After years of wrangling, protests, charges and counter charges, in a 9 to 6 decision, the council approved the ordinance. Council members Scott Griggs, Sandy Greyson, Adam Medrano, Monica Alonzo, Phillip Kingston Carolyn Davis, Mayor Rawlings, Dwayne Caraway and Jennifer Staubach Gates voted, “Aye!” The ordinance passed by the council includes a setback requirement of at least 1,500 feet from the nearest edge of a pad site to the nearest edge of a protected-use property line. Injection wells within Dallas (city limits) are banned and it limited compressor stations exclusively to industrial manufacturing districts. Also approved is a requirement for 100 percent chemical disclosure and the use of discrete tagging additives to track fluid migration in groundwater, and mandated baseline testing for water, air and soil to establish a standard to determine when pollution occurs. The only caveat in the ordinance is that a variance of the code for a new well will be decided on a case to case basis and requires a 2/3 positive vote instead of the requested 3/4 positive vote. Petroleum engineer Bill Crowder of Dallas predicted an economic and legal reckoning from an ordinance that he said might effectively ban drilling. “I want you to look me in the eye next February or March when I ask you, ‘What the heck were you thinking?’” This question is answered with we can breathe the air, drink the water and live in Dallas and Garland. It is time for Garland to adopt this same ordinance to protect us from any quarterback sneaks by the oil companies with, for example, horizontal drilling.

Ask not for whom the gun kills,it will kill you.

Today, Friday, December 13, an armed student entered Arapahoe High School inCentennial, Colorado. A lone shooter came into the high school through a west sidedoor, looking for a particular teacher. The results? One student was seriously injuredafter reportedly confronting the gunman. The teacher was able to escape when he gotword the student was gunning for him. The shooter is dead, shot in the school of anapparent self-inflicted wound, a suicide. The rest of the student body left the schoolwith their hands on their heads, searched before they could leave the area and jointheir parents. The damage to the school, shown on MSNBC immediately, picturedwindows shot out and gunshot holes in the remaining glass.

U.S. Representative Rosa DeLauro (CT3-D) reported, “Since the Newtown tragedy,29,000 people have lost their lives to gun violence.” Rep. DeLauro also reported 52percent of Americans want more gun control. Seventeen states have enacted strictergun laws. The U.S. Congress has done nothing. Three lawmakers in Colorado whoworked and voted for gun control and universal background checks were targeted. Two of the lawmakers were recalled and a third resigned before being recalled. ClintVan Zandt, former FBI profiler, reporting on the Ed Shultz show, said, “We’ve got todo something. There are 280 million known firearms out there for 315 million people. We must identify those individuals with violent tendencies in the elementary schools —those playing violent video games, with mental health issues and teach them conflictresolution skills other than a shotgun.”

Once again the issue has arisen about arming teachers. The response from Van Zandt,on a Saturday MSNBC show, was this is an “atrocious idea.” Arapahoe High School hasmore than 4,000 students, and approximately 125 teachers and administrative staff. When the emergency responders arrived, there would be 125 plus the lone shooterarmed, ready to shoot. Who’s who? How could the perpetrator be identified?

The question is, who will be yielding what weapon? A mentally ill, untreated youthwith an AK-47 or armed with a dozen 30-bullet clips for their a handgun? Or will it bethe Congress so caught up in private money they cannot vote for the good of thepeople and put new gun restrictions in effect. When will the members be courageousenough to vote for the good of the people and risk being voted out of office by thefunded crazies on the Right? When will the screams of Second Amendment rights tocarry a gun be silenced with my right to life, liberty and to pursue happiness?

Remember, with 280 million known firearms out there, the guns kill not only somebodyelse, they will kill you and me.

ACA Report Card Reality

1. Lowering healthcare cost.

The New York Times reported on December 2, “From 2007to 2010, per-capita health care spending rose just 1.8percent annually. Since then, the annual increase hasslowed even further, to 1.3 percent. A decade ago,spending was growing at roughly 5 percent a year.” Noone knows for sure what the impact of the ACA had on thelower rate of increase. www.nytimes.com/2013/12/03/business/ affordable-care-act-so-far-seems-likely-to-cost-less-than-expected.html?pagewanted=all

2. Americans can keep the plans they have and like.

The ACA introduced consumer protection by specifyingpolicies must meet certain standards and provide aminimum level of coverage. The result was policies couldcost more for some people depending upon their choice ofpolicies from the exchange, but they will receive improvedcoverage for their money. New policies are required toprovide the protection people thought they were buyingbefore the ACA went into effect.

3. You can keep your doctor.Some people may lose their doctor of choice because thedoctor opted out of participating in the exchanges and notbecause the ACA denied them participation. But millions of people who could not get health insurance for variousreasons including pre-existing conditions or cost areguaranteed coverage with no annual or lifetime cost cap.

4. Job creation.

The Bureau of Labor and Statistics reports “Health careemployment continued to increase over the month(+28,000). Job gains occurred in home healthcare services(+12,000) and offices of physicians (+7,000), while nursingcare facilities lost jobs (-4,000). Job growth in health carehas averaged 19,000 per month thus far this year,compared with an average monthly gain of 27,000 in2012.” http://bls.gov/news.release/empsit.nr0.htm

5. Texas, our Texas.

As of December 6, 2013, Texas was off to a healthy start inspite of interference from Austin. Some 108,410 Texanscreated accounts for health insurance through the FederalMarketplace. Democracy without Socialism is Oligarchy— Willa B. Kulhavy

A year or more ago I exploded in incoherent rage when Bobby Copeland said he answeredhis in-laws’ opposition to President Obama by saying, “No, Obama is not a socialist. He’s agood man! Obama is a Christian. I could see Bobby’s answer to his in-laws was the mosteffective quick one he could have given. But I couldn’t find words to explain why it is badto leave anyone with the short answer when the rich and powerful hire newscommentators to convince voters that capitalism is both Christian and the best economicsystem. Therefore, our democracy should be government for and by the capitalists. ForPresident, Senator, and Representative, I want a good person who is a socialist likeFranklin D. Roosevelt.

According to Webster’s College Dictionary: Religion is a set of beliefs concerning the cause, nature and purpose of the universe.Capitalism is an economic system in which investment in and ownership of the means ofproduction, distribution, and exchange of wealth is made and maintained by privateindividuals or corporations.

Socialism is an economic system in which the means of production and distribution ofgoods are owned and controlled collectively or by the government. A bit of socialism givesthe government ownership and control of some goods in order to, yes, redistribute somewealth.

Communism is a system of social organization based on holding all property by thecommunity, actual ownership being ascribed to the community or the state.

Because capitalism rewards the accumulation and punishes the dissolution of wealth, anoligarchy (a government system in which power is vested in a few people or a dominantclass) is probably the preferred government of a capitalist.

Right now the maximum income rate for a married couple with an income over $450,000to billionaire-infinity is 39.6 percent. After Franklin Roosevelt was elected, the top incomerate went up from 25 percent to 63 percent and climbed to 81.1 percent before World WarII. What was going on? A good bit of government for the people was going on, otherwiseknown as a bit of socialism. There were the government programs to create jobs andraising the standard of living by building dams for hydroelectric power, improving publicand facilities at national parks. That bit of socialism not only created a slew of federalprograms to aid people and grants to states and cities for the provision of jobs and foodassistance for their citizens, it also started the Social Security and Federal Unemploymentbenefits many U.S. citizens have depended on this year. Democracy without Socialism isOligarchy.

John Nance Garner, Bobby Copeland’s great-uncle, was FDR’s vice-president during theDepression and, if Roosevelt hadn’t run for an unprecedented third term, Garner couldhave become president in 1940. Texan John Nance Garner must have been a good man, abit of a socialist, and a Christian (Bobby is). Garner served a government of, by, and forthe people.

If you receive Congressman Sessions’ HS32-R weekly online “newsletter,” you are aware ofthree more House bills he supported which have no benefit for residents of HS 32 — buthave great benefit for major contributors to his campaign account. Sessions continues tosupport de-unification of the states of the United States of America by undercutting federallaw and regulation, and making federal law subject to state law ... somewhat like other“states rights” positions he has taken. The names of the House bills are disingenuous anddeceptive to the true purpose of the bills.

H.R. 2728This House bill would prohibit the Interior Department from enforcing federal hydraulicfracturing regulations, where a state has regulations.

H.R. 1965This House bill would undercut the Interior Department’s ability to conduct research onproposed offshore oil and natural gas production leases.

H.R. 1900The third House bill undercuts the Federal Energy Regulatory Commission’s ability toevaluate the safety and environmental impact of any new natural gas pipeline by forcing theFERC to approve or deny such application within 12 months.

On Wednesday, the House passed H.R. 2728, theProtecting States Rights to Promote American EnergySecurity Act of 2013 , and H.R. 1965, the FederalLands Jobs and Energy Security Act. H.R. 2728prohibits the Interior Department from enforcingfederal hydraulic fracturing regulations in any statethat already has regulations and recognizes states’authority to regulate this type of activity. Requiringadditional federal burdens to the existing regime ofstate-level regulations will do little more than increasecosts, decrease production, and reduce Americanenergy independence.

H.R. 1965 streamlines the leasing and permittingprocess for onshore oil and natural gas production bydirecting the Secretary of the Interior to issueResearch, Development, and Demonstration leaseswithin 180 days of the enactment of the law. OnThursday, the House approved H.R. 1900, theNatural Gas Pipeline Permitting Reform Act of 2013.

H.R. 1900 streamlines our nation’s pipelinepermitting processes in an effort to allow for greatercapacity and promote safe infrastructure. Specifically,the bill directs the Federal Energy RegulatoryCommission to approve or deny any permitapplication for a new natural gas pipeline within 12months. This legislation directs the federalgovernment to improve its permitting processes in aneffort to increase natural gas transportation capacity.

While natural gas and oil production has increasedrecently on state and private lands, production onfederal lands has decreased by 14 percent sincePresident Obama took office. That is why Isupported the above legislation to streamline ournation’s pipeline permitting process, expand onshoreoil and natural gas production by removing inefficientgovernment roadblocks, and prohibit duplicativehydraulic fracturing regulations. It is time for theSenate to join us in reversing the course of thisAdministration’s energy policies.

Catchy Titles — NO Jobs— Katherine Savers McGovern

Congressman Sessions and the GOP House continue to pass bills with catchy titles but no job-building substance. They may help the few at the top, but consumer beware! For example, the“Small Business Capital Assess and Job Preservation Act” exempts private equity fund advisers fromhaving to comply with Dodd-Frank Act — one of the reasons for the 2008 Great Recession — privateequity fund advisors — now they are too busy to complete the financial filings required byDodd-Frank Act. Importantly, what facts identify any specific jobs, particularly well-paying, career-building jobs leading to advancement into the middle class. Not too many “private equity fundadvisors” are either middle class or offer jobs to many people. What jobs or whose jobs are beingpreserved? What’s the target job bank?

The “Innovation Act” is intended to protect folks who are being sued for patent infringement. Whynot let the existing judicial system, well stocked with judges determine, along with a jury, whether apatent infringement suit is without merit.

What needs to happen is for the federal judicial system to be better funded, additional judgesconfirmed and Congressional special interests’ legislation likely written by ALEC blocked as a hazardto our nation’s competitiveness and economic security. This is accomplished by preventing the tiltingof justice to benefit special interests.

Finally, we are all waiting for an objective report that analyzes how these GOP House bills wouldactually increase jobs which pay a living wage, lead to upward mobility and career development.Neither bill reveals what type of jobs would be created, who the “innovators” are who would beprotected and thus hire more people.

Congressman Sessions’Descriptions (via GOP)

On Wednesday, the House passedthe Small Business Capital Access andJob Preservation Act to promote the free-enterprise system and encourageprivate sector investment. Specifically, H.R. 1105 exempts private equityfund advisers from being hit with an unprecedented number of costly rulesand regulations under the Dodd-Frank Act. Forcing these advisers to

complete expensive and unnecessary filings does little more than divert capital, time, and effort thatshould instead be spent investing in growing companies.

On Thursday, the House approved the Innovation Act to protect our patent system and promotetransparency in the patent litigation process. America’s patent system serves as a key tool to ournation’s competitiveness and economic security by promoting American ingenuity through theprotection of property rights. Unfortunately, our nation’s businesses are facing a drastic increase inmeritless patent infringement lawsuits by “patent trolls” that place an unnecessary burden onentrepreneurship and cost job creators tens of billions of dollars each year. The Innovation Act willhelp stop these frivolous lawsuits so that America’s businesses can focus on expanding and hiringmore employees.

Saturday I saw President Obama made an important

fact-packed speech on Wednesday, Dec. 4 about

income inequality and the current and long-term

benefits improvements in equality and upward

mobility would have for individuals, democracy, and

America’s standing in the world. Obama was

speaking to the Center for American Progress, not

the public or Congress, so don’t get hung up on the

lack of big media coverage like I did, just find the

Today, a great man left us. Nelson Mandelawas not just a hero of South Africa, but for allof humanity — an inspirational soul whopossessed the courage to stand up to injustice,regardless of what it might cost him personally.

On the 20th anniversary of his release fromprison, I stood inside his former cell on RobbenIsland — the place where he spent 18 of his 27years of incarceration. I was overcome withemotion realizing what he sacrificed to endapartheid and free a people.

A couple of quotes from President Mandeladaily inspire me in my work as an electedofficial:

“Overcoming poverty is not a gesture ofcharity. It is an act of justice. It is the protectionof a fundamental human right, the right todignity and a decent life.”
