Newsletter 2016-10 March 4, 2016 ONE WEEK REMAINS IN SESSION; MANY ISSUES LEFT TO BE RESOLVED The Second Session of the 83 rd Session of the West Virginia Legislature will end Saturday, March 12, at midnight. Many issues remain, including bills to balance the $353 million projected shortfall in the general fund budget. The Senate Wednesday passed S.B. 555, a bill to provide over $300 million in new annual revenues to for highway and bridge maintenance and construction projects. The vote was 25-9. The bill is currently being discussed by House Finance Committee subcommittee today. All members today received a Legislative Alert and a request from CAWV President Dan Cooperrider to contact their delegates and to come to the Capitol on Monday to meet personally with delegates to gain their support of S.B. 555. The CAWV State Meeting will be held at 7:30 a.m. followed immediately by Senator Capito, who will open WV EXPO and the Marcellus and Manufacturing Development Conference. She will speak on infrastructure funding and energy issues pending in the U.S. Senate. Registration is open for the CAWV State Meeting, being held March 23 at 7:30 a.m. at the Charleston Civic Center. The cost to attend is $35 and registered members will be invoiced. Many CAWV members have served on the licensing board since its inception 30 years ago. There are eight categories on the board. They are: Electrical, piping, general building, general engineering, HVAC, multifamily, plumbing, residential building and specialty.

CAWV MIDYEAR MEETING – A MAGICAL TIME HAD BY ALL All event photos have been posted on the CAWV Midyear Meeting Event Page. Members can access site by using the following link: http://www.cawv.org/events/midyear-meeting.html PROCTOR & GAMBLE PLANT TO BE OPERATIONAL BY FALL OF 2017 Ted Preston, Global Construction Manager for Proctor & Gamble, presented to a large group of attendees at the Appalachian Construction Users Council (ACUC) on Wednesday at the Four Points by Sheraton in Charleston. Mr. Preston was adamant when he said “Proctor & Gamble is a community oriented company that focuses on a ‘built here/made here’ philosophy and we want to partner with West Virginia contractors and use local labor on the project.” Mr. Preston noted that this plant is only the second manufacturing facility built in North America by Proctor & Gamble in 44 years and the company’s first foray in West Virginia. The plant site in Berkeley County contains 465 acres and is expected to hire 300 employees when it opens in the fall of 2017. The plant will eventually employ more than 700 full time employees when it is completed in 2019. Mr. Preston did not give a lot of information about the actual structures that will be built on the site. He did note there will be a manufacturing facility with one million square feet under roof and a warehouse facility that will also be one million square feet under roof. Fluor Enterprises, the construction manager for the $500 million Proctor & Gamble manufacturing facility, has started site work and will be accepting bids on other parts of the facility in the coming months. CAWV members that are interested in pre-qualifying to be put on the bidders list should send an email to P&[email protected] describing your company’s specific areas of construction in as much detail as possible. You will be contacted by a representative from Fluor with additional instructions for pre-qualification and registration for the project bidders list. RE: MEMBERS ASKED TO COME TO STATE CAPITOL MONDAY IN SUPPORT OF S.B. 555

CAWV President Dan Cooperrider is sending a request to all CAWV members to come to Charleston and the State Capitol on Monday, March 7, to meet with their House of Delegates members on S.B. 555, the highway funding bill.

S.B. 555, which passed the Senate Wednesday by a vote of 25-9, is being considered by a House Finance Subcommittee. Subcommittee members met today to begin review of the bill, which generates $316 million in additional revenue for West Virginia’s highway and bridge maintenance and construction program. Delegates want more information on the funding levels included in the bill before meeting again. The subcommittee could meet again today or tomorrow.

S.B. 555 comes on the heels of a House Finance Committee vote Thursday which defeated by a margin of 21-3 a proposal to increase the state’s cigarette tax 45 cents a pack which would raise $78 million for the Public Employees Insurance Board. The bill was introduced by the Governor and the Senate voted 26-6 to increase the tax to $1.00. The Finance Committee was expected to reduce the tax back to the governor’s 45 cents proposal and send the bill to the full House for approval.

ACTION REQUESTED:

CAWV President Dan Cooperrider wants all interested members at the State Capitol Monday, March 7, to personally meet with their delegates. The House usually goes into session at 11:00 so members can plan on being at the Capitol anytime starting at 9:00 a.m. Members can also come around 1:00 p.m. if they would rather come in the afternoon.

If you cannot personally be in Charleston, members must call their legislators and ask them to vote “YES” on S.B. 555. A fact sheet is attached with this memo to be used for talking points. Phone numbers for delegates are available here.

West Virginia Highway Facts

Unique Aspects of West Virginia’s Transportation System:

With roughly 36,000 miles of public highway mileage, West Virginia is one of only four states (Delaware, North Carolina, and Virginia are the others) in which there is no county and/or township ownership of highways.

As a result, the WVDOH has statutory authority for the construction, improvement, and

maintenance of nearly all public highway miles (approximately 36,000 or 93%) in the state, the highest percentage in the nation.

Furthermore, despite West Virginia’s relatively small size, the WVDOH is responsible for

the sixth-largest state maintained highway network in the nation. (Source: W.Va. DOT STIP)

Infrastructure Problems:

Throughout the state, more than one-third of major locally and state-maintained roads and highways have deficient pavements, providing motorists with a rough ride.

Twelve percent of West Virginia’s major roads and highways have pavements rated in

poor condition. Another 24 percent of West Virginia’s major roads are rated in mediocre condition, while 18 percent are rated in fair condition and the remaining 46 percent are rated in good condition.

A review released in February 2016 shows that West Virginia is 8th in the nation in 2015 for having structurally deficient bridges, This is worse than the 14th in nation ranking in 2013.

As roads and highways continue to age, they will reach a point of deterioration where

routine paving and maintenance will not be adequate to keep pavement surfaces in good condition. Costly reconstruction of the roadway and its underlying surfaces will become necessary.

The state’s Transportation Secretary has said that unless significant funds are added to

the state Road Fund, the re-paving cycle for secondary roads and highways will go to a nearly 33-year cycle.

Secretary Paul Mattox announced in January 2016 that the WVDOH has $16 billion of

projects that will never go to bid because of a lack of money.

Jobs:

Roads equals jobs!

West Virginia leads the nation in largest percentage decline of construction jobs.

Thousands of West Virginia jobs are created and retained through highway construction and maintenance.

Costs:

Driving on rough roads costs West Virginia motorists a total of $400 million annually in extra vehicle operating costs. Costs include accelerated vehicle depreciation, additional repair costs, increased fuel consumption and tire wear.

Driving on rough roads costs the average West Virginia motorist $333 annually and the

average Charleston-area driver $383 in extra vehicle operating costs.

Many drivers are paying less in total gasoline taxes today that 10 or 20 years ago due to driving cars with much higher MPG capabilities…using fewer gallons of gasoline.

An average driver in West Virginia uses 853 gallons of fuel (15,786 miles @18.5 miles

per gallon). Each driver pays less than $280 in state fuel taxes annually (853 gallons x 0.33.2 cents/gallon).

Economic Facts:

Area Development magazine (2011) says good transportation (improved access, reduced transport costs and improved, safe highway accessibility) was ranked as the number one site selection factor.

Safety Facts:

West Virginia has one of the highest highway fatality rates in the nation.

The fatality rate on West Virginia’s non-interstate rural roads is more than double the rate on all other roads in the state (2.54 fatalities per 100 million vehicle miles of travel vs. 1.19).

State Road Funds Challenges: The WVDOT advised the Blue Ribbon Highway Commission of these facts:

Minimal revenue growth for state Road Fund for the next several years,

Costs projected to continue to increase, and

Due to the 2.5 cents per gallon decrease in the state wholesale ta in 2015 and 2016, WVDOH is losing almost $40 million a year in revenue.

The state Road Fund’s purchasing power, when adjusted for inflation, continues to

decrease. Overall the impact on inflation over the past years had results in a decline of nearly one‐third in the real value of total dedicated tax revenues in the State Road Fund.

This presentation explores the impact that the selection of structural steel framing can have on the energy performance of a building. Steel elements that bridge across the insulation in a building enclosure can cause significant heating and cooling energy loss-but they don't have to. As buildings become tighter and more insulated, it becomes increasingly important to address thermal steel bridging. OSHA REMINDS EMPLOYERS TO POST FORM 300A INJURY / ILLNESS SUMMARY

OSHA has now issued a reminder to employers to post the OSHA Form 300A at their facilities. Employers must post the summary between February 1 and April 30, 2016, in an area visible to all employees. OSHA Form 300A summarizes the total number of work-related injuries and illnesses that occurred in 2015. Also recent changes have been made to the record keeping and reporting requirements. The rule, which also updates the list of employers partially exempt from OSHA record-keeping requirements, went into effect on Jan. 1, 2015 for workplaces under federal OSHA jurisdiction. Under the revised rule, employers will be required to notify OSHA of work-related fatalities within eight hours, and work-related in-patient hospitalizations, amputations or losses of an eye within 24 hours. Previously, OSHA's regulations required an employer to report only work-related fatalities and in-patient hospitalizations of three or more employees. Reporting single hospitalizations, amputations or loss of an eye was not required under the previous rule. Employers can report these events by telephone to the nearest OSHA Area Office during normal business hours or the 24-hour OSHA hotline 1-800-321-OSHA [6742], or electronically through a new tool which will be released soon and accessible at www.osha.gov/report_online. The new rule maintains the exemption for any employer with 10 or fewer employees, regardless of their industry classification, from the requirement to routinely keep records of worker injuries and illnesses. All employers covered by the Occupational Safety and Health Act, even those who are exempt from maintaining injury and illness records, are required to comply with OSHA's new severe injury and illness reporting requirements. OSHA has posted a new website with plain language materials about the new requirements. For more information on the industries now exempt from keeping records or new industries now covered, please visit www.osha.gov/recordkeeping2014. OSHA has also posted training material and other guidance on how to keep OSHA records to make it easy for newly covered employers to comply.
