B. Delivery, Installation & Commissioning Terms:Delivery, installation and commissioning should be completed within 60 daysof confirmed order.

C. Warranty Service Terms:1. WARRANTY PERIOD: 1 year + 2 years under protection plan from thedate of commissioning.2. Preventive & corrective maintenance of the PCs supplied includingreplacement of defective parts during warranty period, at no extra cost.3. The defective parts under warranty should be first repaired / replaced andthereafter the defective items can be taken out of OIL's premises. Failure torepair or replace a defective part(s) under warranty within the stipulatedperiod will attract penalty, as mentioned in penalty clause.4. Engineers should be available on call basis.6. Bidder will have to arrange its own transport facility for the engineers toattend warranty service calls, and for movement of spare parts.7. Warranty covers free service and free spare parts, excluding theconsumables.

D. Penalty Terms:1. If for any reason, during the warranty period the bidder fails to provideservices within seven successive days from the date of reporting thebreakdown, the period of warranty will be extended by that number(s) of days,at no extra cost to OIL.

H. General Terms & Conditions:1. The Bidder has to be OEM/Joint venture of OEM/Subsidiary ofOEM/Authorised dealer of OEM/Authorised Reseller of OEM. 3.Rate quoted must be firm for delivery. Offer with condition of price variation on any scorewhatsoever would be summarily rejected without any further reference.

4.Bids received after the bid closing date and time will be rejected. Similarly, modifications tobids received after the bid closing date & time will not be considered.

5.THE OFFER SHOULD BE SUBMITTED IN DUPLICATE.

6.In the event of receipt of only a single offer against the tender within B.C. Date, OIL reservesthe right to extend the B.C. Date as Deemed fit by the company. During the extended period, thebidders who have already submitted the Bids On or Before the original B.C. Date, shall not bepermitted to revise their quotation.

7.Any sum of money due and payable to the contractor (including Security Deposit refundable tothem) under this or any other contract may be appropriated by Oil India Limited and set-offagainst any claim of Oil India Limited (or such other person or persons contracting through OilIndia Limited) for payment of sum of money arising out of this contract or under any other

8.For order with F.O.R. Duliajan term, 100% payment against dispatch document will not beentertained. In this regards please refer payment terms in ANNEXURE -MM/TENDER/LP/01/06.

9.The tender will be governed by General Terms and Conditions for Indigenous tender videMM/TENDER/LP/06.

Special Notes : BID REJECTION CRITERIA (BRC) / BID EVALUATION CRITERIA (BEC):

The following BRC/BEC will govern the evaluation of the bids received against this tender. Bidsthat do not comply with stipulated BRC/BEC in full will be treated as non responsive and suchbids shall prima-facie be rejected. Bid evaluation will be done only for those bids that passthrough the "Bid Rejection Criteria" as stipulated in this document.

Other terms and conditions of the enquiry shall be as per General Terms and Conditions forIndigenous tender vide MM/TENDER/LP/06. However, if any of the Clauses of the Bid RejectionCriteria / Bid Evaluation Criteria (BRC / BEC) contradict the Clauses of the tender orMM/TENDER/LP/01/06 elsewhere, those in the BRC / BEC shall prevail.

1.0 BID REJECTION CRITERIA (BRC):

The bid shall conform generally to the specifications and terms and conditions given in thisdocument. Notwithstanding the general conformity of the bids to the stipulated specifications, thefollowing requirements will have to be particularly met by the Bidders without which the same willbe considered as non-responsive and rejected.

i). The Bidder has to be OEM/Joint venture of OEM/Subsidiary of OEM/Authorised dealer ofOEM/Authorised Reseller of OEM. Necessary documents in support of above undertakingshould be submitted.

ii) Bid security:The bid must be accompanied by Bid Security of Rs 18,600.00 in OIL's prescribed format asBank Guarantee or a Bank Draft/Cashier cheque in favour of OIL. The Bid Security shall besubmitted manually in sealed envelope superscribed with Tender no. and Bid Closing date toHead Materials, Materials Department, Oil India Limited, Duliajan- 786602, Assam on or beforethe Bid Closing Date and Time mentioned in the Tender. If bid security in ORIGINAL of abovementioned amount is not received within bid closing date and time , the bid submitted throughelectronic form will be rejected without any further consideration. For exemption for submissionof Bid Security, please refer Clause No. 8.8 of General Terms and Conditions videMM/TENDER/LP/01/06. The Bank Guarantee towards Bid Security shall be valid for 10 monthsfrom Bid closing date. (i.e. upto 16.08.2015).

The format of Bank Guarantee towards Bid Security (Annexure - IV) has been amended to

In case of extension of Bid Closing date against the tender where a bidder has already submittedhis bid with requisite bid security validity within the original B.C. Date, such bidders will extendvalidity of bid security covering the extended period of the bid closing date.

iii). The prices offered will have to be firm through delivery and not subject to variation on anyaccount. A bid submitted with an adjustable price will be treated as non-responsive and rejected.

iv). Bids received after the bid closing date and time will be rejected. Similarly, modifications tobids received after the bid closing date & time will not be considered.

v). Validity of the bid shall be minimum 120 days from the Bid Closing Date. Bids with lesservalidity will be rejected.

vi). Bids containing incorrect statement will be rejected.

2.0 BID EVALUATION CRITERIA (BEC):

The bids conforming to the technical specifications, terms and conditions stipulated in the tenderand considered to be responsive after subjecting to the Bid Rejection Criteria as well asverification of original of any or all documents/ documentary evidences pertaining to BRC, will beconsidered for further evaluation as per the Bid Evaluation Criteria given below:

i) To evaluate the inter-se-ranking of the offers, Assam Entry Tax on purchase value will beloaded as per prevailing Govt. of Assam guidelines as applicable on bid closing date. Biddersmay check this with the appropriate authority while submitting their offer.

ii) If there is any discrepancy between the unit price and the total price, the unit price will prevailand the total price shall be corrected. Similarly, if there is any discrepancy between words andfigure, the amounts in words shall prevail and will be adopted for evaluation.

iii) To ascertain the substantial responsiveness of the bid OIL reserves the right to ask the bidderfor clarification in respect of clauses covered under BRC also and such clarifications fulfilling theBRC clauses in to must be received on or before the deadline given by the company, failingwhich the offer will be summarily rejected.

B. Delivery, Installation & Commissioning Terms:Delivery, installation and commissioning should be completed within 60 daysof confirmed order.

C. Warranty Service Terms:1. WARRANTY PERIOD: 1 year + 2 years under protection plan from thedate of commissioning.2. Preventive & corrective maintenance of the PCs supplied includingreplacement of defective parts during warranty period, at no extra cost.3. The defective parts under warranty should be first repaired / replaced andthereafter the defective items can be taken out of OIL's premises. 3.Rate quoted must be firm for delivery. Offer with condition of price variation on any scorewhatsoever would be summarily rejected without any further reference.

4.Bids received after the bid closing date and time will be rejected. Similarly, modifications tobids received after the bid closing date & time will not be considered.

5.THE OFFER SHOULD BE SUBMITTED IN DUPLICATE.

6.In the event of receipt of only a single offer against the tender within B.C. Date, OIL reservesthe right to extend the B.C. Date as Deemed fit by the company. During the extended period, thebidders who have already submitted the Bids On or Before the original B.C. Date, shall not bepermitted to revise their quotation.

Special Notes : BID REJECTION CRITERIA (BRC) / BID EVALUATION CRITERIA (BEC):

The following BRC/BEC will govern the evaluation of the bids received against this tender. Bidsthat do not comply with stipulated BRC/BEC in full will be treated as non responsive and suchbids shall prima-facie be rejected. Bid evaluation will be done only for those bids that passthrough the "Bid Rejection Criteria" as stipulated in this document.

Other terms and conditions of the enquiry shall be as per General Terms and Conditions forIndigenous tender vide MM/TENDER/LP/06. However, if any of the Clauses of the Bid RejectionCriteria / Bid Evaluation Criteria (BRC / BEC) contradict the Clauses of the tender orMM/TENDER/LP/01/06 elsewhere, those in the BRC / BEC shall prevail.

1.0 BID REJECTION CRITERIA (BRC):

The bid shall conform generally to the specifications and terms and conditions given in thisdocument. Notwithstanding the general conformity of the bids to the stipulated specifications, thefollowing requirements will have to be particularly met by the Bidders without which the same willbe considered as non-responsive and rejected.

i). The Bidder has to be OEM/Joint venture of OEM/Subsidiary of OEM/Authorised dealer ofOEM/Authorised Reseller of OEM. Necessary documents in support of above undertakingshould be submitted.

ii) Bid security:The bid must be accompanied by Bid Security of Rs 18,600.00 in OIL's prescribed format asBank Guarantee or a Bank Draft/Cashier cheque in favour of OIL. The Bid Security shall besubmitted manually in sealed envelope superscribed with Tender no. and Bid Closing date toHead Materials, Materials Department, Oil India Limited, Duliajan- 786602, Assam on or beforethe Bid Closing Date and Time mentioned in the Tender. If bid security in ORIGINAL of abovementioned amount is not received within bid closing date and time , the bid submitted throughelectronic form will be rejected without any further consideration. For exemption for submissionof Bid Security, please refer Clause No. 8.8 of General Terms and Conditions videMM/TENDER/LP/01/06. The Bank Guarantee towards Bid Security shall be valid for 10 monthsfrom Bid closing date. (i.e. upto 16.08.2015).

iii). The prices offered will have to be firm through delivery and not subject to variation on anyaccount. A bid submitted with an adjustable price will be treated as non-responsive and rejected.

iv). Bids received after the bid closing date and time will be rejected. Similarly, modifications tobids received after the bid closing date & time will not be considered.

v). Validity of the bid shall be minimum 120 days from the Bid Closing Date. Bids with lesservalidity will be rejected.

vi). Bids containing incorrect statement will be rejected.

2.0 BID EVALUATION CRITERIA (BEC):

The bids conforming to the technical specifications, terms and conditions stipulated in the tenderand considered to be responsive after subjecting to the Bid Rejection Criteria as well asverification of original of any or all documents/ documentary evidences pertaining to BRC, will beconsidered for further evaluation as per the Bid Evaluation Criteria given below:

i) To evaluate the inter-se-ranking of the offers, Assam Entry Tax on purchase value will beloaded as per prevailing Govt. of Assam guidelines as applicable on bid closing date. Biddersmay check this with the appropriate authority while submitting their offer.

ii) If there is any discrepancy between the unit price and the total price, the unit price will prevailand the total price shall be corrected. Similarly, if there is any discrepancy between words andfigure, the amounts in words shall prevail and will be adopted for evaluation.

iii) To ascertain the substantial responsiveness of the bid OIL reserves the right to ask the bidderfor clarification in respect of clauses covered under BRC also and such clarifications fulfilling theBRC clauses in to must be received on or before the deadline given by the company, failingwhich the offer will be summarily rejected.
