What do you know about the Supreme Court? Is it important? Why or why not?

Make a list of anything you’ve heard of it.

The Judicial Branch(The court system)

Why have a Judicial Branch?When the US began each state had there own form of law, all

very different.

But issues arose. Who had jurisdiction (the

authority of a court to hear, or decide, a

case.) when there was dispute between

states?

When the constitution was finally settled a third branch Judicial or federal court system was

included.

What was under Federal Jurisdiction?

Issues between two states, when an individual sues a

state, or when the federal government

is sued. Territorial Courts, issues with federal taxes, International

trade

Military Courts, veterans, etc.

State VS Federal Courts DistinctionWe must realize there

are TWO systems. State and Federal.

Most trials in the US happen in State Court.

What does the Supreme Court actually do?

the Supreme Court “interprets the laws” or decides if the law goes against the constitution.

Once it gets to the Supreme Court what happens?

Judicial Review - The right of the court to declare laws of

congress and acts of the Executive Branch unconstitutional.

This power came from a court case in 1803 Marbury Vs.

Madison which clarified the Supreme Court had Judicial

Review.

Use your notes to create a chart that follows a case taken to the Supreme Court.

For each step you will draw an accompanying picture

Pretend the law you are fighting is a local Gun Law that restricts you from carrying a

concealed Firearm.
