INFORMATION FOR APPLICANTS

This form should be completed if you intend to visit remote areas of parks and reserves in the Kimberley to undertake a recreational

activity. Permission by what is called a Lawful Authority may be required to undertake that activity under the Conservation and Land

Management Act 1984 (CALM Act) and the Conservation and Land Management Regulations 2002 (CALM Regulations),

especially where these take place outside the current campgrounds and existing visitor facilities.

National Parks and conservation reserves in the Kimberley have long been iconic tourism attractions with a growing number of

people from all over the world coming to appreciate the unique conservation and cultural values of one of the world’s last great

frontiers. The Department of Parks and Wildlife (DPaW) provides many camping and bushwalking facilities in parks across the region

including camping grounds, walking trails, lookouts, toilets and other visitor facilities at the most regularly visited areas of these

world-class camping facilities, day use sites and walk trails open to all. Registration or Lawful Authority is not required to visit these

areas.

There are a growing number of people who want to explore the less visited areas of these parks and experience the rugged beauty,

spectacular landforms and cultural values of the parks. DPaW is keen to encourage responsible, safe and sustainable access to

these areas and this form will assist people to safely access and use areas that don’t have standard visitor facilities while also

providing information for a safe and enjoyable visit.

As your safety is a primary concern for DPaW, this form can provide details that will assist in the event of an evacuation or rescue in

such cases as wildfires, severe weather events or visitors needing assistance in an emergency. By providing your location to DPaW

and having the correct equipment to deal with the challenges presented in these areas, it will help DPaW and other emergency

authorities to assist you if necessary.

There are some activities that, when undertaken on land, or land and waters to which the CALM Act applies ( CALM land), require

what is called “Lawful Authority” under the CALM Regulations. These include (but are not limited to):

Camping in areas that are not designated camping areas;

Lighting a camp fire;

Riding a bicycle other than on a road or a bicycle path;

Driving or using a vehicle other than on a road;

Using an off-road vehicle that is not registered under the Road Traffic Act 1974 (WA)

Landing or taking off in an aircraft (including helicopters);

Using a firearm; and

Travelling with dogs, cats or horses.

Aboriginal people have strong connections to the land DPaW manages in the Kimberley. DPaW is committed to moving to Joint

Management of reserves with Traditional Owners and supporting their native title rights and aspirations. As such, DPaW has agreed

to refer all remote recreational activities applications to the relevant Traditional Owners through their Prescribed Body Corporate,

established Joint Management Bodies or other recognised Aboriginal entities. Traditional Owners will have 20 days to respond and

DPaW has agreed that it will not issue any permit to which the Traditional Owners object.

If no response is received within the 20 days, DPaW will issue the permit but entry to the park will be conditional on the applicant

gaining approval from Traditional Owners to enter any DPaW managed lands that are subject to exclusive possession native title. If

this is the case, DPaW will advise you how to gain permission in responding to your application.

Please discuss your plans with the appropriate DPaW office (see below) at an early stage to determine whether you require lawful authority or have any other questions.

This form should be used for non-commercial activities only. If you intend to conduct a commercial activity, such as a tour or an event, you must complete an application for a commercial operations licence.

Applicants may need approval from Traditional Owners prior to commencing activities. Please contact the relevant DPaW office as soon as possible for more information.

Additional licences, permits, approvals etc. may also be required under other legislation. If in doubt, please contact the appropriate DPaW office.

Applications must be received 28 days prior to commencement of the activity. Applications not received within this timeframe risk not being approved.

PART 2 – Checklist, Insurance Details and IndemnityThe CHECKLIST below is to be completed by ALL, including Government schools, departments and agencies and non-

Government organisations (e.g. private schools, community groups), irrespective of whether lawful authority is required or

not.

The remaining of Part 2 of this form only needs to be completed if you require “lawful authority” under the CALM Act and

CALM Regulations. If in doubt, please contact the appropriate DPaW office.

Government schools, departments and agencies are not required to complete the Public Risk Insurance and the Deed Poll

of Part 2 of this Form. However, non-Government organisations (e.g. private schools, community groups) are required to

do so.

communications may be poor or non-existent, extended recovery times in case of emergency may apply and factors outside of

the control of DPaW such as unplanned bushfires may impact on our excursion.

I am aware of appropriate actions to take in the event of bushfire, injuries or other emergency.

I have prepared an Emergency Management Plan (EMP), a copy of which will be held by a reliable family member or friend

and activated on failing to return at the planned time. I have also lodged the EMP with the local police and the appropriate

DPaW office.

I am aware that non life threatening recovery from remote locations may require the use of a helicopter. I have preparations

in place with suitable companies with suitable aircraft to facilitate any recovery (please add in ‘Further Details’ below).

I am aware that helicopter recovery may exceed $5,000, and I have sufficient resources or insurance to cover non life

threatening recovery using a helicopter.

I understand the requirements that at least four (4) people should comprise any group trekking in the Kimberley area. (This is

to ensure that in case of an accident or injury there is one (1) person to stay with the injured person and two (2) to go for help.).

CONSERVATION AND LAND MANAGEMENT REGULATIONS 2002 Regulation 4 (1)

LAWFUL AUTHORITY TO CONDUCTCERTAIN RECREATIONAL ACTIVITIES

This lawful authority is a written notice for the purposes of regulation 4(1) of the Conservation and Land Management

Regulations 2002 (CALM regulations) and it grants lawful authority to the person named herein as the authority holder

to undertake certain activities in the areas specified below, an act that would otherwise be unlawful under the

regulations.

This authority is not valid without the signature of the Chief Executive Officer or a delegate of the CEO (Regional or

District Manager/Regional Parks Manager) of the Department of Parks and Wildlife (DPaW).

The Chief Executive Officer of the Department of Parks and Wildlife hereby grants to:

     

Lawful Authority to conduct the following activity/activities subject to the Conditions of Approval set out below:

Camping other than in a designated camping area (regulation 66 of the CALM Regulations).

Lighting, kindling, maintaining or using or assisting another person in lighting, kindling, maintaining or using a campfire

(regulation 39 of the CALM Regulations and section 104 of the Conservation and Land Management Act 1984 (CALM Act).

Riding a bicycle other than on a road or bicycle path or in a designated area (regulation 51A of the CALM Regulations).

Driving or using a vehicle other than on a road or in a designated area (regulation 51 of the CALM Regulations).

Driving or bringing an off-road vehicle (regulation 52 of the CALM Regulations).

Landing, launching or making touch down in an aircraft (regulation 65 of the CALM Regulations).
