DRAFT ALBERTA EXPOSURE CONTROL GUIDELINES FOR REVIEW

Alberta Environment and Sustainable Resource Development has released the Draft Alberta Exposure Control Guidelines for Review - http://environment.alberta.ca/01055.html This document presents Alberta’s exposure control policy for contaminated sites and primary direction for site managers, stakeholders and environmental professionals. It outlines requirements for risk management using the exposure control option for managing contaminated land in Alberta through administrative or institutional controls, and physical or engineered barriers. This document anticipates a future Risk Management Plan Guide and User Checklist that will support technical requirements for Risk Management Plan applications to the Department. The Draft Alberta Exposure Control Guidelines document is provided for public comment until March 25, 2014. Concise, direct comments organized by section are appreciated. ENFORCEMENT ORDER ISSUED TO PROTECT LAKE IN COUNTY OF PONOKA

The Alberta government has issued an enforcement order to stop unauthorized work being done to a lake owned by the Crown. The individuals doing the work must restore the lake under the Water Act.

Overview

• Hendrik and Gerritje Krijger performed work on their property that was unauthorized under the Water Act. • This unauthorized work included draining Lake No.21, excavating an area near the outlet at the southwest

edge of the lake, and draining a smaller wetland.

unauthorized activities included the placement of fill material in the lake.

Terms of the Enforcement Order Hendrik and Gerritje Krijger must restore: • the outlet of Lake

No. 21 to the condition and function as it was before the construction of manmade drainage;

• the bed and shore of Lake 21 to its location as it was before the construction of manmade drainage, and the removal of soil in the southern portion of Lake No.21;

• the wetland to the condition and function as it was before the construction of manmade drainage. Enforcement orders ensure that action is taken to remedy a situation when it threatens the environment. They are one of many tools – including education and prevention – used by the Alberta government to ensure all Albertans can continue to enjoy a safe and healthy environment. Related information

BC Amendments improve management of oil and gas, strata properties

VICTORIA - Amendments introduced today clarify both oil and gas activities in the province and strata property governance.

Bill 12, the Natural Gas Development Statutes Amendment Act, 2014, amends three B.C. laws: the Oil and Gas Activities Act, the Petroleum and Natural Gas Act and the Strata Property Act.

Oil and Gas Activities Act (OGAA)

Natural gas and oil activities in British Columbia are regulated under the OGAA. The amendments will allow industry to adopt new operational improvements.

As well, amendments will further define a landowners' right to appeal permits issued on private land and remove the risks associated with unnecessary appeals which could delay oil and gas development.

The amendments will also remove an exemption for a small number of legacy pipelines. Permits will be retroactively issued and the pipelines will continue to be subject to the requirements of the Act and compliance and enforcement actions by the BC Oil and Gas Commission. Petroleum and Natural Gas Act (PNG Act) The natural gas and oil sector has changed significantly since the PNG Act was last updated in 1982. The amendments introduced today will modernize the Act. The Province made this commitment when it released B.C.'s Natural Gas Strategy in February 2012.

The amendments will streamline the administration of natural gas and oil subsurface rights, creating a more consistent approach for all three tenure types - permits, leases and drilling licences. Fines will be updated so they align with penalties in other jurisdictions.

Changes will also permit the Province to modernize tenure practices, and remove duplication with tenure-related laws.

Collectively, these amendments will increase investor confidence in natural gas and oil development, giving companies further clarity about crown land tenure management.

Strata Property Act (SPA)

Amendments to the Strata Property Act will make it easier for strata councils to carry out their responsibilities by removing regulatory barriers for strata corporations and owners, explaining requirements and clarifying definitions within the Act.

The amendments will confirm that paying for and accruing funds to pay for a depreciation report is a legitimate operating fund expense and can be approved by a majority vote.

As well, the amendments will make it easier for strata corporations to pay for repairs recommended by their depreciation report by reducing the required approval for contingency reserve fund expenditures from three-quarters to majority vote.

The amendments will change the definition of purchasers to make it clearer that specified rights and obligations do not end when the title has changed hands.

Quick Facts:

• The Ministry of Natural Gas Development grants tenure for Crown-owned natural gas and oil resources to industry under the PNG Act. These rights are required before exploration and development operations can commence. Exploration and development activities are permitted and regulated by the BC Oil and Gas Commission under the Oil and Gas Activities Act.

• The Strata Property Act provides a framework that enables strata owners to maintain control over their property and have a voice in its management. There are approximately half a million residential strata lots and 29,000 strata corporations in B.C. Depreciation reports have been mandatory since December 2013.

US ISSUES EMERGENCY ORDER FOR CRUDE-BY-RAIL

(Source: HazMat Magazine) The U.S. Department of Transportation (DOT) has issued an emergency order requiring shippers to test oil product from the Bakken region for proper classification, while also prohibiting rail transport of crude oil in less robust tanker cars.

Issued on February 25, 2014, the order came as the U.S. performs its “Bakken Blitz”, designed to investigate the recent uptick in derailments involving misclassified crude from North Dakota. Accurately labelling tanker car contents is critical to ensure there aren’t gases from the lighter oil produced in North Dakota’s shale rock.

The oil involved in Quebec’s Lac-Megantic derailment tragedy, which killed 47 people, involved misclassified oil from the Bakken Region. And over February 2014, the DOT issued three violation notices and fines against tank car loaders in North Dakota for downgrading the hazard rating of crude oil shipments from the Bakken.

The second part of the U.S. emergency order protects against crude oil being transported in weaker Packing Group III tanker cars. All Class III crude oil shipments must be designated as Packing Group I or II, thereby requiring the use of a more robust tank car, the U.S. DOT stated.

“Today we are raising the bar for shipping crude oil on behalf of the families and communities along rail lines nationwide — if you intend to move crude oil by rail, then you must test and classify the material appropriately,” said DOT Secretary Anthony Foxx in a statement. “And when you do ship it, you must follow the requirements for the two strongest safety packing groups. From emergency orders to voluntary agreements, we are using every tool at our disposal to ensure the safe transportation of crude,” added Foxx.

Emergency orders are issued to protect the public and environment from the likelihood of substantial harm created by an imminent hazard.

Shippers are required to use nine hazard classes as a guide to properly classify their hazardous materials. Proper classification will ensure that the material is placed in the proper package and that the risk is accurately communicated to emergency responders. Shipping crude oil – or any hazardous material – without proper testing and classification could result in material being shipped in containers that are not designed to safely store it, or could lead first responders to follow the wrong protocol when responding to a spill.

In addition to Operation Classification, which includes crude oil spot inspections and investigations, PHMSA will be in Minot, North Dakota this week conducting a classification workshop. Field personnel will present training at the 60th Annual State Fire School sponsored by the North Dakota Firefighters Association to provide information about hazmat response, including how to use the Emergency Response Guidebook.

FERTILIZER LIMITS SOUGHT NEAR LAKE ERIE TO FIGHT SPREAD OF ALGAE

(Source: New York Times) A United States-Canadian agency called on Wednesday for swift and sweeping limits on the use of fertilizer around Lake Erie to reduce the amount of phosphorus entering the water and creating a vast blanket of algae each summer, threatening fisheries, tourism and even drinking water.

In a report on the algae problem, the agency, the International Joint Commission, said that fertilizer swept by rains from farms and lawns was a major source of phosphorus in the lake. It recommended that crop insurance be tied to farmers’ adoption of practices that limit fertilizer runoff, and that Ontario, Ohio and Pennsylvania ban most sales of phosphorus-based lawn fertilizers.

The commission, which studies and regulates water uses in streams and lakes along the border of the United States and Canada, urged Michigan and Ohio to invoke the Clean Water Act to limit phosphorus pollution from farmland as opposed to from factories and other places where pollution can be pinpointed and measured.

The proposals are likely to encounter strong opposition from the agricultural industry and fertilizer manufacturers. Both groups have already asked a federal appeals court to prohibit the Environmental Protection Agency from regulating farm-related pollution from phosphorus and other chemicals along the Chesapeake Bay.

Phosphorus — and especially phosphorus in fertilizer, which is designed to be easily absorbed by plants — is the source of the algal blooms, some of which are so toxic that they have killed dogs and sickened swimmers. Beyond clotting the lake’s surface, decomposing algae consumes the oxygen in the lake’s deep center each summer, creating a dead zone where deepwater fish that are essential to the lake’s food chain cannot exist.

National and state governments rid the lake of algae in the 1980s, ordering big cuts in phosphorus pollution from factories and sewage plants. But the blooms returned in the late 1990s as farmers started applying fertilizer on frozen fields in the winter, and spreading or spraying it instead of injecting it into the ground.

In 2011, heavy spring rains washed so much phosphorus into the lake that the succeeding summer, algal bloom, at 1,920 square miles, was three times bigger than any previous one.

That and other large blooms have crippled tourism in a region where sport fishing and lake recreation are major industries, and they have forced towns and cities to filter and even shut off drinking water. The multibillion-dollar commercial fishing industry could be hit hard. The lake’s growing dead zone has prompted deepwater fish to move upward in search of oxygen, only to run into warmer waters that they find hard to tolerate. Deepwater fish such as perch — a favorite food of one big commercial fish, the walleye — could suffer if the dead zone continues to expand.

“The long-term potential impact on fisheries is something we’re really worried about,” said Donald Scavia, a scientist at the University of Michigan’s Graham Environmental Sustainability Institute.

Although the sources of phosphorus range from leaky septic tanks to storm sewers to ordinary rainfall, the biggest contributor is farming, the report indicates — and the biggest farm source is the fields along the Maumee River watershed in Ohio and Indiana.

Both the United States and Canada have set targets for reducing Erie’s phosphorus load by 2018, but the commission’s report states that those targets are too low. To return the lake to the mostly algae-free state it enjoyed in the mid-1990s, it states, the Maumee’s phosphorus runoff must be cut by 39 percent.

Both governments and private organizations conduct programs that encourage farmers to voluntarily limit fertilizer runoff, but regulatory limits are mostly nonexistent. The commission’s report urges a mix of voluntary and legal programs to achieve large reductions by 2022, with a focus on dissolved reactive phosphorus, the sort used in fertilizers.

The report also states that farmers in lakeside states and provinces should prohibit spreading fertilizer on snowy or frozen ground, where it is most likely to be carried away by melting or rains, and should limit applications in the fall.

For homeowners, the report recommends that Ontario, Ohio and Pennsylvania ban the sale of phosphorus-based lawn fertilizers except during the first growing season of new lawns, or when soil tests show that the phosphorus content is too low. It also says that Michigan and Ontario should require inspections of septic tanks to ensure they do not leak.

LACK OF NATIONAL COAL-ASH RULES STIRS ACTION

(Source: Columbus Dispatch) WASHINGTON — A huge North Carolina coal-waste spill into a major river is increasing pressure on the Obama administration to start policing the more than 1,000 such waste-storage sites across the nation.

The federal government doesn’t regulate the disposal of “coal ash,” the dustlike material that’s left when pulverized coal is burned to fuel electrical power plants. Pennsylvania leads the nation in coal-ash production, followed by Texas, Indiana, Ohio and Kentucky.

Coal ash can contain toxic materials such as arsenic and selenium, but the Environmental Protection Agency has left it to the states to decide what rules to put in place. The result has been an inconsistent patchwork of regulations that the EPA acknowledges is full of gaps.

The agency promises to come out with long-delayed rules by the end of the year, but it’s likely to leave the enforcement in the hands of the states.

State coal-ash enforcement is under particular fire in North Carolina after a Duke Energy spill this month poured coal ash into the Dan River. The U.S. Fish and Wildlife Service has estimated that up to 39,000 tons of the waste traveled 80 miles downstream and coated the river bottom in a layer of sludge. It’s endangering aquatic life in the river, and health officials warn against eating fish caught in the contaminated stretch.

“If this doesn’t prove you need to have a strong federal regulation, then what proof does it take?” said Frank Holleman, attorney for the Southern Environmental Law Center, which has challenged state oversight of coal-ash dumps.

The U.S. Justice Department has launched a criminal probe of North Carolina’s environmental agency in the wake of the spill, with state regulators receiving subpoenas to appear next month before a federal grand jury. Among the subpoena demands: State officials must bring any records they have of gifts from Duke Energy.

The environmental group Earthjustice has documented 208 coal-ash storage sites in 37 states with contamination or spills.

One of the options the EPA is considering is to declare coal ash a hazardous waste. That would require special handling and disposal, with direct oversight by the EPA.
