Informe Ambiental de parte del MontereyPeninsula Water Supply Project

En conformidad con las disposiciones de laLey de Calidad Ambiental de California(CEQA), la Comisión de Servicios Públicos deCalifornia (CPUC por su sigla en inglés) seencuentra preparando un Informe deImpacto Ambiental (EIR) para el CaliforniaAmerican Water Company’s (CalAm)propuesto Monterey Peninsula Water SupplyProject (MPWSP). El MPWSP incluye variasinstalaciones y mejoras, entre ellas: unsistema de toma de agua de mar, unaplanta de desalinización de 9 millones degalones por día (mgd); almacenamiento yred de transmisión de agua y mejora delalmacenamiento en los acuíferos porprocesos de ampliación y recuperación. Co-mo alternativa de la planta desalinizadorade 9-mgd. El EIR evaluará una planta dedesalinización de 5.4 mgd junto con unacuerdo de compra de 3,500 acre-pies poraño de agua de la proupesta del MonereyRegional Water Pollution Control Agency’scon el projecto de reposicion de agua sub-terranean. Notice of Preparation of EnvironmentalImpact Report for the Monterey Peninsula

Water Supply ProjectIn accordance with the provisions of the Cal-ifornia Environmental Quality Act (CEQA),the California Public Utilities Commission(CPUC) is preparing an Environmental Im-pact Report (EIR) for the California AmericanWater Company’s (CalAm) proposed Monte-rey Peninsula Water Supply Project(MPWSP). The MPWSP is comprised of vari-ous facilities and improvements, including:a seawater intake system; 9-million-gallons-per-day (mgd) desalination plant; waterstorage and conveyance facilities; and im-provements to CalAm’s existing SeasideGroundwater Basin Aquifer Storage and Re-covery (ADR) facilities. As ome alternative tothe 9-mgd desalination plant, the EIR willevaluate a 5.4-mgd desalination plant cou-pled with a purchase agreement for 3,500acre-feet-per-year of water from the Monte-rey Regional Water Pollution Control Agen-cy’s proposed Groundwater ReplenishmentProject. The MPWSP EIR will serve as a sub-sequent CEQA document to the CalAmCoastal Water Project EIR (SCH #2006101004)certified by the CPUC in December 2009. Theproposed MPWSP is needed to replace exist-ing water supplies that are constrained bylegal decisions affecting the Carmel Riverand Seaside Groundwater Basin water sup-plies: State Water Resources Control BoardOrder No. WR 95-10 (Order 95-10) and theMonterey County Superior Court’s adjudica-tion of the Seaside Groundwater Basin. AN ORDINANCE OF THE COUNCIL OF THE CITY OF MONTEREY

AMEND MONTEREY CITY CODE SECTION 18-46 ENTITLED "LEVYOF ASSESSMENT AMOUNT" TO INCLUDE UNINCORPORATED

AREAS OF THE COUNTY IN THEMONTEREY COUNTY TOURISM IMPROVEMENT DISTRICT

THE COUNCIL OF THE CITY OF MONTEREY DOES ORDAIN, as follows:

SECTION 1:

WHEREAS, on October 17, 2006, the City Council of the City of Monterey (the"Council") adopted ordinance No. 3376 establishing the Monterey County Tourism Im-provement District ("MCTID") pursuant to the Parking and Business Improvement AreaLaw of 1989, Streets and Highways Code section 36500 et seq. (the "1989 Law"); and

WHEREAS, on October 4, 2011, the City Council amended Monterey CityCode section 18-46 modifying the amount of the levy of assessment for the MCTID; and

WHEREAS, clerical errors were made in the amendment to Monterey CityCode section 18-46 which necessitate clarifying the ordinance to include the unincorpo-rated areas of Monterey County in the MCTID assessment;

NOW THEREFORE, the Monterey City Council declares as follows:

SECTION 2: That the City Council of the City of Monterey hereby adopts thefollowing amendment to Articles 4 of the Monterey City Code, amending section 18-46to read as follows:

Sec. 18-46. Levy of Assessment - Amount.

The MCTID includes all lodging businesses within the boundaries describedin Section 18-44. The assessment shall be levied on all lodging businesses, existingand future, within the MCTID boundaries as follows: in the County of Monterey andthe cities of Monterey, Marina, Carmel by the Sea, Sand City, Del Rey Oaks, Seasideand Soledad the assessment shall be $2.00 per occupied room per night for full servicelodging businesses and $1.00 per occupied room per night for limited service lodgingbusinesses, and in the city of Salinas the assessment shall be $2.50 per occupied roomper night for full service lodging businesses and $1.50 per occupied room per night forlimited service lodging businesses. Limited and full service shall be as defined bySmith Travel Research. Except where funds are otherwise available, an assessmentwill be levied annual to pay for the improvements and activities within the area. Newhotels within the boundaries of the MCTID will not be exempt from the levy of assess-ment pursuant to Section 36531 of the Act. Pursuant to the transient occupancy tax or-dinances of the County, and the Cities assessments pursuant to the MCTID shall not beincluded in gross room rental revenue for purpose of determining the amount of transi-ent occupancy tax.

SECTION 3: If any section, subsection, sentence, clause or phraseof this ordinance is for any reason held invalid or unconstitutional by a decision of anycourt of any competent jurisdiction, such decision shall not affect the validity of the re-maining portions of this ordinance. The Monterey City Council hereby declares that itwould have passed this ordinance, and each and every section, subsection, clause andphrase thereof not declared invalid or unconstitutional without regard to whether anyportion of the ordinance would be subsequently declared invalid or unconstitutional.

SECTION 4: This ordinance shall take effect and shall be in fullforce thirty (30) days after the adoption hereof.

SECTION 5: Pursuant to Government Code section 36933, within 15 days af-ter passage of this ordinance, the Clerk of the City of Monterey is hereby directed topublish this ordinance in The Herald, a newspaper of general circulation printed, pub-lished, and circulated in the City of Monterey and designated for that purpose by theCounty of Monterey.
