WASHINGTON THIS WEEK
Seven months after her term officially expired, Sherrie Marshall has started the
exit process from the FCC by recusing herself from FCC broadcast or cable
proceedings, according to Inside Radio, leaving only three commissioners, plus
Marshall's continuing work on common carrier and private radio issues. Inside
Radio thinks Marshall will end up at DC law -firm Latham & Watkins.
The Electronics Industries Association (EIA) has pushed the timeline for
submitting hardware to be tested with the proposed DAB systems to July 1.
Originally, the submission of hardware was scheduled for April 15, with actual
testing to begin July 1. April 15 is now the deadline for the completion of
testing procedures by the EIA's Digital Audio Radio subcommittee, and for the
testing site to be chosen. Also at the DAR subcommittee meeting last week, four
of the five system proponents presented their system descriptions.
The Commission has reversed a review board's disqualification of Salt City
Communications, Inc. on a financial issue, and remanded the proceeding back to the
board for consideration of issues that weren't considered previously for a new FM
at 89.9 MHz in Syracuse, NY. The ALJ, in his initial decision, found that Salt
City was financially qualified based on a $600,000 line of credit. But the Review
Board reversed the ALJ citing that Salt City may have not disclosed the fact that
it had a $300,000 loan limit.

In another review board action, two applications have been designated for hearing for a new FM on 102.1 in Milford IA.
The Commission has upheld a Review Board action granting the application of Troy Broadcasting Corporation for a new FM on 94.7 in Brundidge AL after two competing applicants unsuccessfully petitioned for review on financial issues.
Depending on your point of view, good things come in fours on Long Island NY.
Sacred Heart University has been granted applications for four translators for the communities of Selden, Huntington Station, Ridge, and Noyack. The four will most likely relay Sacred Heart's WSHU -FM Fairfield CT. Last year, the Commission allocated four new frequencies to separate communities in "the Hamptons" of Suffolk county NY.
ELSEWHERE
Pat Robertson's long -promised news network, the Washington -based Standard News has hit the air with, it says, 200 stations. SN is offering three different news channels for either subscription or barter and plans to launch its own news service later this month. Business Radio Network and its affiliated networks American Forum and Sports Entertainment Network will use SN news. Former WEEI Boston VP John Rodman is the managing editor; former Christian radio syndicator Ray Fowler will be affiliate relations manager.
Pat Robertson isn't the only one with a new network this week. Bud Paxson's web of Florida AMs has finally begun functioning as a network with the debut of the nightly "The Sports Nut" program which will also run on Paxson's soon -to -be -sold WWNZ -FM Orlando. More programs should be added soon. Incidentally, we don't know if Bud had this in mind --or if anybody else has picked up on it yet - -but if you were to take Bud's Tampa AM, WHNZ -570, and combo it with his Orlando FM WVRI, you would have the Heinz 57 /Variety combo. And if you don't like Heinz 57 on food, there's always Paxson's LMA'ed WAIA Jacksonville, or, as it's known, W -Al -A.
Paxson has decided to "round out" his Florida FM shopping spree with the purchase of WEZY Lakeland FL (Tampa) from Root Communications. Root will keep WLKF (AM)
Lakeland. This will give Paxson FM duopolies in Jacksonville, Orlando, Miami, and Tampa.
Entercom has done it again --this time in Pittsburgh. In a repeat of a stunt pulled in Seattle in 1991 when KBRD became KMTT "The Mountain," Entercom, using the name ECI License Company LP, ran spots on competing stations in the market announcing the debut of "The Rebel." The spot for the Rebel, which sounded like it was promoting an upcoming movie, was actually a precursor to their switch to
country on now LMA'd WORD -FM 104.7 MHz. The spot was placed by an out -of -town agency on a Friday afternoon and allegedly ran fifteen times on each station before it was pulled.
As part of a dues restructuring, National Public Radio is expanding its newscasts from 18- hours -a -day, five days a week, to 24- hours, beginning this October, meaning that stations will be able to take cultural /information packages all day without necessarily carrying its "Morning Edition" and "All Things Considered" magazine shows.
Unistar is launching a weekly artist profile show, "Nineties Country," which will

In case the situation at the FCC has brought to mind the age old question "Who's in charge here ?" during recent weeks, the Clinton administration now has an answer for you. Commissioner James Quello has been named interim FCC chairman replacing Al Sikes.
A few of the Commission's field offices decided it was time to hit the road for
some informal station visits. The results are on the back page.
The Cleveland Plain Dealer reports that a new NTIA study found that black owners
control 2.2% of the nation's AM stations and 1.4% of the FMs. If that doesn't
sound like a lot, Blacks are doing better than Hispanics who control only 1.3% of
the AMs and 0.5% of the FMs. 81% of the AMs and 68% of the FMs owned by minorities were made possible through minority tax credits.
The Commission has granted an application by Welch Communications, Inc., for
review and reversed the Review Board's resolution of both financial and lack of
candor /misrepresentation issues against Welch and granted its application to build a new FM at Swanton OH. The Commission concluded that Welch "did everything required of a borrower to ob4 -in a loan from its lender," and therefore resolved the issue in his favor. The Commissioñ also affirmed decisions by the Board which granted the application of McMurray Communications for a new FM on 97.3 MHz
at Lebanon OH, and Troy Broadcasting for a new FM on 94.7 MHz in Brundidge AL.
April Fool's Day is on the way and with it the inevitable string of radio station
hoaxes. To make sure yours is legal, call the NAB's Karen Livesay at 202- 429 -5462
for a copy of the catchy -titled "Preventing The Broadcasting of Hoaxes or Other
Deceptive Programming," a new guidebook which, NAB says, was prepared for Infinity Broadcasting which, you may remember, had a little hoax trouble of its own.

SGC is the Nashville -based Super Gospel Country web, which runs a mix of southern
gospel and secular country. Super -AC is our new code for the CITY FM network to
standardize it with its Country network, the previously mentioned Super - CW.

The Radio Advertising Bureau's Managing Sales Conference in Dallas this past week hosted a record 1,600 attendees who heard the newest angles on sales, profitability, and industry growth. Despite many broadcaster's efforts to combine audiences and sell "bulk ", the conference emphasized the premise on which radio was founded...the creative, niche sell. "Out -of- the -box" approaches were the focal points of many of the seminars, culminating into a presentation entitled "The World's Greatest Salesperson," where two managers from the U.K.'s Metro Radio Group showed managers how they've enjoyed 20% percent growth over four years using the "creative -led sell." Maurice Dobson, Sales and Marketing Director, explained how 30 percent of Metro Radio Group's sales staff are copywriters and producers who develop the scripts before clients are closed. What a concept...
New duopolies this week besides those reported in the format section: Saga's KRNT /KRNQ Des Moines picks up Midwest Communications' KIOA- AM -FM. Midwest picks up the WHET /WQZZ FM pair near its existing WGEE /WIXX Green Bay, Wisc., combo with the money from the Des Moines sale. Also, Keymarket's WEZC Charlotte is now in an LMA- to -buy with Trumper's WTDR.
Several investors in Zapnews, the radio news service, including former CNN President Reese Schonfeld, have filed suit against the company alleging the company's founder, Jim Hood; misreprp.serted the potential profitability of the company. The plaintiffs are asking for their money back -- approximately $75,000 each --plus the benefits of estimated tax losses after the business plan did not disclose important information about the company's financial records.
At Jones Satellite Networks, Roy Simpson, who joined JSN in December, announces the following promotions: Mike Tyler from regional manager to NSM; Don Hibbits from Marketing Associates to group and major markets manager; Pat Evans from SMN to regional manager for Fla., Ga., Miss., and Ala.,; and Walter Vaughan from SMN to regional manager for the Carolinas, Tenn., and Va. Jones launches its "CD Country" format on Feb. 25.
A -Ware Software, the MusicScan people, have announced the new MusicScan Format Complete --a line of "fully functioning format datasets" for stations launching new formats from scratch. The service is available for oldies, AC, soft AC, easy, and country. Call 414 -521 -2890.
After being tested on air at KBOQ Monterey, Calif., the on -air music shopping service SoundServe is ready to roll out its product nationally. Listeners buy music from an 800 -number established for each station; participating stations get a cut of the sales. For more info, call 800- 678 -4810.
The Radio Advertising Bureau has given its annual marketing partnership awards to
the Detroit Radio Advertising Group for its work with the Big Three automakers and to the Northern California Broadcasters Association for helping to bring Nestle's MJB Coffee in as a radio advertiser.
Dolly Parton has been announced as the opening entertainment for this year's Country Radio Seminar to be held March 4 -7 at the Opryland Hotel in Nashville. This is Parton's first CRS appearance. Other schetiu,.ed performers include Suzy Boggus, Reba McEntire, and Canadian country star Joan Kennedy. CRS registration thus far is up 14% over last year's attendance to date. Video channel VH -1 has announced that it will syndicate the audio portion of its
live performance series "Center Stage" through MJI Broadcasting. For more info,

WASHINGTON THIS WEEK Acting FCC chairman James Quello has announced two major staff appointments. Quello's senior advisor since last year, Brian Fontes, has been named chief of staff. Fontes was also a member of the U.S. delegation to the ITU's 1991 Geneva TELCOM. Also, Quello's legal advisor Lauren "Pete" Belvin is now acting director for the office of legislative affairs.
CANADA THIS WEEK After a gripping year of discussions about whether Bryan Adams and Celine Dion were indeed Canadians, the Canadian broadcast lobby has changed its Canadian content rules. Previously, either the entire lyric or entire music to a song had to count toward the 50% Canadian mark needed for a song to count as part of a station's 30% Canadian content requirement (got that ?) Now, however, if a Canadian co- writes both music and lyrics with an international collaborator, the song will still count as one part Cancon. This means that most of Bryan Adams' last album will again count as Canadian. Most of Dion's material, however, which comes from outside authors, will not.
As part of its decision to allow the CHUM Group to control both sets of Windsor, Ontario FMs, the CRTC has given oldies outlet CKLW -FM a number of new exemptions from its usual programming requirements. CKLW -FM has no limit on the number of "hits" it can play and can be 5% spoken word instead of the usual 15 %. It must, however, up its Cancon from 12% to 20 %.
ELSEWHERE Although it hasn't announced an exact date, R &R now says the roll -out of its long - promised airplay monitoring system will begin "immediately." R &R's system, which will be part of its larger on -line data network, will cover "all R &R reporting stations in all major formats, along with all national music video channels" in the top 100 markets. The announcement of R &R's system, which it says "was 100% accurate in identifying all music -- currents, recurrents, and gold," comes several weeks after the demise of one competitor, Monday Morning Replay, and the roll -out of Billboard's new Airplay Monitor publication.
D.C.'s WPGC (AM) is now offering its business news format on a subcarrier, following the demise of its night -time simulcast agreement with crosstown WMET. WMET, meanwhile, picks up the brokered ethnic and talk programs displaced by rival WNTR's switch to an all children's format.
Kurt Hansen's Accuratings service has announced he'll add Los Angeles to his list of markets, now putting hjm in all of the top five, beginning with the release of a winter book. Elsewhere in the ratings biz, former Birch Scarborough executives Bill Livek and Bill Engel have announced the formation of their new qualitative data firm Symmetrical Polling, Inc. Several weeks after moving its "Lovephones" show to midnight, WEGX Philadelphia has announced that it will no longer simulcast that sex -talk show with co -owned WHTZ (Z100) New York, but will now run its own, less controversial "relationship - oriented" program.
The promotion directors' organization Broadcast Promotion & Marketing Executives (BPME) has announced a name change to PROMAX, short for Promotion & Marketing Executives in the Electronic Media.
Format syndicator Bonneville moves toward the full -service consulting biz this week with the announcement that it will simulcast the "Young Country" format popularized by Alliance Broadcasting's KYNG Dallas. Inside Radio suggests that further Bonneville announcements may be forthcoming.
Sports Entertainment Network adds a new weekend program, Softball This Week. The show will air Saturday and Sunday 1 -3 AM eastern, which means that if you play softball on Saturday afternoons, it should be on right after you get done drinking.

WASHINGTON THIS WEEK
The FCC has fined WLUP (AM) Chicago $33,750 in indecency penalties for two early
1991 broadcasts on penis size --one discussion of male insecurity between Steve
Dahl & Garry Meier and another from midday host Kevin Matthews. WLUP owner
Evergreen is still facing a pending court case over the $6,000 in previDus fines
that it has refused to pay off.
The D.C. Court of Appeals that shot down a 24 -hour indecency ban several years ago
has stayed enforcement of the FCC's new safe harbor rule -- restricting indecency
until after midnight, instead of the current 8 p.m. cutoff --until it can hold oral
arguments which, according to Inside Radio, will take place sometime this fall.
The National Assn. of Broadcasters has filed a friend -of- the -court brief in a
supreme court case --U.S. vs. Edge Broadcasting. Edge's WKOC rimshots Norfolk, Va.,
from its city of license, Elizabeth City, N.C. Edge says it's entitled to run
Virginia Lottery ads, even though there's no state lottery in North Carolina. NAB
was joined by the ACLU, the state association of broadcasters, and a number of
major groups in the filing.
In other NAB news, the association is now offering the full text of the Radio
Broadcast Date System standards developed by the National Radio Systems
Committee's RBDS subgroup. To make sure you read this before the movie comes out
and everybody spoils its secrets, call NAB's member services department at

ELSEWHERE
After months of speculation, Unistar goes from here to Infinity this week with the
network announcing that its business will now be managed by the group broadcaster.
Infinity will also have the right to acquire an equity interest in Unistar.
Infinity president /CEO Mel Karmazin will also be Unistar's CEO, overseeing its
networks and Market Research Group, Inc. Unistar chairman /founding partner Nick
Verbitsky exits. President Bill Hogan, despite his budding career as a Sean
Connery lookalike, will retain that position, reporting to Karmazin. Infinity, of
course, had gotten into the ad -hoc network biz lately with its syndication of
Howard Stern and planned syndication of the Greaseman and, perhaps, Don Imus.

The North Carolina Talk Network is based out of WCRY Fuquay -Varina, N.C., which simulcasts its programming .n co- owned WEEB Southern Pines, N.C., and LMA'ed WHPY Clayton, N.C. :r.vestigative reporter /talk host Jack Anderson has jumped from the Independent Broadcasters Network to the Marlborough, Mass. -based Sports Final Network. SFN, which had run primarily repeats of its nighttime programs during the day, is fashioning an entire non- sports lineup around Anderson during the day and will now be known as the Talk America Radio Network (TARN). TARN, which says it already has committments from 45 of Anderson's IBN affiliates, can be reached at 508- 460-0588. Bob Long is station relations manager.
Help, It's the Care Bear Bunch: As children's programs proliferate, a new Boston - based venture called the Friendship Co., says it will have its "Apple Pie Network" up and running in the next 3 -6 months, according to Inside Radio. Principals in the company include former CBS executive Dick Brescia, Catherine Smith from the Children's Radio Network, and comedian Stan Freberg. The new network will tie -in with the merchandising people who came up with the Care Bears.
Back in December, Arbitron announced it would be pulling out of several of its smaller markets, among them Pascagoula, Miss., Lufkin, Texas, and Sioux City, S.D. Fortunately, a disappointed Sioux City could be reached for comment and Arbitron has told Inside Radio that Sioux City will get a spring book again -- except that it's too late for this year, so Sioux City will get a rare summer book for '93.
