    GENERAL INFORMATION

    The APVMA (Australian Pesticides and Veterinary Medicines Authority) Gazette is published fortnightly and contains details of

    the registration of agricultural and veterinary chemicals products and other approvals granted by the APVMA, notices as required

    by the Agricultural and Veterinary Chemicals Code (the Agvet Code) and related legislation and a range of regulatory material

    issued by the APVMA.

    Pursuant to section 53(1) of the Agvet Code, the APVMA has decided that it is unnecessary to publish details of applications

    made for the purpose of notifying minor variations to registration details. The APVMA will however report notifications activ ity in

    quarterly statistical reports.

    The Australian Pesticides and Veterinary Medicines Authority advises that an error was published in the Commonwealth

    of Australia Gazette for Agricultural and Veterinary Chemicals, No. APVMA 6, 27 March 2012.

    In the notice, Reconsideration of Active Constituents, Selected Registrations and Label Approvals Related to Diuron,

    the APVMA announced various decisions in relation to the review of diuron. In the notice, Table 4 listed those active

    constituent approvals that were subject to the outcomes of the review. Active approval number 53534 was incorrectly

    displayed in this table.

    The entire notice Reconsideration of Active Constituents, Selected Registrations and Label Approvals Related to Diuron

    is republished on page 28. Changes apply only to Table 4 on page 28 of this Gazette.

    The Australian Pesticides and Veterinary Medicines Authority advises that an error was published in the Commonwealth

    of Australia Gazette for Agricultural and Veterinary Chemicals, No. APVMA 8, 24 April 2012.

    In the notice, Nova Agro Haloxyfop 520 Herbicide incorrectly identified the active constituent as haloxyfop.

    The correct entry for the Notice of Registration for Nova Agro Haloxyfop 520 Herbicide appears on page 4 of this

    Gazette.

    The Australian Pesticides and Veterinary Medicines Authority advises that an error was published in the Commonwealth

    SUMMARY OF THE APVMA’S EVALUATION OF DIBBS PROGAS FUMIGANT IN ACCORDANCE WITH SECTION

    14(3)(E) AND (F) OF THE AGRICULTURAL AND VETERINARY CHEMICALS CODE (THE ‘AGVET CODE’),

    SCHEDULED TO THE AGRICULTURAL AND VETERINARY CHEMICALS CODE ACT 1994

    The APVMA has evaluated the application and in its assessment in relation to human and environmental safety under section 14(3)(e) of the Agvet Code, it proposes to determine that:

    (i) The APVMA is satisfied that the proposed use of Dibbs Progas Fumigant would not be an undue hazard to the

    safety of people exposed to it during its handling and use when used in accordance with the proposed label

    directions.

    The Office of Chemical Safety (OCS) in the Department of Health and Ageing has conducted a risk assessment on

    the product and concluded that it can be used safely when used in accordance with the proposed label directions.

    Based on worker exposure data, the toxicology data and other information on the product provided and considered

    in the risk assessment, the First Aid Instructions, Warning Statement, Safety Directions, Precaution Statements and

    Re-handling statement have been established to minimise worker exposure to the lowest practicable level, i.e.

    below 5 ppm propylene oxide for short term exposure, and below 1 ppm for long term exposure

    The APVMA accepts the findings and recommendations of the OCS evaluation.

    (ii) The APVMA is satisfied that the proposed use of Dibbs Progas Fumigant will not be an undue hazard to the safety

    of people using anything containing its residues provided the product is used in accordance with the proposed label

    directions.

    The APVMA are proposing to recommend the inclusion of an MRL for propylene oxide in almonds of 100mg/kg.

    Both long term (chronic) and short term (acute) dietary exposure as estimated by the National Estimated Dietary

    Intake and National Estimated Short Term Intake calculations respectively are acceptable.

    (iii) The APVMA is satisfied that the proposed use of DIBBS PROGAS FUMIGANT containing the active constituent

    Propylene Oxide is not likely to be harmful to human beings if used according to the product label directions.

    The product Dibbs Progas Fumigant is a liquid (vapour producing) formulation containing the active ingredient

    propylene oxide at 830 g/L. It will be used in fumigation of almonds for the control of insects and microbiological

    spoilage. It is new to the Australian market and is intended as a replacement for fumigants such as methyl bromide,

    ethylene dibromide and ethylene oxide.

    In animal studies, propylene oxide is of moderate acute oral and dermal toxicity, and low inhalational toxicity.

    However, acute exposure to 400 ppm is likely to be immediately dangerous to life and health in humans. Propylene

    oxide is a moderate to severe irritant to skin and eyes, and may cause allergic contact dermatitis in humans.

    First aid and Safety Directions recommended by the Office of Chemical Safety have been included on the label.

    The APVMA accepts the findings and recommendations of its advisors on these criteria.

    (iv) The APVMA is satisfied that the proposed use of DIBBS PROGAS FUMIGANT is not likely to have an unintended

    effect that is harmful to animals, plants or the environment if used according to the product label directions.

    The proposed use of Dibbs Progas Fumigant is limited to fumigation chambers fitted with scrubbers and mist

    eliminators to ensure environmental release of the exhaust gas is negligible. There are sufficient data available in

    literature sources to perform an adequate risk assessment. DSEWPaC concludes that use of propylene oxide as a

    fumigant of commodities to control microbial contamination does not present a hazard to the environment, provided

    that, the label recommendations are followed when using the product and fumigation occurs in airtight chambers

    fitted with efficient scrubbers to remove propylene oxide.

    (v) The APVMA is considering whether the proposed use of DIBBS PROGAS FUMIGANT would not adversely affect

    trade between Australia and places outside Australia.

    (vi) In relation to its assessment of efficacy under section 14(3)(f), the APVMA is satisfied that data from trials

    supporting the efficacy of the product adequately demonstrate that if used according to the product label directions,

    the product is effective for its proposed uses.

    residues, safety and first aid, environmental fate and toxicity, trade and efficacy. Submissions should state the

    Reconsideration of Active Constituents, Selected Registrations and Label Approvals Related to Diuron

    This is a republication of the diuron notice from the Commonwealth of Australia Gazette for Agricultural and Veterinary

    Chemicals, No. APVMA 6, 27 March 2012, in order to correct information in Table 4 on page 28 of this Gazette.

    The APVMA, in accordance with Part 2, Division 4, of the Agvet Codes, has reconsidered all approvals of the active

    constituent diuron, registrations of all products containing diuron and the approvals of all associated product labels.

    Diuron is a broad-spectrum residual herbicide used in agriculture for pre- and post-emergent control of broadleaf and

    grass weeds. It was first registered in Australia in 1978. As at 20 February 2012 there are currently 101 registered

    products containing diuron of which 66 are affected by the suspension proposal.

    The APVMA commenced its review of products containing diuron in 2002 due to concerns about the potential impact of

    diuron on the environment and to human health. Of particular concern was the impact of diuron use on aquatic

    ecosystems, including the Great Barrier Reef.

    A Preliminary Review Findings (PRF) Report was released for public comment in July 2005. This report identified that for

    most uses specified on labels, there was the potential for diuron to result in adverse effects on aquatic species.

    A maximum rate of 0.9 kg ac/ha was proposed at this time.

    Following the assessment of a significant amount of new data and information the 2005 environmental assessment

    component of the review report was substantially revised and published as the 2011 Report. The 2011 environmental

    assessment was very different from the 2005 PRF, utilising revised ecotoxicity endpoints, improved modelling, a greater

    use of monitoring data, and consideration of risks associated with all diuron uses in broadacre agriculture. The PRF

    focussed primarily on use in sugarcane. The 2011 environmental assessment report, as with the 2005 PRF, identified

    risks to aquatic environments from all uses of diuron. The 2011 report identified risks to primary and secondary streams

    based on adverse impacts on algae and aquatic plants, but not to the Great Barrier Reef.

    The toxicology assessment prepared as part of the review was also published in 2011. This assessment identified that

    there were no concerns for public health with the continued approval of diuron active constituent.

    On the 24 November 2011 the APVMA suspended the registrations and label approvals of 66 registered diuron products.

    The suspension was put in place until 31 March 2012 during which time new information was to be assessed and a

    revised environmental assessment report prepared. New instructions for the use of diuron during the suspension period

    were issued via APVMA permits (PER13198 and PER13239).

    This suspension did not affect antifouling paints, aquarium or pond products containing diuron.

    The APVMA has now completed the reconsideration of the active constituent approvals of diuron, registrations of

    selected products containing diuron and the approvals of all associated product labels.

    Following the finalisation of its reconsideration of diuron, the APVMA is satisfied that active constituents of diuron (listed

    in Table 1) meet the requirements for continued approval. As a result, the active constituent approvals for diuron are

    affirmed.

    The APVMA is satisfied that the requirements for continued registration of selected antifouling paints, aquarium and pond

    products and approval of associated labels are met. On this basis the registration of these products and associated label

    approvals in Table 2 have been affirmed.

    The APVMA has also cancelled all previously approved labels for these products (s.41 of the Agvet Codes) as they no

    longer contain adequate instructions for the safe use of the products. Cancelled labels are denoted with ‘c’ in Table 2

    below. A 2 year period from the date of cancellation will apply for the phase out of products bearing a cancelled label.

    The APVMA is not satisfied that the requirements for continued registration of products and approvals of associated

    labels for products listed in Table 3 are met. However, the APVMA is satisfied that the label particulars can be varied in

    such a way that the products can be used without being likely to have an unintended effect that is harmful to animals,

    plants or things, or to the environment. Accordingly, the APVMA has varied the label particulars [s.34(5) of the Agvet

    Codes]. On this basis the APVMA is satisfied that continued registration of these products in accordance with their

    instructions for use would not be likely to have an unintended effect that is harmful to animals, plants or things or to the

    environment. The APVMA has affirmed the registration of these products.

    The review is now considered complete for the active constituent approvals listed in Table 1, and the product

    registrations and label approvals listed in Tables 2 and 3.

    The following active constituent approvals (Table 4) and product registrations (Table 5) occurred after the

    commencement of the diuron review in 2002. Continued approval and registration is subject to the outcomes of the

    review.

    The APVMA has determined that there are no outcomes of the review relevant to these products and therefore no further

    action with respect to the diuron review is required. Continued approval and registration is supported

    Amendments to the APVMA MRL Standard

    The Australian Pesticides and Veterinary Medicines Authority (APVMA) approves maximum residue limits (MRLs) of

    agricultural and veterinary chemicals in agricultural produce, particularly produce entering the food chain. The MRLs

    approved by the APVMA are associated with a regulatory decision to register a product, grant a permit approval, or as an

    outcome from a review decision and are set out in the MRL Standard published by the APVMA. The MRL Standard lists

    MRLs of substances that may arise from the approved use of agricultural and veterinary chemical products containing

    those substances on commodities used for human consumption as well as livestock feeds. The MRL Standard also

    provides the relevant residue definitions to which these MRLs apply. There may be situations where the residue

    definition for monitoring and enforcement is different to the definition used for dietary risk assessment purposes.

    MRLs are set at levels which are not likely to be exceeded if the agricultural or veterinary chemicals are used in

    accordance with approved label instructions. In considering MRLs and variation to MRLs, the APVMA takes into account

    studies on chemistry, metabolism, analytical methodology, residues, toxicology, good agricultural practice and dietary

    exposure. In approving MRLs, the APVMA is satisfied, from dietary exposure assessment, that the levels set are not an

    undue hazard to human health.

    The APVMA has varied the MRL Standard as set out below with effect from the date of this notice.

    Proposal to Amend Standard 1.4.2 of the Australia New Zealand Food Standards Code

    In the previous notice, the APVMA gazetted particular amendments which it has approved varying maximum residue

    limits (MRLs) for substances contained in agricultural and veterinary chemical products as set out as in the APVMA’s

    MRL Standard.

    Under Section 82 of the Food Standards Australia New Zealand Act 1991 the APVMA is proposing to incorporate these

    variations (numbered 11O) to MRLs into Standard 1.4.2 - Maximum Residue Limits of the Australia New Zealand Food

    Standards Code.

    MRLs contained in Standard 1.4.2 provide the limits for residues of agricultural and veterinary chemicals that may

    legitimately occur in foods. By this means, Standard 1.4.2 permits the sale of treated foods and protects public health

    and safety by minimising residues in foods consistent with the effective control of pests and diseases.

    The APVMA and FSANZ are satisfied, based on dietary exposure assessments and current health standards, that the

    proposed limits are not harmful to public health.

    The Agreement between the Government of Australia and the Government of New Zealand concerning a Joint Food

    Standards System, excludes MRLs for agricultural and veterinary chemicals in food from the system setting joint food

    standards. Australia and New Zealand independently and separately develop MRLs for agricultural and veterinary

    chemicals in food.

    Food Standards Australia New Zealand (FSANZ) will make a Sanitary and Phytosanitary (SPS) notification to the World

    Trade Organization (WTO).

    The APVMA invites comment on these proposals. Details on how to make a submission appear near the end of this

    notice, below the details of the proposed amendment.

    The APVMA will consider any public comments made in response to this proposal. If the APVMA decides to proceed with

    the proposal, it will further notify any variations it makes to Standard 1.4.2 in the APVMA Gazette. The variations will take

    effect as from the date of that subsequent notice.

    INVITATION FOR SUBMISSIONS

    Written submissions are invited from interested individuals and organisations to assist the APVMA in considering the

    proposal to vary Standard 1.4.2 - Maximum Residue Limits of the Australia New Zealand Food Standards Code.

    Submissions should be strictly confined to relevant matters that the APVMA must consider (such as public health and

    safety) which are associated with the occurrence of the proposed residues in foods. Comments received outside these

    grounds will not be considered by the APVMA. Claims made in submissions should be supported wherever possible by

    referencing or including relevant studies, research findings, trials, surveys etc. Technical information should be in

    sufficient detail to allow independent scientific assessment.

    Please note that FSANZ will make a SPS notification to the WTO and submissions related to impacts on international

    trade should be made to FSANZ in response to that notification.

    All personal and confidential commercial information (CCI)2 material contained in submissions to the APVMA will be

    treated confidentially.

    Submissions must be made in writing and should be clearly marked as a ‘submission on the proposed amendment to

    Standard 1.4.2’ and quote the correct amendment number.

    They are published in weekly instalments using the date the application was accepted for assessment. If an application

    summary has been amended, the APVMA will publish the amended version on the website and list it separately in the

    APVMA Gazette Notice for Application Summaries.
