ANNUAL ADMINSTRATIVE REPORT WITH ANNUAL REPORT UNDER RIGHT TO INFORMATION ACT IN RESPECT OF THE DEPARTMENT OF THE ADVOCATE GENERAL, STATE OF HIMACHAL PRADESH SHIMLA FOR THE YEAR 2008-09. 1. ANNUAL ADMINSTRATIVE REPORT WITH ANNUAL REPORT UNDER

RIGHT TO INFORMATION ACT IN RESPECT OF THE DEPARTMENT

OF THE ADVOCATE GENERAL, STATE OF HIMACHAL PRADESH

SHIMLA FOR THE YEAR 2008-09.

1. Background & Introduction

The Department of the Advocate General, State of Himachal Pradesh is

basically an advisory body of the Government. No plan schemes are dealt with

by this department. The Governor of each State shall appoint a person who is

qualified to be appointed a Judge of a High Court to be Advocate General for the

State under clause (1) of Article 165 of the Constitution of India. The Advocate

General of the State shall hold office during the pleasure of the Governor.

2 Particulars of its Organization; functions and duties. The department of the Advocate General, Himachal Pradesh came into

existence in the year 1971 with skeleton staff and with the passage of time and

due to increase in case work manifold, the staff strength of the department of the

Advocate General has also been increased slightly. Prior to 1971 the Govt. cases

were being defended by private Advocates on counsel fee as settle by the Govt.

The main function of this department is to conduct cases on behalf of the State

Government before the Hon’ble High Court of Himachal Pradesh and also before

the Central Administrative Tribunal in which the State Government is a party.

Besides the above, the Advocate General is required to do the following work: -

(a) He shall advise the State Government upon which the Home

Secretary or the Legal Remembrancer to the Government of the

State may refer legal matters to him.

(b) He will represent or arrange for the representation of the State at

all stages before the High Court in criminal cases and cases of a

quasi-criminal nature, such as those relating to the Press law, writs

under the Constitution, extradition and preventive detention.

(c) He will appear, or arrange for the appearance of counsel, in the

following civil cases: -

i) Cases in the High Court to which the State Govt. is a party;

ii) Cases in the High Court to which officers serving under the state

government are parties and which the state Government has

decided to conduct on behalf of such officers;

iii) Cases in the High Court in which neither the State Government nor

such officers are directly interested, but in which government

consider themselves to be sufficiently interested to render it

advisable to;

(iv) Appeals from the cases referred to in clause (iii), (v) He will appear personally before the High Court when so required

by Govt. in references from subordinate courts to which

Government is a party or in cases withdrawn to the High Court from

subordinate courts under Article 228 of the Constitution or any

other law.

(vi) He will appear himself or arrange for the conduct of civil cases of

the nature described above, when so required, in the other civil

courts of Shimla.

(vii) He will also be expected to appear in any civil or criminal case

outside Shimla whether in courts subordinate to the High Court or

in the Supreme Court, in any other court, when specially desired to

do so by the State Government or by the Legal Remembrancer.

(viii) He will take part in the proceedings of the House or Houses of the

State legislature or any committee of the legislature of which he

may be named as member.

(ix) He shall also discharge the functions conferred on him by or under

the Constitution or under any other law for the time being in force.

3. Goals and Objectives of Annual Action Plan fixed and accomplished:- The department of the Advocate General, State of Himachal Pradesh is

basically an advisory and non-plan department. The main object of this

department is to conduct all types of cases before the Hon’ble High Court of

Himachal Pradesh as well as before the Central Administrative Tribunal, on

behalf of the Government of Himachal Pradesh.

4. Major Programmes and Schemes with target, achievement, budget expenditure and main activities alongwith special mention or shortfall or extra achievements; Since the department of the Advocate General only deals with legal

matters, as such, does not deal with any programmes and schemes etc.

5. Legislation, Rules and Regulations finalized: This department does not finalize the Legislation, Rules and Regulations

as its main function is to defend the Government in all cases before the Hon’ble

High Court and Central Administrative Tribunal and also to give advice to the

Government of the State upon such legal matters and to perform such duties of a

legal character which may, from time to time, be referred or assigned to him by

the Governor, and to discharge the functions conferred on him by or under the

Constitution of India or any other law for the time being in force.

6. Administrative and Economic Reforms Initiated:

The department of the Advocate General is basically a non-plan

department. The main object of this department is to watch the Government

interest in all cases in which the State Government is a party before the High

Court and Central Administrative Tribunal and as such, does not deal and initiate

any Administrative and Economic Reforms.

7. The five years plan and annual plan: The department of the Advocate General is non-plan department and

does not deal with such plan.

9 The powers and duties of its officers and employees:-

The function and duties of the above officers of this department are to

conduct Government cases before the Hon’ble High Court of Himachal Pradesh,

and Central Administrative Tribunal and the duties of the employees of this

department are to maintain liaison between different departments of the State

and Central Governments and to convey day to day court orders while

conducting Government cases. Not only this, the employees of this department

are required to maintain judicial record in proper form and also to make it

available before the Hon’ble Court as and when the same is required to be

produced in different cases. In addition to it, the Librarian of this department is

required to maintain the Library books in proper form and make it convenient to

make available the library books in the courts while defending Government

cases. It is relevant to point out here that the library of this department is one of

the biggest libraries of the State of Himachal Pradesh and the work load qua the

librarian of this department is always at high stake.

10 The procedure followed in the decision making process, including

channels of supervision and accountability.

The decision-making procedure in this department is that the Advocate

General functions as the Head of the Department, one Deputy Advocate General

has been declared as Head of Office and the another Deputy Advocate General

is functioning as Drawing & Disbursing Officer, the Administrative Officer looks

after and supervises the whole Administrative work whereas the Superintendents

supervise the work of Administration as well as judicial while they are posted in

respective sections. As a whole, the whole process of decision-making goes in

the above hierarchical manner and all the staff working in this department is

accountable to their duties to the respective authorities.

11 The norms-set by it for discharge of its function:- The norms set by this department for the discharge of its functions is that

this department is divided/bifurcated in different sections viz. Judicial Section,

Administrative Section, Store Section, library and Accounts Section qua the

category of Ministerial staff. So for as the officers who are working on legal side

in this department are concerned they are required to defend/conduct

Government cases before different courts and their deployment is ordered by the

Head of the Department according to the requirement and the stake of cases

before different courts from time to time.

12 The rules, regulations instructions, manual and records, under its control or used by its employees for discharging the functions;

This department does not have its own rules, regulation, instructions and

manuals etc. except the R&P Rules of the following categories of its employees

which stand already notified and published in HP Rajpatra for the general

information of the public: -

i) Recruitment & Promotion Rules for the post of the Deputy Advocate

General in the pay scale of Rs.14300-18600.

ii) Recruitment & Promotion Rules for the post of the Assistant

Advocate General in the pay scale of Rs.13500-16800.

iii) Recruitment & Promotion Rules for the post of the Administrative

Officer in the pay scale of Rs.7880-11660.

This department does not hold any document of its own. However,

the documents /record which are required while conducting government

cases are summoned by this department from the concerned departments

and produced the same before the Hon’ble Courts and then return the

same back there and then to the representatives of the concerned

department.

14. The particulars of any arrangement that exists for Consultation with, or representation by, the members of the public in relation to the formulation of its policy or implementation thereof:-

This department does not make any policy of its own, as the main

function of this department is to conduct government cases before

different courts. However, the policies being framed and formulated by the

Government from time to time are being followed & implemented by this

department in its letter and spirit.

15 A statement of the boards, councils, committees and other bodies consisting of two or more persons constituted as its part or for the purpose of its advice, and as to whether meetings of those boards, councils, committees and other bodies are open to the public, or the minutes of such meetings are accessible for public:

As stated above the main function to this department is to conduct

Government cases before different courts and does not deal with the

public directly and there is hardly any necessity to constitute any board or

committee nor there is any need to hold any meeting with the public in

general or with any other dignitaries in particular.

General, Additional Advocates General and the Deputy Advocates General, who

The budget allocation of this department is “Voted-(Non-Plan)”. The total

allocation of the budget for the financial year 2009-10 is to the tune of

Rs.2,16,48000/-. During the last financial year i.e. 2008-09 the original budget

estimate was Rs.2, 00,96,000/- and the actual expenditure for this financial year

was Rs.2,60,25,810/-. However, the SOE wise budget in respect of this

Department during the current financial year and for the year 2007-08 & 2008-09

is as under;-

It is, however, relevant to point out here that except the non-plan budget,

this department does not have any plan budget nor does it deal with any

scheme whether centrally sponsored scheme or otherwise.

scheme nor there is any such programme in hand of this department as at

present.

The particulars of facilities available to citizens for obtaining information, including the work hours of a library or reading room, if maintained for public use; The library of this office is only meant for making available the books in

different courts while conducting Govt. cases & it is not functioning as a

public library and hence no facility is available to the general public in this

regard.
