'APIWellNo:43013504040000''APIWellNo:43013504040000'

Ten Point Well Program &Thirteen Point Well ProgramPage 3 of4

The operator's minimum specifications for pressure control equipment are as follows:

An 8" Double Ram Hydraulic unit with a closing unit will be utilized. Function test of BOP's willbe check daily.

Refer to Exhibit C for a diagram of BOP equipment that will be used on this well.

6. TYPE AND CHARACTERISTICS OF THE PROPOSED CIRCULATION MUDS:

From surface to ±350 feet will be drilled with an air/mist system. The air rig is equipped with a 6½" blooie line that is straight run and securely anchored. The blooie line is used with a dischargeless than 100 ft from the wellbore in order to minimize the well pad size. The blooie line is notequipped with an automatic igniter or continuous pilot light and the compressor is located lessthan 100 ft from the well bore due to the low possibility of combustion with the air dust mixture. The trailer mounted compressor (capacity of 2000 CFM) has a safety shut-off valve which islocated 15 feet from the air rig. A truck with 70 bbls of water is on stand by to be used as killfluid, if necessary. From about ±350 feet to TD, a fresh water system will be utilized. Clayinhibition and hole stability will be achieved with a KCl substitute additive. This additive will beidentified in the APD and reviewed to determine if the reserve pit shall be lined. This fresh watersystem will typically contain Total Dissolved Solids (TDS) of less than 3000 PPM. Anticipatedmud weight is 8.4 lbs/gal. If necessary to control formation fluids or pressure, the system will beweighted with the addition of bentonite gel, and if pressure conditions warrant, with barite

No chromate additives will be used in the mud system on Federal and/or Indian lands withoutprior BLM approval to ensure adequate protection of fresh aquifers.

No chemicals subject to reporting under SARA Title III in an amount equal to or greater than10,000 pounds will be used, produced, stored, transported, or disposed of annually in associationwith the drilling, testing, or completing of this well. Furthermore, no extremely hazardoussubstances, as defined in 40 CFR 355, in threshold planning quantities, will be used, produced, stored, transported, or disposed of in association with the drilling, testing, or completing of thiswell.

Hazardous substances specifically listed by the EPA as a hazardous waste or demonstrating acharacteristic of a hazardous waste will not be used in drilling, testing, or completion operations.

Newfield Production will visually monitor pit levels and flow from the well during drillingoperations.

7. AUXILIARY SAFETY EQUIPMENT TO BE USED:

Auxiliary safety equipment will be a Kelly Cock, bit float, and a TIW valve with drill pipethreads.

8. TESTING, LOGGING AND CORING PROGRAMS:

The logging program will consist of a Dual Induction, Gamma Ray and Caliper log from TD tobase of surface casing @300' +/-, and a Compensated Neutron-Formation Density Log from TDto 3500' +-. A cement bond log will be run from PBTD to cement top. No drill stem testing orcoring is planned for this well.

9. ANTICIPATED ABNORMAL PRESSURE OR TEMPERATURE:

No abnormal temperatures or pressures are anticipated. No hydrogen sulfide has been encounteredor is known to exist from previous drilling in the area at this depth. Maximum

bottomhole pressure will approximately equal total depth in feet multiplied by a 0.433 psilfootgradient.

10. ANTICIPATED STARTING DATE AND DURATION OF THE OPERATIONS:

It is anticipated that the drilling operations will commence the fourth quarter of2010, and takeapproximately seven (7) days from spud to rig

To reach NewfieldProduction Company well location site Ute Tribal 6-21-4-3W located in the SE1/4 NW 1/4 Section 21, T4S, R3W, Duchesne County,Utah:

Proceed southwesterly out of Myton, Utah along Highway40 - 1.4 miles + to the junctionof thishighway and UT State Hwy 53; proceed in a southwesterlydirection approximately6.4 miles toit's junctionwith an existing road to the southwest;proceed in a southwesterly directionapproximately 2.7 miles to it's junctionwith an existing road to the northwest; proceed in anorthwesterly direction approximately 1.5miles to it's junctionwith an existing road to thenortheast; proceed northeasterly approximately 0.8 miles to it's junctionwith the beginning of theproposed access road to the west; proceed westerly approximately 5,072' passing the proposed 15-21-4-3W location; continue in a northwesterly direction approximately 6,045' to the proposedwell location.

The aforementioned dirt oil field service roads and other roads in the vicinity are constructed outof existing native materials that are prevalent to the existing area they are located in and rangefrom clays to a sandy-clay shale material.

The roads for access during the drilling, completion and production phase will be maintained at thestandards required by the State of Utah, or other controlling agencies. This maintenance willconsist of some minor grader work for smoothing road surfaces and for snow removal. Anynecessary fill material for repair will be purchase and hauled from private sources.

2. PLANNED ACCESS ROAD

Approximately 11,117'of access road is proposed for the proposed well. See attachedTopographic Map "B".

The proposed access road will be an 18' crown road (9' either side of the centerline) with drainageditches along either side of the proposed road whether it is deemed necessary in order to handleany run-off from normal meteorological conditions that are prevalent to this area. The maximumgrade will be less than 8%.

There will be no culverts required along this access road. There will be barrow ditches andturnouts as needed along this road.

There are no fences encountered along this proposed road. There will be no new gates or cattleguards required.

All construction material for this access road will be borrowed material accumulated duringconstruction of the access road.

3. LOCATION OF EXISTING

'APIWellNo:43013504040000''APIWellNo:43013504040000'

Refer to Exhibit "B".

4. LOCATION OF EXISTING AND/0R PROPOSED FACILITIES

There are no existing facilities that will be used by this well.

It is anticipated that this well will be a producing oil well.

Upon construction of a tank battery, the well pad will be surroundedby a dike of sufficientcapacity to contain at minimum 110%of the largest tank volume within the facility battery.

Tank batteries will be built to State specifications.

All permanent (on site for six (6) months or longer) structures, constructed or installed (includingpumping units), will be painted a flat, non-reflective, earth tone color to match one of the standardenvironmental colors, as determinedby the Rocky Mountain Five State Interagency Committee. All facilities will be painted within six months of installation.

5. LOCATION AND TYPE OF WATERSUPPLY

Newfield Production will transport water by truck from nearest water source as determined by aNewfield representative for the purpose of drilling the above mentioned well. The available watersources are as follows:

Johnson Water DistrictWater Right : 43-7478

Neil Moon PondWater Right: 43-11787

Newfield Collector WellWater Right: 41-3530 (A30414DV, contracted with the Duchesne County ConservancyDistrict).

There will be no water well drilled at this site.

6. SOURCE OF CONSTRUCTIONMATERTALS

All construction material for this location shall be borrowed material accumulated duringconstruction of the location site and access road.

A mineral material application is not required for this location.

7. METHODS FOR HANDLING WASTE DISPOSAL

A small reserve pit (90' x 40' x 8' deep, or less) will be constructed from native soil and claymaterials. The reserve pit will receive the processed drill cutting (wet sand, shale & rock) removedfrom the wellbore. Any drilling fluids, which do accumulate in the pit as a result of shale-shaker

carryover, cleaning of the sand trap, etc., will be promptly reclaimed. All drilling fluids will befresh water based, typically containing Total Dissolved Solids of less than 3000 PPM. Nopotassium chloride, chromates, trash, debris, nor any other substance deemed hazardous will beplaced in this pit. Therefore, it is proposed that no synthetic liner be required in the reserve pit. However, if upon constructing the pit there is insufficient fine clay and silt present, a liner will beused for the purpose of reducing water loss through percolation.

Newfield requests approval that a flare pit not be constructed or utilized on this location.

A portable toilet will be provided for human

'APIWellNo:43013504040000''APIWellNo:43013504040000'

A trash basket will be provided for garbage (trash) and hauled away to an approved disposal site atthe completion of the drilling activities.

Immediately upon first production, all produced water will be confined to a steel storage tank. Ifthe productionwater meets quality guidelines, it is transported to the Ashley,MonumentButte,Jonah, and Beluga water injection facilitiesby company or contract trucks. Subsequently, theproduced water is injected into approved Class II wells to enhance Newfield's secondary recoveryproject.

Water not meeting quality criteria, is disposed at Newfield's Pariette #4 disposalwell (Sec. 7, T9SR19E), State of Utah approved surface disposal facilities, or Federally approved surface disposalfacilities.

8. ANCILLARY FACILITIES

There are no ancillary facilitiesplanned for at the present time and none foreseenin the nearfuture.

9. WELL SITE LAYOUT

See attached Location Layout Sheet.

Fencing Requirements

All pits will be fenced according to the following minimum standards:

a) A 39-inch net wire shall be used with at least one strand of barbed wire on top of the net.

b) The net wire shall be no more than two (2) inches above the ground. The barbed wireshall be three (3) inches above the net wire. Total height of the fence shall be at leastforty-two(42) inches.

c) Corner posts shall be centered and/or braced in such a manner to keep tight at all times

d) Standard steel, wood or pipe posts shall be used between the comer braces. Maximumdistance between any two posts shall be no greater than sixteen (16) feet.

e) All wire shall be stretched, by using a stretching device, before it is attached to the cornerposts.

The reserve pit fencing will be on three (3) sides during drilling operations and on the fourth sidewhen the rig moves off location. Pits will be fenced and maintained until cleanup.

Existing fences to be crossed by the access road will be braced and tied off before cutting so as toprevent slacking in the wire. The opening shall be closed temporarily as necessaryduringconstructionto prevent the escape of livestock, and upon completion of constructionthe fenceshall be repaired to BLM specifications.

10. PLANS FOR RESTORATION OF SURFACE:

a) Producing Location

Immediatelyupon well completion, the location and surrounding area will be cleared of all unusedtubing, equipment, debris, material, trash and junknot required for production.

The reserve pit and that portion of the location not needed for production facilities/operationswillbe recontoured to the approximated natural contours. Weather permitting, the reserve pit will

'APIWellNo:43013504040000''APIWellNo:430 13504040000'

reclaimed within one hundred twenty (120) days from the date of well completion. Before any dirtwork takes place, the reserve pit must have all fluids and hydrocarbonsremoved.

b) Dry Hole Abandoned Location

At such time as the well is plugged and abandoned, the operator shall submit a subsequent reportof abandonment and the State of Utah will attach the appropriate surface rehabilitation conditionsof approval.

11. SURFACE OWNERSHIP-Russell and Crystal Moon.See attached Memorandum of Surface Use Agreement and EasementROW..

12. OTHER ADDITION4L INFORMATION

Newfield Production Company requests 11,117' of planned access road to be granted. Refer toTopographic Map "B". Newfield Production Companyrequests 5,911' of surface gas line to begranted. Newfield Production Company requests 5,938' of buried water line to be granted.

Surface Flow LineNewfield Exploration requests that 5,874' for construction ofup to a 14" bundled pipe consistingof 2-2" poly glycol lines and 1-3" production line. Refer to Topographie Map "C" for theproposed location of the proposed flow line. Flow lines will be tan and will be constructed usingthe followingprocedures:

Clearing and Grading: the proposed flow line will be placed on the surface of the ground. As suchno grading or clearing will be needed. The flow line will be centered staked every 200 feet prior tothe installation. The flow line will be as close to the access road as possible without interferingwith the normal road travel, or road maintenance

Installation for portions along existing roads, lengths of pipe will be laid in the barrow ditch, welded together and moved into place. For lines that go cross-country minimal access will beneeded only for maintenance purpose. It is in the best interest of Newfield Exploration to avoid wetand saturated ground that would cause ruts greater than 3 inches in depth. Disturbed areas will bereclaimed with in 120 days of the end of the installation.

Termination and final restoration: A notice of abandonment will be filed with the BLM for finalrecommendations regarding surface reclamation. After abandonment the flow line will be removed, and any surface disturbancewill be reclaimed according to the standards and specifics set by theBLM

Subject: APD Newfield Production Company Ute Tribal 6-21-4-3W RDCC Project No. 22188

Dear Ms. Mason:

The State of Utah, through the Public Lands Policy Coordination Office (PLPCO), has reviewed this project. Utah Code (Section 63J-4-601, et. seq.) designates PLPCO as the entity responsible to coordinate the review of technical and policy actions that may affect the physical resources of the state, and to facilitate the exchange of information on those actions among federal, state, and local government agencies. As part of this process, PLPCO makes use of the Resource Development Coordinating Committee (RDCC). The RDCC includes representatives from the state agencies that are generally involved or impacted by public lands management.

Division of Air Quality

The proposed well drilling project may require a permit, known as an Approval Order, from the Executive Secretary of the Air Quality Board. If any compressor or pump stations are constructed at the site a permit application, known as a Notice of Intent (NOI), should be submitted to the Executive Secretary at the Utah Division of Air Quality at 150 N. 1950 West, Salt Lake City, Utah, 84116 for review according to R307-401: Permit: Notice of Intent and Approval Order, of the Utah Air Quality Rules. A copy of the rules can be found at www.rules.utah.gov/publicat/code/r307/r307.htm.

The Utah Division of Air Quality (DAQ) encourages the use of Best Management Processes in protecting air quality in Utah. The state recommends emission standards for stationary reciprocating internal combustion engines. These standards are 2 g/bhp-hr for engines less than 300 HP and 1 g/bhp-hr for engines over 300 HP.

The proposed project is subject to R307-205-5: Fugitive Dust, of the Utah Air Quality

Rules, due to the fugitive dust that will be generated during the excavation of the roadway for the project and possibly the pad (based on pad size). These rules apply to construction activities that disturb an area greater than 1/4 acre in size. A permit, known as an Approval Order, is not required from the Executive Secretary of the Air Quality Board, but steps need to be taken to minimize fugitive dust, such as watering and/or chemical stabilization, providing vegetative or synthetic cover or windbreaks. Regional/Local Setting & Topography

The proposed location is approximately 13.4 road miles southwest of Myton, UT in the Antelope Creek/ South

Myton Bench area. Drainages in the area are ephemeral and run westerly toward Antelope Creek. Antelope Creek

contains a small perennial stream. It drains northerly to the Duchesne River which is approximately 6 miles from

the general area. Broad flats and rolling hills with those near the edge of the bench becoming steep and intersected

with draws, characterize the area. No seeps, springs or ponded water exist in the general area. Access is by State,

County and planned or existing oil field development roads. Approximately 5,664 feet of new construction across

Moon’s private land will be required to reach the location.

The proposed Ute Tribal 6-21-4-3W oil well pad is oriented in a west to east direction on a gentle northeast slope

leading toward a valley to the north. A draw to the southeast will be crossed with the access road. Maximum cut is
