interest by some Mechanical registrants to introduce a specialty of "Piping" as a sub-discipline and test module with the NCEES. The BTR obliged the registrants' request to craft a letter to NCEES supporting dialog and discussion on the matter. For further information contact Christopher Lohr of Hen-derson Engineers in Phoenix at 602-336-5240. Contact Patti Pritzl at the Board office with any concerns.

VP Builders informed Core that they did not have a contract for the building and when questioned by Board investigators, Maddox indicated that he had not seen the report with his stamp until Board investigators showed it to him.

The Board entered into a consent agreement with Brownell to re-solve the complaint, in August 2014, which, pursuant to A.R.S. § 32-106.02, required him to

1.) pay a $2000 civil penalty, 2.) obtained his assurance that he would discontinue his illegal ac-tions and 3.) pay the costs of the Board’s investigation. The Board then forwarded the case to the Attorney General’s office for criminal prosecution.

On May 24, 2016, Brownell en-tered into a plea agreement with the State, in Pima County Superi-or Court, whereby he plead guilty to a class 5 felony, Fraudulent Schemes and Practices, for illegal actions committed on December 30, 2013 through January 30, 2014. The Court sentenced Brownell to 2 years of probation and imposed various fines and penalties upon him, including re-quiring him to repay Core Con-struction the exact amount of $3537.00, and to pay restitution to all victims and insurance com-panies described in the Board’s Investigative Report, P14-058.

The second felony conviction ob-tained from a Board Enforcement case involved the fraudulent use of an architect seal in February 2012. The Board received a com-plaint in April 2012, against Christopher A. White, a non-registrant, which alleged that he prepared a report evaluating a

roof damaged by hail in Paradise Valley, AZ that he illegally af-fixed with a seal belonging to Bri-an G. Mofitt, R.A. #41397. Evi-dence indicated that White was contacted by Construction Diver-sified while working for himself under the title of CW Global Con-sulting, an unregistered firm, to evaluate a previously rejected in-surance claim for hail damage to a tile roof. White signed the report and sealed it with Moffitt’s seal.

Moffit denied to Board investiga-tors that he worked for CW Global Consulting and denied inspecting the roof at issue. He explained that he and White had been fellow employees at a previous firm, and surmised that White must have obtained his stamp electronically there.

The Board sent its complaint against White to a formal hearing. After White failed to appear at the hearing, the Board deemed his ad-mission to the factual allegations in the Complaint and Notice of Hearing. It ordered White to pay a $12,000 civil penalty and the costs of the Board’s investigation, and then forwarded the case to the Attorney General’s Office for criminal prosecution.

White entered into a plea agree-ment with the State in Maricopa County Superior Court in October 2016, in which he plead guilty to Solicitation to Commit Taking Identity of Another Person or En-tity, a class 6 felony, committed on or between November 11, 2011 and February 29, 2012. The Court sentenced White to 3 years of pro-bation, various fines and penalties and restitution in the amount of $9,485 to the Board as a result of its investigation, M12-055.

Felony Convictions of Non-Registrants Obtained

The Attorney General’s Office obtained felony convictions as a result of two of the Board’s en-forcement cases against unli-censed individuals who engaged in work that required professional registration with the Board.

In March 2014, the Board re-ceived a complaint against Mark Brownell, a non-registrant and owner of J.R. Tuttle Co. The complaint alleged that Brownell submitted plans to Core Construc-tion as an estimate of a building for the Sahuarita Unified School District. The plans were affixed with a fraudulent stamp illegally obtained from Richard Allen Maddox, P.E. #35575.

Mr. Maddox was employed by VP Builders at time as a PE and when interviewed by Board staff, indicated that Brownell had, in the past, used the company tem-plate to prepare calculations and drawings for builders. Evidence indicated that Maddox’s stamp was photo-shopped from a previ-ous report Brownell had accessed. The fraudulent use of the stamp was discovered when Core Con-struction contacted VP Builders to verify calculations. At that time,

The Arizona State Legislature is currently in its 53rd legislative session. A number of Bills have been dropped this session that could affect the AZ-BTR and registrants. You can read more about these bills below.

SB1055: Expedited Rule Making

This bill proposes to amend language regarding the expedited rule making process for agencies.

It removes language allowing agencies to expedite rulemaking for the purpose of removing repeated verbatim language within the rules and rules regarding in-ternal governmental operations not sub-ject to violation by a person. It adds language allowing agencies to expedite rules for a course of action outlined in a Committee approved five-year-review report and for rules of another agency that has been or imminently will be con-solidated into the agency.

Furthermore, an agency wishing to ex-pedite rulemaking must submit a pro-posed expedited rulemaking notice to the Rules Committee. After delivery of the notice, the agency and the council must post the expedited rulemaking on their respective websites and allow any person to provide written comment for at least 30 days after posting the notice.

This bill reduces an agency’s ability to expedite rule changes to ‘clean up’ its rules but does allow changes for agency consolidation. It further adds a level of review through the rules committee and better access to the public.

SB1072: Scope of Court Review on appeal from administrative decisions.

This bill proposes to add language to broaden the scope of the Court’s ability to review agency disciplinary actions. It grants the Courts the ability to reverse, vacate and remand agency actions that are contrary to the law, regardless of any previous agency determination, and decide all questions of law.

Currently, the Courts do not decide all questions of law; they review the ad-ministrative record and evidence of the matter to make a determination. This grants Courts a higher authority over agencies when interpreting administra-

tive law.

SB 1186: Alarm Industry Finger-printing bill .

This bill proposes to mandate alarm agents and controlling persons provide proof to the Board of having a valid fingerprint clearance card.

Currently, alarm agents and controlling persons must submit fingerprints to the Board annually. The fingerprint records must be stored in office. The use of fingerprint clearance cards would alleviate registrants from submitting annual fingerprints, extend their registration from two to three years, and free the Board from the responsibilities of storing fingerprint records.

SB1437: "Right to Work" bill

This bill proposes adding language to limit the number of agency occupational regulations; specifically that regulations shall be limited to those that are demonstrated to be necessary to specifically fulfill a public health, safety or welfare concern.

The bill would allow individuals to petition an agency to repeal or modify any occupational regulation if harmed by said regulation. It would also allow any individual to file an action to challenge an occupational regulation through court or general jurisdiction. The plaintiff of such a challenge will prevail if the plaintiff proves to the court through a preponderance of the evidence that the challenged occupational regulation burdens the entry into or participation in an occupa-tion, trade or profession and the state fails to prove to the court through a preponderance of the evidence that the regulation is necessary to specifically fulfill a public health, safety or welfare concern.

HB2271: Military Training, Experi-ence and Education Accreditation

This bill proposes to allow an applicant’s training, experience and education obtained in the United States Armed Forces, National Guard, or other Reserve Component to partially or fully satisfy the training, experience and education requirements for occupation-

al or professional licensure, certification or registration .

Currently, the Board does accredit training, experience and education ob-tained in the United States Armed Forces, National Guard, or other Re-serve Component . However, other agencies may not.

Governor's Regulation Rollback

Proposed Rule Changes Submitted

Over the last six months, the Home Inspector Rules and Standers Committee (HIRSC) and the Legislation and Rules Committee (L&R) have been hard at work updating agency rules for submission to the Governor’s office for approval to take them to GRRE. Stakeholders, such as AIA, regularly attended and participated in these meetings. The HIRSC focused on new definitions and clarity to its rules. One of the substantial proposed changes was the striking of definitions under A.A.C. R4-30-247 and adding definitions for peer reviews, peer reviewer, parallel inspections, and parallel inspector. In line with the proposed definition inclusions, the committee proposed additional language specifying the minimum requirements to become a peer reviewer. The L&R committee was very busy over these last six months, meeting four times, and focusing on streaming the rules. In the recent past, Assayers and Remedial Specialists were under the jurisdiction of the BTR. Through legis-lation, Assayers and Remedial Specialists have been deregulated and ADEQ is now cleaning up remaining methamphetamine contaminated properties. However, the rules in which these professions are to be regulated still exist within the BTR’s rules. The committee

proposed striking them. The committee also proposed simple updates, such as

a new fees schedule, but most proposed changes

centered on more complex issues. For example,

education and work experience were discussed at

length, specifically, accreditation of international

degrees and registration standards.

Other proposed rule changes included removing ar-

chaic language throughout, broadening the Board’s

discretion when reviewing registrant/applicant crimi-

nal histories, clarifying Enforcement Advisory

Committee procedures and evaluation standards,

providing respondents with investigation information

sooner in the Board’s investigation process, and

removing the expiration date from professional seals.

These proposed rule changes were submitted the

Board for review at the March, 2017 Board Meeting.

Board members motioned that the proposed rule

changes be submitted to the Governor’s office. The

Governor’s Office subsequently approved to review

the proposed rule changes.

I refer all registrants to ARS 32-101 definitions:

20. "Land surveying practice" means the performance of one or more of the following professional services:

(a) Measurement of land to determine the position of any monument or refer-ence point that marks a property line, boundary or corner for the purpose of determining the area or description of the land.

(b) Location, relocation, establish-ment, reestablishment, setting, reset-ting or replacing of corner monuments or reference points which identify land boundaries, rights-of-way or easements.

(c) Platting or plotting of lands for the purpose of subdividing.

Board Secretary’s Communique (Continued) (d) Measurement by angles, distances and elevations of natural or artificial features in the air, on the surface and immediate subsurface of the earth, within underground workings and on the surface or within bodies of water for the purpose of determining or establishing their location, size, shape, topography, grades, contours or water surface and depths, and the preparation and perpetuation of field note records and maps depicting these features.

(e) Setting, resetting or replacing of points to guide the location of new construction.

Speaking of drones and UAVs, I some-times describe professional liability insurance as the "opposable thumbs" of licensure. A registrant that has demonstrated a recognized level of

competency through licensure can be insurable as such. Seemingly then the amateur drone operator offers little or no financial protection or client cover-age for liability. The marketability of this assurance as an incident of licen-sure may set the professional registrant apart when engaging savvy and sophis-ticated clients in a free market environ-ment. The employment of professional liability insurance is not a regulatory item under the BTR purview nor is this advice from the BTR.

The Pitfalls of Pre-listing Inspections By Randy West, CHI

This has happened to all home inspectors. You complete a home inspection and report for Buyer A. A month later you get a call from Buyer B. Buyer A did not buy the home, and someone provided Buyer B with a copy of your report. Buyer B has some questions for you.

We all handle this call differently. Some inspec-tors tell me they will not answer any questions for anyone but their client. Some inspectors will answer a few basic questions, but explain to Buyer B that they have no contractual obligation with him, and that conditions at a home can change rapidly.

But what if you did the inspection for the seller of the home, a ‘pre listing’ inspection. Your cli-ent, the seller, wants you to answer a potential buyers questions when they call you. After all, the reason he hired you was to reduce unex-pected delays after getting a purchase contract. If you refuse to answer questions for a potential buyer, are you not doing a disservice to your cli-ent?

Even if you tell the buyer several times on the phone that he was not your client, you have no obligations to him, conditions at the home may have changed, etc., that buyer may ‘think’ he received a home inspection report. Attorneys state that if the buyer ‘believes’ he received a report, it makes it more difficult to dismiss any claims he may file at a later date.

And this belief is often reinforced by Realtors encouraging buyers to rely on an existing inspec-tion report. I have even seen Realtor ads for a home that stated “includes recent home inspec-tion report”. This makes it even easier for a buy-er to claim they thought the report was ‘theirs’.

And of course nothing prohibits the buyer from filing a complaint with the BTR against a regis-trant. If the buyer feels your inspection did not comply with the Standard of Professional Prac-tice for Arizona Home Inspectors, it doesn’t mat-ter if they were the client or not.

Copyright protection would not protect you. Copyright protection prevents others from copy-ing information. It does not prevent them from giving something away. I can buy a book and

legally give it to a friend when I’m done reading it, or even sell it to someone. Once you buy a book, you can do anything you want with the actual book. If you make 30 copies of the book to sell, or copy a significant amount to use in your own book, that would be copy-right infringement (and/or plagiarism).

I have also heard you might have higher expectations for a report done for a seller. Say you stated in your report there was an evaporative cooler on the roof, but it was 10 degrees outside, the cooler has been discon-nected and covered for the winter, and ice on the cooler may have caused damage if you tried to remove the cover. Working for a buyer, this is a reasonable com-ment in a report. Neither you nor the buyer should do anything that might cause damage to the property. However, if your client is the seller, why didn’t you ask him to remove that cover so you could check the interi-or of the cooler. Or remove the shelves in front or the electrical panel, or the Porsche below the attic access. You get the idea.

So should you do pre-listing inspections, knowing that you might end up with a ‘client’ that you never met and never paid you anything? That’s an individual decision every home inspector must make. I have the following disclosure in my report:

This report is for the sole use of the Client for this time period only. The inspector has no obliga-tion to anyone other than the Client and only for the specified time period.

An attorney recommended this disclosure; not for pre-listings but for anyone else reading the report. I have this disclosure in my report, not the Inspection Agree-ment, so anyone reading the report will see it. You can change the ’45 days’ to a specific date or a different number of days.

Register Your Firm!

Cases against unregistered firms is a recurring violation here at the AZBTR. These cases normally end with firms signing a Consent Agreement, paying fines and having their violation on record. In order to reduce the number of unregistered firm cases, the AZBTR presents the following information to edu-cate registrants and the public.

What Does the BTR Consider a Firm?

A firm is a business that offers Board regulated professional or occupational services to the public. As de-fined, a Firm can take the form of any type of business structure including:

Sole Proprietorship, Limited Liability Company, Cooperative, Corporation, Partnership

See A.R.S. 32-101. Purpose; definitions for the precise definition.

What to Know About the Board’s Firm Registration Requirement

A firm must be registered with the BTR to practice any Board-regulated professions or occupations. The firm must conduct its professional services under the charge of a designated registrant principal. A firm not regis-tered with the BTR that practices any Board-regulated professions or occupations is in violation of Arizona statutes and is subject to investigation.

To become registered with the board, an Application for Registration Form, with the appropriate fees, must be submitted. To complete the form, include a complete list of Board regulated services the firm provides and a designated registered principal for each service provided. An Arizona Registrant must be designated as the individual in responsible charge of the services being offered by the Firm. A Firm may have more than one Principal, and the Principal need not be an officer of the corporation. Firm Principals can be changed and/or added at any time by filing the appropriate form. Firm registration is required annually by completing and fil-ing the Annual Firm Registration form available on the Board’s website. The current annual Firm Registration fee is $50.00, which must be submitted with the Annual Firm Registration form.

Contact information, updates to principals and branches must be made in writing within 30 days of any change.

Any firm branches located in the State must be registered. Registration is similar to a firm, but a different form is used and the designated registrant doesn't need to be a principal.

Home inspector firms cannot advertise home inspection services unless a registered home inspector prepares the firm’s home inspections as a result of an on-site observation.

See A.R.S. 32-141(A)(B)(C)(D). Firm registration for the precise definition.

Does My Firm Need to be Registered?

If your Firm Name appears on a Professional Document or a Home Inspection Report, your Firm needs be registered with the Board.

If your Firm advertises or offers to provide any professional or occupational services regulated by the Board, your Firm needs be registered with the Board.

If your Firm name appears in a contract, proposal or agreement to provide any professional or occupational services regulated by the Board, your Firm must be registered with the Board.

Those at the Arizona Board of Registration wish to ex-press our sadness at the loss of Elizabeth Wheat, long time member of the Ameri-can Society of Landscape Architects and the first female board chairman here at the AZBTR.

Elizabeth comes from a long line of landscape pro-fessionals with her great-grandparents founding the Wheat’s Riverside Nursery in Phoenix in 1906. Eliza-beth’s father was an ASLA fellow and established the Wheat’s Landscape Center. Elizabeth first registered as a professional landscape ar-chitect in Arizona in 1980. She founded Wheat and

Elizabeth was a member of CLARB and served as its Regional Director. She was a member of ASLA since 1980 and president of the Arizona chapter in 1984. She was a board member of the AZ-BTR in the early nineties and became the first woman board chairman in 1993.

Elizabeth’s works in the state included, but are not limited to, the Speedway Boulevard Demonstration Project in Tucson in 1994 which was declared amongst one of the top ten Arizona

public works projects of the 20th century, the I-10 corri-dor between 1989 and 2010, and the Urban Landscape Management Plan in Tucson in 2007. She is also known for her contributions and support of the landscape ar-chitect program at the Uni-versity of Arizona and giv-ing her time to local councils and committees.

Kayla Blanco

Kayla is a true born and raised Arizonan. She has worked for the Board of Technical Regis-tration for over 3 years. She started in March of 2014 working at the Front Desk, then moved on to be the Enforcement Assistant, where she took care of cases and financial assur-ance for Home Inspectors for 2 years. She is now back with Board Operations in the posi-tion of Accounts Payable / Receivable.

She enjoys spending time with her loving husband, adorable nieces, and her fur baby Dug. She also travels to the California Beaches whenever she gets the chance. When she’s not thinking about work she is thinking about Star Wars, Harry Potter, and Disneyland.

Adrianna Soto

The Board welcomes new staff member Adrianna Soto.

Adrianna joined the Board’s Enforcement Unit as the Administrative Assistant, filling the vacancy left by Kayla Blanco’s transfer to the Operations Unit.

Since 2014, Adrianna worked with the Department of Child Safety as an Inspection Coordi-nator. Her experience includes licensing, investigative and administrative duties. Adrianna will provide essential administrative support to the Board’s investigative team and will be responsible for compliance related to Home Inspector’s financial assurance requirements.

Adrianna was born and raised in Tempe, Arizona. She received an early college scholarship at the age of 16 and was able to attend high school and college simultaneously. Adrianna graduated from high school a year early and began working on her degree in Administrative Justice. She now is married with three children and will begin working on her second De-gree in June of 2017.

Licensing April 7th was Licensing Manager Michelle Fleming’s last day at the BTR. Michelle began working for the BTR in 2015, but has an extensive work history with the state. A wonderful supervisor with an upbeat atti-tude, Michele will be missed. Thank you for your dedication and hard work Michelle!

ENGINEER EXAMINATION AUTHORIZATION

The AZBTR plans to return to Auto-approval through NCEES.

What does this mean? Examinees will no longer need to apply to sit for the PE/PS exam through the Arizona Board of Technical Registration if the following criteria is met: 1.Examinees must have passed the FE/FS exam and that exam must be verified in the E3 system. 2. Examinee must have education that is verified by transcript and meets the board's ABET requirement (EAC, ETAC, and/or ASAC). If you do not meet the above criteria, you will be required to apply to sit for the PE/PS through the Arizona Board of Technical Registration. Please note that ALL applicants are required to have 60 months of education/experience to be eligible to sit for the PE/PS exam.

Please make sure to check the website for the newest forms when it is time to apply for or renew registra-

tion. Do not save forms for reuse. If an application or renewal is submitted using an older version of a form

it will be returned with a letter stating why the form was returned.

IN-HOUSE FINGERPRINTING

If your firm conducts fingerprinting in-house, please make sure you are following CJIS/CHRI procedures,

specifically the following:

The technician must complete the AZBTR’s Fingerprint Verification Form and seal the form and the com-pleted fingerprint card in the tamper-evident envelope The technician must then seal the envelope and write their name or identification across the edge of the seal. They are not to give the fingerprint card to the appli-cant without first sealing it inside the envelope.

The applicant must provide the unopened envelope containing their fingerprint card and the Fingerprint

Verification Form to the Board with their initial application package, certificate renewal package or annual

fingerprint resubmission package.

Operations

The 2nd Quarter renewals were mailed in April and are due 6/31/17. If a registrant did not get the reminder in the mail they can download the form from the BTR website. April renewals have been mailed for Home Inspectors and Alarm Agents.
