NOTICE FOR THE ANNUAL GENERAL BODY MEETING

The Annual General Body Meeting of the Association of Medical Consultants, Mumbai shall be held on th

1) Condolences.

2) To appoint 2 Returning Officers for the elections to the new Managing Committee for the year 2016-2017

3) To conduct the elections simultaneously with the AGMth4) To read and confirm the minutes of the Annual General Body Meeting held on the 29 of March 2015 at

PRESIDENT REPORTDear Friends,Time flies and it is only for us to watch how beautifully it does. It only seems yesterday I was penning my thoughts for action for the year ahead and yet I am here today penning my report card of the year gone by. I embarked on a

thjourney as a leader of one of the most vibrant and powerful medical organizations of the country on the 29 of March 2015 and it will be with a sense of relief and fulfillment that I will be handing over charge to the incoming

thPresident Dr. Veena Pandit on the 27 of March 2016.

The year began with an incident which really rattled a lot of us. A young physician in a nursing home in Panvel was assaulted brutally by the relatives of a patient who died inspite of receiving the best possible care and surviving for 21 days in the ICU. There was a strike by the local doctors to protest against this brutal assault and we at AMC led a delegation to the Police Commissioner of Navi Mumbai and the accused were arrested and the stringent provisions of the Medicare Act (Prevention of Violence against Medical Personnel act) were slapped against them.

A decision was taken to form the “Zonal Crisis Management Task force” in all zones of AMC comprising of senior doctors both from AMC and the local medical associations to ensure that members facing the risk of physical violence or any other mob threat could immediately ask for help and senior doctors from this task force will rush to provide assistance to reduce the threat. I am glad to inform you that the task force is active in all zones and this preventive action has averted the threat of violence in several cases across the city. We also decided to enroll the services of a security agency TOPSLINE which has promised to send a team of security officers to any member who enrolls with them (in the city of Mumbai and specified areas of the periphery Thane Mira Road, Bhayander and parts of Navi Mumbai) and who asks for help by calling on one number 1252. This service is free of charge to all the members of the Professional indemnity scheme and available at a nominal charge of Rs.600 per year to all other members. This initiative of our association received world-wide attention and I am glad to inform you that the Los Angeles Times covered this story in one of their editions.

We organized a panel discussion as AMC Zonal Meet 1 on “Attack on doctors-Are we soft targets”? at Vashi on the 26th of April 2015. The panelists were the Police Commissioner Mr K.L.Prasad, CEO of Zee Marathi, Dr Uday Nirgudkar, The Local MLA .Mr Patil Advocate Amit Karkhanis and our own Dr Lalit Kapoor. The panel was moderated by Dr Bipin Pandit and Dr Prakash Patil. The program was well attended by over 300 doctors and the message was given that AMC has adopted a policy of Zero tolerance to violence against doctors.

The next program was the Doctors Day celebrations and this year the Theme was “Cancer Prevention and early thdetection”. We had a full day activity on this on this theme at the Inorbit Mall Malad on the 28 of June 2015 and

the day culminated with an enthralling performance by noted percussionist Sivamani and his artist wife Runa Rizvi. The Central atrium of Inorbit Mall was packed with almost 4000 people during this performance and the positive buzz which this program generated among the public was amazing. This was the first time that AMC

We conducted a workshop on 'Medico Legal issues in Clinical Practice' at Mira road on Sunday 14 June 2015 in collaboration with the Wockhardt hospital. The registrations for this program were so overwhelming that in fact they had to be stopped 2 days prior to the event. The workshop included a talk by Dr Lalit Kapoor's on 'Common Medico Legal issues in Clinical practice”. This was followed by Dr Niranjan Agarwal's talk on 'Growing Intolerance towards Medical Outcome in Society'. Mr Jehangir Gai's deliberations on 'Recovering Hospital bills' got a keen hearing from the delegates. A panel discussion on 'Death in Clinical Practice' with Dr Avinash Supe, Dr Suganthi Iyer, Advocates Rajendra Sorankar Ashish Chavan consumer activist Jehangir Gai and Politician, social worker cum chairman of the Umrao Hospital Trust Mr Muzaffar and DySP Mr Suhas Bavche as the panellists and moderated by Dr Niranjan Agarwal and Dr Ashok Shukla rounded of the day.

reached out to the masses and the message that Cancer can be prevented and early detection saves lives was given to the public. A small booklet for patient education on the subject was also released on that day. We also

thhad a program on the 5 of July at the Courtyard Marriott Andheri with Mr Nilesh Shah the CEO of Kotak Mutual fund addressing doctors on the “Equity market in India in the coming decade” and a session on “Stand-up Comedy” by artists from the Laughter Canvas Club”.

thA Zonal Meet 3 was organised on 9 August 2015 at Evershine Banquets, Goregaon West, wherein the prime attraction was the panel Discussion on “Legal Issues In Nursing home Practice”. Additional Commisioner of Police Fateh Sinh Patilji, the local MLA Yogesh Sagarji. Adv Piyush Shah Dr Revankar and Dr Lalit Kapoor were the panelists. The Addl. CP invited coordination of doctors groups with their respective Police station Officers to enable the police to help doctors facing issues of mob violence. Adv Piyush Shah offered his expert help to interpret the Judgment regarding Shop & establishment Act.

thAMCON 2015 was held on the 29 of November 2016 at the Taj Land's End hotel. It was a well-attended program and the show stopper was of course the Panel discussion on “Impact of recent court judgments- Should there be a capping of the compensations awarded for medical negligence?” The panelists included the recently retired Chief Justice of the Bombay High Court Justice Mohit Shah, eminent lawyer Rui Rodrigues, medicolegal expert Dr Neeraj Nagpal, Dr Alok Kumar from the MCI and it was superbly moderated by Dr Lalit Kapoor the doyen of the Medicolegal cell of AMC. We will be consulting our legal experts to seek ways to bring in capping of the compensations awarded which we feel will surely add to the costs of medical care and make it unaffordable for the masses and make doctors practice defensive medicine. We were honoured by the presence of Shri Ahmed Javed the Police Commissioner of Mumbai who addressed us on “Handling an unruly mob in the OPD” and answered questions regarding attacks on doctors and how the law could protect us. He also released the “Medicolegal Manual for the Police” an AMC publication which is a compilation of all relevant medico-legal acts and case reports. We have distributed the manual across several police stations of the city and adjoining areas including Raigad and this has been widely appreciated by the police. This compilation has been the result of the hard work of our Treasurer Dr Vipin Checker. Shri Ramadorai the Advisor to the Prime Minister on the National Skill Development Council delivered the Dr C.L.Jhaveri oration. The program ended with a debate on the 'Role of the media in affecting doctor patient relationship”. The media was well represented by Malti Iyer from the Times of India, Miss Somita Pal from the DNA Newspaper and Mr Thatte a freelance journalist and the doctor's perspective was highlighted by Dr Ashok Kriplani and Dr Arshad Ghulam along with Advocate Yogesh Naidu.

We are all aware that the medical profession is under attack from all and sundry. Actors, the media politicians and disgruntled patients all have many harsh words for our profession. To deliberate on the reasons and to make an attempt to reclaim the dignity of the profession we had a program in collaboration with the Global Forum for

rdEthics and Spirituality in Medicine (GFESH) on the 3 of January 2016 at the J.W. Marriott hotel Juhu Mumbai. The conference had an oration from His holiness Swami Radhanathji from ISKON.

stThe 21 Century has been the era of Information technology. Information technology has changed our lives in more ways than we could have imagined at the turn of the century. It is expected to help the healthcare industry to lower costs, improve efficiency and reduce errors, while also providing better consumer care and service. The Government of India under the able leadership of Prime Minister Narendra Modi has visualized a dream of a “Digital India” and we as healthcare professionals cannot disappoint him and it should be our endeavor to use Information technology for optimum utilization of human resources to ensure healthcare for even the remote villages in our country. On an individual level many doctors have been using IT for providing better services for themselves and for their patients. But we need to accept that many senior doctors still are “Technologically challenged” In order to help our members to keep pace with technology and leverage its use for providing better

stservices for our patients AMC in collaboration with the Thakur College of Management studies organized the 1

th stever Conference "Leveraging Information Technology for Better Healthcare" on the 20 and 21 of February 2016. It was a pathbreaker towards better coordination between the IT professionals and Healthcare

thprofessionals to help society in general. The conference on the 20 of February had lectures on cybercrime, the National E health authority and a panel discussion with participation from doctors the government and IT

stprofessionals. The 21 of February had hands-on workshops on basics of IT, digital marketing, netbanking and online trading. This entire program was well appreciated by all members and we have demands to repeat the same in the near future for the benefit of those who missed it.

stWe had another program on the 21 of February 2016 at the Ramkrishna Mission Hospital Mumbai on “Newer Imaging modalities in Medicine”. Apart from the brilliant academics the highlight of the program was that it was graced by the presence of Dr Sekhar Basu the Director of Bhabha Atomic Reasearch Centre Mumbai and Chairman Atomic Energy Commission. The program was attended by over 350 delegates and full credit to Dr Ajit Desai for organizing this wonderful program.

At the inaugural address I had announced a desire to bring together all stake holders in the field of medical education on one platform with an intention to arrive at a consensus on the future of medical education in our country in general and state in particular. With this intent in mind we had a program called “Aarogya Manthan”

th on the 5 of March 2016 at the Y B Chavan Auditorium opposite Mantralaya. It included representatives from the MCI, MMC, Maharashtra University of Health Sciences, Deans of various medical colleges, Heads of Medical Education units of all medical colleges, senior teachers both present and retired, representatives from the students and also our own senior AMC members. This brain storming session was conducted under the watchful eyes of the Union Minister of State for health Mr Shripad Naik. We will collate the suggestions and the deliberations into the form of a consensus report and send it to the Union Government and State government as our humble attempt to suggest the road ahead of Medical education in 2016. Our Joint Treasurer Dr Sushmita Bhatnagar did a brilliant job of getting together all stake holders and with able assistance from Dr Umesh Oza we were able to ensure a free and frank exchange of ideas.

Friends you are aware that the Medico-legal cell of AMC is the most vibrant cell of the organisation. Under the able guidance of Dr Lalit Kapoor it has provided yeoman services to members facing various medico-legal issues. The professional indemnity scheme of this cell has been one of the finest available in the country. After analyzing the changes in the insurance industry with the advent of several private players we were able to negotiate with Oriental Insurance our insurance provider for better financial terms. The Extraordinary General body meeting of

ththe Cell held on the 11 of February 2016 approved the shift to a common master policy with a single renewal date for all 5000 members of the scheme. We were also happy to announce that all members of this scheme would be given an additional cover of 25% of the sum insured as a complimentary offer by the Association. This offer would be without any increase in the fees paid and is available to all members with immediate effect. In view of the rising incidence of litigations against doctors and the increasing payouts granted by the courts AMC recommends that all members should increase their sum insured to at least 1 crore. A part of the financial benefits offered by Oriental insurance is being retained by the association to create a contingency fund for the members of this scheme.

Friends Team AMC 2015-16 sincerely thanks all members for their cooperation by attending the programs organized in large numbers and expressing support to the association whenever required. This was reflected in

th the cooperation from all members who abstained from non- emergency radiological work on Dec 8 2015 following a call from the association which was given with an intent to draw the attention of the government to make urgent changes in the PcPNDT act to prevent unnecessary harassment of doctors for minor clerical errors.

I would be failing in my duty if I fail to acknowledge the support and cooperation from all my office bearers and my

committee. My Hon Secretary Dr Mukesh Gupta was as usual dashing and energetic, my Treasurer Dr Vipin Checker, (ably assisted by Dr Vivek Dwivedi Joint Treasurer) was brilliant with the accounts and in addition he was the brains behind the “Medicolegal Manual for the police”. Dr Sushmita Bhatnagar and Dr Ashok Shukla performed their roles as joint Secretaries with a lot of flair. Dr Veena Pandit our President Elect, Dr Sangeeta Pikale our IPP and my Vice Presidents Dr Pradeep Baliga and Dr Smita Sharma were people whom I could turn to whenever I needed any help or advice. Our Editor Dr Nitin Rao delivered 4 brilliant editions of “The Grasp”. My committee members, our Chairpersons of various cells, AMC India Director Dr Kapoor, Zonal Directors and the

Trustees gave me a free hand to take decisions whenever required. Finally all our office staff Rabiya, Pramila, Kamlesh ,Sagar, Vandana, Pranali, Mrs Jyothi Bhosale and Ramdas all cooperated beautifully to ensure a smooth running of the office.

I have already stated earlier but would like to reiterate “All accolades if any should be reserved for my Team AMC 2015-16 and brickbats are solely for me”. If I have failed in my duty as President in any way or missed out in acknowledging help from any quarter I humbly beg for forgiveness.

been attending AMC programs our main channels of detailed communication besides the Website. I take this

opportunity to share my experiences.

In the Last 11 months as Secretary of AMC and the ensuing 1 months left ahead I have realised and learned some

aspects of life which only could have happened by working in this organisation. In last almost decade and a half of

my association with the organisation and having worked closely as active member of the committee under last 11

presidents, it is nothing but a master class in Life. Be it professionalism, relationship management, zeal to keep

the interest of fellow colleagues at the forefront, dealing and liasoning with the regulatory authorities to achieve

the rightful outcome to secure the ethical and professional rights of our members, power of group dealing for

achieving the most advantageous outcome for association and the members.....and many more such skills can be

enlisted. Last but not the least it was nothing but humble pleasure working with our present President Dr Sudhir

Naik who has the ability to go against all odds for the benefit of the AMCites and capability to pursue and finish the

projects undertaken. He gave the committee members especially me, full freedom to come up with out of the box

ideas and suggestions which on merits of practical implement ability were adopted and pursued. A true leader is

the one who makes the team feel wanted and is able to extract the best out of all team members. This is the legacy

he has followed and left behind.

Insurance deadlock: When dealing with Insurance companies and authorities under the Team NOAH AMC

regarding the cashless deadlock we realised that it is not just the need of health care providers but there is also

industry driven need to partner together but only thing coming in the way is the approach of insurance

companies to squeeze us consultants and nursing home owners to enable them to bring their claims ratios down.

It will be extremely difficult for our members to survive if we agree to the rates on offer. The interactions with

private insurance sectors especially Bajaj Alliance group was quite heartening.

Violence on Doctors: the year started with spate of violent episodes which was dealt by interacting with the

senior Police officials, creating Zonal Task Force Committees, Mobile App with Emergency button, Tie up with

Topsline security services. Session on Ethics and communication to work on primary prevention of such situation

was also thought of and program organised with partnering GFESH.

Ongoing AMC schemes: It is perceived that it is difficult to improve on excellence. Such amazing products created

by years of efforts by our seniors can hardly be altered with. So we focused on improving the service and worked

on improving the return of investments. Meetings and discussions with our brokers, Agents, Feedbacks from

members, guidance from chairmen and advisors and past chairmen of the schemes were taken. Review of

existing market changes especially the thrust in the sector by private companies and large broking houses was

done culminating into making our existing schemes of Professional Indemnity more cost effective for members

without altering the functioning and facilities.

Value addition and Reaching out : Continuing with the tradition of working for overall welfare of the medical

professionals previous activities were continued with some new flavours added. AMC program at the Inorbit mall

which saw footfall of 40,000 patrons at the mall, Cancer awareness activities, Mentorship programs for post

graduate consultants, Program on Ethics and communication, release of books on Cancer awareness and

common medical practice related laws, Forthcoming events on IT in Health care, Brainstorming on Medical

Education reforms etc were some important activities .

I thank all my seniors, fellow committee members, all trustees especially managing trustee for the constant

support and guidance. In the course of my working at the AMC I had opportunities to intellectually interact

personally with more than 20 past presidents of AMC and several more who could have taken up the mantle but

chose to work in other capacities, which brought to light a fact that wherever they are,in whatever capacity they

engage with the organisation ,they may have long left the post but their passion for AMC is forever burning. AMC

looks forward for passionate young talents with fire in the belly to do more in their life besides professional

excellence. If any of you out there feel that you can contribute to your fraternity in some way ...please join this

elite group of active AMCites. Elections are just a democratic way of creating systematic non bias platform but

individuals with true interest of fellow colleagues at heart are always welcomed at AMC team with open arms.

Minutes of the Annual General Body Meeting - 2015thThe Annual General Body Meeting of the Association of Medical Consultants was held on 29 March 2015 at

Grand Sarovar, Goregaon (West), Mumbai.

The Honorary Secretary Dr. Vipin Checker announced the commencement of the meeting at 5 pm but it was adjourned for 15 minutes due to lack of quorum. It was reconvened at 5.15 pm.

The house observed silence of 2 minutes as a mark of respect for the departed members.

2) To appoint 2 Returning Officers Dr. Dilip Naik & Dr. Shrikant Badwe for the elections to the new Managing Committee for the year 2015-2016: Dr. Vipin Checker introduced and welcomed Dr. Dilip Naik and Dr. Shrikant Badwe. 3) To conduct the elections simultaneously with the AGM: Dr. Dilip Naik explained the Election procedure in detail. He said that campaigning would not be permitted inside the hotel. Dr. Lalit Kapoor said that the venue needs to be discussed - whether it means the building where the elections are undertaken or includes the adjoining area.Dr. Umesh Oza said that they could campaign outside the building and that a discussion should take place before the next elections.

rd4) To read and confirm the minutes of the Annual General Body Meeting held on the 23 of March 2014 at Mumbai Cricket Association, Bandra, BMC. : The minutes had been circulated earlier. They were accepted and passed.Proposed by Dr. Ajit DesaiSeconded by Dr. Bipin Shah

5) Business arising out of the minutes : Submission of constitution. Dr. Sangeeta Pikale said that a significant amount of work has been done. She said that Advocate Jagtap needs more information and that Dr. Ashok Shukla would follow up.Dr. Sujata Rao said that the book had been announced in the last AGM. It was released at AMCON.Dr. Sangeeta Pikale said that guidelines have been created for joint programmes with any other association. Dr. Sudhir Naik endorsed the same.Dr. Bipin Shah said that there should be clarification if anyone uses the AMC PAN Card. Dr. Sujata Rao said that this has been decided.

6) To read the minutes of the AGM of various cells - Health and Accident cell Medico Legal Cell, Social Service Cell, Media Communication Cell, MMC Interaction Cell, Consultant Benevolent Scheme Cell, AMC NoAH Cell, Affiliate Unit Cell: Dr. Sangeeta Pikale said that the reports are in the AMC booklet. The reports were accepted.Proposed by Dr. Suhas Kate.seconded by Dr Oza

7) To receive and adopt the audited balance sheets and the income expenditure statements for the year 2014 - 2015: This is a part of AGM Report and has been circulated. They were accepted by the house.Proposed by Dr. G.B. KulkarniSeconded by Dr. G. Tomar.

8) To appoint Auditors for the year 2015 - 2016 : Dr. Sangeeta Pikale said that Mr Jokhakar our auditor team has done their work correctly the treasurer and OB agreed and they were reappointed.

9) To recommend the names proposed by the Managing Committee for various posts :A) Chairman of Public Relations cell Dr. Rajesh Dave continues in his position as he has not completed his tenure.B) Dr. Sangeeta Pikale said that Dr. Suresh Rao, Chairman H&A Cell has done a brilliant term. He has informed the managing committee that he would continue to help. Dr. Suhas Kate would take over the responsibility of the H&A Cell. Dr. Umesh Oza said that Dr. Suresh Rao has done a lot of work and that this should be minuted. He said that Dr. Suresh Rao would be advisor to the cell. The entire AGM acknowledged Dr. Suresh Rao.

C) Chairman of CBS Cell - Dr. Bipin Shah has completed two terms and would continue, as resolved by the managing committee.D) Chairman of Affiliate Unit Cell - it was ratified that Dr. Kishore Adyanthaya be reappointed.Chairman NoAH Dr. Niranjan Agarwal's name has been recommended by the managing committee as Dr. Sudhir was the President , This was ratified. E) Dr. Bipin Pandit has completed 2 terms as Trustee and has been reappointed as resolved by the managing committee.F) Director of AMC India. Dr. Lalit Kapoor ratified G) Dr. Shrikant Badwe, Trustee is eligible for reappointment and his reappointment was ratified.H) Dr. Umesh Oza has completed one term as Trustee. A correction was made in the notice which mentions 2 terms. Dr. Oza was reappointed.I) Trustee - To consider the reappointment of Dr. Suhas Kate. This was ratified.Dr. Sangeeta Pikale thanked the Trustees for taking up the responsibility.Proposed by Dr. Vivek ShethSeconded by Dr. Wagle.

10) To inform the house and discuss about NAT HEALTH & CII - representing AMC: Dr. Sangeeta Pikale discussed NAT HEALTH. She said that she had a very active interaction with many stakeholders at the Nathealth Summit where the the Government officials were present, She further mentioned that NatHealth was actively trying to become a strong stakeholder in policy decisions for healthcare. She thanked Dr. Suhas Shah for actively interfacing with Nathealth. Dr Pikale also informed the house that Her representation at the CII where she gave a very positive possibility of payer provider partnership was well received . AMC has made commendable representation on both these forums this year .

11) To receive and adopt the reports of the various cells of the Association prepared by the Managing Committee : These were adopted. 12) To propose sending the Annual Report by email to all members and hard copy only on request : Dr. Sangeeta Pikale said Rs. 13 to 14 Lakhs are spent on courier and stationery. There has been a discussion about this. Out of 8000 members, 200 want e copies. The rest are yet to respond.Dr. Anil Suchak said that those who request hard copies should get them, others should get soft copies. Dr. Sudhir Naik said that it had not been passed so it has been put up again on the Agenda. He said that The Grasp being the face of AMC should be as hard copy as it serves many purposes when on the table. Dr. Rashmi Mehta said that the Grasp copies go to the old paper stores and can be read by anyone, which should not be the case. Dr. Bipin Pandit participated in the discussion.

Dr. Deepak Baid said that email may bounce so an update is needed. Dr. Sangeeta Pikale said that we will start it. It was decided that henceforth the Annual Report would go as soft copy.Dr. Jyoti Taskar asked about the election notice. She suggested that it should go as hard copy. The house said that this notice could go with The Grasp, which could be sent a little later than it as at present.Dr. Ajit Desai said that if there are e copies of reports there would be no hard copies. It was decided that 50 to 100 copies should be printed for the office and meetings.

13) Enrollment of new members for the year 2014 - 2015: Dr. Sangeeta Pikale said that there are 324 new members which brings the membership strength to 8400.

Dr. Jyoti Taskar said that as per the constitution Thane District is in the jurisdiction of AMC. Thane District has th

been divided into Thane and Palghar Districts w.e.f. 15 August 2014, hence the membership from these areas has to be organized in order to be in accordance with the government.

Dr. Sudhir Naik said that there is a need to revisit this issue.Dr. Wagle asked about the representation from Thane.Dr. Bipin Pandit and Dr. Umesh Oza said that there should be deliberation. Dr. Sujata Rao said that Dr. Vivek Sheth had said in the managing committee that though his area Raigad has been included in Navi Mumbai, it should be redefined. Dr. Checker said that he would give the area wise representation in detail.Dr. Sudhir Naik asked if we need to increase the managing committee member strength. Dr. Bipin Pandit and Dr. Wagle said that this would not be required. The ratio should be changed.

16) Any other matter with the Permission of the Chair pertaining to aims and objections of the Association: Dr. Wagle asked about programmes in the neighbouring states. Dr. Kishore Adyanthaya said that AMC Mangalore has 150 - 160 members. The managing committee meets every Wednesday. There are plenty of medico-legal matters. Bengaluru has around 50 members, Kolhapur too.

Dr. Sangeeta Pikale said that the programme committee this year is leaving behind Rs. 18 Lakhs. She proposed that at least 5 lakhs out of this could be used for the media communication cell. She said that we should have networking with other organisations and governments which is vital so we can create an active strong possibility to impress on the government and public at large regarding issues faced by doctors and medical fraternity at large.She made a strong mention that both social service cell and Media communication cell cannot function without funds and then are paralysed .Dr. Kate said that 25 % could be for the association. Dr Kapoor denied fund allocation and demanded the discussion in trust board prior to AGM.Dr. Umesh Oza said that the proposal should be made and taken up by the Managing committee which can give funding.Dr. Niranjan Agarwal said that in his Presidential Year he had taken it up. He said that there are programmes in Karnataka and Kolhapur. It is not paucity of funds that prevents more programmes. He said that there is an initial excitement which later goes down. In Nagpur and Solapur a few local bodies prevent AMC formation. He said that a federation – FOMA could be formed.Dr. Sangeeta Pikale said that she had got in touch with doctors in Kerala. She said that we will have to reinvent FOMA. This year an attempt was made with Mira-Bhayander Association, MARD , etc Dr. Sujata Rao agreed with Dr. Niranjan Agarwal. She said that many people were interested in places where her CEA Awareness talks were hosted. Dr. Lalit Kapoor said that we should have a common interest. He said that local people ask about the need for AMC. He said that he was in Kolkata the previous day to give a talk to Dermatologist (Aesthetic Procedure Practitioners). He said that professional indemnity does not include this group, but our policy includes them with an additional fee. He said that we should get 25 consultants to apply to AMC, then others will join.Dr. Bipin Pandit said that in his experience most areas are dominated by IMA where there are GPs and Consultants. He said that GPs fear that they may not get anything if Consultants form a group e.g. Solapur, where they feel that AMC is not needed. He said that there should a way to convince them about the increase in Medico

Legal issues. Dr. Sudhir Naik said that when CEA comes and becomes applicable to single units it will happen. Dr. Anil Suchak said that he is active in IMA too. He said that Medico Legal cases come to IMA. As there are more cases now the importance of AMC should increase. He said that we should be able to make a niche in all places. Dr. Debashish Das said that it is not the family physicians but consultants who oppose.It was discussed that just as IMA has autonomy at various levels we should have the same. The need to actively work on AMC India project was expressed by all.

Dr. Suchak said that only a few people feel threatened and that we need to identify them, he was speaking in response to a mention that IMA was actively opposing AMC.Dr. Niranjan Agarwal said that each affiliate unit has a separate President, Secretary, Treasurer and that they have enough autonomy, but unfortunately there are not many in private practice but in hospitals – e.g. Ajmer and Dharwad. He said that when we go to make a presentation they are very happy but their enthusiasm immediately subsides as there is resistance from seniors.Dr. Das said that like Dr. Kishore Adyanthaya in Mangalore we should identify people individually to work. Dr. G. B. Kulkarni said that they should be able to speak the same language. Dr. Tomar said that we are growing and we should change the way we conduct the elections. He said that it is grossly unfair to those who cannot attend. He suggested e-voting and said that it would be proper voting.

Dr. Sangeeta Pikale said that we should take the decision as this has been discussed many times where majority are now in agreement.Dr. Ketan Parikh and Dr. Jyoti Taskar said that it cannot be decided as it needs to be on the agenda. Dr. Parikh said that it is not a panacea. Dr. Ketan Parikh said that the concept of AGM with elections is illegal and that we need to stop this illegality. It has been raised since 15 years and has to be undone. He suggested starting elections at a certain time and then the AGM starts. He said that we cannot have a situation where people are not permitted to attend the AGM. Dr. Debashish Das said that we could have elections with AMCON. Dr. Ketan Parikh said that we can have the term

stfrom 1 April; the AGM can be dissociated from elections. This will need a constitutional amendment. Dr. Sangeeta Pikale that there would be a good team that can prepare in advance. Dr. Ketan Parikh said that the AGM should not be conducted when the elections are going on. He said that he hoped it would be put on record. Dr. Sudhir Naik said that he would discuss this with the President Elect and irregularity can be corrected next time.Dr. Das suggested 5 voting centers on different days. Dr. Sudhir Naik said that this would be looked into. Dr. Umesh Oza said that on behalf of the members he would like to congratulate Dr. Sangeeta Pikale and the others for a very successful and remarkable year. 15) Installation of the New President and the New Managing Committee: Dr. Sudhir Naik was installed President 2015 - 2016 with the traditional exchange of the medallion from Dr. Sangeeta Pikale and the exchange of seats. Dr. Sudhir Naik in his address spoke about his plans for the year. He said that while doctors must comply with the PNDT Act, the severe punishment given for errors in filling up the forms is very disturbing. He said that he would work on this issue. This was met with by an applause from the house.The members of the new team were welcomed by President Dr. Sudhir Naik with a flower. This concluded the AGM. This year our claim ratio has been quite favorable at 83% . Hence this year also we have not increased our THpremium rates for the 7 consecutive year. To encourage the younger age group to join our scheme we have

decided to give no claim bonus of 5% for every claim free year (Maximum up to 20%) up to the age of 60 years & 5% to 10% for the age group 61-70 ( Main Member & Spouse). Our projected claims ratio for this year.

Since we have opted out of TPA system we will continue to make payment to the tune of 60% of projected claim to the needy members where the likely expenditure is more than two lacs

2) Co-payment to be reduced from 10% to 0%

3) Robotic surgery will be covered from this year 3 years after joining the scheme. Maximum amount payable

4) In the event of any death of member below 60 years of age and he/she being the H & A scheme for more than

10 years family will be given an amount equivalent to average of the sum insured in last 10 years. If he or she in

the H & A scheme between 5 to 10 years than he/ she will be given 50% of amount of average sum insured in last 5

years.

5) No claim bonus eligibility for the age group 61-70 years to be increased form 5% up to maximum 10%. 5% for

every claim free year.

6) Restriction of Fracture neck of femur not covered for first two years to be abolished.

Dear Members,

We are proud to have completed 11 glorious, successful years of conducting the Consultant Benevolent Scheme. Presently, the total number of members enrolled in the scheme is 1158 (till January 2015). Since the inception of the scheme, we are sad to inform you that we have lost 35 members. However scheme could serve them with Benevolent Fund of a sizable amount. The last member received a contribution of 4,63,600/-. Since the inception, the scheme has disbursed total amount of Rs. 1,29,76,900/- (One Crore Twenty Nine Lac Seventy Six Thousand Nine Hundred only) as a Benevolent Fund. The 12 members have a premature retirement from the scheme because of various reasons. In this current year every member has paid the contribution in time & there was no defaulter. 14 new members have joined the scheme in current year giving a growth rate of approx. 1.5% per annum, we are deeply concerned with the slow growth of the scheme, in spite of all its tremendous advantages. This scheme can be considered as a term insurance policy or an investment model. A special drive will be undertaken to show case the highlights of the scheme, and we have no doubt that in the years to come this will be one of the most sought out models in this category in the medical world .

We pay homage and sincerely condole the death of our following FIVE colleagues and members in the scheme. On your behalf, the committee has promptly sent out their deepest condolences to the family of the diseased.

The benevolent funds that have been paid to the beneficiaries of each of them are mentioned in columns next to their names. We pay this fund in a shortest possible time with simplest of procedure.

In current financial year (Till January 2016) we have paid total Benevolent Fund of Rs. 23,08,600/- (Twenty Three Lacs Eight Thousand and Six Hundred Only).

This year we have completed digitalization the data of all members of CBS (1188) since inception of the scheme.

We might have to increase the annual fees (presently Rs. 200) next year, as service charges has become 14.5% & also there is increase in administrative expenses.

We earnestly request you to enroll as many of your Colleagues of AMC & their spouse in the scheme as early as possible. This will enable us to give still larger amount of Benevolent Fund to the family members in the event of untimely demise.

Report of AMC-NoAH Cell

The year 2015-16 has been a year full of meetings, deliberations & exchange of ideas between AMC-NoAH & many

health insurer and providers as well as the concerned industries. On the GIPSA empanelment front we have literally

taken the process to its logical end and the first batch of 50 AMC FEQH accredited hospitals has been already sent

to them. The process began but for a last moment hurdle of poor rates being reoffered pulled us back. This issue is

still being bargained & doors are not yet closed. Being into big business, the economies is the only issue they

understand & are trying their level best to squeeze us maximum which is being resisted by us.

Similar efforts with various private player such as ICICI Lombard, Reliance, Aditya Birla, SBI etc. have been

undertaken and may be before your read this report, the ICICI Lombard would have already empanelled the 150

accredited hospitals.

The grievances of members in regards to Bajaj Allianz was sorted out in a one to one meeting with the concerned

members & Bajaj representatives to everyone's satisfaction.

As representative of small scale providers & the Nursing Homes we got an opportunity to represent AMC NoAH at a

panel discussion on 'The methods of increasing medical tourism in Maharashtra' at NESCO ground, Goregaon,

Mumbai on 28th September 2015. The invite came to us courtesy Dr Nilima Vaidya Bhamare who is an active

Managing Committee Member of AMC. Dr Niranjan Agarwal represented AMC and laid forward the suggestions to

utilise the existing Nursing Homes for various medical tourism purposes which could be made more affordable &

attractive. He also utilised the moment to raise concern about violence on doctors and hospitals as the same was

projecting negative image about health care in India globally & same would hamper medical tourism.

The CII meet on 12th October 2015 at Delhi 'Re-Imagine The Future- Act Now' was attended by Dr Niranjan Agarwal

as panellist for the Panel Discussion on “Health Insurance Cover for All- “Carrot or Stick” Approach”. The invite came

thanks to Dr Suhas Shah our active committee member and Mr A Vaidheesh from CII. We got an unique opportunity

to project the importance of small healthcare in influencing growth of health insurance. Presently the medical

insurance industry is bleeding due to majority of these clients going to tertiary health care even for innocuous

problems. The FICCI 8th Annual Health Insurance Conference on 10th December 2015 at New Delhi on 'Creating

Value through Customer Centricity' was attended by Dr Sudhir Naik, convenor of NoAH. He was also able to stress

the importance of small nursing homes in health delivery and neutralising the high cost of tertiary care.

Discussions for an unique policy for all NoAH members for fire, flood, theft, medical equipment repair etc. is being

đone & may materialise soon.

The AGM of NoAH was held on 30th January 2016 at AMC Office. It was decided to revisit FEQH Standards and

introduce more objective criteria with transparent markings. The criteria would include site, size, infrastructure,

doctors qualifications etc. other than the already existing criteria. Thereafter the Nursing Home would be divided

into clusters A, B, C, D etc. & then work out a common costing for each cluster across Mumbai.

The AGM also decided to convert members who have not yet got the FEQH Accreditation to associate membership

with immediate effect. The same would be reconverted to full membership once the criteria is fulfilled.

The Medico-legal Cell has been working round-the-clock this year, what with the significantly increased incidence of cases , thanks, partly , to the media which perceives medical mishaps to be a good source of sensational news reporting aided by the fact that medical professionals provide easy targets who rarely hit back . Every 'horror' story of medical negligence that gets published leads to a domino effect whereby more such reports are generated and the vicious cycle continues.

A number of disturbing trends emerged this year which need to be brought to the notice of our members.

· Consumer cases which were file 14 to 16 years ago are being brought out of the closet and astronomical compensations are being awarded. Many of these judgments are perverse and populist, having been handed down by laymen.

· The interest on the awarded amount of compensation is quantified at mind-boggling figures which cast a back-breaking burden on the hapless doctor. In one case which was decided this year, over Rs 19 lakhs was awarded as compensation , to which the interest amount at 9 % for 14 years (the time it took for the case to conclude) worked out to Rs 23 lakhs !! Even if one decides to appeal, the amount has to be immediately deposited with the Court.

· Further aggravation of the problem is caused because the Insurance cover which one may have may turn out to be grossly inadequate as this sum was decided 14-16 years ago and the interest amount would not have been factored at that time.

· The urgent message is: Please enhance your sum Assured in your professional indemnity Policy to a minimum of Rs. 50 lakhs (any specialty) and much more if you are in high-risk surgical specialties. Do it forthright.

· There is a need for AMC to take up with the appropriate law making Bodies to impose a ceiling or capping on the compensation amounts awarded. And importantly, a ceiling must also be imposed on the number of years a case can drag on. For example, if a case is not decided in 5 years max, it should be closed.

· The working of our Professional indemnity scheme suffered a setback recently when Mr R.C.Suri, our co-ordinator with Oriental Insurance Co suffered a CV accident and had to undergo craniotomy for decompression. He is still incapacitated and not in a position to work. We are in the process of coping up with the problems on account of his absence. Hopefully, the alternate arrangements will enable us to carry on the various insurance schemes seamlessly.

· The increase in the number of calls for medico-legal help is a matter of concern. Apart from devising methods of making our support system to members facing such problems more aggressive, we need to step up sensitization of our members towards preventive aspects.

Programme Committee Chairman : Dr Kritika Doshi

Dear friends, these are challenging times for doctors. The social framework of society is changing rapidly and we are faced with challenges every day.

This year, team AMC 2016 under the leadership of President Dr Sudhir Naik decided to face these challenges by organizing events to serve as a common platform to meet lay people and reduce the stress of practice. Also, to promote the social commitment of AMC, this year the theme was “Cancer-awareness and Prevention”

The beginning of the year saw multiple incidences of violence against doctors. AMC has in the past taken interest and helped initiate the “Medicare Act”. This year, AMC's response was to form a task force in each zone, develop the AMC app and ask local representative to take immediate action in terms of prompt physical presence at the venue.

thThe first event was held at Vashi on 26 April 2015 to deliberate on this topic of “Doctor-a soft target”. The panel discussion was fruitful and the personal account by the doctors who faced public wrath and violence helped sensitize the Politicians and Law Enforcers on strict implementation of the “Medicare Act”. This was followed by a

thCME at Mira Road Wockhardt Hospital on 14 June 2015 on “Medicolegal issues in Clinical Practice”

thTo improve patient and doctor interaction, the Doctors day celebrations were held on 2 Sundays- 28 June 2015 th

saw a grand performance by Sivamani and troupe at Inorbit Mall, Malad. A CME for doctors was held on 5 July 2015 for our members with a stand up Comedy act to de-stress the members.

thThe zonal program held on 9 August at Evershine Banquet Hall discussed how we can ease the “Roadblocks in Healthcare Delivery”

After very successful meets during Doctor's Day and zonal events, AMCON 2015 too was a huge success. It was held at Bandra-Taj Lands End and the highlight was the panel discussion on the role of Court judgements on Medical Negligence and the compensation awarded. The Supreme Court awarded more than Rs 11 crore in damages (including interest) against several doctors and a private hospital in Kolkata for the wrongful death of a patient. The impact of consumer complaints, court judgments is affecting the psyche of the doctors. Such judgments can lead to anxiety over the size of medical malpractice liability. This is now a reality though! The high compensations awarded in some medicolegal cases was discussed by eminent panelists comprising Justice Mohit Shah ( recently retiered as Chief Justice of Bombay High Court), Dr Ramakant Panda (Vice Chairman and MD- Asian Heart Institute), Dr Neeraj Nagpal (Convenor,Medicos Legal Action Group, Managing Director MLAG Indemnity) and Dr Ajay Kumar (Council Member, World Medical Association, Member-Ethics committee of World Medical Association (WMA).

In Addition, there were talks on tackling the Pain of adversity by Swami Bodhatmanadji - the Acharya of the 16th Residential Vedanta Course at Sandeepany Sadhanalaya, Powai, Mumbai; the C L Zaveri Oration by Mr S Ramadorai (the adviser to the Prime Minister of India in the National Council on Skill Development) who spoke on “Changing Paradigms - Interdisciplinary Learning”; Mrs Brinda Somaya spoke on “Mumbai's Timeless Heritage”

stand Dr Sanjay Deshmukh the VC of Mumbai University spoke on challenges of healthcare in the 21 century.

th stThe next event after AMCON, scheduled on February on 20 and 21 Feb 2016 was aimed at educating our members and giving all a hands on learning of IT and computers. Our aim was to give you an opportunity to learn more about the use of electronics and internet in our day to day practice. AMC has taken the initiative to design our own App and digital pen for record keeping. Taking this further, we had made an initiative to help members become familiar with e-technology and lose their fear of internet by organizing a conference on “use of IT in Healthcare. This was held at the Thakur Institute of Management Studies, Kandivali. Some of the highlights of this conference were-

1) There was a hands-on workshop for the delegates and each person had a computer station and teacher for a group: Topics for the IT Workshop included-

a) Basics of Computer and Internet - Computer Jargons made easy

b) Digital Marketing

c) Cyber Security

d) Document Management & Common Gadget (use of Bluetooth)

e) Open source Mobile App on Healthcare - Life made easy for Doctors

f) MCA My Pen Session

2) There were talks by leaders in IT and Healthcare field3) A lecture on Cyber Security by Police Department

thOn the 5 of March 2016 at the Y B Chavan Auditorium opposite Mantralaya we had a program called “Aarogya Manthan”- where representatives from the MCI, MMC, Maharashtra University of Health Sciences, Deans of various medical colleges, Heads of Medical Education units of all medical colleges, senior teachers both present and retired, representatives from the students and also our own senior AMC members had a brain storming session was conducted under the watchful eyes of the Union Minister of State for health Mr Shripad Naik.

We will collate the suggestions and the deliberations into the form of a consensus report and send it to the Union Government and State government as our humble attempt to suggest the road ahead of Medical education in 2016. AMC programs this year gave members a chance to earn 13 MMC credit points only from our own programs.

As program committee chairperson, I have enjoyed every moment of organizing these events and would like to thank all the members for making them a huge success. We look forward to lead and take initiatives for various issues faced by our members. I would like to thank every member of Team AMC 2015-16 and all AMC members for participating and making these events memorable.

'The GRASP' Report 2015-16

It gives us immense pleasure to present the Annual Report for the year 2015-16. As is the convention, we

published 'The GRASP' as per schedule in May 2015, August 2015, November 2015 and in February 2016. At the

outset, the editorial team thanks all the authors for their contributions to the magazine. We are also thankful to

the President, Dr. Sudhir Naik, the Secretary, Dr. Mukesh Gupta, and the entire Managing Committee for their

inputs from time to time. Our gratitude to the Program Committee Chairperson and the Chairpersons of various

Report of AMC Activities from the Zonal Director

Association of Medical Consultants, Mumbai organised the first AMC Meet on Sunday, 26th April at Navi Mumbai Sports Association. “Doctors - As a soft target?” Was the topic of Panel Discussion. The Topic was particularly chosen due to increase in the incidents of violence against the doctors recently.

The Panelists were Mr. K.L. Prasad, Commissioner of police, Navi Mumbai, Mr. Prashant Thakur, MLA, Dr. Uday Nirgudkar ,CEO Zee Marathi Chanel & Editor of English news paper DNA, Dr. Lalit Kapoor Director AMC India project, Dr. Sudhir Naik President AMC, Adv. Amit Karkhanis and Dr. Dilip Rane Vice President Navi Mumbai Sports Association. The Moderators were Dr. Bipin Pandit Trustee and Member of Maharashtra medical council and Dr.Prakash Patil Director of Life line Hospital, Panvel.

Doctors expressed their concern about police callous attitude in filing the FIR, role of media in increasing attacks on doctors and how to overcome this problems were the few questions put forward to the Panelists. The Panelists gave very satisfying answers to these questions.

The programme was attended by more than 500 delegates and it was a grand success. I thank each and every one who has been instrumental in doing this programme a great hit. I would like to thank specially to Dr. Sanjay Pattiwar for giving us an invaluable help in making this programme a gala event.

The Raigad-Navi Mumbai region held a CME, RAMICON- on 13th December 2015 at Dr.Babasaheb Ambedkar Technological University, Lonere. It was a first of its kind seminar held in Raigad region in AMC style. It was organised exclusively for Consultants in the Konkan region and it had non academic topics. More than 75 consultants, from as far away as Pen in the north to Chiplun in the south attended RAMICON.

Dr. Sudhir Naik, President AMC, inaugurated the CME & in his Inaugural speech spoke on 'AMC, today & in future'. Adv. Ashish Chavan gave a lecture on Current Laws & Consulting Practice. Dr. Lalit Kapoor spoke on “Recent Judgements & their Implications in Consulting Practice”. Ms. Nehal Mota of Finnovate delivered a Lecture on “Financial Planning for Consultants”. Dr. Rajendra Barve gave a dramatic presentation On” Managing Stress for Consultants in practice & at home!”. Dr .Ajit Desai gave valuable Inputs.

On 28th June 2015 Association of Medical Consultants, Mumbai, along with Navi Mumbai Association of Paediatrics, celebrated a “Doctors’ Day” with Blood Donation drive at Mody Hospital, Airoli. Forty- four bottles of Blood were collected.

Last but not the least; I would like to thank Dr. Vivek Sheth, Dr. Praveen Mody, Dr. Sanjay Pattiwar, Dr.B.J.Shinde, President, IMA Mangaon-Tala, Dr. G.K.Rauth, Sr.Surgeon, Dr. Patankar, Sr. Paediatrician and Dr. Ketan Nikam, Ophthalmic Surgeon. For their valuable support otherwise this year would not have been successful.

Report of AMC Activities from the Zonal Director

At the very start of the year, doctors from every suburb area of Jogeshwari to Dahisar were contacted & explained the need to form an Action Task Force in every locality to combat mob violence of patients. Accordingly a group (of 72 doctors) was formed consisting of key leaders from each suburb (East & West) & it started functioning on whatsapp. The key leaders in turn have formed their local groups. The various groups were activated at different times during the year, to face an angry mob of patient's relatives. The presence of the group of doctors along with their communication skills with the mob subdued their anger & avoided a violent turn of events.

In one incident, a police complaint was also lodged against the relatives & the relatives had to admit their fault & apologise.

thA Zonal Meet was organised on 9 August 2015 at Evershine Banquets, Goregaon West, wherein the prime attraction was the “panel Discussion” on. Adv Ashish, Addl. CP, Adv Piyush Shah, was the panelists. The stimulating discussions led to some promising conclusions. Mr Sagar &Mr Revankar promised to pursue the implementation of the Non requirement of Shop & Establishment Act for Clinics & Nursing Homes. Addl. CP invited coordination of doctors groups with their respective Police station Officers to solve the doctor-patient interactions. Adv Piyush Shah offered his expert help to interpret the Judgment regarding shop & establishment Act.

The efforts to coordinate with the Police of different suburbs are continuing at local levels & hopefully should smoothen the doctor- police & doctor –patient interactions for the better.
