Purchasing a Property

Once we have identified your dream property, negotiated and settled on the right price with the vendor, its important to seek professional advice to ensure the following:

Your financing options are either cash financing from your home country via a mortgage on an existing property, or via a Spanish bank.

Spanish banks will offer you a mortgage (hipoteca) with competitive rates and conditions. The average Spanish mortgage terms, for non-residents, are up to 80% of the valuation of the property, with a 15-30 year repayment period and current interest rates are set at approximately 3%. The formalities and loan procedures with the Spanish banks are straightforward. They require far less personal information to perform a credit check than you would be asked for at home.

The Spanish banks estimate the credit valuation more on the property valuation than on your current credit history. Spanish banks usually take two weeks to conduct a credit check and to confirm a mortgage. If you buy off-plan from a property developer they often have their own in-house financing schemes.Contracts

Once you have identified your dream property and you are ready to initiate the purchase process by paying a 6,000 Euro reservation deposit, your property will be taken off the market. This amount can be deposited with a lawyer of your choice.

The reservation deposit will allow the property to be reserved for a 7-14 day period during which the lawyer is able to carry out the necessary searches and negotiate the pre-sale contract with the vendor. The contract will set out the conditions of the purchase hence, what is included in the price, the payment schedule that is responsible for the transaction costs and subject to conditions if appropriate. The full deposit (normally 10%) is then paid.

This contract is legally binding for both parties, with the purchaser forfeiting his deposit if he changes his mind, and the vendor being liable to pay back double the deposit if he changes his mind.

The final public contract or title deed (escritura de compraventa) is formalized by the public notary upon completion (normally within 30 days) and confirms the contract is legal and the purchase money has been paid. The title deed is then presented to the property register (Notary) for inscription. Your lawyer will provide you with a NIE/fiscal number (numero de identification de extranjeros), which is essential for property purchases and tax payment. He will also obtain a copy of the nota simple or title deed from the land registry, to prove the following:

Legal constructed area Plot size Boundaries of the property

Your lawyer will also check mortgages or any other charges against the property, if the local rates have been paid, and whether community charges apply. In the case of a resale property, the lawyer will request to view the last receipts of the property and wealth tax, as these can be passed onto the purchaser if left unpaid.

If purchasing from a new development, the deed of declaration of the new construction, the construction licenses, and occupancy permission will also be requested.The lawyer will also check to see if the local authoritys planning department has any development plans in progress that may affect the area in which the property is located.

Taxes

The rule of thumb is to allow an additional 10% of the declared purchase price to cover the transfer tax (impuesto sobre transmisiones), notary and lawyer fees.

The transfer tax for Costa del Sol is calculated at one of the following rates.

7% of the declared purchase price on the title deed for a resale property

IVA (impuesto sobre el valor anadido) at 7% + 0.5% stamp duty if buying a new property from a developer

15% if purchasing a building plot or commercial premises.

There is also a tax (plus valia) based on the increase in the value of the land since the last sale.

The notary will normally charge up to 1-2% (including tax & registration fees), and your lawyer will charge approximately 1%. If applying for a mortgage your bank will also have a scale of charges.

On-going Fees, Annual Taxes & Utilities

Owners of property in Spain are liable for municipal real estate taxes or rates (impuesto sobre bienes inmuebles) based on the official rate-able value of the property (valor catastral).

In addition, there is a yearly wealth tax to pay on your net assets. These taxes are significantly lower than throughout the rest of Europe.

If your property is part of an apartment complex or urbanization, then community fees will be charged to cover the cleaning, maintenance, lighting and upkeep of the common areas, swimming pools & gardens. Electricity and gas are commonly cheaper than in northern Europe and water is normally metered, meaning you only pay for what you use. Telephone and Internet connections are usually in-line with the latest technology.

Over the last 3 decades Marbella has grown from a fishing village to a cosmopolitan city. Currently there are more than 135,000 people living in Marbella. For fine dining and partying there is no better place on the Costa del Sol than Marbella. There are 100s of world-class restaurants in the town centre around the main square Plaza los Naranjos and its small surrounding streets, along the beachfront and of course in the luxury marina of Puerto Banus. EL ROSARIO is a small residential urbanisation located on the beach, just outside of Marbella. The area is very laid-back, with a mix of luxury villas and apartment complexes, all within walking distance of the lovely beach. El Rosario is an excellent destination for couples and families looking for a quieter location, yet close to all the amenities and leisure facilities of Marbella, which is literally 10 minutes away in the car. El Rosario isnt a town, but there are bars, restaurants and a supermarket in the local vicinity. For more amenities, the larger resort of Elviria is just five minutes in the car, and Marbella around 10 minutes drive. El Rosario is home to a lovely stretch of golden sand, which forms part of the stretch of beach of East Marbella, which is thought to be one of the best along the Costa del Sol.There are lots of bars and beach restaurants, public showers and water sports can be found at intervals along the beach. MIJAS COSTA belongs to Mijas, the largest municipality on the Costa del Sol. It stretches from the picturesque mountain village Mijas Pueblo down to Calahonda with 12 km of coastline. Mijas Costa is very popular among foreigners moving to the Costa del Sol. Set high on the mountainside overlooking the coast, Mijas Pueblo is the best known village within the area. Thousands of tourists visit the village each week for a walk through the historic centre or a tour with the famous donkey taxi. This is also the ideal place to buy your souvenirs. Mijas Costa is the perfect place for lots of different activities. There are 8 championship golf courses, various schools for horseback riding, several tennis clubs and lots of watersport facilities around the area known as La Cala de Mijas.

EL FARO is Idyllic and charming and best known locally for its iconic lighthouse, from where it gets its name. Located in the Mijas municipality, El Faro is perched on a jutting peninsula that is located a couple of kilometres west of Fuengirola, El Faro boasts some of the finest Mediterranean views found anywhere on the coast. This is the spot where the coastal highway becomes extremely winding. The road hugs low and close to the shoreline, leading to somewhat distracting views of the richly azure Mediterranean horizon. Once there, El Faro proves extremely alluring for visitors and residents of all ages.

LA CALA DE MIJAS acts as a natural divider between 'east' Costa del Sol and 'west' Costa del Sol. The town delivers a mixture of expat-haven, affordability, authenticity and affluence. The town centre has fountains for roundabouts; manicured tree-lined avenues; portly old Spanish gentlemen staring in bemusement at the fast-paced town that has sprung up around them; and a multinational collection of families and couples dashing all over the place, lending La Cala de Mijas a slightly muddled, but intoxicating, atmosphere.

RIVIERA DEL SOL is located approximately 35 km from Malaga airport. You can reach the area by taking the AP-7 toll road within 20 minutes or by the coastal road. Riviera del Sol is a mixed residencial and holiday area. It has its own 18 hole golf course (Miraflores golf) and all amenities you require are within easy reach. There are several small shopping centers with shops, bars and restaurants. Within 10 minutes drive you can find large shopping centers like the Miramar in Fuengirola and La Caada in Marbella. Also the main Costa del Sol hospital is within 10 minute reach.

CALAHONDA spreads over 300 hectares from the Mediterranean and 3 kilometres up the hill to almost 300 metres above sea level where you can visit the shrine La Ermita de Calahonda with its breathtaking views. The fact of elevation also means that a lot of the properties here enjoy spectacular panoramic sea views and of the Mediterranean coastline to Gibraltar and all the way to the mainland of Africa. Calahonda has developed to a modern urbanisation with a lot of facilities; two medical centres, six supermarkets, over 60 restaurants and bars, 2 butchers shops, 3 pharmacies, 2 hardware stores, service centre for TV and computer repairs, internet cafes, bakery, 5 banks, wonderful beach restaurants along the board walk and more. Yet you will only find two small apart hotels in Calahonda, and no big tourist hotels. This has proven very successful as it is a retreat for the residents and a favourite destination for the residential tourist. The residential tourist typically either owns or rents a property and visits several times a year.

OTHER AREAS MALAGA CITY, with over 600.000 inhabitants, is the capital of the Costa del Sol. It has a large historical heritage that is still visible at lots of different places within the town centre. Malaga is one of Spains most visited cities mainly because of its climate with an average of 300 days of sunshine. Malaga has the 2nd largest port in Spain and the new international airport is the 3rd largest in the country. The city welcomes over 700.000 tourists a year through the port alone and more than 100 daily flights are coming in with people visiting the city and tourist resorts outside the capital. Some of the most visited sites are the Picasso house and museum, Calle Larios, with its shops and tapas bars, the Alcazaba Moorish castle and the imposing Cathedral. Millions visit the various events which take place annually, such as the summer fair or feria; the traditional Easter week Semana Santa religious processions; and Spanish Film festival, among others.

TORREMOLINOS was in the late 50s and early 60s the first tourist resort on the Costa del Sol. In those days the rich and famous gathered around the pools of the luxury hotels around La Carihuela, with its lovely beach bars and chiringuitos. Nowadays Torremolinos has grown to a city with over 50,000 inhabitants and with lots to offer. From sunbathing along the 7 km. beach, inexpensive dining in the town centre, just off the main street, calle San Miguel, enjoying tapas or fried fish in La Carihuela or along the beach in Bajondillo, Playamar and Los Alamos. During the summer Torremolinos is one of the hottest places among youngsters for going out to one of the numerous pubs, discos and nightclubs!

BENALMADENA is geographically split between Arroyo de la Miel (town centre), Benalmadena Costa (coast) and Benalmadena Pueblo (village). Benalmadena Costa is most famous for its Puerto Marina, a luxury marina with more than a 1,000 moorings and properties built on islands inside the port. On either side of the marina there is a total of 8km of Blue Flag sandy beaches with a lovely boulevard leading to Torremolinos on one side and the 5* Torrequebrada casino/hotel on the other. There is also plenty to do for families with children. You can visit the theme park Tivoli World or take the cable cars to the top of the mountain where you can have the most stunning views over the coastline. Other places not to be missed are Sea life and Paloma Park.

FUENGIROLA is one of the Costa del Sols largest tourist destinations with over 60,000 residents. This number almost triples in the months July and August. Situated only 25 km from the capital Malaga, Fuengirola is also the final stop for tourists travelling by rail, which connects all the towns between Malaga and Fuengirola. One of the most lively places in Fuengirola is the old town centre with the main square Plaza de Constitucon , where you find lots of shops and Spanish and international restaurants. From here you can easily walk down to the beach and along the boulevard to Fuengirola marina. When visiting Fuengirola, you have to visit the street market on either Tuesday or Saturday morning. Also check out if there is an event or concert during your visit at the ancient castle Castillo Sohail.

BENAHAVIS is the wealthiest municipality of Costa del Sol and boasts of having the best public school of the coast. The village itself is a picturesque whitewashed mountain village overlooking the Guadalmina River with its narrow cobbled streets that still keep the original Moorish layout. There are pretty houses, some shops and a simply amazing choice of restaurants. It is known locally as the Rincn de la Gastronoma or the gastronomic corner of the Costa del Sol. Benahavis is in many ways one of Andalucia's best kept secrets. It is situated just 7 km inland from the main coast road, immediately west of San Pedro de Alcntara and only a few minutes from Marbella and Puerto Banus. For the golfer Benahavis offer a huge choice of courses within a short distance.

ESTEPONA is the largest town west of Marbella. It stretches over 22km of coastline and has around 60,000 inhabitants. The New Golden Mile is the most up market area east of Estepona with luxury properties on either side of the motorway and several 5* hotels such as the Ritz Carlton and the Kempinsky.Home
