    BACKGROUNDThis easement was issued for a 30-year term, commencing July 1, 2012 and expiring June 30, 2042, for an access road andsurface 10-inch or less gas gathering pipeline. The easement contained approximately 6.26 acres.

    NARRATIVEThe applicant has requested that the easement be amended to allow for an additional access road and an additional pipelinecorridor. The majority of the road and pipelines have already been constructed under mineral lease. Short segments will now beconstructed to connect the existing facilities to a proposed well on adjacent federal property. This easement is necessarybecause the facilities will now carry off-lease product. The pipeline corridor would contain up to four (4) lines (one (1), 12-inch orless natural gas pipeline; one (1), 8-inch or less water pipeline; one (1), 4-inch or less residue pipeline; and one (1), 8-inch orless fresh water/completion water pipeline). The gas and residue lines will be surface installed, and the water pipelines will beburied and installed at a later date if they become necessary. The additional access road easement is approximately 6,671.66feet long and 30 feet wide, containing approximately 4.60 acres. The additional pipeline corridor easement is approximately6,642.30 feet long and 30 feet wide, containing approximately 4.58 acres.

    The project area has been surveyed for cultural resources by MOAC (U19MQ0192). No cultural resources were located on trustland. The amendment can be considered cleared for cultural resources with a finding of "No Historic Properties."

    The project area was previously reviewed by the Resource Development Coordinating Committee ("RDCC") (see ESMT 1771).Comments were received as follows:

    Uintah County(Applicant should) contact Uintah County's Community Development Department for the necessary County permits and theUintah County Road Department for permits and regulations when crossing County roads.

    Utah Geological Survey Paleontology SectionAlthough there are no paleontological localities recorded in our files for this project area, the Eocene Duchesne River Formationthat is exposed here has the potential for yielding significant vertebrate fossil localities. The office of the State Paleontologisttherefore recommends that a paleontological survey be conducted for this project and its easements by a paleontologist with avalid permit.

    The project area was surveyed for paleontological resources by Uinta Paleo (report dated June 3, 2019). Reportrecommendations are as follows:

    If Tertiary bedrock of the Brennan Basin Member of the Duchesne River Formation is impacted during ground disturbance onthis project, it should be spot checked for fossil resources. The bedrock is sandstone and mudstone that may have a clayeysurface. If there is a dramatic color change, that should also be checked for fossils. If significant vertebrate fossils are

    BACKGROUNDOn July 12, 2019, the applicant submitted the subject application to purchase an easement for an existing power line.

    The application was submitted for Trust review on July 17, 2019, and was accepted by the Director on August 9, 2019.

    Because the proposed easement is for an existing facility, it is exempt from review by the Resource Development CoordinatingCommittee ("RDCC").

    NARRATIVEThe applicant proposes to operate, repair and maintain an existing power line within the Grantsville and I-80 Blocks. Theexisting power line is known as the Grantsville-Marblehead 46kV transmission line and was originally authorized by ESMT 777(U-25608). The original easement will expire December 31, 2019, and the applicant has requested this replacement easement.The line is authorized by ROW 540 across other adjacent trust lands. The proposed easement is approximately 46,107.2 feetlong and 60 feet wide, containing approximately 63.52 acres. The requested term of the easement is perpetual, allowable uponpayment of a rental premium per a settlement agreement between the applicant and the Trust.

    BACKGROUNDPROPOSED ACTION:The applicant desires to lease this land for the construction and operation of a plant that will extract lithium and other metalsfrom brine and for a disposal well to dispose of the spent brine. The brine will come from a well or wells on lands managed bythe Bureau of Land Management ("BLM").

    RELEVANT FACTUAL BACKGROUND:The applicant, A1 Lithium, Inc., holds unpatented placer claims in the area. The applicant submitted an application to lease trustland on May 20, 2019.

    NARRATIVEThe proposed lease was submitted to the Resource Development Coordination Committee ("RDCC"). Through that process,Utah State Parks expressed concerns about the impact of the proposed lease activities on visitors at Dead Horse Point StatePark. A1 Lithium met with State Parks, the School and Institutional Trust Lands Administration ("SITLA") and the Public LandsPolicy Coordinating Office. A1 Lithium addressed State Parks' concerns and has agreed to provide information to State Parks toshare with visitors who may have questions about the project. In accordance with R850-30-500-2(a) an advertisement was placed in the Moab Times Independent for three (3) consecutiveweeks soliciting competing applications. None were received. Notice of the proposed lease was also given to adjoininglandowners and lessees.

    R850-30-400 requires that the Trust receive at least fair-market value for surface leases. The annual lease payment of$15,000.00 per year meets the fair-market value requirements established by rule. In addition to the annual rent, the lessee willpay $0.15 per barrel for water disposed of in the disposal well. The disposal fee is based on comparisons with other leases thatallow for water disposal.

    The applicant requested a term of 30 years. This term is within the standard term for this type of lease as described in R850-30-200. The lease will be reviewed every five (5) years. As part of the lease reviews, the annual rent and disposal fees may beadjusted by either calculating adjustment of the Consumer Price Index ("CPI") or a fair market value determination based onappraisal or other comparisons.

    FINANCIAL/REVENUEThe project cost on trust lands is valued at $5,200.00. Because the applicant is not the permittee of record, the project will notbe eligible for amortization. Note: the life of the project (the benefit) is 10 years.

    NARRATIVEThis range improvement is in compliance with R850-50-1100(5)(a) and (b). The project does enhance the value of the resourcespursuant to R850-50-1100(5)(c).

    FINANCIAL/REVENUEEstimated cost/value of the project is $8,417.00 with $1,041.66 being provided by the applicant and the remaining portionprovided by WRI and GIP. The applicant’s portion will be amortized as shown below.
