FROM THE CEO’S DESK

It’s OK to Slam the DoorThe month of January is named after Janus, the god of the doorway. The name has its beginnings in Roman mythology coming from the Latin word for door.

It makes sense to me since January is the door to the new year.

Some of us will be running through that door into 2014 recharged and renewed and ready to go. While others will gladly want to slam the door shut on what might have been a not-so-great 2013.

If you’re ready to really slam that door, that’s a great thing. It’s a sign that you’re fed up and might be ready to make changes for a better year.

Change is necessary and change is good - there are term limits with our politicians for a reason. If we aren’t constantly changing to improve our own business which will positively change our lives, our families lives and our communities, etc., then we will forever be condemning ourselves to eternal life in the present. Essentially, if we aren’t moving forward, we’re moving backwards.Individuals and organizations that enjoy consistent success make positive change an abiding and critical element in their business models and business plans to the point that they expect change to happen and are ready for it.

Behavioral studies have established that when something positive (or negative, for that matter) is expected, that’s what is likely to happen. It’s called the Pygmalion Effect and it can be very powerful - either way. So go ahead, slam that door on 2013! Exciting changes await you on the other side of the threshold.

1. SHORT SALE DEFICIENCY JUDGMENTS: As previously mentioned in these comments, the Civil Code of Procedure, Section 580e was passed and took effect on July 15, 2011. This section stated that if the lender or lenders agreed to a short sale, on a single family 1-4 units property, the lender(s) could not later sue the borrower for the deficiency. However, a case just came down from the Appellate court showing that in a short sale that transpired prior to the effective date of 580e, the lender could sue the borrower for the deficiency, if there was a provision in the short sale documents stating that the borrower would remain liable for the deficiency. To the contrary though, the borrower would still have been protected from a deficiency judgment on either loan, if the loan had been a purchase money loan on a single family owner occupied residence (CCP Section 580b). So, any current short sale appears to be protected on single family 1-4 units. But if a lender threatens to sue for a non-purchase money loan, on which a short sale was completed after July 15, 2011, be sure to encourage the borrower to see a knowledgeable real estate attorney and they will be protected.

2. FORMS – OTHER THAN C.A.R.: Occasionally, clients are presented with offers, contracts and proposed leases, usually on commercial or apartment buildings, which are not C.A.R. forms. These are usually drawn by attorneys representing rather sophisticated buyers, sellers or landlords, and they usually contain many dangerous pitfalls for the consumer. Do not let your clients fall into this troublesome arena, and do not attempt to play lawyer, which will put you in a dangerous arena as well. Always recommend that the clients see a knowledgeable real estate attorney. Every such document I have reviewed has turned out to be tremendously advantageous for the party who paid the attorney to draw the document, and very unfavorable for the other party. Rely on your C.A.R. documents, which are fair and reasonable for both sides of the transaction. Any changes or additions that are drawn in or added are clear and shown in the counter offer forms or addendums, and easily noticed and read. If any of these comments are not clear to the clients, again, refer them to an attorney. The main point here is the lengthy, attorney drafted, one sided agreements contain many hidden

dangers, would become obvious if you used your C.A.R. forms that you are familiar with.

3. SALE OF A PARTIAL PROPERTY: Sometime agents and their clients become confused as to what property can be sold separately. For an example, a client attempts to sell the four unit apartment building on the back part of a flag lot. There are two units on the front part of the property. The price is agreed to based on the value of the four units. Once in escrow, the documents are drawn to sell the entire property (6 units) for the same price. The seller halts the transaction and a lawsuit is filed by the buyer for the entire property. A property cannot be sold unless it has its own lot description. In the above example, the property was one property per the legal description. It had not been subdivided, and therefore could not be sold separately. Before you list a property or make an offer on a property for a client, run a title search and be sure what can be sold separately and who owns it. If any questions, run it by your title officer, surveyor, real estate attorney, or all the above.

Getting all of the necessary pieces in place for any real estate deal in today’s risk-averse housing finance environment can be a complicated affair. And when you add an international component to a transaction that requires financing, you increase the odds that something can go wrong.

At a Global Forum held during the California Association of REALTORS® Expo several months ago in Long Beach,

a panel of experts — Steven Hung of CTBC (formerly Chinatrust Bank), John Fernando of Orange Coast Title and Regan Franklin at Inter Valley Escrow — discussed steps you can take to make the road to the closing table smoother. Here is a list of things they said you can do to prevent deal-derailing problems:

1. Get proof of liquid assets: This is important in any

My name is Mike Vachani and I am honored and privileged to be in a position to serve the members of the AAR as President for 2014. It is not often I get to intertwine my love for real estate, my fellow REALTORS®, and my friends and family with my desire to make a positive change in the legislative arena and organized side of professional real estate. I

believe we can all make a difference, whether it is personal or professional, by volunteering our time and energy to go after what we are passionate about.

I am passionate about life and making a difference in everybody I come in contact with. This is what drives me and keeps me positive and ready for the next day. I believe a good attitude, high integrity, and positive outlook in life (and a smile on the face) is infectious and can outweigh any tough times in our life.

I am married to my beautiful wife Sharon and have three terrific kids. When I am not running my brokerage, I spend time with my family, coach my kid’s sports teams, or volunteer at their schools. I think it is very important to put family before everything else in life, including my career. My other passions include traveling, flying, mentoring, and meeting new people.

I love real estate and everything we do as REALTORS®. We are the vital link between the homeowner, the Community, and our Affiliates. My passion for real estate started at a young age. I grew up in a real estate family. My dad and mentor owned a brokerage in Irvine for over 30 years. I still remember passing out open house flyers at eight years old, helping my dad prepare for open houses, or reading through the MLS Books and Hotsheets. I was able to correctly guess the price of a house by the age of 12. My dad taught me the importance of education and taking time to make a difference in the lives of others. This passion for real estate and helping the consumer led me to get my real estate sales license in 2000, and broker’s license in 2005.

I received my undergraduate degree from UCLA (GO BRUINS!) with a degree in Business Economics and Psychology. I earned my graduate degree, a Masters of Business Administration in Real Estate and Finance, from the Paul Merage School of Business at UCI. After

my undergraduate studies, I worked for Frito Lay as an Operations Manger. I had the opportunity to work in management in the corporate world. After graduate school, I took a job at the Lewis Companies as a project manager in land acquisition and development where I built my skill set in Commercial and Investment real estate. In 2007, I opened the Provenio Group Inc., my own full service realty and investment brokerage, and joined the Arcadia Association of REALTORS®.

As the incoming 2014 President of the AAR, I will lead a board with an ambitious agenda to serve and enhance the professional development of our members. Our Association is a diverse one, and I hope to develop a greater sense of community among our members and encourage all to seek each other out – for guidance, consultation, or to offer mentorship to the next generation of leadership. What will make our Association thrive will be the willingness of all members to participate, volunteer and share their skills. As we enter a new year, there are signs that the struggles of the past five years are easing. But there is no question that we still have work to do! I prefer to think of the challenges of the coming year not as negatives, but as opportunities to strengthen and grow. We may all prefer for things to move along smoothly, but this may tend to lull us into a place of complacency and contentment. The times when we are pushed outside of our comfort zones can be scary, but they can also offer the greatest chances for growth. We must push ourselves to find new ways of doing things when the old ways no longer work. This is where The AAR can become an essential tool for our careers and success is real estate.

How can you MAKE A DIFFERENCE? Find out what you are passionate about! Slow down and examine your life – break it into segments and see where you spend most of your time. Is it at church, your child’s school, coaching a soccer team, or volunteering for a charity? Be involved and make a difference by giving back in one of the areas you love – you will be surprised how you will grow both personally and professionally. Never forget who is most

Affiliate Corner“What is a Home Warranty and How Does It Work?”

A home warranty is NOT an insurance policy, it is a residential service contract between the home owner and the home war-ranty company. The home warranty covers the major systems and appliances that break down due to normal wear and tear during the contract period.

Home warranties are not just available during a real estate transaction, they can be purchased at any time and there are dif-ferent plans to suit to the home owners.

Using a home warranty is simple. When a covered items fails, simply call or go online to place your claim. A prequalified licensed and insured technician will be assigned to your service claim. They will contact you to set up a convenient appoint-ment time. When the technician arrives, the home owner will pay a nominal fee directly to the technician (this is called a service fee). The technician will then diagnose the failure. If it is covered by the warranty, it will be either fixed at that time or

if parts need to be ordered, the failure will be fixed as soon as parts become available with no additional service fee due.

A home warranty benefits not only the home owner, but the real estate agent and the seller as well. The home buyer is benefited with peace of mind knowing that should a covered item fail (and as appliances and systems get older, they do), their out of pocket costs are controlled. The benefit to the REALTOR® is peace of mind knowing that the parties in the transaction are being taken care of and that if the home owner has a good experience with their home warranty company it makes them look good for referring them - which leads to more referrals for the agents. The seller’s benefit is also peace of mind, knowing that should an item fail right after the close of escrow, the home buyer won’t come after them for the costs of the system replace-ment. The home warranty is there to protect all parties.

transaction, as you’ll need to know what your clients will be able to pay. But it’s especially crucial when the client will be seeking financing and making an escrow offer. And you’ll want to be sure they can demonstrate proof of those assets in any country they’re in, not just the buyer’s home nation.

2. Get those assets into the U.S.: Beyond getting an accurate picture of your clients’ ready money overseas, you need to help them prepare to move those funds into an FDIC-insured U.S. bank to make the purchase. Again, this is especially important when financing is being sought. Also, when wiring money into the U.S., you and your clients should be aware of any restrictions on cash amounts that can be transferred at one time.

3. Have them form a U.S.-based LLC: Oftentimes, establishing a limited liability company offers an easier way for foreign individuals to move money into United States and purchase (and later sell) a property. But you should talk to a financial expert who has experience with that specific situation before advising your clients to move in that direction.

4. Verify marital status: If your clients have a spouse, lenders want to know about it regardless of where they were married or whether their marriage is legally recognized in their home

country or the United States. That’s because lenders want to know if anyone besides the title holder will have a claim to the property. If clients are married, they’ll have to get an interspousal deed.

5. Get documents translated correctly: “Se habla espanol” in a Yellow Pages advertisement does not mean the company in question can reliably translate real estate contracts. For reasons related to accuracy and legal assurance, translations should be done by a U.S. court-appointed translator.

6. Determine who can supply authorized signatures: It’s not uncommon when dealing with foreign purchases of U.S. properties to have multiple-buyer situations. Whether you’re working with a group of family members or an overseas company, make sure the person signing the contracts is empowered to spend the funds.

7. Know when to use original signatures: In some cases, electronic signatures will be fine. But in others, an original signature will be required. If your clients aren’t in the U.S. for long periods of time leading up to closing, make sure to take into account the time it will take to get the documents to them for signing and getting those back to you.

Every year, the Events 4 Charity Auxiliary hosts several events including the weekly 50/50 raffle, Bingo, Bumper Bowling, and the Day at the Races. The proceeds of these charitable events are gathered up and distributed to local charities at the end of each year.

We sincerely thank each and every person who not only has volunteered so generously of their time and effort, but also those who attended these events and contributed financially. It is because of you that the E4C Auxiliary and the AAR were able to give so generously this year to those in a time of need.

The Arcadia Association of REALTORS® recently welcomed Carol Kennedy, Dilbeck Real Estate into the prestigious group of California Association of REALTORS® Honorary Members for Life. Carol was presented with her certificate by AAR 2013 President, Andy Bencosme at the December 11th MLS Caravan meeting at the Masonic Center. In order to achieve this status, a REALTOR® must have been a member of the Association for over 25 years and also have attained a certain age. Congratulations Carol! She will now have her state and local annual Association dues waived for life!
