Protecting yourself in writingAs business owners, we spend so much time working

on getting business we may lose track of the paperwork needed to protect ourselves when we do get a signed contract. Our contract is all we have in protecting ourselves should a matter go to court or arbitration. There have been recent legislative changes that require new language in our contracts. It indicated that pool contracts required Pool Recovery Fund information with the address to contact for homeowners. If you have not updated this, your contract may technically not be enforceable. You should consult an attorney to make sure you have a current, enforceable contract.

Another item we may overlook that has potential to cause problems is change orders. Even the smallest change by a customer should be done in writing.

Education volunteers neededThe 2017 Everything Under the Sunsm Expo is February 17-18 with continuing education beginning on Thursday, February 16. Continuing education is a significant element of the annual Show and volunteer monitors play a crucial role in its success. FSPA invites all FSPA members to volunteer as a course monitor.

Volunteer ID checkers support course monitors by helping to verify photo identification of attendees.

Monitor duties and responsibilities include:• Arrive at the meeting room early to ensure the

speaker is ready and all audio visual needs have been met.

• Check in attendees. This requires attendees to present a photo ID at the door.

• Give attendees an evaluation form and copy of the course syllabus.

• Ensure that the instructor and attendees sign the attendance roster.

• Read an instructor announcement prior to class beginning.

• Monitor seminar times to ensure they begin / end promptly.

• Collect attendee course evaluations as they leave the meeting room.

• C l e a r s p e a k e r s /attendees from meeting room when course is complete.

• Monitor the doors so no one arrives late or leaves early.

People tend to have convenient amnesia when it comes to what they told your guy in the field and what they say they told them later. This can cause major issues as the customer will refer back to the contract and there would not be any paper trail on changes made in the field. Ninety-nine times this may not be a problem but the one time it is, it can cost you lots of money with no recourse. I’m sure this has happened to many of us, including myself. I now have my superintendents carry iPads with the ability to write up an addendum onsite and have the customer sign the addendum right on the iPad and email it to the office to print. This saves time and money while protecting you at the same time.

Color sheets are another form that need to be handled properly. How many times has someone called up and said that the tile or paver color is wrong or the wrong interior was installed because they didn’t remember what they picked months ago. A properly completed color sheet will protect you from this problem. Adding wording regarding variations of color in tile and pavers will also protect you from people claiming they didn’t know thin and thick pavers may not match perfectly.

In today’s very litigious world, paper is necessary to protect ourselves from future problems and headaches. More importantly it will protect us from losing money.

On a separate note, this month the Florida Show is taking place. I encourage all to attend and bring your employees. As an FSPA member, you receive free education for you and all employees. There are also hands-on training seminars offered by many manufacturers on the show floor. Take advantage of this benefit of being a member. If you are not a member, it isn’t too late to sign up and take advantage of the free education. Hope to see you all at the show!

All in the family

Being a member of a trade association such as Florida Swimming Pool Association (FSPA) has many benefits. Among them are increasing your purchasing power, gaining political clout and enhancing your reputation. But if asked, many members will count the personal and professional relationships and the ability to network, gain and share knowledge as the most important benefit.

Sometimes you may even get to work together on a project and the result of the collaboration can be a better product and service for the customer and more opportunities for the builders, distributors and manufacturers involved.

In 2015 Ken Zook, manager for Waterford Lakes Community Association and member of FSPA, made this opportunity possible when he called fellow FSPA member Tony Caruso, T.C. Water Features, to inquire about replacing their 28-year-old vacuum D.E. filter system. Tony in turn contacted me at Aquaworx (also a FSPA member) and we set up a time to meet at the site along with the aquatic engineer, Gordon Shepardson (FSPA member at the time, now retired).

The Waterford Community has a 108,000-gallon pool and requires 600 gallons per minute of flow to meet the Department of Health (DOH) code. This pool is very popular and many times the bather load (120) is at capacity. The best option available at that time to lengthen the filter run was to double the number of elements from 80 to 160 19” grids. This resulted in it taking approximately four hours to backwash the pool, sometimes daily during peak usage, and taking a large amount of D.E. powder that had to be applied and disposed of properly. They also had a small 6-pound per day chlorine generator to reduce the chemical usage that had little or no effect.

In discussing the options available, the possibility of auto-backwash came up and I told Ken that we could not do that with D.E. filtration but we could with sand. I told him that if he was interested in that option I could bring someone in that could help us with that and we rescheduled and the next time we met I brought along Chris Secue with CES (also a FSPA member).

At that meeting we came up with the ultimate “green” system utilizing variable frequency drives, a commercial grade salt system sized for that pool and sand filters that that could be backwashed in three minutes with the pull of a lever.

All of this was controlled by a BECSys5 that monitored everything and would text and/or email the maintenance person when anything was needed such as backwashing, chemicals or salt. It also had a system that created its own brine and eliminated the need to add salt by hand, which was sometimes done when people were in the pool!

Ken then set up a time for us to meet with the community’s Board of Directors in the auditorium of a local school. Tony, Chris and I formed a panel on the stage and fielded questions from the board members. Tony answered questions about the installation, Chris answered questions on the return on investment of the equipment and I answered questions about the layout of the tanks and enclosures.

The board members were impressed and voted to proceed with the new and improved equipment. We were all involved at various stages of the installation and it was a great success.

“It has been a pleasure to have multiple members of the FSPA work together to enhance the pool operations for another member. Having everyone on the same page, understanding the challenges as a team to find the right solutions made the solution and transition so much easier.” said Ken Zook.

This was a great experience for all of us and a great testimony to teaming up with your fellow members to get a better outcome than we could have been achieved individually. We have already come together to work on other similar projects and look forward to many more in the future.

CILB continues pool electrical discussion

On January 12, FSPA members attended a Construction Industry Licensure Board (CILB) Rules Committee meeting in Jupiter, Florida. The CILB was discussing the FSPA’s request to define installation or repair of pool/spa equipment as it pertains to electrical work. The Committee agreed to put forward for consideration at their next meeting language similar to what FSPA

put forth for their consideration: (16) Installation or repair: Pursuant to section 489.105(3)(j)(k)(l), F.S., the term

“installation or repair” of pool/spa equipment, as it pertains to swimming pool and spa electrical work, is defined as inclusive of replacement, disconnection or reconnection of power wiring on the load side of the dedicated existing electrical disconnecting means. If installation, alteration, removal, replacement, or upgrading of this circuit is necessary, the work shall be performed by a licensed electrical contractor only.

They requested that the Board attorney use the above FSPA suggested language and based on their comments, make any necessary tweaks. The language will then be included in their next meeting packet for further consideration and public comment. That meeting will be held at 8:30 a.m. February 10 at the Embassy Suites Jacksonville – Baymeadows. FSPA is simply seeking clarification that pool professionals can continue doing work that the industry has done for decades but has come under some question by various building departments. Legislative Days March 22-23Legislative days for 2017 is quickly approaching. This is an excellent opportunity

for you to get involved in something that really matters! FSPA is holding its annual legislative days’ event March 22-23. Legislative days is where members come to Tallahassee to voice our industry concerns to legislators and the agencies that regulate us, and to continue to cultivate relationships with those in government. FSPA Government Relations Consultant Jennifer Hatfield has set up meetings for FSPA members with both the Department of Health and the Department of Business & Professional Regulation. Jen has also arranged for members to meet with their elected State House and Senate members from their chapter area.

Often in the daily routine of service professionals, the perspective of performing a service call follows our client’s view and is only visual.

Did you clean the tile? Can you make sure to system vacuum the pool? Did you brush the sides? When is the last time you cleaned the filter? The biggest question, when is it safe to swim?

Typically at a weekly service call we adjust the chemicals to properly sanitize the water. Based on amounts of required sanitizers added, standard answers for the last question vary from a few minutes to a couple of hours. But what are we missing?

A customer opens the windows, looks at the sparkling water and sees a clean pool from tile to floor, and feels our job is done! But is it? As swimming pool professionals our job needs to be more about what lies beneath than visually what looks clean and inviting to the eye.

Don’t get caught up on how fast we can make the pool look inviting without taking a moment to step back from our daily routines and be observant from a 360 degree view for the pool occupants. How are the surroundings? Are loose unsecured coping and trip hazards present? Are all the barriers in place? Are all gates in operational order, whereas to be self-closing and latching (assume the client goes through the gates even if you know they are never used)? Is the pool equipment clear of debris and vegetation which can cause limited/no access, shortening life and performance and in some extreme cases even being a fire hazard? If the system needs to be shut off, does the homeowner know how and have unlimited access?

The swimming pool users rely on us to be observant and can often take for granted that everything is okay from the surface. Many clients have not gone by their pool equipment for months or even years! How is the overall visual appearance of the equipment? Are there exposed electrical wires requiring the attention of a qualified electrical contractor?

Service is the backbone of our industry, the front line of defense. Waiting for the client to notice something may be a costly assumption that everything is working well. Many times it is not until the pool requires a repair or renovation that problems are brought to an unsuspecting pool owner.

The pool user often assumes weekly service is a weekly check-up and that “okay” on a service ticket indicating weekly service was performed is a sign-off that the pool is safe.

We should not assume the customer notices water in the light, the main drain cover is loose or other issues beyond algae or debris in the pool. Taking a few moments and making a quick observation of all the swimming pool surroundings can help provide all swimming pool users a friendlier and safer environment to enjoy.

Whatever level, as aquatic professionals safety is everyone’s responsibility and often can be profitable for your bottom line as well!

Observation, communication and stepping back for a moment to remember when a client ask, “when is it safe to swim”, is more than a question of sanitation but a responsibility of all swimming pool professionals.

Don’t assume the homeowner knows there swimming pool, and always recommend a professional to perform necessary repairs within there scope of license and abilities.

Swimming season is around the corner, lets all provide the swimming pool owner, friends, and family a safe fun experience.

Last month we discussed that much of what happens with the Florida economy and in Tallahassee (with the exception of the wonderful FSPA lobby efforts) may be, for the most part, out of our control. However, there are things that we can each do to control certain aspects of our individual destiny. Further, that includes the “destiny” of a company’s business insurance program and cost thereof.

We discussed taking steps to make yourself more attractive to insurance companies such as 1) reducing avoidable claims, 2) developing a true safety culture, and 3) cooperating with the carriers safety, claims departments, etc. The insurance carriers look at all of this when evaluating you as a prospective policy holder and determining rates and coverages.

In addition to these suggestions, two good steps to make your company more attractive are as follows:

The selection of subcontractors, and management and controls of those subs, through the implementation of legal contracts with strong, protective language.

Most businesses hire a subcontractor from time to time. Each time you do, your company is at risk. That is because, ultimately, you can be held accountable, or liable, for many of the actions of your subcontractor. Whether it is determined legally in court, or simply the opinion of your good customer, you often will be involved with

any issues or problems which may arise out of your and your subcontractor’s work.

Therefore, we should take the relationships with subcontractors very seriously and structure good controls. You should seek the counsel of a good construction attorney to implement a formal subcontractor agreement. It is suggested, at the very least, that you mandate that all subcontractors comply with the following:

1. Maintain the same general liability limits you do (or higher) 2. Add your company as an additional insured to their general liability policy.3. Provide you evidence of a workers’ compensation insurance policy in

their company name if an employee, laborer, helper, etc. is brought to any jobsite. A valid workers’ compensation exemption is sufficient when it is only that person working on your jobsite; this is critical.

4. Sign a formal written contractor-subcontractor agreement which requires a waiver of subrogation from the subcontractor and includes a hold harmless clause in your favor.

Most of this (with the exception of the written agreement) is evidenced in the certificate of insurance provided by the subcontractor.

Always require a valid certificate of insurance be provided before the subcontractor performs any work for you. Don’t wait until the job is done and you are ready to pay the sub to confirm he has insurance. If they don’t have the proper insurance coverages it causes a problem because insurance coverage cannot be backdated. So, if it is June 1 and they secure coverage it will be effective on June 1. If the work was performed in April or May not only is there an insurance coverage issue (sub was uninsured at the time) there is an audit additional premium issue (you will be charged a higher premium as if you did the work).

Also, expect good jobsite safety practices of your subcontractors to maintain a safe, secure, and clean jobsite. Requiring the subcontractor to adhere to the same strict safety standards that you hold your employees to is a good practice.

Managing your auto exposures is another other way to help reduce costs. This is important as our roads become more crowded with less experienced drivers and the ease with which we are all distracted is increasing every day.

At the same time, just about everyone now uses a smart phone. They are regularly used to phone, text, read email, browse the internet and play music. Restricting this usage by your employees is critical! It all began in 1972 as the Florida Pool & Spa Show and was often referred to as the spring show.

After many years as the Florida Pool & Spa Showsm, in 2009 the trade show also became known as the Orlando Pool & Spa Showsm to make it a destination event and not limit it to only attracting attendees in Florida.
