Special Recognition: Alex Smith, North Asheboro Middle School, 2008 Holiday Card Winner

Board Spotlight: Tonight students and staff from Balfour Elementary school will demonstrate one piece of interactive technology in use in their classrooms. Wendy Graham and the 5th grade team are presenting their collaborative project: “Sensational Senteos”.

Community Partner Spotlight: Takelia Barnes and the College Foundation of North Carolina is our Community Partner Spotlight this evening. Takelia works closely with our middle and high schools on the various tools available through CFNC, she also conducts numerous workshops for students and parents about applying and paying for college. She is a great resource to our students and staff.

Minutes of the Asheboro City Board of Education November 13, 2008

Policy Committee

The Policy Committee convened at 6:00 p.m. in the Professional Development Center Conference Room with the following members present: Derek Robbins, Committee Chairman Archie Priest, Jr. Gidget Kidd Dr. Kelly Harris Committee member absent was Joyce Harrington. Staff members present were: Dr. Diane Frost, Dr. Hazel Frick, Dr. Dot Harper and Dr. Tim Allgood. Chairman Kidd called the meeting to order and turned the meeting over to the administration for policy review. Dr. Frost reviewed Policy 6022 – Registered Sex Offenders which outlines the requirements for handling registered sex offenders, the exceptions, and enforcement details. The policy is required by law to become effective December 1, 2008. Dr. Frost reviewed Policy 4260 – Student Sex Offenders which is a new policy outlining the details of student sex offenders on school property, restrictions, and educational services. The policy is required by law to become effective by December 1, 2008. Dr. Frost reviewed Policy 3470/4305 – Alternative Learning Programs/Schools. She noted minor wording changes and “academic plan” added to required components. Policy 2122 – Role of Board Members and Policy 1742/5060 – Responding to Complaints was reviewed. These policies are in compliance with no changes needed at this time. The Committee reviewed Policy 2330 – Board Meeting Agenda. The Committee agreed to bring back the policy to the December meeting for possible changes in wording. Policy 6022, Policy 4260, and Policy 3470/4305 will be taken to the full board for 30-day review at its December board meeting. With no further business, the meeting adjourned at 6:45 p.m.

Finance Committee

The Finance Committee convened at 6:45 p.m. in the Professional Development Center Conference Room with the following members present: Chris Yow, Chairman Gidget Kidd Archie Priest, Jr. Phillip Cheek

Linda Cranford Kyle Lamb Jane Redding Staff members present were: Dr. Diane Frost and Harold Blair. Mr. Yow called the meeting to order. Mr. Blair discussed the child nutrition program results for 2007-2008, the recent history of fees paid to Sodexo, and Sodexo’s request to adjust the reimbursement guarantee based on Section 7H of the contract and the extraordinary increase in food costs for the 2007-2008 school year. Mr. Blair continued with a discussion on Asheboro City Schools 403b Plan and new guidelines established by the IRS. Further items discussed were Asheboro City Schools plan specifications, addendums A and B listing of vendors, and third party administer agreement with Great American Plan Administrators. There being no further business, the meeting adjourned at 7:22 p.m.

Opening The Asheboro City Board of Education met in regular session at 7:30 p.m. in the Professional Development Center with the following members present:

Board member absent was Joyce Harrington. Staff members present were: Dr. Diane Frost, Harold Blair, Curt Lorimer, Brad Rice, Dr. Hazel Frick, Dr. Tim Allgood, Gail Hicks, Mike Mize, Jennifer Smith, Dr. Dot Harper and Carla Freemyer. Chairman Kidd called the meeting to order and Ms. Cranford gave the invocation and led the Pledge of Allegiance. A motion to approve the agenda was made by Mr. Jones, seconded by Mr. Lamb, and unanimously approved by the Board. Special Recognition and Presentations Ms. Freemyer recognized Wal-Mart as a Community Partner for their support for Asheboro City Schools by holding a Tools for Schools program, Teacher of the Year program, and contributions to the Asheboro City Schools Education Foundation. Teachey kindergarten teacher, Donna Menius, and Jill Snotherly, technology facilitator, along with several of their students, shared ways they use interactive technology in their classrooms. Superintendent Diane Frost recognized Ms. Janet Means, principal of Balfour Elementary School, as Asheboro City Schools 2009 Principal of the Year. Dr. Frost praised Ms. Means for her leadership style, high quality instruction and parent involvement at Balfour School.

Public Comments Chairman Kidd opened the floor to public comments. Three individuals representing local dance studies appeared before the Board requesting an amendment to a proposed change to Policy 5030 – Community Use of Facilities. Upon motion by Ms. Redding, seconded by Mr. Yow, the Consent Agenda was unanimously approved by the Board. Information, Reports and Recommendations Mr. Harold Blair, Director of Business and Finance, along with Mr. Tony Buscemi of Sodexo, provided an update on last year’s child nutrition program accomplishments and challenges. Mr. Buscemi requested the Board consider allowing an adjustment to be made to the costs charged to the program as well as depreciation be waived from the formula used to determine whether Child Nutrition finished the year with an excess or deficit. Dr. Dot Harper provided information on the No Child Left Behind status of the elementary schools. Balfour, McCrary and Loflin Schools are required to offer ‘Choice Transfer’ to their students to Lindley Park or Teachey Elementary. Balfour will also offer supplemental educational services to qualifying students. These changes will begin second semester. Dr. Hazel Frick presented policies for 30-day board review: Policy 3460, Graduation Requirements - Proposed changes include an addition to allow students to graduate with fewer than 28 credits under criteria approved by the superintendent upon recommendation by the principal as long as the student meets all state graduation requirements and successfully completes a graduation project; Policy 4040/7310, Staff-Student Relations – A proposed change is the addition of a definition of the term “employees,” to include independent contractors and school safety officers with the exclusion of student employees; Policy 4240, Child Abuse/Reports and Investigations – Now included in the legal requirement for school employees to report suspected child abuse is the addition of neglect, dependency, or death as a result of maltreatment; Policy 4250/5075/7316, North Carolina Address Confidentiality Program – This is a new proposed policy that encourages eligible individuals to participate in the North Carolina Address Confidentiality Program. It states that the program helps to protect the location of victims of acts of violence and provides program details and outlines the handling of school personnel and student information of those included in the program. Action Items Dr. Frost reviewed steps taken by the Graduation Committee to consider changing the graduation dates for the Classes of 2009 and 2010. The Committee’s recommendations were either June 10, 2009 at 7:00 p.m. or June 11, 2009 at 7:00 p.m. Ms. Redding and Mr. Priest, as members of the Committee, shared their perspectives on the committee’s process and recommendations. Chairman Kidd reminded the Board that a motion was made and seconded at the October 9, 2008 meeting to set the date and time for graduation for the Class of 2009 for Friday, June 12, at 9:00 a.m. At the same meeting a motion was made and seconded to lay the motion on the table. The motion passed. Mr. Robbins, seconded by Mr. Lamb, moved to take the October 9 motion off the table. The motion did not pass with Mr. Robbins and Dr. Harris voting for the motion and the other 8 members voting against the motion. After further discussion, Ms. Redding, seconded by Mr. Priest, made a motion to move graduation for the Class of 2009 to Wednesday, June 10, 2009 at 7:00 p.m. and the Class of 2010 to Wednesday, June 9, 2010 at 7:00 p.m. Motion passed 8 to 2 with Mr. Robbins and Mr. Lamb voting against the motion. Elementary Schools and the Early Childhood Development Center presented continuous improvement plans highlighting their goals for the 2008-2009 school year. Upon motion by Ms. Cranford and seconded by Mr. Cheek, the Board unanimously approved the plans as presented. (A copy of the continuous improvement plans will become a part of these minutes.) After a 30-day review, Dr. Frick requested board members approve Policy 1755/7237 – Sexual Harassment Complaint Procedure for Employees. A motion was made by Mr. Jones, seconded by Mr. Lamb, and unanimously approved by the Board to accept the policy as submitted. (A copy of the policy will become a part of these minutes.)

Dr. Frick presented Policy 5030 – Community Use of Facilities for board approval. Mr. Lamb made a motion, seconded by Mr. Jones, and unanimously approved by the Board, to have the Policy Committee review the policy for further revisions. Mr. Blair presented a proposed Asheboro City Schools Section 403(b) Retirement Plan which will allow employees to continue their contributions with their current 403(b) provider and have the same plan options and benefits as currently provided as long as these providers comply with IRS regulations. Mr. Blair also presented an agreement between Asheboro City Schools and Great American Plan Administrators, Inc. that will allow Great American to monitor employee contributions, loans, withdrawals, etc. to assure compliance with the approved plan. A motion was made by Mr. Lamb and seconded by Dr. Harris to approve both the plan and agreement as presented. Motion carried 9 to 1 with Mr. Jones voting against the motion. Mr. Mike Mize presented surplus property bids for 2008. A motion was made by Mr. Jones and seconded by Mr. Cheek to approve the bids as presented. The Board unanimously approved the motion. Superintendent’s Report/Calendar of Events Superintendent Frost reported that the Asheboro High School Zoo School has been selected as one of the sites for the North Carolina School Innovation Tour and she encouraged all to visit the school on Tuesday, November 18, 2008 between 10:00 a.m. and 2:00 p.m. Dr. Frost directed the Board’s attention to an invitation to attend the Piedmont Triad Education Consortium’s annual meeting on Friday, December 5, 2008 at 8:00 a.m. The meeting is held to celebrate the success of Piedmont Triad school districts. Balfour Elementary School will be presented as our Signature School for 2008. Dr. Frost shared dates of interest for board members: The Legislative Committee will meet on November 25, 2008 at 7:30 a.m. at the Asheboro City Schools’ Administration Building; a legislative breakfast will be held January 15, 2009; and a board appreciation luncheon will be held on January 22, 2009. Ms. Carla Freemyer shared the Calendar of Events highlighting the following: FAN Workshops, Preparing your Child Academically for Success, November 14, 2008 at 12:00 p.m. and November 17, 2008 at 6:30 p.m.; The Board of Education’s Strategic Plan Update, November 18, 2008 at South Asheboro Middle School and November 20, 2008 at Loflin Elementary School. Ms. Freemyer also noted a date change for the Senior Holiday Luncheon at Loflin Elementary. The luncheon will be held on Thursday, December 11, 2008 at 12:00 p.m. Ms. Freemyer shared Points of Pride for Asheboro City Schools: Eight students selected to All-State Honors Chorus; the AHS Theatre Conference competition awards; and Asheboro High School teacher, Owen George, being named Wal-Mart Teacher of the Year. Board Operations Chairman Kidd shared that the Asheboro City Board of Education received the following recognitions at the North Carolina School Boards Association’s Conference held November 11th in Greensboro: Master Board Level III Status making the Board the only system that has reached the Level III status; Special Achievement Award for Exemplary Boards for having all members earn at least 12 hours of training during the 2007-2008 academy year making them 1 out of 35 of 115 boards in North Carolina to receive this distinction; and Mr. Chris Yow being named to the 2008 All-State School Board for his

Chairman Harrington called the meeting to order and recognized Dr. Frost to lead the agenda. Dr. Frost began the meeting by sharing the NCSBA top priorities for the 2009 legislative session. Dr. Frost then reviewed a proposed 2009 legislative platform for Asheboro City Schools. The Committee participated in open discussion on platform issues. The Committee agreed present the legislative platform to the Board of Education for approval at its December meeting. (A copy of the proposed 2009 Legislative Platform will become a part of these minutes.) The legislative breakfast with local legislators will be held January 15, 2009 at the Professional Development Center. A native of Wixom, Michigan in the greater Detroit area, Ashley Belpasso is recommended to teach fifth grade at Balfour School. Miss Belpasso graduated from Central Michigan University in July 2008 after completing her student teaching internship in an assignment split between second grade and special education classrooms in middle and high schools. There she worked with visually impaired students in self-contained and inclusion settings.

Asheboro City Schools Recycling Program

Now, more than ever, it is essential that the children in Asheboro City Schools learn the value of natural resources (including trash!) and the critical role that each of us plays in our environment. Schools can make a significant contribution to our community by reducing the amount of waste going into our landfills. By participating in the Asheboro City Schools Recycling Program we can divert upwards of 80 percent of our waste! Who Recycles?

School Calendar for 2010-2011

1. Convene a Calendar Committee

Calendar legislation requires that “Local boards of education shall consult with parents and the employed school personnel in the development of the school calendar.” Use of a Calendar Committee is an effective and efficient method of consulting with parents and staff. Use of a Committee to form the school calendar is a public exercise, an opportunity to interact and share the decision-making process with the publics we serve.

Constraints created by General Statutes related to school calendars make it difficult to form multiple calendars for consideration. $991.00 NAMS Continuous Improvement Plan has as one of its goals, “Increase utilization and integration of technology in classroom instruction.” (Goal 1.3) Through the development of student produced videos, students will increase their knowledge of technology, have an opportunity to be creative and develop original work, while increasing their knowledge of math and science. Carol Fleming CWM 5th Graders Give Back with Art from their Hearts

$977.37 Students will experience reading across the curriculum in their art classes while they study art history. Students will determine the theme for the project, develop sketches of ideas, and explore art styles. Each 5th grade class with complete one of the four canvas panels which, together, will complete the project. The Art Project will be donated for public display at Randolph Hospital. Students will have an opportunity to ‘give back’ to the community through this project.

Balfour Hip Hop Multiplication

$975.51 The 3rd Grade Teacher Team from Balfour would like to purchase 4 MP3 players per class (a total of 20 MP3 Players) and install the Hip Hop Tables which include fun songs for learning each of the multiplication tables. Every week, four students from each class will take home the MP3 players to listen to/ learn their multiplication tables in order to help them memorize the facts. Student progress will be charted throughout the year.

Jennifer Miller SAMS Recycling $555.00 Recycling has become a topic every person should become excited about. The goal of this project is to provide recycling bins for paper in every classroom and sorting bins outside the cafeteria for other types of recyclable waste products. While reducing the waste stream at the school, students would also be involved in: the collection of data and analysis of the total amount of waste recycled materials from the school; research regarding the recycling process; developing a sense of responsibility for protecting our environment.

Policy 3470/4305: Alternative Learning Programs/Schools As recommended to the Board Policy Committee, November 13, 2008 This policy outlines an alternative learning plan to meet the academic and behavioral needs of students that have not been successful in a regular education setting. ALTERNATIVE LEARNING PROGRAMS/ SCHOOLS Policy Code:

3470/4305 A. PURPOSES

The board is committed to the goal of providing a safe, orderly and inviting learning environment at each school. The educational program and the behavior management plan developed at each school, as well as numerous other strategies identified in board policies, are intended to create such an environment and help each student be a contributing and successful member of the school.

Alternative learning programs or schools are provided as an option for when a student’s behavior management or academic performance needs cannot be met in a regular education setting. The purposes of the alternative learning program or school are to (1) intervene and address problems that prevent a student from successfully achieving in the regular educational setting; (2) reduce the risk of the student dropping out of school by directing resources to helping the student resolve issues affecting performance at school; (3) return the student to the regular educational setting as soon as practical with the skills necessary to succeed in that environment; and (4) preserve a safe, orderly and inviting learning environment at the regular educational setting.

The alternative learning program or school should be developed and implemented to reflect the purposes as described above. The educational program is expected to meet all board policy and state requirements. In addition, the educational program and supporting services should be designed to facilitate the transition of the student back into the regular educational setting.

Staff of the alternative learning program or school should receive training to assist them in successfully meeting their requirements.

The alternative learning program or school are required to develop and implement a behavior management plan, a school improvement plan an academic student learning plan, and a parental involvement plan in accordance with board policy. In addition, a conflict resolution plan, as provided in board policy 3431, Conflict Resolution, must be included in the school improvement plan. In developing and implementing these plans, the board encourages the principal and staff to review successful alternative education programs and use resources made available by the superintendent.

The superintendent and board will review these plans in accordance with board policy. While providing flexibility at the school level to develop the plans, the superintendent and board will only approve plans that are reasonably likely to meet the purpose of the alternative learning program or school. Beginning with the 2006-07 school year, prior to the implementation of a new alternative learning program or school, the board will develop an implementation proposal that is consistent with the State Board of Education standards for alternative learning programs. The board will then submit the proposal to the State Board for its review. Upon review by the State Board, the board will consider any recommendations to modify the proposal made by the State Board before implementing the alternative learning program or school. The board will also review on a regular basis whether the school district’s alternative learning programs and schools comply with State Board standards.

C. TRANSFER TO ALTERNATIVE LEARNING PROGRAMS OR SCHOOLS

Students generally are assigned to a school based upon attendance area. However, as provided by law, the board may assign any student to a school outside the attendance area in order for the student to attend a specialized school or for any reason the board, in its sole discretion, deems sufficient.

Students may be transferred to the alternative learning program or school on a voluntary or involuntary basis or as an alternative to long-term out-of-school suspension or expulsion. The processes for transfer are provided below.

1. Responsibilities of Referring School Staff

In addition to any other procedures required by this policy, prior to referring a student to the alternative learning program or school, the principal of the referring school must: a. Document the procedures that were used to identify the student as being at risk of

academic failure or as being disruptive or disorderly; b. Provide the reasons for referring the student to an alternative learning program or

school; and c. Provide to the alternative learning program or school all relevant student records,

including anecdotal information and the student’s current intervention plan.

2. Responsibilities of Alternative Learning Program/School Staff In addition to any other procedures required by this policy, once a student is placed in an alternative learning program or school, the appropriate staff of the alternative learning program or school must meet to review the records and other documentation forwarded by the referring school. Based upon the student’s records, input from the referring school, and any input provided by the parent(s) concerning the student’s needs, the alternative learning program or school staff is to determine what develop and implement academic support services and behavior intervention strategies are recommended as appropriate for the individual students.

3. Voluntary Referral

The board encourages parental involvement in decisions regarding the child’s education and in identifying effective options for addressing concerns regarding the child’s behavior and/or academic performance.

Voluntary transfers are encouraged whenever possible. A voluntary transfer is an agreement by the parent or guardian and principal that the transfer is an appropriate option for the particular student. After agreement has been reached, the principal of the regular educational setting and the coordinator of the alternative learning program or school will arrange the process and time for the transfer. The principal of the regular educational setting will notify the superintendent of the transfer.

4. Referral as Option to Long-Term Suspensions, 365 Days Suspensions and Expulsion

A student may be given the option or may be required to attend alternative learning program or school for violation of board policies, school standards or rules that could result in a long-term suspension, 365 days suspension or expulsion.

Board policies will be followed for any student who may have engaged in behavior that could result in long-term suspension, 365 days suspension or expulsion. Alternative learning program or school may be considered as an option for a portion or the full duration of the period of suspension or expulsion. The alternative learning program or school may be an option to a long-term suspension or 365 days suspension if approved by the superintendent. In order to consider the alternative learning program or school as an option to expulsion, the superintendent must make a recommendation and the board must choose to approve the alternative learning program or school as a modification to the expulsion.

At any stage in the proceedings, a parent may request that alternative learning program or school be considered as an option to long-term suspension or expulsion. The superintendent will maintain records as required by board policy 4345, Student Discipline Records. Once approved, the student may be transferred to the alternative learning program or school. If the alternative learning program or school does not have the capacity to accept the student immediately, the student may be suspended from school until the alternative learning program or school can accept the student.

5. Involuntary Referral

A student may be required to be transferred from the regular educational setting to the alternative learning program or school under any of the following circumstances:

a. the student presents a clear threat to the safety of other students or

personnel; b. the student is a significant disruption to the educational environment at the

regular educational setting; c. the student is at risk of dropping out or not meeting standards for

promotion and additional or different resources from what is available at the regular educational setting are needed to address the issue; or

d. the student has been charged with a felony or a crime that allegedly endangered the safety of others and it is reasonably foreseeable that the educational environment at the regular educational setting will be significantly disrupted if the student remains.

Prior to an involuntary transfer, the principal of the referring school will document efforts to assist the student in the regular educational setting. The principal must also document the student’s behavior and academic performance. A voluntary transfer is preferable to an involuntary transfer. Therefore, the school should meet with the parents to try to reach consensus on resolution of the performance or behavior issues.

If an agreement is not reached and a basis for involuntary transfer exists, the principal may recommend transfer to the alternative learning program or school to the superintendent, or designee. The principal must provide in writing (1) an explanation of the student’s behavior or academic performance which is at issue, (2) documentation or a summary of the documentation of the efforts to assist the student, and (3) other existing circumstances

which support an involuntary transfer. A copy of the recommendation and report will be provided to the parents by certified mail or in person. The parent may request an informal meeting with the superintendent, or designee, to discuss the transfer. The superintendent, or designee, may determine who can be present at the meeting. If the superintendent, or designee, approves the transfer, the principal of the regular educational setting and the coordinator of the alternative school are to make all necessary arrangements. The parent may appeal the superintendent’s decisions to the board. The board will hear the appeal in closed session. The board will follow its procedures as provided in policy 2500, Hearings Before the Board. During the period of the appeal, the student may be transferred to the alternative learning program or school.

D. TRANSITION FROM ALTERNATIVE LEARNING PROGRAMS OR SCHOOLS

In most instances, the goal of the alternative learning program or school will be to return the student to the regular educational setting as soon as practicable with the skills necessary to succeed in that environment. The alternative learning program or school and regular educational setting will work together to help create successful transition for the student.

If the student is not returned to the regular educational setting, the alternative learning program or school will assist in the transition of the student to other educational settings, including any other programs offered by the school district, community colleges or vocational schools.

E. ASSIGNMENT OF PROFESSIONAL STAFF TO ALTERNATIVE LEARNING PROGRAMS OR

SCHOOLS

In assigning professional staff to the alternative learning program or school, the superintendent will consider the experience and evaluation ratings of professional staff. As district resources allow, the superintendent shall strive to avoid assigning to the alternative school less experienced professional staff and professional staff who have received an evaluation rating of "less than above standard" within the last three years.

1. Information To Be Reported Each year, the board will evaluate the alternative learning program or school based upon the report provided by the superintendent and any other information the board wishes to consider. In addition to data required by board policy 3430, School Improvement Plans, the alternative learning program or school must report the following information annually to the board: a. referral patterns from the schools, including age, race, gender and method of transfer

(voluntary, alternative to suspension or expulsion, or involuntary); b. drop out rates; c. how long students stay at the school and where they go when they leave the school

(including the regular educational setting, community college/technical schools or drop out);

d. training and development of professional employees assigned to the alternative learning program or school;

e. a list of services or programs in which the alternative learning program or school coordinates with other governmental agencies; and

f. any other measures the superintendent requires. To assist the board with evaluating the alternative learning program or school, the local safe schools plan also must include measures as to the effectiveness of the alternative learning program or school.

2. Items To Be Considered

In addition to any other outcomes the board deems important, the board will determine whether:

a. a diverse group of students is referred to the alternative learning program or school; b. the alternative learning program or school complies with State Board of Education

standards; c. the alternative learning program or school incorporates best practices for improving

student academic performance and reducing disruptive behavior; d. staff at the alternative learning program or school is well-trained and are provided

appropriate staff development; e. the alternative learning program or school is organized to provide coordinated services; f. students at the alternative learning program or school receive high quality and rigorous

academic instruction; and

Policy 4260: Student Sex Offenders As recommended to the Board Policy Committee, November 13, 2008 This is a new policy that in accordance with G.S. 14-208.18 states that a student sex offender may be present on school property only to the extent necessary to receive educational services. S TUDENT SEX OFFENDERS Policy Code: 4260 The board is committed to the safety of students, employees and other persons on school property. In order to create and maintain a safe school environment and comply with G.S. 14-208.18, the board establishes the following policy provisions. A. STUDENT SEX OFFENDER ON SCHOOL PROPERTY

Except to the extent the student is permitted to be on school property to receive educational services, a student who is enrolled in the school system and is a registered sex offender subject to policy 5022, Registered Sex Offenders, is expressly forbidden (1) to knowingly be present on any property owned or operated by the school system, including school buildings, athletic fields, playgrounds, parking lots, buses or other property, and (2) to attend school-sponsored or school-related activities. A student subject to policy 5022, Registered Sex Offenders, who is receiving educational services on school grounds must comply with the requirement that he or she be supervised by school personnel at all times.

B. EDUCATIONAL SERVICES FOR STUDENT SEX OFFENDERS

1. If permitted by the board, a student who is subject to Section A of this policy and is eligible to attend public school under G.S. 115C-378 may be present on school property subject to any conditions and restrictions imposed by the board.

2. The board will hold a hearing to determine whether to expel the student or provide the student with educational services. The decision to expel the student will be based on the standard established by G.S. 115C-391(d)(2).

3. Prior to expelling a student pursuant to G.S. 115C-391(d)(2), the board will

consider whether there is an alternative program offered by the school system that may provide educational services to the student.

4. If the board of education determines that a student will be provided educational

services on school property, the student must be under the supervision of school personnel at all times.

5. If a student subject to this policy violates the conditions and restrictions placed

upon the student by the board, school administrators and the board will follow established student discipline procedures and impose an appropriate disciplinary measure, up to and including expulsion.

6. If a student subject to this policy is a child with disabilities, he or she will be

provided educational services in compliance with federal and state law.

Policy 5022: Registered Sex Offenders As recommended to the Board Policy Committee, November 13, 2008 This is a new policy that in accordance with G.S. 14-208.18 bans registered sex offenders from school property. It outlines restrictions for individuals that are required to register under the Sex Offender and Public Protection Program and have been convicted of any sexually violent offense or any other offense where the victim was under the age of 16. Further, it establishes requirements for enforcement and exceptions that can legally be made under certain circumstances.

R EGISTERED SEX OFFENDERS Policy Code: 5022 The board is committed to the safety of students and other persons on school property. In order to maintain a safe school environment, the superintendent and all school personnel shall enforce the provisions of this policy at all times. A. REGISTERED SEX OFFENDERS BANNED FROM ALL SCHOOL PROPERTY

In accordance with G.S. 14-208.18, all persons who (1) are required to register under the Sex Offender and Public Protection Program AND (2) have been convicted of any sexually violent offense or any offense in which the victim was under the age of 16 years at the time of the offense are expressly forbidden to knowingly be present on any property owned or operated by the school system, including school buildings, athletic fields, playgrounds, parking lots, school buses, activity buses or other property of any kind for any reason, including attendance at sporting events or other school-related functions, whether before, during or after school hours. In addition, sex offenders subject to G.S. 14-208.18 may not attend or be present at any student function or field trip on or off school property that is (1) school-sponsored or (2) otherwise under the official supervision or control of school personnel. This policy applies to all covered sex offenders regardless of their relationship to or affiliation with a student in the school system.

B. PERSONS PROHIBITED FROM SCHOOL PROPERTY

The superintendent or designee shall consult with the board attorney and create and maintain a list of the criminal offenses that subject a person to the requirements of Section A above.

C. ENFORCEMENT

All school personnel must immediately report to a school administrator the presence or suspected presence of a known or suspected registered sex offender on school property. School administrators and other supervisory personnel shall report to the superintendent and law enforcement when they reasonably believe that a registered sex offender is or has been on school property or at a school event. School administrators also shall notify the superintendent or designee of any known student or parent or guardian of a student at their school who is suspected to be a registered sex offender.

D. EXCEPTIONS

A person who is banned from school property under G.S. 14-208.18 may be on school property only under the following circumstances.

1. Students

Students who are subject to G.S. 14-208.18 may be on school property only in accordance with policy 4260, Student Sex Offenders.

2. Voters

Voters who are subject to G.S. 14-208.18 and are eligible to vote may be present on school property for the sole purpose of voting if the school property is being used as a voting place. The voter must notify the principal of the school that he or she is registered under the Registry Program and the voter must remain at all times in the portion of the school being used as the polling place. The voter must leave school grounds immediately after voting.

3. Parents or Guardians

a. An individual who is subject to this policy and is the parent or guardian of a student enrolled in school may be on school property only for the following reasons:

1) to attend a scheduled conference with school personnel to discuss

the child’s academic or social progress; or 2) at the request of the principal or designee, for any reason relating

to the welfare or transportation of his or her child.

b. For each visit authorized by the principal in accordance with subsection (a) above, the parent or guardian must provide the principal with prior written notice of his or her registration on the Sex Offender Registry and notice of his or her presence at school. Notice of his or her presence at school includes the nature and specific times of the visit.

c. For each visit authorized by subsection (a) above, the parent or guardian

must arrange to meet a staff member at the edge of school property, check in at the principal’s office upon arrival and departure, and remain under the direct supervision of school personnel at all times. If school personnel are not available to supervise the parent or guardian during any visit, then the parent or guardian will not be permitted to enter or remain on school property.

d. For each visit authorized by subsection (a) above, the parent or guardian

must comply with all reasonable rules and restrictions placed upon him or her by the principal, including restrictions on the date, time, location and length of meeting.

In order to ensure compliance with this policy, each contract executed by the board must include a provision that requires the other party to the contract to conduct an annual check of the State Sex Offender and Public Protection Program and the State Sexually Violent Predator Registration Program on all employees who may be sent to perform tasks on or deliver products to school property. Persons who are subject to Section A of this policy may not be sent onto school property for any reason. In addition, each time the board enters into any contract or agreement for contracted services that involve direct interaction with children, the contract must include a provision that requires the other party to the contract to conduct an annual check of the National Sex Offender Registry on all contracted employees who may have direct contact with children. No contractor or employee of a contractor registered with the State Sex Offender and Public Protection Program, the State Sexually Violent Predator Program or the National Sex Offender Registry may have direct interaction with children. This provision applies to contracts with a single individual.

The AHS Nova Academy . . .

PURPOSE 

To provide a nontraditional pathway to graduation 

 

ELIGIBLE STUDENTS

Eligible students will be fourth year AHS students not yet classified as seniors, or students who have dropped out for a semester or more, and/or students who have a demonstrated hardship; approved by the superintendent or designee, upon recommendation by the principal.  AHS staff has identified approximately 15 students who could benefit from this program during the second semester of this academic year. 

 

GRADUATION REQUIREMENTS

These students may graduate with fewer than 28 credits and must meet all state graduation requirements and successfully complete a graduation project.  Each student will have an individualized plan based on their transcript and educational goals. 

 

CURRICULUM

 Courses will be delivered using web‐based and online programs with teacher support.  All courses are based on 135 clock hours of instruction.  Flexible hours will be available to accommodate student schedules. 

 

SERVICE LEARNING REQUIREMENT

All students in the Nova Academy will be required to complete a service learning component.  Three hours of community service will be required for each course credit earned in the Nova Academy.  This service learning component can be met in a variety of ways, including business attire events sponsored at the school.

APPLICATION PROCESS

Students may be referred to this program by a counselor, teacher, or parent.  Students will complete a written application including a brief essay about why they are interested in the program and what they hope to achieve, and will also participate in a follow‐up interview.  Students will be selected for the program based on their individual needs and commitment to completing the program. 

 

PARENT INVOLVEMENT

Parents will participate in the initial planning process for each student.  Regular and frequent contacts with parents will include teacher contacts, academic progress reports, and home visits.  Parents will be invited to participate in business attire events and service learning activities. 

 

LOCATION and HOURS

The AHS Nova Academy will be housed on the AHS campus in the renovated space in the southeast building of Comet Corner.  Hours will be 8:00am‐8:00pm, Monday through Friday. 

 

STAFFING

The AHS Nova Academy will be staffed by a certified teacher who will serve as the coordinator and instructional facilitator for the program and a non‐certified instructional facilitator. 

 

COMMUNICATION PLAN

Eligible students will be invited to consider this program to meet their graduation goals.  Other communication strategies that will be used to inform our community about this program will include a brochure, website, civic group and parent presentations, and eventually a DVD of personal success stories. 

 

TIMELINE

The AHS Nova Academy will begin second semester of the 2008‐09 academic year.

PROPOSED 2009 LEGISLATIVE PRIORITIES

Local Control

1. Number of LEAs per county—Maintain local control on the number of LEAs per county.

2. Calendar flexibility—Revise the public school calendar law to restore local flexibility. Reinstate the five teacher workdays which were eliminated in the calendar law changes of 2004 since those days are essential for professional development of school personnel. Adequate Funding

3. Funding formulas--Provide sufficient funds to guarantee that all funding formulas are fully funded.

4. Sales tax refund or exemption--Restore the sales tax refund for public schools or create a permanent exemption.

5. Testing/accountability personnel--Fully fund the LEA cost of administering the state testing program, including an LEA testing coordinator, school testing coordinators, and technical assistance.

6. Instructional technology and technology support personnel--Fully fund an LEA technology coordinator, school technology coordinators, and technical support staff in order to achieve 21st century learning goals.

Support for Public Schools 7. Employee benefits--Protect health insurance and retirement benefits

for public school employees. 8. Retired teachers—Reinstate legislation that sunsets June 30, 2009,

to allow LEAs to hire retired teachers. 9. ABC bonus pay—Determine a consistent process for awarding ABC

Asheboro City Schools 2007-2008 Sodexo Contract Adjustment

December 11, 2008 As discussed in the November Board meeting, the Asheboro City Schools Child Nutrition program experienced a loss of $134,384 during the 2007-2008 school year. For the same year Sodexo guaranteed Asheboro City Schools a profit of $10,000. Based on the contract, any difference between our loss and the $10,000 guarantee will be reimbursed to Asheboro City Schools. This reimbursement is limited to the amount of the Management Fee we paid to Sodexo during the year. The Management Fee Asheboro City Schools paid Sodexo for 2007-2008 was $94,626. Since the difference between the guarantee and the loss was greater than Sodexo’s Management Fee, Sodexo would reimburse Asheboro City Schools the entire Management Fee of $94,626 under normal operating conditions. Section 7H states that the guaranteed reimbursement is contingent on vendor pricing remaining constant throughout the year. Because vendor pricing increased by over 13% in 2007-2008, Sodexo is asking that the amount of the reimbursed guarantee be reduced. Instead of reimbursing the school system $94,626, Sodexo is requesting an adjustment to the reimbursement based on Section 7H of the contract. 2007-2008

Policy 3460: Graduation Requirements As recommended to the Board Policy Committee, October 9, 2008 This policy provides North Carolina requirements for high school graduation along with high school exit standards, local board requirements, and special circumstances that require approval by the superintendent. Revisions have been made that include replacing the words “senior project” with “graduation project.” A provision has also been added that allows students to graduate with fewer than 28 credits under criteria approved by the superintendent upon recommendation by the principal as long as the student meets all state graduation requirements and successfully completes a graduation project.

GRADUATION REQUIREMENTS Policy Code: 3460 The board recognizes the importance of setting rigorous graduation requirements in order to help ensure that students are receiving an education that will prepare them to be productive members of society. A. STATE REQUIREMENTS In order to graduate from high school, students will be required to meet the following requirements:

1. the minimum requirements of the state competency examination or other state-mandated exam of essential skills;

2. the high school exit standards (effective for freshman entering in 2006-07 who are taking the Career Prep Course of Study, the College Tech Prep Course of Study, or the College/University Prep Course of Study);

3. the minimum requirements of the state computer skills test;

4. successful completion of 20 course credits in the chosen course of study and all other course requirements mandated by the State Board of Education; and

5. successful completion of all additional course and other requirements mandated by the board of education.

B. HIGH SCHOOL EXIT STANDARDS

Beginning with students entering the 9th grade in 2006-07 who are taking the Career Prep Course of Study, the College Tech Prep Course of Study, or the College/University Prep Course of Study, students must meet the high school exit standards in order to graduate. The exit standards consist of the following requirements: 1. Students must receive a passing grade demonstrate proficiency on all of the

Students who do not receive a passing grade demonstrate proficiency on any of the five end-of-course tests will be provided retest opportunities as provided in board policy 3420, Student Promotion and Accountability.

2. Students must satisfactorily complete a senior graduation project. The

superintendent or the superintendent’s designee will develop, monitor and score the senior graduation projects, using state adopted rubrics. The superintendent or his/her designee may incorporate any senior graduation project requirements that are already in place in the district. In addition, requirements of the senior graduation project will include:

• a review process; • an eight to ten page research paper written on an approved topic of student

choice; • a product related to the paper that requires significant hours of work; • a portfolio that reflects the Senior Graduation Project process; • a presentation to a panel of community and faculty members; and • literature, service-based learning or work-based learning experiences as defined

by state models.

The superintendent or the superintendent’s designee will give special consideration to transfer students arriving in the second semester of the senior year.

C. LOCAL BOARD REQUIREMENTS

Students also are required to meet all graduation requirements of this board. All students must successfully complete the maximum number of units a student could earn in grades 9 through 12 minus four units. A total of 28 units must be earned, with course units required in the following courses:

English 4 Social Studies 3

(including government/economics, U.S. History and world studies)

Mathematics 4 (including high school algebra)

The principal is responsible for ensuring that parents and students are aware of all graduation requirements. The guidance program should assist students in planning their high school courses to help ensure that students are taking all of the required units and selecting electives consistent with their post-graduate plans. For students who have transferred to the school district during high school, or for other reasons have completed course work outside of the school district, the principal will determine what course work will be applied as credit for graduation.

The board also may require that students successfully complete additional graduation requirements, a research project or a community service project like that mentioned in board policy 3530, Citizenship. Students will be notified of any requirement at least by their junior year. Students who seek assistance or are identified as likely to need assistance in meeting an academic requirement must be provided opportunities for remedial or additional instruction in accordance with board policy 3420, Student Promotion and Accountability. Students whose academic projects do not meet the expected standard must be given additional opportunities to successfully complete the research project and additional opportunities for remedial instruction.

D. SPECIAL CIRCUMSTANCES

The board adopts the following policies to address special circumstances regarding graduation:

1. Honor graduates may be designated by the principal on the basis of criteria

established by the superintendent. Recognition of honor graduates may be included in graduation programs.

2. Graduation prior to that of one’s class may be permitted under criteria to be

approved by the superintendent, or designee, upon recommendation by the principal.

Students seeking to graduate with fewer than 28 credits may be permitted to do so under criteria approved by the superintendent, or designee, upon recommendation by the principal. These students shall meet all state graduation requirements and successfully complete a graduation project.

3. A graduation certificate will be awarded to students enrolled in programs for exceptional children who have not met the requirements on the state competency examinations if the students have successfully completed 20 course units by general subject area (four English, four math, three science, three social studies and one health and physical education) and their individualized education plan requirements. The certificates may be awarded at the regular graduation ceremony.

4. Special education students who are following the occupational course of study will not be required to pass the competency test or the high school exit standards in order to graduate and receive a diploma.

5. Students with Disabilities, other than students who are following the occupational

course of study, may apply in writing to the board to be exempted from taking the competency test. Before it approves the request, the board will ensure that the parents or the child if aged 18 or older, understand that the student must pass the competency test to receive a high school diploma.

6. Other students who have met course requirements for graduation but have not

passed the minimum competency test will receive a certificate of achievement and transcript and will be allowed to participate in graduation exercises. These students will be encouraged to continue to work toward satisfying the requirements of graduation and earning the diploma until the students reach maximum school age.

The relationship between staff and students should be one of cooperation, understanding and mutual respect. The staff has the responsibility to provide an atmosphere conducive to learning and to motivate each student to perform to his or her capacity. The staff is expected to model the behavior expected of students in staff-student relationships. All employees, except student employees, are prohibited from dating, courting or entering into a romantic or sexual relationship with any student enrolled in the school district regardless of the student's age. Employees engaging in such inappropriate conduct will be subject to disciplinary action, up to and including dismissal. All employees are prohibited from sexual harassment (see policy 1736, Sexual Harassment Defined). Any employee who has reason to believe that another employee is inappropriately involved with a student, as described above, will report this information to the superintendent. An employee who fails to inform the superintendent of a suspected inappropriate relationship between an employee and a student may be subject to disciplinary action, up to and including dismissal. For the purposes of this policy, the term “employees” includes independent contractors and school safety officers but does not include student employees. Policy 4240: Child Abuse – Reports and Investigations As recommended to the Board Policy Committee, October 9, 2008 Additions have been made to this policy so that it is in compliance with North Carolina General Statute regarding reports and investigations of child abuse. Now included in the legal requirement for school employees to report suspected child abuse is the addition of “neglect, dependency or death as a result of maltreatment.” In such cases, reports must be made without delay. Additionally, a confidentiality statement has been added that clarifies the extent to which the school district may share information that is relevant to the report with other agencies.

CHILD ABUSE - REPORTS AND INVESTIGATIONS Policy Code: 4240 The board of education supports all employees who make a report of child abuse, neglect, dependency or death as a result of maltreatment in good faith.

Any school employee who knows or has cause to suspect child abuse, neglect, dependency or death as a result of maltreatment is legally required to report the case of the child to the director of social services. The employee also will shall report the case immediately to the principal.

Any doubt about reporting a suspected situation will shall be resolved in favor of reporting and the report will shall be made immediately. A school employee is immune by statute from any civil and/or criminal liability when reporting in good faith suspected child abuse, neglect, dependency or death as a result of maltreatment. Failure on the part of any school employee to report may result in disciplinary action being brought against the employee by the school district or civil action under the law.

The principal may establish a contact person in the school to act as a liaison with social services; however if the liaison is not available when a report is necessary the immediacy is still in effect and the reporting must not be delayed. All employees will shall cooperate fully with the department of social services in their investigation of suspected child abuse, neglect, dependency or death as a result of maltreatment, including permitting the child to be interviewed by social services on school campuses during school hours and providing confidential information, so long as the disclosure does not violate state or federal law. Any confidential information disclosed by the department of social services to employees shall remain confidential and shall only be redisclosed for purposes directly connected with carrying out the responsibilities of the school or the employee. Upon request and to the extent permitted by law, the school district shall share with other agencies designated in G.S. 7B-3100(a), information that is relevant (1) to any assessment of a report of child abuse, neglect, dependency or death as a result of maltreatment by the department of social services; (2) to the provision or arrangement of protective services in a child abuse, neglect, dependency or death as a result of maltreatment case by the department of social services; or (3) to any case in which a petition is filed alleging that a juvenile is abused, neglected, dependent, undisciplined or delinquent. The school district and designated agencies must continue to share such information until the protective services case is closed by the department of social services or, if a petition is filed, until the juvenile is no longer subject to the jurisdiction of juvenile court.

The superintendent will shall develop any necessary procedures for reporting suspected child abuse, neglect, dependency or death as a result of maltreatment and for cooperating with investigations by the department of social services. The board encourages staff development opportunities related to identifying and reporting child abuse, neglect, dependency or death a s a result of maltreatment.

NORTH CAROLINA ADDRESS CONFIDENTIALITY PROGRAM Policy Code: 4250/5075/7316 The board seeks to provide a work and school environment free from violence or the threat of violence against employees, students or other persons. The board encourages eligible individuals to participate in the North Carolina Address Confidentiality Program established pursuant to Chapter 15C of the General Statutes. This program protects the address of relocated victims of domestic violence, sexual offense, stalking or human trafficking to prevent a victim’s assailants or potential assailants from finding the victim through public records. The program provides participants with the use of a substitute mailing address and denies public access to a participant’s actual address. A. PROGRAM DETAILS

The Address Confidentiality Program is administered by the State Attorney General. Information and assistance in applying to the program can be obtained by telephone from the Attorney General’s Address Confidentiality Program Office at (919) 716-6785. Program participants receive an authorization card with a substitute mailing address that can be presented whenever an address is required. Mail sent to the substitute address is forwarded cost-free by the program to the participant at his or her residential address.

B. SCHOOL PERSONNEL PARTICIPANTS

The name, actual address and telephone number of any school system personnel participating in the Address Confidentiality Program shall not be open to inspection as a public record, shall not be included as part of any employee directory published by the school system and shall be redacted from any record released pursuant to G.S. 115C-320. (See policies 5070, Public Records, and 7820, Personnel Files.)

C. STUDENT PARTICIPANTS

The school system shall use the actual address of a program participant, not the substitute address designated by the Attorney General, for any purpose related to admission or assignment but shall keep the actual address confidential from the public. Student records shall reflect only the substitute address and not the student’s actual address. The student’s telephone number also shall be kept confidential from the public. The parent or guardian of a student participant may request that a student’s name be withheld from any release of directory information by the school, as provided in policy 1310/4002, Parental Involvement.

When transferring school records from one school to another, the transferring school may send the files to the participant (parent or guardian) via the substitute address provided by the Address Confidentiality Program to ensure confidentiality of the student’s new location.
