2015 has been an incredible year thus far for the rental housing industry, and I hope you’ve been

taking advantage of the benefits and information the SDCAA provides to keep you up to date and to help you plan. In our weekly email “Updates”, there have been many articles and reports highlighting the growth of the rental industry in the past several years, and opinions of industry insiders is that growth will continue for the time being. Renting remains a very popular choice among baby boomers and millennials as some baby boomers downsize from large homes to smaller luxury apartments in well-managed communities and as millennials rent because they reportedly prefer to live in urban, walkable communities close to their jobs and entertainment. Some analysts expect these trends to continue and perhaps dominate the future.

Last June, the SDCAA released its Spring 2015 Vacancy and Rental Rate Survey and it reaffirmed what we already know about the industry. Rents are increasing as vacancies decrease.

With all of this good news, can we sit back and enjoy the fruits of our labor?

Like any brand or product, companies and properties need to develop appeal or your current or prospective residents may move or look elsewhere. Developing a marketing strategy will help you attract and retain your ideal residents. Remember that your strategy not only should focus on attracting new residents, but keeping your most loyal and best residents. If you really want to achieve your goals for 2016, you need to concentrate on creating more information about your properties and making it available to prospective residents by using

newer technologies, and even develop programs that remind existing residents about the desirable features of their homes. This may include reinvesting in your property to create the perception of greater value, increasing amenities available to current residents, and seeing what the competition is doing that you might emulate. In preparing for the short term future you will want to know how new laws and regulations will affect your occupants and your costs. While current market trends project low vacancy rates and higher rental rates, millennials and baby boomers will only pay more in rent if they see increased value to them.

Competition will only increase with time. The San Diego region for the first time since 2008 is on pace to build 10,000 new units; more than half of those units are likely to be multi-family. But, the San Diego region will need to build at least 12,000 new units a year until 2035 to keep up with the demand of increasing population. It would be logical to expect that cities will want to accommodate more multifamily housing. But the regulatory environment will improve slowly, if at all. And that might require a major effort from all of us to educate public decision makers about community needs.

What’s the best way for you to understand the rental housing market? Read your local media about what’s happening in your area. Check SDCAA and NAA publications and websites for the latest information on what the government at every level is doing or proposing to do. Attend SDCAA seminars and classes to expand your knowledge about rental housing issues. Attend the networking opportunities in your area to ask questions of others in the industry and government who will be there. Attend the tradeshows offered by SDCAA and others to learn about the new products and services available to you. Listen to your occupants and prospective applicants about what they are experiencing with their homes and in their search for homes. A well-informed owner or manager will be prepared for the future.

It is important for the SDCAA to provide its members the most relevant and most recent information on the rental housing industry. In the past few months, our articles addressed the importance of beginning your budgeting process early for 2016, the new state rules for employees working

outdoors in high temperatures, emergency preparedness, and California’s new paid sick leave law. In June, we published the Spring 2015 Vacancy and Rental Rate Survey providing the most recent data on rental and vacancy rates around the San Diego Region. Over the next few months, our articles will focus on new rules taking effect in 2016 regarding electricity rates, water usage rates, plumbing retrofit requirements, smoke detectors and carbon monoxide detectors, among many other relevant topics.

Continuing our commitment to provide you the latest information to help you with your bottom line, this month we published the 2015 Multifamily Fee Survey to provide you latest data on water, sewer, and trash rates, and other fees affecting multifamily housing in the San Diego Region. We hope the data will help members to be aware of the new and pending fees changes. As expected, the most significant fee changes for some local cities will concern water rates. We hope, if you haven't started already, that you are practicing water conservation and sharing the information with your residents.

Other articles include the Past President’s column on revenue and Customer Relationship Management (CRM) on page 10. Please read our local legislative and state updates on page 45 and Page 48.

It’s an otherwise lovely day, but your tenant has responded to your Unlawful Detainer

with an answer and you need to prepare for trial. These are the immediate need-to-know items: the date and time of trial, location of the court and parking, in which department is the trial being held and the name of the attorney with whom you will be meeting. These are the basics, but far more important is the testimony and evidence that you will bring with you.

The testimony and evidence to support your complaint (lawsuit) at trial is dependent upon the witness appearing. Often the plaintiff (landlord) believes that it is the attorney who will do the talking. Unfortunately, the only times that it is permissible for an attorney to testify is on television and in the movies. The attorney will guide you, but facts concerning the tenancy and the books and records, which

accompany it, are not knowledge possessed by the attorney.

Preparing for TrialMuch of the preparation for trial---or lack thereof---began when the landlord was initially renting the property. The application to rent will supply information of value when collecting the judgment. Social Security numbers, places of work and bank accounts should all be collected prior to any rental or lease agreement. They are necessary to determine the financial qualification of the tenant and are of even greater importance when enforcing a judgment. The landlord should have conducted a “walk-thru” before giving keys to any tenant. This is a check off sheet which goes through the amenities, appliances, and conditions of the rental; so the tenant cannot later claim that the premises were not habitable and that they have the legal right to withhold rent. The “walk-thru” should be signed

and dated by both the lessor and lessee. Always bring the “walk-thru” to court.

The lease or month-to-month agreement needs to be brought to court, along with any notices of change which were made during the course of the tenancy. These changes might include increase or decrease in rent or changing the date on which rent is due. The agreement and addendums may already be in the possession of the attorney, but as most are copies, it is always wise to bring originals. Communications made during the course of the tenancy are also important. All evidence of work completed and work requested are important. And, as most evictions are based upon non-payment of rent, it is extremely important to have an accurate accounting which can easily be understood by the judge. If you have been allowing tenants to deposit directly into a bank account, they may have a better accounting than

you. This is never good. Please remember that judges are NOT accountants and a ledger must be simple to read. Many a case has been lost due to sloppy accounting records.

The attorney does not keep your records and cannot save you if your ledger tells a story which is different from the demand made in your 3 day notice.

NoticingWith regard to the notice… Any adult can serve the notice. A process server is preferable, but not necessary. Just remember that whoever does it must be available for court. Do not let Uncle Jerry, visiting from Tennessee do it, unless Uncle Jerry is ready to be back in California and available for trial. Not all notices served are disputed, but many are and then the server must come to court. The landlord or manager who expects to be the witness at the trial is usually the best person to serve the notice.

Pay attention to the “answer” filed by the tenant/defendant. The answer is the tenant’s response to your lawsuit and it outlines the defenses that the tenant will raise at trial. If the tenant claims lack of repairs, then it is your work orders, invoices, and repair records which will be the most important. Alternatively, if the tenant says an amount demanded is inaccurate, then it will be your accounting which will be called into the court’s spotlight. Sometimes it is both. Additional defenses

include retaliation, refusal to accept rent (my personal favorite), violation of rent control, and can go as far as any imagination will permit. The filed answer is your guide for preparation and needs to be considered seriously. It is also noteworthy that the tenant is bound by the parameters of the

answer and cannot raise issues at trial which were not first outlined in the answer.

WitnessesA few words about the proper witness at trial. The proper witness--- and usually there will only be one witness--- is the

person most familiar with the tenancy. This may be an owner, but if the property is managed, it is usually the management company who has the necessary repair records and accounting needed for trial. The manager is usually the one who has had the daily interaction with the tenant as well. The named plaintiff must be the owner, but do not travel across country for an unlawful

detainer trial if someone else has been collecting rents and maintaining your property. Not only is the trip expensive, but the testimony of an absentee owner has no value. The trial court requires the best witness. This is the one who can explain the accounting and refute any affirmative defenses raised in the tenant’s answer.

The Superior Court of the State of California conducts its business in English. Your unlawful detainer takes place in the civil section of the court.

The criminal courts must provide an interpreter, but the civil courts are not required to do so. If you have any doubt about your competency in the English language, you must bring your own interpreter. Even if your attorney speaks your language, they cannot translate for you at court. (Counsel would then be asking and answering his/her own questions.) Often plaintiffs overestimate their proficiency in English and a courtroom is NOT the place for that type of overconfidence. Even native English speakers can have difficulty understanding courtroom proceedings, so if you are not fluent in English, bring a translator.

Your attire demonstrates your respect for the court. Do not wear shorts or tank tops. You need not be formal but smart casual attire is best. The impression that you make upon the court can and does potentially influence the outcome of your case. Dressing appropriately adds to the integrity of your case.

Set aside a generous block of time for your trial. If your trial is in the morning, leave the entire morning open. An afternoon trial may last the entire afternoon. Unlawful Detainer trials are scheduled in multiples and the order in which they proceed is not predictable. The times for each can vary as well. Do not put your attorney in the position of having to rush you through your trial. Do not appear

for an 8:30 matter, informing your counsel that you have a 9:30 dentist appointment. Be relaxed. The lengthy trial heard before yours could be the one that teaches you the flaws in your own case. Take a deep breath. Justice will proceed at its own pace.

Preparation for your unlawful detainer trial is very important. These cases are simple and straightforward and so is the preparation for them. Your case should be submitted to the court in an organized fashion that clearly states your cause of action and negates any defenses raised by the defendant. And finally, do not underestimate the value of a good night’s sleep.

Past President's Column

As promised in July’s column the discussion in August revolves

around Revenue and Customer Relationship Management (CRM) specifically for Independent Rental Owners. In other words, how do you increase your cash flow and how it will affect your property value!? Why? If you are going to ‘Up Your Game’ in the areas of leasing and renewals everyone on your operating team needs to be on the same page. Based upon recent local surveys each of your rents is likely $200-$350 below market. Though I report ‘market rent’ many of you are more concerned about another vacancy and the ‘cost to market-ready’ the rental. Looking forward, I would factor in that during the 4th quarter rents will likely be re-priced by the market again. I realize that there are new apartment communities in the construction pipeline but it needs to be understood that these new lease-ups will lean toward the upper-end sub-markets producing initial sticker-shock and then increased rent acceptance and raised consumer expectations. I have watched this phenomenon play out in other ‘unaffordable markets’. Though I would never suggest to readers what rate to charge I will ask, “What is your business plan for the future and how will you communicate that plan?”

I can show plenty of evidence from companies across many industries to support the idea that trust is the catalyst for both customer and employee satisfaction. Effective communication that is direct and transparent (delivered to the customer it is called marketing; delivered internally it is called

education) can be an essential tool in building and maintaining trust. Additionally, our own management experience supports this theory. We are now in our 5th decade of developing and operating real estate businesses. We incorporate more business management, real estate economics and financial analytics into the training of our clients’ onsite teams across the country to create a consistent approach to revenue while communicating realistic expectations.

Are you practicing sound Revenue Management? Realistically it governs everything important to operating the property; ability to rent vacancies, meet leasing goals, renew leases, to have funds available for future common area budgets, to stay on schedule for capital improvements, or to add staff. I’m still surprised when we see experience on the expense side of the budget but inability to create clear revenue management objectives. Everyone on the team must understand just how important every lease at market pricing is to the rental operation, property value and ownership investment returns.

As an example, when we show leasing specialists and maintenance technicians the details of understanding the cost and effect of a vacancy including lost rent, physical preparation of market-ready rental, marketing requirements, leasing and inadvertent lost team time to accomplish alternative assignments -- the team took more interest in controlling results. They also gained insight into how to improve

communication between leasing and maintenance. Then we walked them through the impact on Net Operating Income (NOI) as well as the relationship between NOI and real estate value. Finally, we helped them understand real estate investment expectations. Overall, there was a substantial awakening to the realities of the business they are in and the ‘why’ of their respective assignments. Suddenly, they knew that their operational routines matter to this business. They saw ‘behind the curtain’ and it changed their performance from that point forward because it became a ‘tether’ for all our subsequent coaching. The results are remarkable.

Properly pricing each of your rental units is a necessary ongoing process to stay competitive in the market at all times. In addition, every living space should be individually priced: according to location within surrounding neighborhood and including onsite (community/floor level and adjacency); floorplan (size/

design/features); availability and uniqueness (one-of-a-kind/view). For example, during an assignment to strategize the initial lease-up of a brand new 40-story apartment building being marketed as the “tallest residential building in New Jersey” at that time, the rent roll was aggressive and there was going to be substantial consumer sticker-shock. The lender was already pushing back on the extent of concessions currently discussed. We asked and received permission to individually price the 415 apartment homes as long as our total equaled or exceeded their total. We met the pricing concerns, created unique leasing presentation and closing capabilities, and produced an occupied property on schedule.During the last decade many revenue optimization tools have been introduced to help management professionals review, revise and re-price individual rental units (even on daily basis) whether single detached houses, townhomes, individual condos or apartment homes.

There are also ‘leasing matrix’ techniques utilized by rental operators to efficiently match lease expirations throughout a portfolio of rentals to periods of optimum ‘leasing traffic’. These techniques afford adequate traffic to address potential rent loss from available vacancies without overtaxing the leasing and maintenance team. Timely utilization of dependable vendors during these high volume intervals pose an additional need to develop and adhere to a ‘leasing matrix’. A new lease-up or a major ‘repositioning’ of property utilizes other techniques such a ‘target list’ to accomplish the same goals of maximizing work flow and market pricing. If short-term rental is allowed or other exceptions to the ‘leasing matrix’ are allowed it should only be at substantial ‘pricing premium’ to compensate for uncovered rent loss.

The last major component of Revenue Management is your renewal program. I’ll leave the details of optimizing your renewal practices to a subsequent column. Suffice it to say that renewal programs must be planned with buy-in from the entire operating team (both onsite and off-site). The renewal plan incorporates intelligence from residents’ files, an invitation to renew followed by an individual appointment with a prepared and practiced leasing presentation. Renewals especially when a major re-pricing to market is underway are tough. Renewals are not for sissies but essential to optimizing NOI. In my experience a portfolio can enjoy a 4-5% bump to NOI for every 1% improvement to the ‘renewal rate’.

You cannot increase NOI or customer satisfaction by keeping rents below market. There is plenty of evidence showing that this practice is actually linked to other practices and/or outcomes that begin a physical deterioration and financial de-evaluation of property value. In addition, there are unwanted increases to liability due to postponed and/or unreported deferred maintenance. The biggest problem seems to be the increased difficulty of rectifying this situation the longer it is allowed to continue. Literally, I have seen owners choose to sell rather than engage necessary management expertise to ‘reposition the operations’.

Revenue management is critical to ‘repositioning the physical condition’ as well. Our “rental stock” is getting older. This fact must be addressed. The timing should be planned rather than forced by renters demanding value from their “rent dollar.” Done strategically, revenue management combined with “capital re-investment” will maintain competitive operations and capture, over the next 5 years, what might be the biggest property value gain in memory.

Now I realize that many Independent Rental Owners have suffered during the great recession and there are still market complications from that time. However, I need to emphasize that our region is in the initial stage of a completely different economic condition. As a keynote speaker on “The State of the Industry in San Diego” panel at this year’s SDCAA EXPO I attempted to address what I see as “connecting the regional

economic data to the next 5 years of independent rental ownership in this region.” I’ll discuss more on this in the next column along with the importance of ‘re-investing in your property’; ‘how-to’ methods and pitfalls.

Legislative• San Diego City Council considers Ordinance regading Zero Waste• State Utilities Commission approves controversial electricity rate plan• Chula Vista approves Council Districts

San Diego City Council considers Ordinance regarding Zero WasteOn July 13, the San Diego City Council unanimously approved a conceptual strategy on how the city will divert virtually all of its waste from the city’s landfill by 2040 – known as its Zero Waste policy. While city already currently diverts two-thirds of its waste, the new strategy hopes to divert up to 75 percent of the city’s solid waste by 2020, 90 percent by 2035, and eventually reach 100 percent diversion by 2040.

The strategies adopted by the City Council include the repeal of the People’s Ordinance and require that all residences in the city to pay for trash service. Require waste haulers to provide bins used for recyclables and green waste to more of its customers, and require waste haulers and the city’s recycling facilities to increase their recycle rate from 26 percent to 50 percent by 2020.

According the Independent Budget Analyst

Office, the policy will cost an estimated $8 million to the city, but the city can cover the cost if the city council adopts the funding recommendations proposed by the City’s Environmental Services Department. Although the policy has been approved, the City Council and Mayor will still need to approve each strategy individually. SDCAA will be analyzing the proposals as they come forward.

State Utilities Commission approves controversial electricity rate planThe California Public Utilities Commission (CPUC) approved a phased, multi-year electricity rate plan in July. The multi-year plan will take effect beginning in 2016 with new regulations taking effect each following year until it is fully implemented in 2019.

The CPUC’s plan will eventually create a two-tier rate pricing system for all customers with a radically new “time-of-use” rate structure going

into effect beginning in 2019. Over the next several years, the present rate system of 4 tiers will reduce to 2 tiers. The pricing in both tiers will be based on new formulas so there is less price disparity. In 2019, all customers will be enrolled into the time-of-use rate structure, but the two-tier structure will still be available.

Residential customers deemed heavy users will pay higher utilities rates compared to those

who use less electricity. But, consumer groups complain that heavy users will pay less comparatively under the new plan than under the present rate structure. Meanwhile, customers that use less energy under the present plan will pay more for electricity in the new plan.

Low and moderate energy users, and subsidized low-income customers will see higher utility rates under the plan. In addition,

minimum bill charges will increase to $10 a month from $5, and subsidized customers will pay the $5 minimum charge under the new plan. All customers still will be responsible for paying the minimum charge even if their electricity usage drops to zero. Many subsidized low-income customers will see their discount rate reduced from 35 percent to 30 percent.

The utilities argued that the present rate system was unsustainable because it provided too many protections to customers that used less energy while imposing expensive rates on the small minority of heavy users. The utilities contended that the majority of customers that used less electricity were paying less than what it cost the utilities to maintain, operate, and update the state’s energy grid. The utilities asked the commission to support a new rate structure where consumers would pay more for fixed costs. The CPUC opted for the minimum charge rather than impose fixed cost charges for now; however, the plan still gives the commission the option to adopt fixed costs in the future.

The commission will soon vote on new tariffs and credits for solar systems. Solar customers and companies that install photovoltaic systems argue the new plan will discourage new customers from getting solar systems and discourages energy conservation.

As mentioned earlier, the commission adopted the implementation of a new “time-of-use” rate plan that start on

January 1, 2019. All customers will be automatically enrolled in the "time-of-use" plan. How much customers pay for energy will depend on when during the day or night they use energy. The plan is intended to get customers to use less electricity during peak times when demand for energy is at its highest so the state can rely less on expensive fossil fuel powered “peaker” plants. Supporters say time of use will encourage people to use less energy while opponents who live in colder or hotter climates will have no choice but to pay more for energy to stay cool or warm. However, customers may opt out of the time-of-use plan to go back to the two-tier plan. The RHC will continue to track and provide you updates as new regulations emerge.

Chula Vista approves Council DistrictsIn a major shift how the City of Chula Vista elects Councilmembers, the City Council voted 4-0 to establish four specific council districts on July 14. Each district will cover a geographic location representing approximately 60,000 residents, and beginning in 2016 each councilmember will represent their district like the City of San Diego and Escondido.

The boundaries of each district were created to keep populations relatively even, kept continuous, and keep communities whole. District 1 will represent the northeastern part of the city, which include the neighborhoods of East Lake, Otay Lakes, and Terra Nova. District 2 represents the northwest section which include the areas of Downtown Chula Vista, North of L Street, and south of State Route 54. District 3, the largest district in terms of geographical size, will cover the southwest neighborhoods along East H Street, south of Telegraph Canyon Road, and east of I-805. District 4 covers the southeast portion of the city representing areas west of I-805, North of Main Street, and the neighborhoods by the Otay Valley Regional Park.

In 2012, city residents approved Proposition B requiring that city council members reside in the districts they represent. Previously, councilmembers were elected by all residents and represented the entire city. The city held 10 workshops and received comments from residents. Elections for Districts 3 and 4 will begin June 2016, elections for Districts 3 and 4 will start in June 2018.

The Legislature is winding down to the summer break (July 17 – August 17),

which means we are once again up against committee deadlines. The policy committees are required to meet and have their bills heard by July 17th. As that date approaches, legislators are hurrying to get bills amended. This escalated effort also involves many of the key bills on which SDCAA is actively involved. Alan, Molly, SDCAA committee members and our lobbying team continue to closely review the flurry of amendments flying back and forth. The Legislature will be out for a month, and SDCAA will use that time to assess and strategize on the bills that have survived in varying forms.

Part of the process includes bills being gutted and amended. This means the content of one bill is completely stripped out and amended with language unrelated to its original content. For example, a gut-and-amend that significantly impacts SDCAA members is AB 723 (Rendon).

The bill recasts underlying law – SB 407 (Padilla-2009) – and turn what was a cooperative agreement into a matter that promotes confrontation and

possible legal disputes.

In 2009, SB 407 was passed and signed into law. The law is simple: owners of single-family housing must install water-saving fixtures throughout their properties by January 1, 2017. Owners of multifamily housing have until January 1, 2019, to do likewise. Cognizant of the difficulties inherent with meeting the requirements of SB 407, single-family owners were given 8-years to comply and multifamily owners were given 10-years.

AB 723 implies that owners are

not complying with the law as “quickly” as the sponsors may like; a law that does not take effect until 2019. If that is the motivation for the bill, where is the evidence? Our opposition is premised on this particular legislation being a solution in search of a problem.

The bill proposes new “disclosure” requirements on property owners – forcing them to throw out their leases and remake them with a disclosure that states, “I will install new showerheads by January 1, 2019.” The purpose of this caveat is lost on us. Common sense and appropriate business

practices beg the question; “Why would a property owner change all their leases to mention a law that does not take effect until 2019?” Also, with no advance notice or discussion, the author of AB 723 is considering amendments to establish an AB 407 enforcement regime squarely aimed at penalizing rental property owners – including unilateral rent reductions and new lawsuits – turning the original, negotiated law into an us vs. them policy.

Thousands of state laws are on the books that compel millions of California citizens and business owners to follow their provisions. The presumption of AB 723, however, is that owners and property managers do not understand the laws andwill not comply with the law. This heavy-handed legislation does not take into account local ordinances requiring retrofitting under certain circumstances. AB 723 also suggests property owners aren’t motivated to meet or aren’t already meeting the objectives of the law. The bill is being promulgated with a disregard for facts and collaborative discussion. Oddly, the bill’s content suggests that the author believes the laws of California require secondary laws to simply re-state the purpose of the original laws.

We don’t want to keep kicking the same horse, but AB 723 undermines an agreement reached in good faith over five years ago. For those reasons, SDCAA is opposing the bill and has notified San Diego legislators of their position.

We have also been working on

amendments to other bills of importance to SDCAA. They include:

SB 328 (Hueso) – Pesticide application by landlord: The bill requires a landlord or a landlord's agent to provide a tenant, and any tenant of adjacent units, with advance written notice of the use of

pesticides at a dwelling unit if the landlord or authorized agent applies any pesticide without a licensed structural pest control operator. We had significant concerns regarding the bill. It overcomplicated a process that did not need to be complicated. However, we have been working with Senator Hueso’s office and, as of this writing, are close to amending the bill to make it

workable for all parties concerned.

SB 551 (Nazarian) – Bedbugs: SDCAA has an oppose unless amended position. This is another bill we have been working on and are close to resolving our issues. We have one last amendment in which we are seeking to eliminate the requirement to purchase a bedbug management plan from a PCO if we already have one. After extensive talks with the sponsor’s, we have shared language with them to address our concerns. In the end, I believe our last remaining concern will be addressed.

SB 655 (Mitchell) – Mold: SDCAA is opposed to SB 655 and we have been seeking amendments to address our concerns. SDCAA supports proven and scientifically sound approaches to help ensure safe housing while encouraging property owners, managers and occupants to follow best practices for controlling excess moisture and mold in buildings. However, SB 655 went overboard in its application. As a practical matter, the author has been working on amendments with us and other opponents of the bill and as they began to sign-off on amendments it has become more difficult to stop the bill from

moving forward. To that end, SDCAA has been engaging the author’s office and sponsors on amending the bill to address our concerns. As of this writing, we continue to work on addressing those issues.
