HIPAA & VOLUNTEER REQUIREMENTS

WHAT IS HIPAA?HIPAA- Health Insurance Portability and Accountability Act

A comprehensive law that establishes:

• Standards around the use of patient healthcare info• Rules about healthcare portability and billing fraud and abuse• Assurance that patient’s right to privacy is protected and info is only

used for appropriate and necessary purposes.

• No different than confidentiality- just adds additional requirements

HIPAA & HELPLINEHelpLine is required to: • protect against reasonably foreseeable threats and

hazards to security and integrity of individually identifiable healthcare info

• Protect against unauthorized uses or disclosure of that info.

PROTECTED HEALTH INFO (PHI)• Individually identifiable health info• Relates to past, present, or future physical or mental health or condition of an individual; the provision of health care; or payment for healthcare

HOW DOES HIPAA APPLY TO YOU?

As SARN advocates: • Be aware of who is around in hospital or law enforcement settings: nurse,

family, law enforcement, victim- lots of people in and out.• Do not share detailed info about victims served with anyone outside of

SARN program/ HelpLine• Any notes on name, phone number, situation, etc. need to be destroyed

after passing on to SARN staff. • Do not email identifying information via email, always leave that info over

confidential voicemail system• Also be aware of posting on social media (location services), text

messages, etc.

WHY COMPLY WITH HIPAA?• Required by federal law• Stiff financial penalties if found in violation• Raises the bar for protecting people’s privacy• Reduces our risk of confidentiality violations

WHEN CAN PHI BE RELEASED W/O CONSENT?

• Law Enforcement purposes• Victims of abuse, neglect, or DV (especially children)• Avert serious threat to health or safety (harm to self) • Emergency treatment• Other misc. reasons

• ALWAYS CONSULT WITH HELPLINE ADMINISTRATION STAFF IF THERE’S AN ISSUE OR CONCERN WITH CONFIDENTIALITY!

TRAINING EXPECTATIONS• Please arrive to training on time• Please turn cell phone volume down or turn off and put away• Please be attentive, especially to guest speakers• Building relationships with community and guest speakers• “Respectful, Responsible, and ready to learn.” –even with each other• Professionalism

• 24/7 hotline- suicide, crisis, information and referral and anything in between

TRAINING GUIDELINES (P.5)• You can share as much or as little personal info as you would like• Realize many serious and tough subjects will be discussed and explored,

could be triggering. • All members of this group are expected to keep any personal info

confidential. • You have the right to pass and not participate• Judgement free zone• Move around as needed, grab refreshments• Relax, dress comfortably

SARN VOLUNTEER ADVOCATEPOSITION DESCRIPTION (P. 10-11)

• Qualifications• Benefits:

• Personal and professional growth• Bettering communication skills• Crisis Management skills• Sexual Assault Training• Community Resource Knowledge• Satisfaction of helping others• Letters of Recommendation• Free professional trainings through Connections Volunteer Center

CONTINUING EDUCATION• Attend a minimum of 4/6 in service meetings (every other month, food,

interesting topic, SARN updates)• Dec. 7th “Self-Care” cookie exchange in service• Required to have 6 hours of continuing education every year, one of

which involves cultural competency• College courses, workshops, webinars, videos, and print articles• Fill out form and submit to volunteer coordinator (19)

CODE OF CONDUCT (P.20)• Courtesy, respect, understanding- arguing with LE or hospital staff is

prohibited• Do NOT assist with medical exam- politely declined if asked• Representing yourself, HelpLine, and survivor’s best interest

• Greivance- verbal/written to VC, if about VC Director of SA Services• HelpLine reserves the right to terminate (3 strikes, you’re out)

PERSONAL VEHICLE USE (P.24)• If there’s an accident, look to own personal auto insurance for protection• MVR permission• Driver’s license or auto insurance revoked, suspended, expired notify

VC ASAP• Prohibited from transporting clients

PERSONNEL POLICY• Quality Assurance• Safety• NO sexual harassment, violence, weapons, or tobacco, AOD• Volunteer Classification• Inactive status up to one year, refresher meeting to assess skills, protocol,

etc.• Send all media contacts to Sue, Executive Director.• Respect equipment

• Secondary Trauma support: follow up from SARN Coord. Or VC

• Nov. 14 from 9:15-10:00 will be Listening skills with Nora• Nov. 14 from 3:15-3:45 will be Crisis Intervention with Amy• Potluck sign up on the 14th

• Meet at the Grady ER on Nov. 15th
