Diving is only available if requested by prior arrangement and includes additional fees as set out below. Divers must complete various pre-dive paperwork and beginners must complete a compulsory pool skills session the day prior to the charter date.

The Contract Your contract is with Denison Star Pty Ltd trading as Explore Hamilton Island. Once you have made your booking and paid a deposit, the cost of your charter as quoted will normally not be subject to any change. However, Explore

Hamilton Island reserves the right to amend charges relating to any increases in GST, Government and Reef Taxes as applicable. Where a charter is booked for the following year, the charter rates that are available at the time of booking will be

honoured, only when confirmation and deposit payment have been received. All food and beverage availability and pricing is subject to change without notice, though otherwise valid until 31 December 2018.

Deposit & Payment A non-refundable deposit of $500.00 is required within 14 days of booking to secure the requested vessel and date. This can be paid by cash, credit card or direct deposit. Visa and MasterCard payments attract a 1.24%

processing fee, with AMEX payments attracting a 1.60% processing fee. Diners card is not accepted. Eftpos transactions do not attract a surcharge. The balance is then due no later than 21 days prior to the charter date.

A contract exists as soon as the deposit is paid and by making that payment you will be deemed to have accepted our quotation invoice and agree to be bound by our booking conditions.

Booking Confirmation Your booking is not confirmed until the non-refundable deposit has been paid and received and advice of this received in writing. Verbal notifications should not be relied upon and may be treated as tentative advice only.

Payment Policy The non-refundable deposit is acceptance of the Term & Conditions as set out here and are subject to change. The full balance of your booking must be paid no later than 7 days prior to your charter date.

All charter details and requirements, including final numbers and food and beverage specifications, are to be confirmed no later than 7 days prior to your charter date. The final charge will be based on this information. If you do not specify your

food and beverage requirements by this requested timing, we reserve the right to select your menu and charge accordingly. All food and beverage is subject to availability and seasonal changes. Beverages on consumption may be paid for on the

day.

Sole Use The minimum fees listed throughout this portfolio are required to be paid to utilise the vessel as a sole use charter. Any unutilised minimum spend amount will be forfeited by the client and cannot be utilised for takeaway or for use

outside the agreed charter service period.

Passenger Numbers An estimate of passenger numbers must be provided upon booking. Final passenger numbers must be confirmed no later than 7 days prior to charter. Final charges will be based on advised final numbers. A guest list of

names and ages of guests under 18 years old attending the cruise must be provided no later than 7 days prior to the cruise.

Cancellation Policy Deposits paid are non-refundable. Clients are permitted one postponement, if notice of postponement is received at least 1 month prior to the charter date.

Cancellation 30 days prior to your charter date will incur no additional charge other than the non-refundable deposit; Cancellations 21 days prior to your charter date will incur a 50% fee of the full charter cost including food and

beverage charges; Cancellations within 14 days of your charter date will incur a 100% fee of the full charter cost including food and beveragecharges.

Weather All charters are subject to weather and tidal conditions and the crew’s discretion. Whilst every endeavour will be made to accommodate destination requests, the weather will play a vital role in such decision. We reserve the right to cancel the

tour, change the destination or vessel on the day, or remain at dock, depending on the conditions to ensure the safety of our passengers and crew. In the event that Explore cancels the tour you will be offered a full refund or an alternate date of travel.

Unscheduled Maintenance Should the vessel you have chosen require unscheduled maintenance, Explore will offer a full refund, alternate vessel or an alternate date of travel.

Indemnity Upon booking a charter, the organiser must accept responsibility for the proper conduct of themselves and any members of their party. We reserve the right to remove or refuse any guest, luggage or goods from the vessel without reason.

Upon such termination, our responsibility for your charter ceases and we shall not be liable for any extra costs or liabilities incurred by you or your party.

All RSA legislation will be upheld on board. Alcohol will not be served to patrons under the age of 18 years or to intoxicated guests. It is at the discretion of our staff to continue, or discontinue, to serve alcohol to guests on board.

Clients are financially responsible for any damages sustained to the vessel, its property and contents, prior to, during and/or after the event by the client, guests or contractors engaged by the client.

Explore Group takes no liability or responsibility for the loss of personal property on board the vessel or during a tour.
