Alameda County Dear Ms. Weston:  

Per your request, Holman & Associates completed a records search and field survey for the above project in Hayward, Alameda County (Map 1). The Project proposes to construct a 59-unit residential subdivision on parcels comprising 17.23-acres (APN 078C-0461-001-13, and -14). The property is located southeast of Tennyson Road and east of Mission Boulevard. Proposed plans would subdivide and construct the 59 single-family residences on 3.6 net acres of the total 17.23-acre property.

The property is designated in the General Plan as Medium Density Residential, Suburban Density Residential, Limited Open Space, Limited Medium Density, and Parks and Recreation. The land is zoned Planned Development, Medium Density Residential and Agriculture, and Open Space and is located within the Mission-Garin Special Design District. The project would require a rezoning to Planned Development (PD) District and Non-Vesting Tentative Map approval for the new 59-lot single family subdivision. The balance of the property would remain in open space. A remainder parcel would receive excess soil from grading on the residential area of the property. The Project would place the fill on the remainder parcel using a temporary haul road within the Project Area that would be removed and revegetated once construction was complete. The remainder parcel is designated as Agriculture in the General Plan. As part of the proposed Planned Development zoning, the land would remain as open space for use by project residents, although precise details remain to be designed. This is a CEQA project that will be reviewed by the City of Hayward (City).

This report was prepared by Sunshine Psota, M.A. (Cultural Resources Management [CRM]), Registered Professional Archaeologist. The author has 37 years of experience in California archaeology, much of it in the San Francisco Bay Area, and meets the Secretary of the Interior’s Standards for professionals in both prehistoric and historical archaeology.

Records Search Results On 25 April 2018, the author conducted a records search at the Northwest Information Center of

the California Historical Resources Information System (CHRIS), an adjunct to Sonoma State University

located in Rohnert Park (File No. 17-2552). All records of identified cultural resources within a half mile, and all archaeological resources reports for projects within and abutting the Project Area were reviewed (50m radius).

No archaeological sites are recorded within the Project Area or within a half mile. Nor are any historical buildings or structures identified within or adjacent to this Project Area. No buildings or other resources are listed on federal or state inventories (CA-DPR 1976; CA-OHP 2012, 2018; NPS 2018). Within a quarter mile, the only resources recorded are a house, a housing complex, a commercial building and a commercial building complex. This built environment dates from ca. 1935-1964, with all but one constructed after World War II (Nayyar 2017a, 2017b, 2017c; O’Connor 1986a, 1986b, 1986c). None of these documents provide a better understanding of earlier Hayward lifeways.

In this portion of the Bay Area, archaeological sites have been recorded adjacent to creeks, springs, wetlands, and the original Bay shoreline and often near the base of the hills. The Project Area is situated at the start of the rolling hills in eastern Hayward with a drainage branching near the eastern boundary and then defining both the southern and northern boundaries. There is a moderate potential for archaeological sites within the Project Area.

The Project Area has not been previously surveyed for its cultural resources potential. Two nearby surveys have been completed. In 1986, Caltrans conducted a series of studies prior to improvements to State Route 238. The archaeological survey described conditions as generally good visibility with lands east of Mission and west of the current Project Area surveyed near the Tennyson area (Fitzgerald 1986). No archaeological resources were identified. The nearby built environment was documented by O’Connor (1986a, 1986b, 1986c, 1986d) with none determined eligible to the National Register of Historic Places.

In 2005, a survey was conducted of the La Vista Quarry that abuts the northern, eastern, and southeastern boundaries of the current Project Area (Busby 2005). Much of that study area was highly impacted by quarry operations and those areas were not surveyed. On the remaining southern grassy slopes, surface soil visibility was poor (0-5%). Soils from animal burrows were inspected and boulders were examined for modifications.

Historic-era maps for the Project Area were examined to identify the potential for archaeological resources that might elaborate on the history. No development or improvements to the Project Area were depicted (Thompson & West 1878; US Army 1943; USGS 1899, 1915, 1959). Based on the review of historical land use, there is a low potential for historic archaeological deposits within the current project area.

Survey On 29 June 2018, Kevin Dobinson and Donielle Neddeau of Holman & Associates completed a

survey of the property (Photos 1-5). The land was inspected using 15m wide transects. All rock outcroppings were examined for signs of modification. Overall, ground visibility was excellent (approximately 85%), because most of the area had been recently disked. Three areas afforded little to no soil visibility. Both the eastern portion of the Project Area and the northern boundary were covered in 3-6 ft. high, dense grasses and star thistle (Photo 4). Additionally, a steep, man-made berm covered with blackberry bushes and dense wetland vegetation was located along the northern boundary.

Three types of native soils were observed. Light-brown clay with subangular igneous cobbles was noted within the eastern portion of the Project Area. In the middle of the central portion, the soil is light-gray/brown clay with subangular igneous cobbles. Historically this area was excavated, with the spoils possibly used to create the berms noted along the northern and western portions of the property. In the western portion, dark-gray/brown clay contained subangular igneous cobbles with three igneous outcroppings near the western boundary.

Debris from a collapsed wooden structure was noted within some eucalyptus trees (GPS: 10S 4165880mN/ 583988mE, Photo 2). This consisted mainly of milled lumber with a few pieces of plywood and no window glass. A light scatter of modern debris included a plastic body of a toy Dodge Challenger. Also, a survey marker had been removed from the top face of the northwest-most igneous outcrop within the Project Area. No prehistoric or historic-era cultural materials were observed during the survey, nor were there any indications of a paleosol (buried surface).

Summary and Recommendations Holman & Associates does not recommend any additional archaeological study. If buried, or

previously unrecognized archaeological deposits or materials of any kind are inadvertently exposed during any construction activity, work within 50 ft. of the find shall cease until a qualified archaeologist can assess the find and provide recommendations for further treatment, if warranted. Construction and potential impacts to the area(s) within a radius determined by the archaeologist shall not recommence until the assessment is complete.

Human graves are often associated with prehistoric occupation sites. Section 7050.5 of the California Health and Safety Code states that it is a misdemeanor to knowingly disturb a human burial and Section 5097.99 of the Public Resources Code defines the obtaining or possession of Native American remains or grave goods to be a felony. If human remains are encountered as a result of construction activities, any work in the vicinity shall be halted and the County Coroner contacted.
