APPENDIX E - PUBLIC PARTICIPATION PROCESS In terms of Appendix 1(3) of GNR 982 of the EIA regulations (2014), a basic assessment report must include:-

1) A basic assessment report must contain the information that is necessary for the competent authority to consider and come to a decision on the application, and must include:

h. A full description of the process followed to reach the proposed preferred alternative within the site, including:

ii. Details of the public participation process undertaken in terms of regulation 41 of the Regulations, including copies of the supporting documents and inputs;

iii. A summary of the issues raised by interested and affected parties, and an indication of the manner in which the issues were incorporated, or the reasons for not including them.

1 INTRODUCTION In line with the above-mentioned legislative requirement, this appendix of the BAR provides the details of the public participation process conducted for the proposed expansion of the Endwell Farm Piggery. The Basic Assessment (BA) provides for the involvement of Interested and Affected Parties (I&APs), in forums that allow them to voice their opinions and concerns, at an early stage of the proposed project. Such engagement is critical in the assessment process, as it contributes to a better understanding of the proposed project among I&APs, and raises important issues that need to be assessed. There are four key steps within the overall public participation process. These include -

Notifying I&APs of the BA;

Holding public meetings;

Making provision for I&APs to review and comment on all reports before they are finalised and submitted to the competent authority; and

Making a record of responses to comments and concerns available to I&APs. Each of the above mentioned steps, which comprised the public participation process of the proposed development, are discussed in detail.

2 NOTIFYING I&APS As stipulated in Section 41 (2) of the EIA Regulations (GNR 982) which states that, “the person conducting a public participation process ………..must give notice to all potential interested and affected parties of the application which is subjected to public participation……”, I&APs must be informed of the BA process.

2.1 Background Information Document A Background Information Document (BID) that provided basic information on the proposed project, the BA process and contact details for registration as an I&AP was prepared. The BID was sent to all persons responding to the inception advertising and organisations identified as potential I&APs in previous EIA processes conducted in the area by CES. A copy of the BID, and proof of distribution, appears on the following pages.

2.2 Written notices 2.2.1 Project initiation When the project was initiated, written notices were sent by registered mail to:

Owners of neighbouring farm portions;

The municipal manager (Ukhahlamba District Municipality);

The municipal manager (Maletswai Local Municipality);

Registered I&APs. A copy of the letter sent appears on the following page. This letter was sent with the BID, the proof of distribution of this letter and the BID appears on the preceding page.

2.3 Advertisements 2.3.1 Project initiation An advertisement notifying I&APs of the initiation of the project was placed in “Die Volksblad” newspaper on 29 October 2015. A copy of this advert appears on the following page.

3 PUBLIC AND PRIVATE MEETINGS

3.1 Site visit with the Department of Water and Sanitation On Friday the 5th of February 2016 a pre-application meeting was undertaken on site with a representative from the Department of Water and Sanitation (DWS). The purpose of the meeting was to discuss the water use licensing requirements for the piggery. 3.1.1 Attendance register
