything about that unless you want to hire a lawyer to go
sue Godrdquo Adley said ldquoMy position is you canrsquot sue people who have
not violated the law That is the worst possible message we could
send to Americardquo
As Chairman of the Transportation Highways and Public Works
Committee Adley said issues concerning the statersquos levees fall
