Peacetime Own territorial waters:

Perfectly legal under all international laws Must provide notification through notice to mariners

High Seas: Must be an immediate and legitimate self-defense/security concern Cannot unreasonably interfere with other ocean uses Scope of mining must be in proportion to the threat Must provide international notification as to the location and duration of field Must maintain presence to warn approaching vessels Must remove mines when no longer threatened

Other nations waters Considered a violation of sovereign territory

Wartime International notification required (may not mine for indefinite period of time) Must remove mines after hostilities cease May channelize but not impede shipping in international straits Must provide alternate route for neutral shipping if mining high seas Cannot solely target commercial shipping
