It’s amazing how the phones start ringing when the weather warms up. Homeowners are asking questions about building and remodeling – that’s a good sign!

CATT roofers who saw my February column about the roof replacement rebate program for the North Tahoe Fire Protection District – take note.

The Fire District has decided it will not be able to use the grant because it requires a staff/budget match. The District is supportive of the replacement program but could not take this on and still meet other financial obligations.

EXECUTIVE DIRECTOR’S COLUMNBy Pat Davison, Executive Director

Doing something is different than watching it being done. This is especially true for contractors hoping to use ‘experience’ in obtaining or upgrading a license. We go for ‘broke’ in helping answer another contractor, before ‘signing’ off our last inquiry in this Capitol Connection…

Q: I currently have a sole owner “B” license that’s been Inactive for years. The company that I work for holds the “C-21” (Demolition) and “A” (General Engineering) classifications. The current Qualifier is retiring and I’m in the process of purchasing the business from him. I applied to replace him as the Qualifier and the CSLB approved me to sit for the “C-21” exam, but determined that I’m not qualified for the General Engineering classification even though I’ve worked for the company for over 5 years. Isn’t overseeing “A” projects for over 5 years enough to qualify to sit for the trade test?

A: When it comes to experience, the CSLB will want to see some hands-on Journeyman or Supervisory experience in your work history. We suggest that you either reword your Experience Record form to better reflect your oversight of paid projects or try and work out an agreement whereby the seller remains on the license so you don’t lose the “A” classification. If the Board will still not accept your revised Experience Certification, we suggest working to gain that additional experience so you can re-apply at a later date. Also, in the meantime you can add your “B” classification onto the license with no testing required!

Q: I would like to obtain my Contractor’s License in CA and NV, but I recently filed a personal bankruptcy. Will this prevent me from getting a license in those States?

A: According to Shauna a personal bankruptcy alone should not prevent you from getting a Contractor’s License in California or Nevada. There is a question on the NV application about whether you’ve filed bankruptcy. The Nevada Board will require that you submit your bankruptcy documents with your application but it’s not often a cause for denial.

The California license application addresses bankruptcies if you check “Yes” to question #10. You’re required to attach a statement identifying all judgments (pending or on record), liens, past due unpaid bills, claims, or suits and a detailed explanation of the situation, including the names and addresses of the parties involved. If the obligation was or is being discharged in bankruptcy, a copy of the filing and a copy of the creditors list are required.

While ultimately you should be able to get a license, the bankruptcy will adversely impact the amount you’ll have to pay for a license bond in each state (i.e. because most bonding is based on your credit score).

Q: Our Company is hiring a new Qualifying individual. He works for another company but will be leaving in order to become our Responsible Managing Employee (RME). My question: At what point must he leave the current license in order to become the Qualifier on our license? Also what

happens to this present employer’s license after he leaves?

A: Your new RME should rightly Disassociate from his current employer’s license effective the last day of employment. He will not be able to officially become your Qualifier until he has been removed from his present license. His employer will then have 90-days from the date of Disassociation to qualify someone new.

Q: Our Corporation has a CA contractor’s license with a fictitious business name. When advertising or signing contracts do we need to use the full corporate name and dba name?

A: You can use the FULL name (corporate and dba) or just the fictitious business name (dba) alone for advertising and contract purposes. In addition, you should always display the license number in advertising or signage.

BUILDERS’ NEWS By The Building & Safety Division, Town of Truckee

Obtaining Inspections in the Town of Truckee

A permit holder can expect accurate and timely inspection service from the Building and Safety Division. Reasonable inspection expectations include the following.

1. Inspections will be performed on the day that the permit holder requests, presently Tuesday through Friday. Inspections can be scheduled in advance or may be scheduled until 6:30 a.m. on the morning of the inspection using an automated voice permits system. One may specify a morning or afternoon inspection.

2. A permit holder may call our office the morning of the inspection between 8 and 8:30 a.m. and ask to speak with the inspector to work out an inspection time. Normally a two hour window is provided. Every effort is made to schedule a time that works for both parties. We do not make “appointments.”

3. The inspection will be either approved or not approved. If approved the inspection card will be signed. If not approved, a written correction notice will be issued identifying all correction items.

4. One may question the validity of a correction item. It is reasonable to ask the inspector for clarification or a

code section. The inspector will provide clarification or a code section within one business day.

5. Code questions are answered for free. Anyone can call the Division at 582-7820 with a code question. Questions are normally answered within one business day.

6. If one disagrees with a correction item, the first line of appeal is Chief Building Official (CBO). The CBO is charged with the authority of interpreting and administering the adopted codes. The CBO will normally respond to appeals within one business day.

7. The interpretation of the CBO may be appealed to the Truckee Board of Appeals. The board consists of an architect, civil engineer, a general, a plumbing, a mechanical, and an electrical contractor, and a disabled access specialist. The process to obtain an appeal is detailed on the Town website at the Building and Safety Division page.

Thanks to CATT member Jamie Brimer (Brimer Construction and Plumbing) for contacting the CA Board of Equalization (BOE) after BOE mailed out a confusing letter to all CA licensed contractors regarding payment of sales tax. The mailing was done in February. Jamie thought CATT members would like to hear the explanation of when sales tax must be paid and when it doesn’t have to be paid as part of a construction contract. Just because you paid

sales tax at the supply house doesn’t mean you don’t owe the state some sales tax on the marked up portion. You may be considered a “retailer” and didn’t know it! Do you need a seller’s permit? Come to the presentation and find out. Knowledge is power - find out what BOE wants from you before it’s too late!

Three CATT member companies can point with pride to their roles in helping the Tahoe National Forest-Truckee Ranger District receive a “Gold” level certification for the new district office north of downtown Truckee. The “Gold” level certification is based on the US Green Building Council ‘s LEED (Leadership in Energy and Environmental Design) program. This is the first LEED-certified building in California for the Forest Service. Gary Davis Group did the site design, Ward-Young Architecture and Planning did the building design in collaboration with another firm, and Bender Engineering and Commissioning did the commissioning.

Art Chapman (JMA Ventures) was given the “Citizen of the Year” award from the North Lake Tahoe Chamber of Commerce/CVB/Resort Association at a dinner in mid-February. The award was based on “his dynamic leadership in the $500 million redevelopment planned for Homewood Mountain Resort on the West Shore.”

Tahoe Quarterly magazine recently announced the winning projects for their Mountain Home awards. CATT member companies highlighted in the winning project descriptions (Old Tahoe, Craftsmanship, Contemporary, Family Friendly, Rustic Retreat, Interior Design, Historic Remodel) were: Olson Olson Architects, Bruce Olson Construction, NSM Construction, Interior Design by Julie Johnson-Holland, Mountain Forge, Johansen Masonry, Kelly Brothers Painting, In House Builders, Mark Tanner Construction, Estate Landscape & Irrigation, Sierra Pacific Windows, Peter Gerdin Architect, Crestwood Construction, Gary Davis Group, MWA Architects, and Mt. Lincoln Construction. Named in the “Merit Award” project descriptions were: Dennis E. Zirbel Architect, Ward-Young Architecture and Planning, J. Corda Construction, and Incline Builders. Runners-up included: Loverde Builders and Rock & Rose.

MIT Systems has formally changed its name to Epic AV Automation. Email and website addresses have also been changed to incorporate the new name. Phone/

fax and street location on Business Park Drive in Truckee have not changed.

Kelly Brothers Painting was recognized with a 2012 “Picture it Painted Professionally” (PIPP) award from the Painting and Decorating Contractors of America (PDCA) at the 2012 Painting & Decorating Expo. The PIPP awards are presented for overall project excellence and superior craftsmanship. Kelly Brothers Painting, Inc. won this award for the Decorative Finishes - Commercial category. “The PIPP awards recognize the very best of the best in the painting industry and honors PDCA members by showcasing their stellar work among their peers from across the nation,” said Darylene Dennon, past chair and current treasurer of PDCA. “I applaud Kelly Brothers Painting, Inc. on their outstanding performance and excellent craftsmanship.”

Gary Davis Group was again in the news for their donation of design, engineering, and specifications for a proposed Lighthouse Bus Shelter to be constructed between the Lighthouse Shopping Mall and state campground in Tahoe City. The report of the donation was re-printed in both the Sierra Sun and Reno Gazette-Journal newspapers.

Another Increase Proposed for CA Workers Comp RatesEmployers in California are going to be very unhappy with the mid-year workers’ comp rate filing the Workers’ Compensation Insurance Rating Bureau (WCIRB) is about to make. It will soon file for a 9.1% average increase. This is over and above the 37% rate increase that Insurance Commissioner Dave Jones approved for January 2012. The filing will come in at an average rate of $2.51 per $100 of payroll compared to the $2.33 for last year.

The amount is 7.7% above what the WCIRB filed last year. It says the increase represents deterioration in the system that is largely tied to the 2010 accident year. The actual increase to rates being used by carriers, however, is likely to be lower since carriers have been steadily increasing their filed rates.

Fanny Bridge in Tahoe City serves as the main artery for vehicles, cyclists and pedestrians to enter and exit Lake Tahoe’s West Shore to Tahoe City and/or Truckee. Nearing the end of its useful life, 83 year-old Fanny Bridge is in need of repair. This situation has prompted the Tahoe Transportation District (TTD) to take a close look at how fixing Fanny Bridge and constructing a new State Route 89 would aid in solving various traffic issues. Seven action Alternatives are being reviewed. At present time, there is no preferred alternative.

Currently, existing traffic delays directly impact almost everyone living, working or visiting the Tahoe City/West Shore area. One of the goals of this project is to assist people in meeting time frames for service deliveries, aiding in more swift emergency access and egress and overall getting people where they need to go such as school, work, business or doctors’ appointments along with meeting dinner reservations, tee times and other social engagements.

The SR89/Fanny Bridge Community Revitalization Project plans to reconstruct the historic 83 year-old structurally deficient Fanny Bridge. In addition, the project will help reduce bicycle and pedestrian

conflicts and alleviate present and future travel demand and associated back-ups in these specific areas: on State Route 89 (West Lake Drive) heading into Tahoe City, the Truckee River Crossing and associated intersections and along State Route 89 entering into Tahoe City from Interstate 80. Other project goals include enhancing the economic and social vitality of the area along, developing gateways to Tahoe City, along with providing additional emergency access and egress.

The TTD strives to continuously give accurate and up to date information to the Tahoe City/North Lake Tahoe Communities about the proposed State Highway 89/Fanny Bridge Community Revitalization Project, keeping the community apprised of Project Development Team decisions and requesting comments and ideas about the project.
