Senate Bill 1843 amends the Code of Corrections, the Juvenile
Court Act, and the Probation and Probation Officers Act to
clarify how probation fees should be collected when a case is
transferred from one jurisdiction or county to another. The
bill provides a definition for "transfer case" and clarifies
that the probation department from the original sentencing court
shall retain all probation fees collected prior to the transfer.
And after the transfer, all -- all probation fees shall be paid
to the department to which the case has been transferred. I --

SENATOR STADELMAN:
Mr. President and Members of the Senate, Senate Bill 1859
is a bipartisan initiative designed to greatly increase the
economic benefits of sports tourism to the State of Illinois -
Winnebago County, Rockford and surrounding cities. This bill
allows the county board in Winnebago County to impose a hotel
tax of up to two percent, if municipalities that make up more
than sixty-seven percent of the county's population pass
resolutions in support of this tax. The revenue will help pay
for a sports facility's capital project. This bill will help
Rockford and the State regain its competitive edge by upgrading
its facilities. The tax is supported by the local hotel/motel

proposal. This will keep Illinois as the number one destination
point for major soccer tournaments in the nation. Just this
last weekend – and some of you have children that are in there –
we had teams from six states spending a week in Illinois,
leaving their dollars here. If we don't get this project done,
unfortunately, those national projects go to states like Kansas
or go to Florida. This helps Illinois reclaim number one spot,
and I would urge support for this great piece of legislation.

calling that to the University of Illinois' attention, they have
persisted that we have to pass a law to tell them to follow the
law - thus, Senate Bill 2163. So I would urge my colleagues to
join me in asking, in the most strenuous terms, that the U of I

Chamber. Senate Bill 2188 would allow for the issuance of
search warrants by electronic means. It would require that
there be a simultaneous audio and video connection between the
party requesting the search warrant and the judge who's
considering it. All the other rules that apply with regards to
search warrants would be -- apply in this situation as well,
including filing of a written search warrant and the filing of a
return on a search warrant after the search warrant is executed.
At the request of the Illinois Civil Liberties Union, there was
a provision added through an amendment that also requires local
–- local circuits to adopt specific rules if they choose to add
to -- with regards to procedures for the issuance of electronic

primary one - which they historically had since the 80th General
Assembly. And this just restores that. It was a scrivener's
error. Does not grant anything that they do not have. I do
want to add that the scrivener who made this error, consistent
with North Korean policy, has been shot.

Senate. This is an initiative brought to me by the School
Management Alliance. 2321 allows a school board to excuse
pupils in grades nine through twelve enrolled in a show choir
program for credit, taught by a certified teacher, from engaging
in physical education courses if those pupils request to be
excused for participation in such show choir, and only excused
for one semester per school term, and the show choir emphasizes
dance-type movement with singing. I would like to –- since that
was a little complicated, I would like to stress some points to
this bill. Currently, school districts can grant high school
students an exemption from physical education to complete
coursework necessary for admittance into institutions of higher
education or for participation in varsity sports, ROTC, or
marching band. This bill only applies to schools that offer
school choir for -– school show choir for credit. Dance has to
be an essential part of this bill, which has proven to be a
great cardiovascular workout, as well as often found in P.E.

on observation, 'cause I've never been involved in it
personally, but show choir is a very physical activity and, like
I said, in this bill, it does completely emphasize the dance

who –- and –- and children in this, they can go up to practices
from forty-five minutes to two hours on a nightly basis while
they're in -- in season. So I would have to say this is an
extreme physical sport.

Senator, I want to –- as you know, we had a very hectic day
that day in committee. As the Chairman of Education Committee
in the Senate, we were presenting some very controversial bills
that day. And due to our great leader on the other side -- as
one of the last bill's coming through, I remember looking up at
one of my leaders over there and he did a quick okay. And we
had handled a moratorium bill and I think the waivers for school
districts, et cetera. And this one -- if you know my reputation
here, I'm a great supporter of the Illinois Association of
Physical Educators, Recreation and Dance {sic} (Illinois
Association for Health, Physical Education, Recreation and
Dance), which is called IAHPERD. And I've led a -- championed
over the last fifteen years in trying to make sure that physical
education is vital and necessary. I inadvertently gave an okay
on my vote to let this out of committee. However, it strongly
concerns me, as America and Illinois, as we continue to find
these waivers for –- for choir, for any little reason that we

try to take 'em out of physical education. It has created more
type 2 diabetes in this State. Less than thirty-five percent of
our men are able to go to –- to enlist in the Army, due to
obesity and other chronic disorders. I have to rise in total
opposition to this legislation, as there is a strong movement to
try to make sure -- as these professors and teachers write those
waivers and then drive off to Bally's and work out themselves,
we don't have children having the same opportunity. If we keep
waiving 'em out of physical education, as they're sitting home
doing less and less and doing more on computers -- I would
suggest to the Legislature to please take a good look at this
piece of legislation. I -– I honor the lady in terms of her -–
her quest and trying to assist in her community; however, I
think the timing is off. I would -– I -– I definitely -– and
especially would not ask -– I would ask you to search your soul
on this one, because if we go down this road, this -- in the
area of public health - and by the way, right before I became
Chairman of Education, I'm the former Chairman of Public Health
- that this issue continues to be one that's very contentious in
the State. So, on behalf of all the schoolchildren that need to
get out there and exercise in physical education, for all the
children in recess, for the organization of IAHPERD, I would ask
that the Senate say -- let's say Present. Let's pull this out
of the record right now. Let's reconsider it, so I can take
this and move on forward. If not, I would ask all the General
Assembly Members here to vote Present or No.

Senate. Senate Bill 1693 amends the Illinois Identification
Card Act and the Illinois Vehicle Code to allow peace officers
to provide their work address instead of their home address when
applying for an Illinois Identification Card, driver's license,
or an instruction permit. I know of no opposition. When I
introduced it, there were a couple of questions in committee.
One was why we were doing this. One of the reasons we were
doing this, last year, during the NATO, protesters -- there were
some instances where people showed up threatening officers'
families. About a year prior to that, we passed legislation for
judges to use their work address on their Identification Card.
So this is what we want to do for our peace officers throughout
the State of Illinois, not only for the City of Chicago, but for

all peace officers that are working as first responders. One of
the questions in committee is, what happens when you go to the
airport and you're going through TSA? The simple answer is that
-- we called them. We had the FOP talk to their boss there, and
their simple answer was that the ID doesn't need to be a
driver's license, and other acceptable forms, such as a
passport, do not have addresses on them. So, the only time it
comes into play is when you don't have any type of ID - that's
when you're going to run into a problem. And the second
question was, what happens when you go to early voting and you
show your ID? If there is any problems, the Board of Election
said that you can just take a copy of your bill, whether it's a
water bill, electrical bill. That's what they currently do now
if there's any questions regarding your identification. And I
will attempt to answer any other questions.

don't necessarily need it to –- in order to vote?

discussion, if he could fill us in a little more on what is
happening in that area of the safety of teddy bears.
