Our association, like the MSBA, ABA and so many other nonprofit trade and professional associa-tions across the country, is now formally engaged in the business of training leaders. We not only pair attorney mentors to newly admitted lawyer

mentees (as we have for decades), but our Leadership Development Academy is in its fourth year training new lawyers who demonstrate potential to be tomorrow’s BAMC leaders. Each year we are fortu-nate to receive applications too numerous for us to accept all of the well qualified candidates. Academy fellows choose year-long proj-ects that make a real difference—this year working to increase mem-ber awareness of our Bar Foundation’s charitable works and the ease with which we can contribute to its Endowment Fund.

As we all feel the pull of so many financial and professional obli-gations and responsibilities, those who remember a slower, more deliberate pace of practice can appreciate why the spontaneous apprenticeships and strong collegiality of the past must be cul-tivated more formally and deliberately. As financial imperatives reduce opportunities for new lawyers to learn by observing and being trained on the job, law schools have taken on greater respon-sibility for getting them into courtrooms, mediations and other practice situations with real-life clients. The Court of Appeals and associations like ours replicate the mentoring that happened naturally in the past, but in which an ever shrinking percentage of new lawyers are nurtured solely as they “grow up” in practice. has served his community as an advocate, civic leader, educator, and distinguished

jurist. Prior to his tenure on the bench, Judge Simmons enjoyed a successful law

practice providing counsel in a wide array of civil disputes, with a focus on family

law. He recently retired after a decade on the Montgomery County District Court

and now brings his skill and experience to The McCammon Group to serve the

mediation and arbitration needs of lawyers and litigants throughout Maryland.

CIRCUIT COURT NOTESJohn W. Debelius, Administrative JudgeFAMILY LAW SELF HELP CENTERThe Circuit Court’s Family Law Self Help Center is now offering evening hours. The Center will remain open every Tuesday until 8:00 p.m. This extension of service hours will allow more flexibility for those patrons who have limited or no ability to leave their jobs during the day. LAW LIBRARY RENOVATIONSThe Circuit Court Law Library will begin extensive reno-vations in April of this year. During this time the Library will remain open with limit-ed access to some areas. We will keep you apprised of the ongoing status of the renova-tions and we appreciate your patience while we improve this resource.

ASSIGNMENT OFFICEIn early April the Assignment Office will be relocating to the space previously occupied by the Criminal Department. The new offices will be adjacent to the screening station at the Maryland Avenue entrance.

CRIMINAL DEPARTMENTThe Criminal Department has relocated next to the North Tower Elevators on the Lobby Level. This area was formally the Appeals window.

VOLUNTEERS FOR WEBSITE TESTINGThe Circuit Court is seeking tech savvy and non-tech sav-

vy members of the Bar to test the New Circuit Court Web-site. The testing takes about 15 minutes and can be done from your desktop. Those wishing to help us improve our website and benefit your fellow BAMC members may contact Anne Grant at [email protected] or by phone at 240-777-9152.

not reserve this effort only for those demonstrating or pro-fessing a need for guidance.

Take a look at our Code of Ci-vility—it’s a valuable thing for each of us to do from time to time (you’ll find it on our web-site in the “Inside the Bar” sec-tion under “About BAMC”). It reminds us, among many other things, we each owe “duties and responsibilities to … each other as fellow professionals.” I hope and expect all of us will try to pass on to newer generations of lawyers our hardest learned lessons, as well as lessons we were fortunate to learn less painfully from the tutelage of a more experienced attorney. Helping can be as simple as in-viting a new lawyer along to an upcoming BAMC or MSBA ac-tivity, or suggesting that they contact the Mentor-Mentee Committee to be paired with an experienced and committed mentor. Prospective mentors and mentees can check our

website for a description of the program, and Chair Emily Gel-mann’s contact information ap-pears in this Newsletter.

Also, remember to suggest to attorneys not selected as 2016-17 Leadership Academy fellows to please apply again this year. Applications are due by May 31, 2017. Details will be available on the Leadership Develop-ment Academy Committee part of the BAMC website on April 3, 2017. Contact information for Committee Co-Chairs Keith Rosa and Chris Roberts also ap-pears in this Newsletter.

Finally, you might think it odd that I began a column fo-cused on mentoring with a quote from Emerson’s paean to non-conformism that es-chews “foolish consistency [as] the hobgoblin of little minds…..” To me the point is still to be yourself; but, with the benefit of all you can learn from your colleagues, to help you be your best self.

The Montgomery County Inn of Court is devoted to devel-oping the ethical and trial advocacy skills of Montgomery County litigators. The Inn currently comprises: 27 Associates, 27 Barristers, 54 Benchers, and 45 Judges & Masters. Asso-ciates are recent law school graduates or attorneys licensed to practice law in Maryland for not more than five years. Associates serve a one-year term and there are 27 vacancies anticipated for 2017-2018. Barristers are attorneys licensed to practice law in Maryland for at least five years, are of good character, and seek to improve their skills as trial or appellate advocates. Barristers serve a three-year term and 9 vacancies are anticipated for 2017-2018. Benchers are attorneys licensed to practice law in Maryland, who have demonstrated supe-rior character, ability and competence as trial or appellate advocates. Benchers are honored with lifetime membership in the Inn, but vacancies occasionally occur, so applications for Bencher positions are also being taken. The Montgom-ery County Inn of Court meets on the second Tuesday of the month from September through May in Rockville, for a social hour and dinner, followed by an educational presenta-tion in the Circuit Court. In addition to doing many things well, we all have nagging and stressful issues in our practice that we just don’t seem to get right. These most stressful issues are usually what we need to work on to get better. Yet we avoid them or regularly try solutions that do not work. When they fail, we live with them and sometimes this can limit our success.

What would it take for you to get outside opinions about how to solve these stuck places? Some lawyers use col-leagues, coaches, others in the practice, friends, or some combination of these tools. It takes a lot for us as lawyers to admit we can’t solve something. Getting over our hesitation can mean the difference between having a good practice or a great practice.

Lawyers and leaders who realize and accept that they don’t do everything well look outside for answers. Examples in-clude problems with profitability, handling difficult clients, managing staff, hiring the right people, prioritizing work, customer service, reducing last minute legal work, transi-tion issues for younger and retiring attorneys and managing stress.

Coaches can help clients get through stuck places. Coaching is a partnership between the attorney and the coach to tack-le the problems and move on to other practice goals. The parts of coaching that make this happen are brainstorming a solution, breaking it down into steps and the coach holding the lawyer accountable for taking those steps.

Some lawyers find coaching from colleagues, friends or other people in their firms. Our Bar’s monthly Law Firm Manage-ment Section is another resource for help. At the meeting, each attendee brings up their stressful or stuck places and other lawyers make suggestions or tell everyone what they did to solve the problem. By sharing ideas, all of us get better.

By Ann SundtIn 1981, when I was a law clerk to the administrative judge of the circuit court for Montgom-ery County, Rita was selected by the judges to be the first wom-an domestic relations master in Montgomery County’s history.  I appeared before her often as a lawyer.  I would like to explain the next story by reminding you that, although I was 40-something years old, I was still a “young” law-yer – inexperienced and nervous.  In this particular case I made an objection to some evidence the opponent wanted to introduce; Rita asked “What’s the basis for the objection?”  and I swallowed, coughed, and said: I don’t know but if you can give me a minute I’ll think of one.”  She laughed out loud and said;” I’ll give you 3 minutes” – and then went on with the proceeding.  3 minutes later she asked: “well … the basis

for the objection?” and I coughed out something and … she over-ruled me.   Believe me, after that, I studied the rules of evidence in a way that no law school had ever inspired … and never again did I find myself in that situation. 

Rita did not suffer fools – or lazy or unprepared lawyers. But, as my story illustrates, she gave inexperienced lawyers the ben-efit of the doubt, trusted that they would learn and improve.  She  believed that courts were instruments of justice. When a client suffered because of his or her lawyer’s incompetence, or lack of preparation, her displea-sure was a measure of her deep conviction that we, the lawyers, are instruments of justice.

Twelve years later I joined her as a domestic relations mas-ter.  My good fortune.  She was my mentor, my coach, and my friend until the day she retired. We talked daily and shared many experiences:  both work and family.  One night as I was agonizing over a case that had to be decided, she popped into

my office – it was late – every-one else had gone – and asked: “What’s the problem?”    I de-scribed the case.  She asked:  “What do you want to do?”  She then went on: “Figure out what you want to do … and do it.”    And then she left.

I was shocked: what did that have to do with anything?    What did I want to do?   What about the law?

I’m not sure I realized that night how significant a moment that was for me.    But I understood it when I became a judge … and here’s what I realized:

Rita was reminding me that there is the law, and then there is a higher law – called justice.  Laws are made by those who are in power; justice is a concept some of us are fortunate enough to learn at the hands of our par-ents, our teachers, our ministers, rabbis and priests … As Alexan-der Solzhenitsyn wrote: “Justice is conscience, not a personal conscience, but the conscience of the whole of humanity.”

I think Rita would have agreed with Clarence Darrow: “Justice has nothing to do with what goes on in a courtroom; Justice is what comes out of a court-room.”

I think of my friend Rita when I hear those words: “One nation under God indivisible with lib-erty and justice for all.”

A memorial service honoring the life of Master Rita Rosenk-ranz will be held in the Ceremonial Courtroom in the Circuit Court for Montgomery County on Thursday, April 20, 2017 at 4:30 p.m. Members of the Bar, Judiciary, and Courthouse staff, along with members of the public are invited to at-tend.  For further infor-mation, contact Rebecca Strandberg at 240-247-0675.

HIGH SCHOOL MOCK TRIAL COMPETITION

I want to thank all of the attorneys and Judges for participating in the High School Mock Trial Competition. 

Fortunately, this year went smoothly with no cancellations and/or rescheduling due to school closures.  I think that may be a first. 

For the first time in the past ten years, we had two new teams in the finals.  My father’s alma mater, BCC, battled my own alma mater, Churchill, to determine who would be this year’s winning team.  In a back and forth trial that was before the Honorable John C. Mof-fett, Churchill prevailed by three points.    

I want to also thank my colleague, Casey Cirner, for helping me obtain all the Courtrooms for all 50 plus trials, along with my assistant, Valerie Choinski, for sending out all the material to each of the judges, and my counterpart with the school system, Scott Zanni.  I would also like to thank the Sheriffs for opening the Courtrooms each night and Judge Greenberg, Judge Quirk, Judge Albright, Judge Storm, Judge Dugan and Judge Debelius for the use of their Courtrooms over the past three months. 

Finally, a big thank you to Judge Gelber, Judge Koch, Magistrate Wisor, Magistrate Segal, Magistrate Bonifant and Judge Moffett for judging and/or coaching in this year’s competition. 

This terrific program could not help without everyone’s involvement.  Thank you for a terrific year.

The Section met on Wednesday, March 1, 2017 and had a spirited discussion about regulations concerning the Department of Transportation’s Pipeline and Hazardous Materials Safety Administration, led by section member Robert Starin, Esquire, and various issues that come before the Surface Transporta-tion Board led by section mem-ber Erik Light, Esquire.

The Section reminds the bar membership of its presenta-tion during the Annual Meet-ing scheduled for May 5, 2017, at the Gaithersburg Hilton.

The title of the presentation is Decoding Social Security Dis-ability: Make Disability Bene-fits Work for your Client.

The presenters will be attor-neys Elliott Andalman and Peter Casciano of Andalman & Flynn, P.C.

The presentation will focus on the basic principles of dis-ability benefits law, including substantive rules, procedural issues and strategy concerns.

The speakers will also cover common disability benefits is-

sues that arise in other areas of law including family, trusts and estates, personal injury, and even criminal. Finally, they will also discuss other areas of disability benefits beyond Social Security Disability, in-cluding Long Term Disability (ERISA), Maryland State Dis-ability and Federal Disability Retirement.

FAMILY LAW SELF HELP CENTERThe Family Law Self Help Cen-ter is implementing evening hours to better serve the public. Evening hours will be held on Tuesdays and the Center will be open until 8:00pm.

COURTROOM 3ECourtroom 3E (formerly Court-room 1) is being retrofitted with audio-visual capabilities to match the South Tower court-rooms.

NOW ON YOUTUBE…Videos have been produced to assist guardians in preparing and completing the annual fi-duciary report. These videos will soon be placed on the Cir-cuit Court website.

SPEAKING OF THE WEBSITE…As the Committee has been advertising, the Court Admin-istration is in the process of redesigning the Circuit Court website. Attorneys are invit-ed to contact Anne Grant at [email protected] or (240) 777-9152 to obtain a login to pre-view the redesigned website and provide feedback.

CONSTRUCTION AND RELOCATIONSOnce renovations are complete in the former Criminal Clerks Office, the Assignment Office will permanently relocate there.

The Licensing Department will soon be renovated. During renovations, the Licensing De-partment will be temporarily housed on the second floor

where Land Records was for-merly located.

In late spring and throughout the summer there will be ex-tensive renovations to the Law Library. This will result in limit-ed availability of the conference rooms during the summer.

SCHEDULING UNCONTESTED DIVORCE HEARINGSThe Clerk reminds attorneys to use the correct Joint Request to Schedule Contested Divorce Hearing if the parties are mov-ing forward on mutual consent grounds. This is not a state-is-sued form but rather is pro-mulgated locally by our Clerk’s Office. The form is available on the Circuit Court website and at the Clerk’s Office.

FAREWELL!The Bench-Bar Committee ex-tends our best wishes in retire-ment to Judge Joseph Quirk, whose last day of service as an active judge was February 28, 2017.

UPCOMING RETIREMENTSIn addition to Judge Quirk, by the end of July the court ex-pects three more judges will re-tire. This will leave four vacan-cies on the Circuit Court bench to be filled by Governor Hogan.

JUDICIARY CLOSING DATES:There is a statewide Judicial Conference June 12, 13 and 14. Hearings will not be scheduled for those dates. The court will only be conducting emergency matters.

CONTINUANCE REQUESTS AND MOTIONSOnce again the court is re-questing attorney cooperation with continuance requests and motions.

a. Put the pending court date under the case number.

b. State what the conflict is with the court date, what the good cause is for the continuance request, and provide continu-ance dates. The continuance dates requested should be 60 to 90 days out, on the appropriate civil day for the case. Comple-tion of discovery will not be a good cause if the attorney has not acted diligently in conduct-

ing discovery, unless the attor-ney is dealing with a late Notice of Intention to Defend.

SETTLEMENTS:Rule 3-506(b) Settlements should be documented in writ-ing, or put on the record in court.

If a settlement involves only an exchange of checks and/or releases or other settlement documents, the court is will-ing to permit a continuance for exchange of checks and/or releases or other settlement documents and the parties should file a dismissal once the conditions are fulfilled. If there is a last minute settlement, it is acceptable to notify the clerk to put a note on the file so that the court will be aware why the parties are not present. This should always be followed up with a writing.

In the last five years, much has changed in the way allegations of sexual assault are handled on college campuses. The U.S. Department of Education has mandated that colleges handle allegations of sexual assault in very specific ways, and have investigated scores of schools for violating these rules. Some states have required schools to change their definitions of what “consent” to sex means. Students who have been accused and punished have pushed back, suing schools for kicking them out. Schools have added an entire layer of administrative infrastructure to the process of investigating and adjudicating these cases. The DOE itself has been sued for the requirement it forces on schools.Matt Kaiser will walk through the nuts and bolts of representing students in campus cases, the differences between these kinds of cases and criminal prosecutions, and the details of suing schools. He’ll also recap the last five years as the law, practice, and policy about resolving sexual assault on campuses has changed, and will talk about what the future may hold. Mr. Kaiser is a former federal public defender in the District of Maryland. He clerked for Baltimore U.S. District Judge Catherine Blake, and worked at Zuckerman Spaeder and Williams & Connolly. Since starting his own firm over six years ago, he has represented students accused of sexual assault on campus, having brought numerous law suits against schools in federal and state court. He has both written and spoken widely about the issues facing students and schools within an array of outlets and publications.

The 2016-2017 Bar Association Leadership Academy fellows ask that you Take Five minutes of your valuable time to contribute to the Montgomery County Bar Foundation Endowment Fund, to continue the legacy of giving to our community.The Endowment Fund was started with a $20,000 gift from Bill Canby. We want to raise that same amount this year. The Bar Foundation supports meaningful programs within Montgomery County, including TV/Law School for the Public; Creating a New Tomorrow; the Pro Bono Program; the Summer Scholars Pipeline Program; High School Mock Trials; the Continuing Legal Education Program; and Montgomery County Special Olympics. This month we want to highlight two specific programs:

Drug CourtOver the last 12 years, 176 candidates have graduated from the two- year program which requires seven days per week participation. Judges Rupp (founder), Quirk, and Maloney participate in the program. Jenna Davis is the coordinator. The programallows participants to obtain many services, including: housing, education, job preparedness, rehabilitation services from licensedprofessionals, and medical care not covered by insurance. Participants attend night sessions, so they can work during the day. Participant can receive $500 worth of classes, training, certifications, and other social enrichment activities, that will provide them a clear path to viable long- term employment and professional success. Montgomery's Miracles, Inc. serves participants of the DrugCourt program with a success rate above eighty percent (80%).

Special OlympicsThe Montgomery County Special Olympics events include both Winter and Spring Games. The Community Outreach Section of the Bar Association has built a lasting relationship with this local chapter. Past events have included the Spring Inspiration Walk, and a series of round- robin, half- court basketball tournaments in the Winter Games. Funds raised at each of the Games are used to provide year- round sports and leadership programs for children and adults with intellectual and physical disabilities. At the SpringGames, BAMC member- volunteers race, score, and oversee the track- and- field events in which the athletes compete. Twenty BAMC members volunteered at the Winter 2016 Games.

The Bar Foundation Endowment Fund relies on the generous donations of BAMC members to continue to fund these programs, all of which have a profoundly positive impact on the Montgomery County community. Look for a Leadership Academy fellow at an upcoming bar luncheon, your next section meeting, or other bar event to learn more about the Bar Foundation and the important programs for which the Endowment Fund provides financial support.

Please help the Bar Foundation continue to support the programs which consistently enrich members of our bar and community. We are not only Leadership Academy fellows, but also contributors to the Foundation. Thank you for your support.

Jessica will discuss the tax im-plications of her recent US Tax Court case of Hylton v. Commis-sioner, where the IRS asserted that the taxpayer was operating a horse activity as a hobby ver-sus a business.  The amount at issue between Federal and State is over $10 million, making this one of the largest horse hobby loss cases in US Tax Court  his-tory.  The US Tax Court held in favor of the IRS, and this case is currently being appealed to the

PRO BONO PROGRAMBy Debbie Craven, Program Coordinator“Access to justice is a funda-mental human right—every-one, regardless of economic or social status, is entitled to justice,” said Ward Coe, chair of the renewed Maryland Access to Justice Commission. “Access to justice is also vital to main-taining social order and peace by providing mechanisms for people to resolve conflicts without resorting to violence. When all people have access to justice, they are able to resolve problems that could otherwise cause the loss of their homes, jobs, savings, and even the cus-tody of their children.”

With this in mind, your contin-ued participation will carry us forward. Your call to volunteer will make a difference to those without resources. Our success is based on your commitment.

The Pro Bono Program pro-vides two ways for county residents to receive free legal

services in civil cases – at a le-gal advice clinic or through the client intake line for referral to an attorney volunteer for direct representation. Our legal ad-vice clinics offer a very unique opportunity to get a glance of the many multifaceted issues facing so many people within our community.  The Pro Bono evening legal clinics operate in five locations across the coun-ty and provide residents the opportunity to walk-in and meet with an attorney volun-teer without scheduling an appointment.  Eligible clients present their legal problems to an attorney and receive free solid legal advice and/or refer-ral to a non-profit or govern-ment social service agency that is ready to lend a hand.  The client intake line operates out of the main office where our small staff screens calls from prospective clients.

The Pro Bono Program cur-rently is participating in two projects. First, we participate in the Judicare Project. Con-tested custody and complex family law cases are referred at a reduced fee to experienced family law attorneys. Attorneys can seek reimbursement of $80 per hour with a cap of 20 hours per case. The Pro Bono Program requires that the attorney must accept a pro bono case for each case accepted under the Judi-care Project.  Second, we refer eligible clients with debt buyer cases to attorney volunteers for direct representation under the Consumer Protection Project.
