Terms & Conditions
1. Advertiser agrees to pay to TCE all amounts due according to
each advertisement invoice to TCE, P. O. Box 472833, Charlotte
NC 28247. Advertiser agrees to pay all invoiced amounts
upon receipt of invoice. Any balance deemed past due (30
days from initial invoice) will accrue a 1.5% interest charge per
month. Additionally, all accounts that are past due will
revert to the one issue rate without exception.
2. The multiple issue rate is available only to advertisers with a
signed advertisement contract on file with TCE and accounts in
good standing. Advertisers carrying unpaid invoices will not be
included in following issues and any advertisement may also be
subject to removal from any issue not yet published. Payment
for invoiced advertisements shall remain due, payable and
subject to collection by TCE through any and all legal means.
Advertiser shall be liable for all unpaid amounts, including but
not limited to attorneys’ fees and costs incurred by TCE in the
collection.
3. Advertisements appear in consecutive issues of TCE,
Advertiser agrees to communicate artwork changes no later
than each issue ad deadline. If Advertiser fails to communicate
artwork changes by said deadline, Advertiser acknowledges and
agrees that Advertiser’s original advertisement will continue to
run in the given TCE issue.
4. Advertiser (and any affiliates, subsidiaries, or other necessary
party) agrees to hold TCE, TCE’s Publisher, and TCE’s owners,
employees, and contractors harmless for any misrepresentation,
infringement, and/or violation of any laws or other party’s
rights, arising from Advertiser’s advertisement. Advertiser
expressly represents and agrees that Advertiser has full rights to
use any and all advertisement material provided to TCE.
5. TCE’s waiver of and/or delay in enforcing of any of these terms
and conditions or Advertiser’s obligations hereunder shall not
prevent enforcement at any later date or waiver of any other
term.
