FERC ATC NOPR

• The Commission– Approved all of the ACT Suite

• Subject to modification

– Issues a NOPR • March 19, 2009

– Created some “challenges”• To MOD-29-01

• Others

19

Western Electricity Coordinating Council

FERC ATC NOPR

• Issue Spotting: MOD-29-01– “Remove” MOD-29-01 R2.7

• Eliminate protection of Existing Path ratings• 69 “Existing Rating” Paths in WECC

– Path Rating Catalogue

– Require re-rating• Changes all contracts and models upon which the Existing

Path ratings are predicated

– Compliance in “one year” questionable– Need to respond

• WECC and multiple entities! 20

Western Electricity Coordinating Council

FERC ATC NOPR

• Issue Spotting: “Mission Creep”– Make Implementation Documents available to

broader range of entities• “Mission Creep”

• Using NAESB Business Practices – FERC has no jurisdiction over “non-jurisdictionals”

• Using Standards– FERC can sweep in “non-jurisdictionals”

– Slippery slope• Infusing non-reliability issues into reliability standards

21

Western Electricity Coordinating Council

FERC ATC NOPR

• Issue Spotting: Counterflows– Would require greater detail in describing

counter flows• WECC uses “counter schedules”

• Issue Spotting: Treatment of Network Resource Designation– Would require greater detail

• Ramifications to members are unclear

22

Western Electricity Coordinating Council

FERC ATC NOPR

• Issue Spotting: Transparency– FERC would require NERC

• Quickly audit the documents

• Replication of results is essential

• Issue Spotting: TRM– FERC says “to vague”– Lock down the ambiguities

23

Western Electricity Coordinating Council

FERC ATC NOPR

• Informational – VSL and VRF will be filed later– Process under review at NERC

• Can’t be lower than before drafting

• Must be consistently applied

• Based on a single violation and not on a cumulative number of violations

24

Western Electricity Coordinating Council

FERC ATC NOPR

• Informational – Other MODs and FAC

• NERC / FERC agree– Retire MODs 1-9; Changes top 10-25

» Outside scope of the NERC ATC Drafting Team» More work to come

• NERC / FERC disagree– FERC says polish FAC-12– Keep FAC -13

• MODs are “operational” (through 13 months)• FACs are “planning” (14 months and beyond)

“The Process”Focus on the Criteria

W. Shannon Black

Manager, Business Practices and Standards Processes

April 22, 2009

Western Electricity Coordinating Council

Process for Developing and Approving WECC Standards• Definitions

– “Standard” • “In the context of this document, the term Standard refers

to a Reliability Standard or a commercial Business Practice.”

• Commercial Business practices are treated the same as a Criterion

• Ramification– Drafting a criterion looks just like a drafting a

standard– Criterion are expected to be followed

Western Electricity Coordinating Council

Measures and Compliance

•  Criterion (Step 11 of the Process)– “As of the effective date of such new or

modified Standard, all industry participants in the Western Interconnection that such Standard is applicable to are expected to implement and abide by the Standard.”

• Without a measure how do we know?

• Compliance is being debated

• Not Raising the Bar– Reminding WECC where the bar lies

68

Western Electricity Coordinating Council

Representation

• It’s Your Process – Use it!– Input into Standing Committee assignment– Participate drafting / all are welcome– Comment / Suggest remedies

• Be part of the answer

– Vote on the final product• Submit comments again at the Standing Committee

– APPEAL!

Western Electricity Coordinating Council

Step 1 – Request To Revise or Develop a Standard

• Must be “Complete”– Are all the applicable blanks filled in?– Is the issue clear to the uninitiated?– Do the Applicable Entities have a

corresponding Requirement?– Extrinsic documents included?– Is the goal of the work product clearly stated?– If you personally cannot answer the questions,

use a task force or work group

Western Electricity Coordinating Council

Step 1 – Request To Revise or Develop a Standard• Benchmark

– If you submitted the Request to NERC – what would be the result?

• Submitted to the “standards” email address– No other authorized medium for submission

• The Request defines the “drafting” scope of drafter’s authority– Different from scope of the criterion

Western Electricity Coordinating Council

Scope

• Must be in “Scope”– Mission

• Does it support reliability of Western Interconnection?

• Does it support efficient competitive power markets?

• Does it support open and non-discriminatory transmission access among WECC members

Western Electricity Coordinating Council

Scope

– Mandates• Does it violate any known NERC Reliability

Standards?

• Does it violate any article of the WECC By-Laws?

• Does it violate any known existing regulatory mandate? (E.g. state or local laws and regulations)

– Magnitude• Does this affect WECC only?

• Do we have authority to do it?

• Contravene or modify NERC or other mandates?

Western Electricity Coordinating Council

Step 2 – Request Validation and Routing

• Assigned by SRRC to Standing Committee

– Input from the industry is requested and considered

– Drafting team vs. standing committee subgroup• Announcements made to state the choice

Western Electricity Coordinating Council

Step 3 – Subgroup Begins Drafting Phase and Announces on WECC Web Site

• Structure / Use the Templates– Requirements

• Identify the Applicable Party– Must use the Functional Model

• Identify the specific task– Perhaps specify when, where and how

• Tasks must be in mandatory language / not subjective

– Measures• Mirror the requirements / Some evidence

– Compliance• Under debate

Western Electricity Coordinating Council

Steps 4 and 5: Draft and Deliberate

• Step 4 – Posted for Comment• First posting is 45-days – all others 30-days

• Step 5 – Deliberates on Comments– Each and every comment must be answered

• A clear question evokes a clear answer– Ask a friend “Do you understand my question?”

• Suggest a remedy– Otherwise…the answer may create other issues you has

not considered

– Use your peers

Western Electricity Coordinating Council

Step 6 – Subgroup Submits Draft for Standing Committee/Interested Stakeholder

• Vote to bring to ballot– Only a majority vote of the drafting team is

required– No quorum is stated– “Must be present to win.”

Western Electricity Coordinating Council

Step 7 – Standing Committee Vote on Recommendation to Board

• Vote to accept as drafted– Remember your WECC role – for the

Interconnection

– Check your philosophies• Is you vote based on your own agenda or the best

interests of the Interconnection?

Western Electricity Coordinating Council

Close it Out / For another Day

• Step 8 – Appeals Process

• Step 9 – Board Approval

• Step 10 – ERO Review, FERC Approval and Implementation of Reliability Standards

Western Electricity Coordinating Council

Background Pre-schedule Process • MIS submitted Regional Criteria request.• The Objectives:

– Codify the pre-schedule process.– To the fullest extent practical, pre-scheduling

should occur the day before the flow day. – Establish a pre-schedule process that aligns, as

close as possible, electric and gas trading days. – Develop and document pre-schedule process

definitions and descriptions.

• MIC assigned to develop Regional Criteria

Western Electricity Coordinating Council

Drafting Team Activities • Draft criterion includes:

– Definitions.– Requirement to preschedule.– Submission deadline; exception for CISO

delays. – Weekend, holiday and new month exceptions.– Rules for determining advanced pre-schedule

days.– WECC creates pre-schedule calendar.
