Proposed changes to 15-12-705(1)

(i) Indicate that the surviving spouse, PARTNER IN A CIVIL UNION, children under twenty-oneEIGHTEEN years of age, and dependent children may be entitled to exempt property and a familyallowance if a request for payment is made in the manner and within the time limits prescribedby statutes;

(j) Indicate that the surviving spouse OR PARTNER IN A CIVIL UNION may have a right of electionto take a portion of the augmented estate if a petition is filed within the time limits prescribed bystatute;

(l) Indicate that all interested parties PERSONS have the right to obtain information about theestate by filing a demand for notice pursuant to section 15-12-204;

Notes:

1. Minor is defined in C.R.S. 15-10-201(32) as a person who is under eighteen years ofage. The family allowance statute, CRS. 15-11-404, references minor children who thedecedent was obligated to support and children who were in fact being supported by thedecedent. The exempt property statute, C.R.S. 15-11-403, only references dependentchildren.

2. Partner in a civil union is already indicated in the JDF 940. This language mirrors theform language. Should be vice-versa.
