Mr. Helton has more than 14 years of environmental management experience in the United States. His knowledge of regulatory compliance and cultural and paleontological resources enables him to manage National Environmental Policy Act (NEPA) and National Historic Preservation Act (NHPA) compliance activities and document preparation. Mr. Helton is a particularly skilled practitioner of federal regulations governing treatment of cultural resources, especially Section 106 of NHPA (36CFR800) and the Native American Graves Protection and Repatriation Act (NAGPRA) (43CFR10). Mr. Helton has significant expertise conducting consultation with State and Federal agencies, as well as facilitating formal government-to-government consultation with Native American groups and tribes throughout the western U.S. Additionally, Mr. Helton has authored numerous environmental technical reports, cultural resources management plans, cultural resources studies, Programmatic Agreements, Memorandums of Understanding (MOU), and contributed to many NEPA documents for a variety of private and public sector clients. Humboldt Bay Repowering Project, Humboldt County, California. Task Lead and CEC approved Designated Cultural Resources Specialist during construction of the Humboldt Bay Repowering Project (HBRP). The project consisted of construction of a load-following power plant consisting of ten natural-gas fired reciprocating engine-generator sets and associated equipment with a combined nominal generating capacity of 163 MW. The project repowers the existing 105 MW Humboldt Bay Power Plant Units 1 and 2. Responsible for ensuring implementation of the cultural resources Conditions of Certification (COCs) and Cultural Resources Monitoring and Mitigation Plan (CRMMP), directly supervising on-site construction monitors, reporting to the CEC's CPM and Cultural Resources Staff, and response to cultural resources discoveries during construction. Prepared Worker Environmental Awareness Program (WEAP) training material and ensured that compliance monitors, contractors, and construction crews met the requirements described in the projects COCs. March AFB was realigned/closed in 1996 pursuant to the Defense Base Realignment and Closure Act of 1990. The Air Force Reserve Command retained a cantonment area, and the Air Force Real Property Agency (AFRPA) is in the process of conveying the remainder of the property to the local community and needs to complete consultation requirements under Section 106 of the National Historic Preservation Act before it can be transferred. The Air Force initiated consultation with the Californian SHPO, the March Joint Powers Authority, and the City of Riverside, California in the preparation of a Programmatic Agreement (PA) to ensure no adverse effects to historic properties will occur. Mr. Fergusson participated in the initial consultation meetings between the AFRPA and the California SHPO. In addition, he updated the PA to reflect recent changes in the requirements and drafted letters requesting the participation of the Advisory Council on Historic Preservation and the relevant Native American tribes.

Reviewed the Programmatic Agreements that have been prepared through the Army Environmental Center for installations located throughout the country. The task was to review the comments and identify patterns of issues that continuously make the documents technically or legally insufficient.

In-House Consultant; Natural Resource Group; May 2006 to August 2006. Mr. Fergusson’s unique skill set made him a valuable consultant to a company specializing in the permitting and licensing of energy related pipelines and facilities. Mr. Fergusson supervised the progress of field crews, reviewed technical reports, and conducted Native American consultations for a number of pipelines across the country.

Mr. Fergusson served as assistant project manager responsible for planning and delegating hours, tracking the budgets of each task, preparing the monthly status report to the client, and preparing the invoice. Mr. Fergusson worked with another contractor on the development of the Environmental Assessment for the identification of the preferred location of the regional heliport. Mr. Fergusson managed portions of the initial feasibility studies as well as the cultural resources (Section 4f) issues.

Task Manager; Desert National Wildlife Refuge Complex Comprehensive Conservation Plan/Environmental Impact Statement; U.S. Fish and Wildlife Service; Las Vegas, NV; 2003 to 2004. Mr. Fergusson served as the Cultural Resources technical lead in the preparation of a cultural resources overview and synthesis of the known archaeological data for the over 1.5 million acre Complex. The document reviewed the existing archaeological data, identified archaeological and historic themes that are common on the Complex, and made management recommendations regarding the needs for future data gathering, and created a context for the evaluation of future cultural resources on the Complex. The project also required the creation of a GIS database that contained the location of, and information about, every cultural resource within the Complex. In addition, Mr. Fergusson assisted the staff with the Native American consultation that included the seventeen tribes that make up the Consolidated Group of Tribal Organizations in southern Nevada.

Project Manager; Clark County Regional Flood Control District EIS; Clark Country Regional Flood Control District; Las Vegas, NV; 2003-2004. Mr. Fergusson managed the cultural resources needs for the final document and served as Project Manager over the final phases of the project, including the preparation of a web-based GIS tool allowing for the preparation of basic environmental documents for flood control facilities.

Project Manager; Summerlin Village Cultural Resources Survey; G.C. Wallace (Prime contractor to Howard Hughes Corporation); Las Vegas, NV; 2004. Mr. Fergusson managed the cultural resources survey of 5,000 acres of undeveloped land on the west side of the Las Vegas Valley. Upon completion the report was successfully submitted to the Army Corps of Engineers and the Nevada State Historic Preservation Office. As a result of the inventory, it was determined the additional Native American consultation was required as well as a treatment plan to mitigate adverse impacts to cultural resources from the planned development.

Project Manager; Kern River 2003 Expansion Project; Kern River Gas Transmission Company; Utah (statewide); 2001 to 2004. Mr. Fergusson managed the Kern River cultural resources mitigation project in Utah. Kern River Gas Transmission Company found in necessary to loop an existing natural gas line with a new 36 inch natural gas pipeline to fuel new power plants in California. The pipeline began in Wyoming and stretched nearly 700 miles to California, crossing Utah and Nevada. Utah contained over 160 significant archaeological sites that required mitigation. Mr. Fergusson successfully negotiated a multi-million dollar budget, carried out the fieldwork on time and under budget, and supervised the lab work and report production. Elements of the mitigation included excavation, construction monitoring, reconnaissance inventory of new work areas, synthesis reports, popular reports for public distribution, specialized archaeological analyses of artifacts, and numerous technical reports and presentations.

Project Manager; Manning Canyon Inventory; Bureau of Land Management Salt Lake Field Office; Utah County, UT; 2003. Mr. Fergusson successfully bid and managed the Manning Canyon Cultural Resources Inventory project through the Salt Lake Field office of the BLM. Mr. Fergusson lead the effort to inventory the property, make management suggestions to the BLM on the preservation or mitigation of significant cultural resources, and produce the final report, which was approved by both the BLM and the Utah State Historic Preservation Office.

Ms. Lawson conducted cultural studies for the expansion of telecommunications cable along forest service roads in Siskiyou County, CA including the initial literature search, Native American consultation, Phase I pedestrian survey, and preparation of the final report. Work was done in October and November 2008. Ivanpah Solar Generating Station, San Bernardino County, CA. Ms. Lawson participated in additional field studies of several locations around the Ivanpah SEGS project area, including pedestrian survey and site recordation and evaluation. Ms. Lawson conducted the literature search and assisted in the writing of the cultural section of a fatal flaw analysis to determine the level of technical studies required for a proposed solar farm project. Work was done in August 2008. California Border Patrol-Indio Station, Indio, CA. Ms. Lawson conducted cultural studies for the expansion of the CA Border Patrol station in Indio, CA including the initial literature search, Native American consultation, Phase I pedestrian survey, and preparation of the final report. Ms. Lawson functioned as Lead Archaeological Surveyor (Crew chief and Field director) for this project and was involved in the Phase I survey, the Extended Phase I survey, and the Phase II Evaluation and has been an author on the following documents for this project: ASR (Archaeological Survey Report), XPI (Extended Phase I) proposal, XPI Supplemental Proposal, XPI report, HRER (Historical Resources Evaluation Report), AEP (Archaeological Evaluation Proposal), and AER (Archaeological Evaluation Report). All documents were prepared according to the Caltrans Standard Environmental Reference handbook. Two different research designs were written for the XPI proposals and the AEP; Ms. Lawson was a coauthor of these documents and developed the research design for several of the research domains. Ms. Lawson also assisted in the preparation of all site records for the 100+sites included in these reports, the evaluation of the historic archaeological resources for the HRER, directed lab analyses, and conducted the lithics analysis for the Phase II Evaluation. Copper Mountain Verizon Wireless, Twenty-nine Palms, CA. October 2007. Field work was completed in one day. Ms. Lawson visited a proposed location for cell tower upgrades and wrote a site report for proposed impacts. Laguna Canyon Road Widening Mitigation, Orange County, CA. October 2005, September 2006, and September 2007. Fieldwork was conducted at various times and totaled approximately 7 weeks. Ms. Lawson served as Field Director, assisting with the cultural resource management for the widening of Laguna Canyon Road and subsequent biological mitigation within prehistoric site CA-ORA-1055. This project is located in Caltrans District 12. As field director, Ms. Lawson oversaw unit excavation, feature excavation, and assisted with the monitoring of controlled grading, as well as in the definition of a burial discovered during construction monitoring and supervised up to five field technicians. Additionally, Ms. Lawson conducted analysis of a portion of the flaked stone tools recovered during the monitoring and recovery phases of this project and assisted in the preparation of the final report. A portion of this project included the development of a research design for the geotechnical testing and subsequent ground truthing. Ms. Lawson assisted in the development of this design. Beaumont Sports Park, Beaumont, CA. May 2007. All fieldwork was completed in one field day. Two prehistoric sites were recorded and a Phase II evaluation, consisting only of shovel test pits, was conducted at the one of these sites.

McSweeny Farm Project, Hemet, CA. May 2004 through July 2004, February 2005. Ms. Lawson served as Field Director for a total of 4 months of fieldwork. The project consisted of the Section 106 Phase II evaluations for 14 sites, including prehistoric milling sites, one prehistoric habitation site, and historic refuse dumps. Ms. Lawson was responsible for overseeing unit excavation, shovel test pits, auger testing, supervised six additional crew members, and coordinated with the local Native American groups to provide tribal monitors for the project. She also monitored mechanical trenching within site boundaries, coauthored the Testing and Evaluation Plan, which presented the research design for the test excavations, and authored portions of the final report. Stoneridge Estates, Moreno Valley, CA. August 2004. Fieldwork lasted one week. Ms. Lawson served as Field Crew for this survey of approximately 300 acres and the recordation of 12 prehistoric sites. She was an author on the final report. Gibbel Estates Project, 80 Acres, Hemet, CA. August 2004 and October 2004. Fieldwork for this project lasted for approximately four days. Ms. Lawson served as Field Director for the CEQA survey of 80 acres, the recordation of one new prehistoric site, and the Phase II evaluations of new site and one previously recorded site located within the project. This previously recorded site was recommended eligible to the California Register. Ms. Lawson supervised four additional crew members and was the primary author on final report. Southern California Edison, Sky Forest, CA. June 2004. Ms. Lawson served as Crew Chief for this project. Two days were spent in the field. Ms. Lawson was responsible for the literature search and the Section 106 Phase I survey of a power line which was damaged during the Waterman Canyon wildfire. Ms. Lawson supervised one additional crew member. Cajalco-Ramona Corridor, Riverside County, CA. May 2004. This intensive pedestrian survey spanned 3 weeks. Ms. Lawson served as Field Director for the Section 106 Phase I survey of 10 mile section of the proposed transportation corridor. Ms. Lawson was responsible for directing the field survey and supervised an additional three crew members. Rancho Bella Vista, Riverside County, CA. Ms. Lawson served as Lab Director for this project and conducted the artifact analysis of collections recovered at three sites during construction monitoring.
