I. OVERVIEW
The Committee on Public Safety, Law Enforcement and Judiciary convened the public
hearing on June 15, 2011 at 9:06 a.m. in I Liheslatura's Public Hearing Room. Among the items on the agenda was the consideration of Bill 221-31 (COR) - 11 An act to amend Item (35) of §67.100 and to add Item (39) to Article 1 of Chapter 67 relative to drug free school zones/' sponsored by Senator Frank F. Blas, Jr.
Public Hearing Requirements:
Notices of the hearing w ere disseminated via facsimile and email to all senators and all main media broadcasting outlets on June 8, 2011 (5-day Notice) and on June 13, 201J (48-Hour notice), pursuant to meeting the requirements of the Open Government Law. Notice of the hearing was also posted on the Guam Legislature1 s website.

II. SUMMARY OF TESTIMONIES
Chairman Adolpho B. Palacios, Sr. convened the public hearing for the Committee on
Public Safety, Law Enforcement and Judiciary at 9:06 a.m., read the agenda, recognized the Senators present, read the title of the Bill and deferred to the author to give an overview of the Bill. Chairman Palacios called the panel of Chief Deputy Attorney General Phil Tydingco and Chief of Police Fred E. Bordallo, Jr., to testify.
Senator Frank F. Blas, Jr., stated that the Bill would expand the definition of a Drug Free
School Zone to include a child care facility. He stated that the intent is to protect the most vulnerable in the community. Senator Blas thanked his co-sponsors for their support.
Chief Deputy Attorney General Phil Tydingco stated that the Attorney General's Office
supports the intent of the Bill. He said that child care facilities should be covered by the definition of a Drug Free School Zone.
Chief Fred E. Bordallo, Jr., stated that he fully supports the Bill. He stated that he
believes that there should not be any drug dealing around child care facilities.
Chairman Palacios stated that he supports adding child care facilities to the definition
of a Drug Free School Zone.
Chairman Adolpho B. Palacios, Sr., thanked the panel for their testimony and declared
that Bill No. 221-31 (COR) is duly heard. The Chairman concluded the hearing and requested that written testimony be submitted. He adjourned the hearing at 10:54 a.m.

AN ACT TO AMEND ITEM (35) OF §67.100 AND TO ADD ITEM (39) TO ARTICLE 1 OF CHAPTER 67 RELATIVE TO DRUG FREE SCHOOL ZONES.
1 BE IT ENACTED BY THE PEOPLE OF GUAM:
2 Section I. Item 35 of §67.100 of Article 1 of Chapter 67 of Title 9 of the
3 Guam Code Annotated is hereby amended to read as follows:
4 "(35) Drug Free School Zone means any area within one thousand
5 (1,000) feet of a public or private elementary, secondary or post secondary
6 educational institution or ~ child care facility or its accompanying grounds; or
7 within the vehicle of any school bus which transports students while in motion;
8 or within two hundred fifty feet (250') of any school bus not in motion or a
9 designated school bus stop or shelter, including any school bus transfer station.
I 0 Notwithstanding the provisions of this Section, a Drug Free School Zone shall
11 not include private real property which is not a school or~ child care facility or
12 the accompanying grounds of a school or child care facility."
13 Section 2. Item 39 is hereby added to §67.100 of Article 1 of Chapter 67 of
14 Title 9 of the Guam Code Annotated to read as follows:
"(39) Child Care Facility means any center licensed by the Department
2 of Public Health & Social Services to provide care, education, and supervision
3 for a child for all or part of the twenty-four (24) hour day, whether or not the
4 facility is operated for profit, or charges for the services it offers."
5 Section 3. Severability. If any provision of this law or its application to any
6 person or circumstance is found to be invalid or contrary to law, such invalidity shall
7 not affect other provisions or applications of this law which can be given effect
8 without the invalid provisions or applications, and to this end the provisions of this
9 law are severable.

Aft.er reviewing Bill No. 221-31, we agree to the act to amend item 35 of 67.100 and to add item 39 to article 1 of chapter 67, relative to drug free school zones.
After reviewing Bill No 220-31 , we agree to the three (3) years sentence which will be canied out for an individual who is found guilty of distributing a non-narcotic controlled substance listed in schedule I or 11 to a minor or a pregnant woman. The punishment fits the crime since a minor or unborn child is harmed as a result of illicit drug use.
After reviewing Bill No. 216-31, we agree to the changes made relative to updating the Guam uniform controlled substance act based on the U.S. DEA schedule listing.
