The City Council of the City of Palestine Texas convened in a Regular Meeting on Monday November14 2011 at 400 pm for the Worksession in the City Hall Conference Room and at 530 pm for theRegular Meeting in the Council Chambers at City Hall 504 N Queen Street Palestine Texas with thefollowing people present

WORKSESSION
Mayor Pro Tern Denmon called the worksession to order at 403pm
Discuss an Interlocal Ayreement with Veterans Services reizardina rental space and other amenities at
Palestine Mall
Discussion was held regarding a request from the Veterans Services for the city to provide supportthrough an interlocal agreement for rental of a space at Palestine Mall Evelyn Cupit advisedCouncil that the County has pledged 60000 per month and they are requesting that the Cityconsider paying the monthly utility costs for the rental unit 36 The Council indicated that theyneed to look at utility costs for the unit and the condition of the air conditioning units beforemaking a decision The Council directed Staff to place on the November 28 agenda for furtherdiscussion
Discuss the inhouse distribution of certain overthecounter drugs
Discussion was held regarding pros and cons of the inhouse distribution of certain overthecounter drugs The Council directed staff to see if other cities have a similar program
Discuss amendments to Article X Signs
Planner Jeffrey Lyons presented proposed amendments to the sign ordinance
Discuss amendments to Article XII Landscaping StandardsThe Council directed staff to place this item on the November 28 agenda for discussion
Discuss the Texas State Railroad Contract
Councilmember Presley advised Council that the Texas State Railroad Authority is requesting that thecity delay repayment of the loan He advised that the City of Rusk and the State of Texas would have toapprove their portion Council consensus was to continue working with the TSRR
With no other business to come before the Council the worksession was adjourned at 532 pm

The invocation was given by Councilmember Denmon and was followed by the Pledge of Allegiance
PUBLIC COMMENTS PUBLIC RECOGNITION AND ANNOUNCEMENTS
James Smith addressed Council regarding the process used for hiring the new Police Chief
Isaac Wynn addressed Council regarding emails and the Police Chief selection committee for communitymembers
Interim Police Chief Alan Wilcher introduced new Police Officers James Hcavener Daniel Lacey andMichael Miller
Officer Melvin Hill was recognized for his promotion to Sergeant Officer Jeffrey Powell was recognizedfor his promotion to Lieutenant
Finance Director Elizabeth Saegert reported that a proclamation was signed by Mayor Herringtondesignating November 711 201 as Municipal Court Week
Mayor Herrington read aloud proclamations for PJs in Palestine and Small Business Saturday

A Public Hearing reYardimz a Zoning Change from R1 Single Family Detached Low Density district toMF1 Multiple Family Low Density District on property located approximately 215 feet south of theintersection of S Rovall Street and E Huffsm Street on the east side of S Ro StreetPlanner Jeffrey Lyons provided staff comments for the zoning change Mayor Herrington opened thepublic hearing Property owner Lamona McCloud Cuba spoke in favor of the zone change With noother speakers the public hearing was closed
A Public Hearing retwdinfz the abandonment of Rampart Street RightofWayPlanner Jeffrey Lyons advised Council that a public hearing is not needed for the abandonment
A Public Hearing regarding the Taxation of Personal Property known as Goods in Transit otherwiseexempt from Ad Valorem Taxation
Mayor Herrington opened the public hearing With no speakers the public hearing was closed

Mayor Herrington reported that he attended the opening of The Place Community Center He reportedthat City staff held the MallOWeep event at Palestine Mall He thanked Councilmember Harding forhosting a Veterans Day Celebration at WalMart He reported on the Veterans Days Parade andceremony in Veterans Park He commended the City Manager for a great job on the Police Chiefselection committee
Councilmember Chivers reported that Washington School had a very nice Veterans Day event
CITY MANAGERSREPORT
City Manager Mike Ohrt reported that a meet and greet for Police Chief candidates will be held onNovember 15 at the Carnegie Building IPublic Works Director Tim Perry provided a summary of the cleanup day
Chamber of Commerce Director Meghan Hill provided a recap of the 2011 Fall Festival

Departmental reports were provided for Public Works Development Services Finance and EconomicDevelopment

Councilmember Presley made a motion seconded by Councilmember Denmon to appoint JanieSepulveda to the Library Board Place 2 Upon vote motion passed 60 with Councilmember Yelvertonnot present for the vote

Planner Jeffrey Lyons advised Council that on February 23 1948 the City Council voted unanimously toclose Rampart Street and instructed the City Attorney to draft the ordinance He also advised that after acareful search of city records it appears that the ordinance was never presented to the Council foradoption Councilmember Denmon made a motion seconded by Councilmember Presley to adoptOrdinance No 05111 as presented Upon vote motion passed unanimously
Consider an Ordinance approving amendments to Article X Signs 05211Councilmember Presley made a motion seconded by Councilmember Yelverton to adopt Ordinance No05211 as presented by Planner Jeffrey Lyons Upon vote motion passed unanimously

Councilmember Presley encouraged residents to decorate for the Christmas holiday season
Councilmember Chivers encouraged everyone to visit Santas Workshop in Main Street and attend theBreakfast with Santa event at the Civic Center and the Kwanzaa event at Palestine Mall
Councilmember Harding encouraged everyone to attend the Dogwood Jamboree event
Councilmember Denmon commended Councilmember Harding and WalMart employees for hosting theVeterans Day Celebration
