Welcome Nebraska Planning & Zoning Association

Welcome to the 2017 Nebraska Planning Conference. The Nebraska Planning and Zoning Association is excited for this year’s conference and the training opportunities it will provide. This year will be the conference’s third at the Younes Conference Center, a facility that has proven to provide not only a clean, modern environment that is perfect for the Nebraska Planning Conference, but Younes also provides a number of different housing choices for your stay in Kearney during the conference.

This year’s agenda provides an excellent array of sessions that should prove to be very beneficial to your educational desires. Thanks to the efforts of the NPZA and Nebraska APA Conference Committees, we have the opportunity to hear from a variety of experts in their field, as well as some notable national speakers. Our keynote speaker this year will be Carol Rhea, FAICP, the Past President of APA. We will also have the opportunity to hear from Ron Sims, the former Deputy Secretary of HUD, during our General Session on Thursday morning.

Welcome to the 2017 Nebraska Annual Planning Conference and to Kearney, Nebraska.

As we assemble we are reminded about the impact of planning on our communities in Nebraska and also gain a better understanding of tools planning has to offer. Our conference is a place to reconnect with old friends and to connect with new ones. At the heart of every community are its people and this conference is no different, whether you are a seasoned planning professional or a new citizen planner, making a connection with another person facing similar issues is invaluable.

General Information Conference Overview

The Nebraska Planning Conference is an annual event providing training to planning commission members as well as continuing education for professional Planners. Each conference session will be led by one of our experts on a specific planning topic, developed around emerging areas as well as continually challenging issues in the field of planning. These sessions may be considered to be above the understanding of the lay person and planning commission member, but may provide some insight for these individuals.

Conference session presenters will range from planners, attorneys, professors, consultants, and engineers, all of which are locally or nationally recognized for their efforts in the field of planning. (Conference sessions are not intended to be a platform for vendors focusing on their products and/or services.)

Learning Objectives

1. Conference attendees will leave the conference with more knowledge and examples regarding current and future planning issues on both a local and national level.

2. Conference attendees will be equipped with new tools to improve planning process and invoke community change.

3. Conference attendees will be provided examples of processes and data that can be duplicated and applied to the planners’ individual community.

Dave has spent nearly 30 years engaged in the general practice of law including representation of the City of Battle Creek, Village of Meadow Grove, Madison County, City of Norfolk, and City of Hastings. Mr. Ptak has presented several workshops and institute courses for NPZA and NE APA over the past 10 years. His working knowledge, understanding, and experiences working with land use law and its applicability will provide you an excellent learning experience. A range of issues will be discussed which include zoning, subdivision, annexation, incompatible uses, non-conforming uses, responsibilities, conflict of interest, and many more.

A responsive and relevant vision for transformation allows community leaders to identify short-range, affordable, achievable placemaking projects. This action-oriented approach to community development, or “practical urbanism,” affects long-lasting improvements in the public realm.

Nebraska law requires every entity (municipal or county) that wants to engage in zoning to first create and adopt a comprehensive plan. In many cases, people are more interested in zoning regulations and either the protection they can offer or the “rights” they will infringe upon. The session will relate the comprehensive plan to the regulations and show how those regulations are an extension of and a means to implement the plan over the course of time. Understanding that connection can be key to getting willing compliance and moving the vision of the community forward.

Wind energy continues to be a growing industry in the United States. Several states are tapping this renewable resource and as growth continues, projects are breaking new ground. While landowners received at least $180 million in land lease payments, many still face challenges from the development of projects on their land. Many counties and municipalities are reassessing their zoning and siting requirements or developing them for the first time. Learn about the typical construction process, potential problems landowners and communities might face, county regulations for commercial wind energy systems, and recommendations for their future development.

The session will focus on implementation strategies for redevelopment of mixed-use corridors and downtowns. Every Nebraska community has commercial districts that have been allowed to deteriorate from a lack of adequate upkeep and maintenance Rehabilitation efforts are cost prohibitive. Public/private partnerships provide the best access to public intervention tools and financial incentives. Discussion will highlight the redevelopment process and methodology behind this collaborative planning process to address blighted and substandard commercial districts that are typically approaching 100+ years of age. Recent examples will be illustrated from Auburn, Beatrice, Lincoln, and Madison.

The session includes topics such as conditional use permits, special use permits, administrative permits and building permits, and will give guidelines on setting conditions for various permits. This session will discuss the Nebraska Silver Jackets effort, a collaborative partnership amongst federal and state agencies to address flood risk management. An emphasis of the presentation will be on the "tool box of authorities" effort which aims to compile information on various agency authorities and resources into a user friendly format. This resource will help local governments identify available resources to assist their planning needs. Some project efforts out of the Silver Jackets, USACE Continuing Authorities Program, Nebraska Sustainability Program and Hazard Mitigation programs will be presented to provide context to the different authorities.

Tax Increment Financing (TIF) is often the only tool cities have to encourage economic development and private investment in deteriorating areas by temporarily redirecting future property tax revenues to finance associated infrastructure costs associated. Of late, TIF has faced growing opposition in the Nebraska Legislature and before the public due to several well-publicized projects. In addition, the State Auditor recently issued a report questioning the use of TIF in a number of Nebraska communities. This session will discuss TIF basics as well as developments in the Legislature and what communities and developers can do to preserve this invaluable redevelopment tool.

Additionally, we will interject a small technical review of how acquired data is manipulated and analyzed. This session will provide a practical overview of hazard mitigation planning requirements, procedures and components. Presenters will explain how to integrate hazard mitigation with local land use, develop successful hazard migration plans, and address the extreme climate for local communities. Local government entities are required to develop and submit local hazard mitigation plans in order to be eligible to receive federal funds, including the Hazard Mitigation Grant Program, Pre-Disaster Mitigation Program, and Flood Mitigation Assistance Program. Planning ahead of disasters can help reduce community vulnerabilities and increase resiliency in the disaster management cycle: mitigation, preparation, response, and recovery.

In addition to her work as a consultant, Rhea has worked as a city, county, regional, and state planner. She has a history of volunteer work that includes serving as a planning commissioner, on a historic foundation board, and in many leadership roles within APA.

Trends in urban planning -- technology, disruption and reinvention -- are not limited to the shores of the U.S., nor to the Western Hemisphere. "Reinventing Planning" provides a unique snapshot of planning in South Africa, based on experiences from Planning Africa 2016 and travel across the diverse country. South Africa is the economic engine of sub-Saharan Africa and it's rapidly urbanizing. Economic migrants

from other countries in Africa are settling in informal developments lacking adequate infrastructure and social services. Supporting human settlement through education, healthcare, job training and infrastructure is the priority for many planners in South Africa.

Urban agriculture touches on many planning issues from health and safety and land use to economic development and property value. It can include front yard gardens, bee keeping, chicken/egg production, animal husbandry, and home processing of meat. This session will discuss local regulations for personal versus commercial uses and potential conflicts between neighbors. Explore the best ways to promote expanded urban agriculture while maintaining and enhancing a sense of place and meeting people's expectations of what their community should look, sound, and even smell like.

“Web-based engagement” (sometimes termed “Crowdsourced” engagement) covers a wide array of technological approaches to garnering community feedback that are available to planners. These approaches can include smart-phone apps, online surveys, and interactive web-apps, to name a few. For planners looking for an efficient way to collect a large amount of high quality data, the utility of web-based engagement is obvious. For community members, online engagement allows convenient, anonymous access to the planning process. Presenters will share case studies and demonstrate the pros and cons of popular forms of online engagement.

The session will inform policy makers and planners on creating a landscape plan that integrates the site into its surroundings, adheres to local stormwater quantity and quality requirements, and

“Lighter, Quicker, Cheaper” (LQC) is a phrase to describe the simple, short-term, and low-cost solutions that are having remarkable impacts on shaping neighborhoods and cities around the world. This approach allows communities to quickly translate their vision into reality using low-cost experiments and engages citizens to assess and evolve their vision before launching into major construction. The Lancaster County Planning Department organized two LQC demonstration projects for Bennet’s Village Park and Hallam’s Main Street. This session will cover the initial planning and implementation of the LQC projects and the resulting outcomes.

Ron Sims is a civic volunteer active in health, education, environmental and social equity issues. Appointed by Governor Jay Inslee, Sims serves as the chair of the Washington Health Benefit Exchange Board. The board is responsible for the implementation of the Affordable Care Act in Washington State.

Sims is on the Board of Regents of Washington State University. He was appointed to the board by former Governor Chris Gregoire. The Board of Regents is the university's governing body.

Sims is on the Board of Directors of the Washington Health Alliance, formerly the Puget Sound Health Alliance, a nonprofit organization he helped found where employers, physicians, hospitals, patients, health plan providers and others from throughout the region come together to improve health care quality.

Sims served as the Deputy Secretary for the U.S. Department of Housing and Urban Development from 2009 to 2011. He was appointed by President Obama and unanimously confirmed by the U.S. Senate. As the second most senior official at HUD, Sims managed the day-to-day operations of an agency with 8,500 employees and an operating budget of nearly $40 billion.

Prior to his appointment at HUD, Sims served for 12 years as the elected Executive of Martin Luther King, Jr. County in Washington State, the 13th largest county in the nation with 1.8 million residents and 39 cities including the cities of Seattle, Bellevue and Redmond.

As County Executive, Sims was nationally recognized for his work on the integration of environmental, social equity and public health policies that produced groundbreaking work on climate change, health care reform, affordable housing, mass transit, environmental protection, land use, and equity and social justice.

Born in Spokane, Washington in 1948, Sims is a graduate of Central Washington University.
