Personal Safety and Turnover - Hiring the Right People !

Psychometric Testing !When hiring, first test, and then interview. That’s the protocol suggested by a recent HBR article. In 2012, 7 million people applied for 260,000 jobs. That translates to hundreds of applicants for a single position. Often resume’s are embellished, and interviews may not uncover the red flags that contribute to absenteeism, poor work ethic or performance. Using psychometric testing first weeds out the least suitable applicants for a service based job. The 17 question initial screening measures a variety of metrics. !Here is an example of a typical question: !A customer has dropped a bottle, and broken glass and oil are spreading across the floor. One of your colleagues is helping the customer. You have a lot of shelves to refill before your break. Her responsibilities will be to perform final inspections of the night interior work, address work orders, and address staffing problems. They will perform detail inspections and create special project assignments that focus on improving small visual details that make a big difference in the property. A full description of all employee positions and management structure is included in the transition plan. To minimize issues with communication, all day staff will speak and write English and will be provided with company iPhones so they can report through CBRE’s work order system. !!

2. Damp wipe horizontal surfaces to remove spillage as needed

3. Clean all entry door glass, handles and metal frames to remove fingerprints and polish kick plates.

1. Empty sanitary napkin receptacles and wipe with a disinfectant.

2. Clean and sanitize mirrors, towel cabinets, dispensers, faucets and polish bright work.

3. Toilets and urinals to be cleaned and sanitized inside and outside. Toilet seats to be cleaned on

both sides using a disinfectant. Polish bright work.

4. Clean and sanitize all sink basin and counter tops. Polish bright work.

5. Dust partitions, walls, artwork, tops of mirrors and frames, door frames, air vents, vanities, etc.

6. Remove splash marks from walls around sink basins and urinal partitions.

7. Clean and disinfect showers. Polish bright work.

8. Dust locker exteriors. Removes wired clothes hangers from the tops of lockers.

9. Clean and sanitize drinking fountains, doors, and door handles. Spot clean fingerprints, marks and

to be furnished by CLIENT.)

4. Dust walls, lockers, tops of mirrors, frames, vanities, air vents, fan blades, lights, light fixtures.

5. Clean and sanitize all sink basins. Polish bright work.

6. Clean mirrors, top to bottom, in exercise and movement studio

7. Mop all hard surface floors with a neutral disinfectant cleaner. Remove rubber mats, clean and

clean.

8. Clean and disinfect walls and floors in wet steam rooms.

both sides using a disinfectant, polish bright work.

10. Clean countertops and shelving.

3. Dust and damp mop all hard surface floors. Vacuum carpeted floors.

4. Police employee entrance area for debris and litter. Remove as needed.

5. Police for bedrid, loading dock.

6. Police for bedrid trash compactor, can and chemical stooge areas. Hose clean nightly. Trash

Compactor Container area will be maintained by hotel.

!B. Weekly:

2. Spot clean all horizontal and vertical surfaces to remove spillage. Clean bar tops and counter tops.

3. Clean all interior door glass and door handles. Spot clean interior glass.

4. Vacuum carpeting, taking care to get into corners, slog edges and beneath furniture

5. Dust mop or vacuum all hard surface with an untreated dry dust mop, remove gum, etc.,

6. Damp mop hard surface floors with a wood cleaner. (Bona)

7. Spot clean carpeting to remove spills etc., as needed.

8. Vacuum and/or brush clean all upholstered furniture as needed.

9. dust and damp wipe all baseboards as needed.

!!B. Weekly Cleaning

1. Accomplish all high dusting not reached in above mentioned cleaning. (Ceilings, wood Work and

CLEANING SCHEDULE Kitchens !

Kitchens to include: Main Kitchen, Banquet Kitchen, Saguaro Blossom and Employee Kitchen, Onyx and Proof Bars. !A. Nightly Cleaning

1. Glass: Spot clean all interior door and wall glass.

2. Walls, Pillars, Ceiling Tiles: Spot clean to remove, spills, splatters, scuffs and streaks.

3. Sinks: Clean and rinse. Clean drains.

4. Floor Drains: Remove and clean covers and screens. Clean debris. Flush with hot water.

5. Floors: Sweep, deck scrub with degreaser, vacuum waster water and dry all kitchen, bar and

passage way flooring.

6. Floor mats: Collect and remove to designated area. Clean and degrease. Allow to drip dry.

Replace in original location insuring mat connectors are in place.

7. Doors: Spot clean to remove fingerprints and scuff marks.

8. S/S Tables and Shelving: Clean open and unobstructed surfaces and wipe dry.

9. Fixtures/Dispensers: Clean tops, sides, underneath and edges. If shelves are cleared by hotel,

Mmi to automatically clean. Hotel will attempt to notify by email as well.

10. Vents: Spot clean to remove dust, fingerprints, spills, splatters and residue.

11. Trash Cans: Hotel agrees to do a final trash run of all trash containers located in all kitchen and bar

areas between 8pm-11pm, and replace liners. Oranje agrees to empty all cans located in the

kitchen and bar areas, at least one time per overnight shift, if there is trash in them, and to replace

liners. (Liners to be provided by CLIENT.) Hotel is responsible for cleaning the interior and exterior

of all trash cans.

Kitchens to include: Main Kitchen, Banquet Kitchen, Saguaro Blossom and Employee Kitchen, Onyx and Proof Bars (Lower Level Ironwood Kitchen not included). Ironwood Banquet kitchen will not be cleaned on night it is not used. !A. Nightly Cleaning

1. Hoods: Clean and degrease exterior of all hoods daily.

2. Stoves, Ovens, Broilers, Flat Tops, Salamander, etc: Clean burners. Clean all surfaces inside,

outside, sides and rear if possible. Remove grease drippings, carbon deposits and residue. Remove

and clean drip pans and racks. Clean burner holes. Replace foil if needed. Foil and seasoning for

ovens. Broilers and grills to be provided by the hotel.

3. Deck Ovens: Clean all surfaces inside and out. Remove and clean racks. Clean pilot light drawers of

drippings and residue. Replace foil.

4. Convention Oven: Clean all surfaces inside and out. Remove and clean racks.

5. Deep Fryers: Clean exterior surfaces. Clean inside door. Clean inside of kettle only if emptied by

hotel staff.

6. Tilt Kettle and Steam Kettle: Clean all exterior surfaces daily. Clean inside of kettle only if emptied

by hotel staff.

7. Hot Water Food Warmers/Steamers: Clean inside and out. Remove and clean racks.

8. Slicers, Mixers, Band Saws, Rollers, Griddles: Clean external surfaces. Clean stands top to floor.

special project.

point. (Liners to be furnished by CLIENT.)

5. Damp wipe all pubic and private phones using disinfectants.

6. Dust mop or vacuum all hard surface floors with an untreated dust mop or vacuum.

7. Damp mop all hard surface floors.

8. Vacuum carpeted areas, spot clean carpeting to remove spills and stains. Vacuum and/or brush clean

upholstered furniture as needed.

Service Agreement !This JANITORIAL SERVICE AGREEMENT (the “Agreement”) is made effective as of this _______ day of _______________________, 20______ (the “Effective Date”) by and between Oranje Commercial Cleaning (hereinafter “Company”) and Four Seasons Resort Scottsdale at Troon North (hereinafter “Client”) for services at 10600 E Crescent Moon Dr, Scottsdale, AZ 85262. Company and Client are referred to herein each as a “Party” and, collectively, as the “Parties.” !WHEREAS, Client desires for Company to perform the cleaning and maintenance services described herein and set forth in detail in Exhibit “A” hereto (the “Services”) at certain of Client’s facilities, as also set forth in Exhibit “A” hereto (the “Facilities”); and !WHEREAS, Company is willing to provide the Services at such Facilities upon the terms and conditions set forth in this Agreement; !NOW, THEREFORE, for good and valuable consideration, the receipt of which is hereby acknowledged by the Parties, Company and Client agree as follows: !1. Services. Company shall provide the Services listed in Exhibit “A” hereto, as it may be amended

from time to time in a writing signed by the Parties, at the Facilities, as also listed in Exhibit “A” hereto. In addition to the Regular Services listed on Exhibit “A”, Company may provide Additional Services listed on Exhibit “A”, as requested by Client from time-to-time, and Client agrees to pay the prices stated on Exhibit “A” for the provision of such Additional Services. Should Client desire for Company provide other services not listed on Exhibit “A”, the Parties shall agree in writing upon the terms for the provision of such services. All services provided by Company will be performed on weekdays (excluding state or federal holidays, credits for which were considered as part of any costs and fees stated in this Agreement such that no other adjustments for such holidays will be made) after business

hours unless otherwise stated. Company and/or its agents shall furnish all equipment and cleaning supplies necessary for the performance of the Services.

2. Commencement of Services; Term; Automatic Renewal. Company shall commence providing the Services on ___________ ___, 20___ (the “Commencement Date”). The initial term of this Agreement shall be from the Effective Date until one (1) year after the Commencement Date (the “Term”). Unless this Agreement is terminated pursuant to Section 6 below, the Term shall automatically extend and renew annually on each anniversary of the Commencement Date upon the same terms and conditions plus a standard 3% cost increase, unless one of the Parties provides written notice of the termination to the other Party at least thirty (30) days prior to such anniversary date. If timely notice is give for termination, this agreement will expire at midnight of the anniversary of the Commencement Date. !

3. Hazardous Materials. Client warrants that Client’s Facilities are free of asbestos and all other hazardous materials and hazardous waste materials (collectively, “Hazardous Materials”), and Company reserves the right to seek recovery from Client for any injuries, damages, losses, or other liability to Company or any of its agents, employees, or independent contractors due to their exposure to such Hazardous Materials at Client’s Facilities. Client further holds Company and its agents harmless and indemnifies Company from any and all liability for the exposure of Client and/or Client’s agents, employees, or independent contractors due to their exposure to such Hazardous Materials or other harmful conditions at Client’s Facilities. !

4. Independent Business Relationship. Company will select and designate all representatives, agents and/or independent contractors to perform the Services, certain of which may be independent contractors of Company. All persons rendering the Services will be independently bonded and insured. The Parties agree that (i) neither Company nor any of its representatives, contractors, independent contractors or sub-contractors, are or shall be deemed to be employees or agents of Client during the term of this Agreement, (ii) that such persons will not be within protection or coverage of Client’s workers' compensation insurance, and (iii) that no withholding of social security, federal or state income tax or other deductions shall be made from the sums agreed to be paid to Company herein.

!5. Non-Solicitation; Non-Employment. Company warrants, covenants and agrees that, during the term

of this agreement and within one hundred and fifty (150) days thereafter, Company will not employ any employees, agents or representatives of Client without the express written consent of the Client. Client warrants, covenants and agrees that, during the term of this agreement and within one hundred and fifty (150) days thereafter, Client will not employ any employees, agents or representatives of Company without the express written consent of Company. !

6. Termination. Other than a termination pursuant to Section 2 above upon an anniversary of the Commencement Date, this Agreement may only be terminated as follows: (a) Early Termination By Client Without Cause. Upon thirty (30) days’ written notice to Company of

Client’s desire to terminate this Agreement (including due to Client’s vacating the Facilities) and Client’s payment to Company at the time such notice is provided of an early termination fee equal to one-half of the number of months from the month during which such notice was provided to the anniversary of the Commencement Date multiplied by the average of the monthly fees and other charges by Company to Client for the Services for the three (3) months preceding such notice multiplied plus the cost of any free (“tag”) services that were included in the Agreement.

(b) Early Termination By Client Due To Destruction of Facilities. If one or more of the Facilities is/are destroyed, Client may immediately terminate this Agreement as to any and all Services to be performed at such destroyed Facilities by providing written notice of Client’s desire to terminate the provision of such Services at such destroyed Facilities, which Services and Facilities shall be specifically set forth in such notice.

(c) Early Termination By Company Due to Client’s Non-Payment. Client’s failure to pay to Company any sum when due shall constitute a breach of Client’s obligations pursuant to this Agreement, and Company may terminate this Agreement immediately upon Client’s failure to pay any sum due to Company within ten (10) business days of Client’s receipt of an invoice or other notice that such amount is due. Company may also, at its sole discretion, suspend provision of the Services,

including during the aforementioned ten (10) business day period, until Client tenders payment in full of all amounts listed in the aforementioned invoice(s) or notice(s).

(d) Early Termination by Client Due to Company’s Material Breach. Other than as set forth in Sections 2 and 6(a) above, Client may only terminate this Agreement due to Company’s material breach of this Agreement, which shall mean a failure of Company to perform its obligations pursuant to this Agreement after (i) Client provides a written notice identifying such alleged breach(es) to Company with specificity and Client’s proposed corrective action, (ii) Client and Company confer regarding such alleged breach(es) and Client’s proposed corrective action, and (iii) Company fails to cure such alleged breach(es) within ten (10) business days following the later of such written notice or conference; provided, however, that none of the following shall constitute a material breach of this Agreement:

i. Company’s provision of the Services in the manner required by this Agreement; ii. Company’s failure to provides services or products Company is not required by this

Agreement to provide; and iii. Company’s performance of the Services in a reasonably prudent and acceptable manner

according to community standards for the janitorial and maintenance services industry, even if Client demands some additional or more extensive performance by Company. !

7. Payment to Company. Payment upon all invoices is due upon receipt; and such balances, if not paid within ten (10) days, shall accrue interest at one-and-a-half percent (1.5%) per month. Client agrees to pay Company for the Services and any applicable sales taxes or other taxes, pursuant to the terms of this Agreement, in valid United States currency via cash, check, or credit card by delivering same to the following address:

8. Miscellaneous. (a) Time of the Essence. Time is of the essence concerning all of Client’s obligations pursuant to this

Agreement.

(b) Counterparts and Signatures by Fax or Pdf. This Agreement may be executed in one or more parts, all of which taken together shall constitute one instrument. The Parties agree that fax or pdf signatures shall be deemed original signatures for the purpose of this Agreement.

(c) Entire Agreement. The terms of this Agreement constitute the entire agreement between the Parties and supersede any prior agreement between the Parties; and the Parties represent that there are no collateral agreements or side agreements not otherwise provided for within the terms of this Agreement.

(d) Modification. Any modification or amendment of this Agreement shall be in writing and shall be signed and executed by all the Parties.

(e) Severability. In the event that any term or provision in this Agreement is determined to be unenforceable by a court or arbitrator of competent jurisdiction, then such unenforceability shall not invalidate the entire Agreement. The Parties shall be entitled to enforce all other provisions of this Agreement regardless of any partial invalidity.

(f) Succession of Benefits. The provisions of this Agreement shall inure to the benefit of and be binding upon the Parties hereto, their heirs, executors, administrators, and assignees.

(g) Non-Waiver. The failure by one Party to require performance of any provision of this Agreement shall not affect that Party's right to require performance at any time thereafter, nor shall a waiver of any breach or default of this Agreement constitute a waiver of any subsequent breach or default thereof.

(h) Arbitration. Any and all disputes, controversies or claims arising out of or relating to this Agreement or any alleged breach thereof shall be settled by arbitration in Phoenix, Arizona. One arbitrator shall be each Party, and the third arbitrator shall be named by the two arbitrators so chosen. In the event the third arbitrator is not agree upon, he or she shall be named by the American Arbitration Association. The parties shall name the arbitrators within thirty (30) days after one or the other has given notice. The award made by all or a majority of the panel of arbitrators shall be final and binding, and judgment may be entered in any court having jurisdiction thereof. The cost of the arbitration procedure shall be borne by the losing party, or, if the decision is not clearly in favor of one party or the other, the costs shall be borne as determined by such arbitration proceeding. At the request of either party, arbitration

proceedings shall be conducted in the utmost secrecy. In such case, all documents, testimony and records shall be received, heard and maintained by the arbiters in secrecy, available for inspection only by any party and by their respective attorneys and experts who shall agree, in advance and in writing, to receive all such information in secrecy. In all other respects, the arbiters shall conduct all proceedings pursuant to the Uniform Arbitration Act as adopted in the State of Arizona and the then existing rules and regulations of the American Arbitration Association governing commercial transactions to the extent such rules and regulations are not inconsistent with such Act or this Agreement.

(i) Attorney's Fees and Costs. If any Party fails to comply with any of the provisions of this Agreement and the other Party initiates an arbitration to enforce such provisions, the losing party in such action will pay the prevailing party’s reasonable costs and expenses, including attorney’s fees, incurred therein.

(j) Applicable Law. This Agreement shall be governed by, and construed and enforced in accordance with, the law of the State of Arizona, notwithstanding any conflict of law provisions to the contrary.

(k) Paragraph Headings. Paragraph headings used herein are for convenience and reference only and do not define, limit, or describe the scope or intent of any provision in this Agreement.

(l) Interpretation. All Parties acknowledge that they have been, or have had the opportunity to be, represented by counsel in negotiating this Agreement. As a result, the Parties agree that the terms of this Agreement shall not be construed against the drafting party, but shall be construed according to their plain meaning.

(m) Authority to Sign. Each Party expressly and severally represents and warrants that it is authorized to enter this Agreement, that the person signing on behalf of that Party is authorized to do so, and that this Agreement, when executed by all of the Parties, constitutes a binding and enforceable obligation of such Party in accordance with the terms of this Agreement. !!!

7. Spot clean carpeting to remove spills etc., as needed.

8. Vacuum and/or brush clean all upholstered furniture as needed.

1. Glass: Spot clean all interior door and wall glass.

2. Walls, Pillars, Ceiling Tiles: Spot clean to remove, spills, splatters, scuffs, and streaks.

3. Sinks: Clean and rinse. Clean drains.

4. Floor Drains: Remove and clean covers and screens. Clean debris. Flush with hot water.

5. Floors: Sweep, machine scrub with degreaser, vacuum waster water and dry all kitchen, bar and

passage way flooring.

6. Floor mats: Collect and remove to designated area. Clean and degrease. Allow to drip dry. Replace

in original location insuring mat connectors are in place.

7. Doors: Spot clean to remove fingerprints and scuff marks.

8. S/S Tables and Shelving: Clean open and unobstructed surfaces and wipe dry.

9. Fixtures/Dispensers: Clean tops, sides, underneath and edges. If shelves are cleared by hotel, Mmi

to automatically clean. Hotel will attempt to notify by email as well.

10. Vents: Spot clean to remove dust, fingerprints, spills, splatters and residue.

11. Trash Cans: Hotel agrees to do a final trash run of all trash containers located in all kitchen and bar

areas between 8pm-11pm, and replace liners. MMI agrees to empty all cans located in the kitchen

and bar areas, at least one time per overnight shift, if there is trash in them, and top replace liners.

(liners to be provided by hotel) Hotel is responsible for cleaning the interior and exterior of all trash

cans.

1. Hoods: Clean and degrease exterior of all hoods daily.

2. Stoves, Ovens, Broilers, Flat Tops, Salamander, etc: Clean burners. Clean all surfaces inside, outside,

sides and rear if possible. Remove grease drippings, carbon deposits and residue. Remove and

clean drip pans and racks. Clean burner holes. Replace foil if needed. Foil and seasoning for ovens.

Broilers and grills to be provided by the hotel.

3. Deck Ovens: Clean all surfaces inside and out. Remove and clean racks. Clean pilot light drawers of

drippings and residue. Replace foil.

4. Convention Oven: Clean all surfaces inside and out. Remove and clean racks.

5. Deep Fryers: Clean exterior surfaces. Clean inside door. Clean inside of kettle only if emptied by

hotel staff.

6. Tilt Kettle and Steam Kettle: Clean all exterior surfaces daily. Clean inside of kettle only if emptied

by hotel staff.

7. Hot Water Food Warmers/Steamers: Clean inside and out. Remove and clean racks.

8. Slicers, Mixers, Band Saws, Rollers, Griddles: Clean external surfaces. Clean stands top to floor.

Proof Bar will have the grout deep cleaned at no additional charge.

Club, Bell closet, Wine Room, Housekeeping Office, Exec Steward Office 1. Scrub and recoat up to 1x per month, on request only, no additional charge.

!General Notes

1. Honing, polishing, and sealing of any and all stone surfaces in will be treated as project work. IE:

Travertine Floors and Walls, Flagstone and Slate Floors and Walls, Marble Counter Tops.

2. High dusting in ceilings, lattices and other areas not reachable by standard 6’ ladder will be treated as

special project.

3. Grout cleaning, unless specified in this schedule, will be treated as project work.

RESIDENCE CLUB CLEANING SCHEDULE

Lobbies/Foyers !

Main Lobby, Reception Area, Library, Game Room, Fitness Center, Administrative Areas, Back of House Area !A. Nightly Cleaning

1. Thoroughly dust all horizontal surfaces under 8’ including tables, chairs and furnishings. High

dusting of vents, fans, etc will be checked daily and completed if needed.

2. Damp wipe horizontal surfaces to remove coffee rings and spillage as needed.

3. Clean all entry door glass o both sides, handles ad metal frames to remove fingerprints and polish

kick plates.

4. Empty trash receptacles in entrances, reception and bell desks and remove to a central collection

point. (Liners to be furnished by CLIENT.)

5. Damp wipe all pubic and private phones using disinfectants.

6. Dust mop or vacuum all hard surface floors with an untreated dust mop or vacuum.

7. Damp mop all hard surface floors.

8. Vacuum carpeted areas, spot clean carpeting to remove spills and stains. Vacuum and/or brush clean

upholstered furniture as needed.

9. Vacuum “walk off”mats.

10. Check and remove cobwebs from all entrances.

11. Clean and polish drinking fountains.

****Stripping and sealing of any flagstone flooring will be treated as project work.****

Restrooms !

Restrooms to include: Guest Restrooms, Administrative Area Restrooms, Locker Rooms !A. Nightly Cleaning

1. Stock towels, tissue and hand soap. (To be furnished by CLIENT.)

2. Empty sanitary napkin receptacles and wipe with disinfectant.

3. Empty trash receptacles and wipe with disinfectant. (Liners to be supplied by CLIENT.)

4. Clean and polish mirrors.

5. Toilets and urinals to be cleaned and sanitized inside and outside. Polish bright work.

6. Scour and sanitize all basins. Polish bright work.

7. Dust partitions, walls, tops of mirrors and frames, air vents and vanities.

8. Remove splash marks from walls around basins.

9. Mop and rinse restroom floors with a neutral disinfectant.

10. Clean and disinfect showers and steam rooms. Polish bright work.

11. Damp wipe lockers.

12. Clean and sanitize drinking fountains.

13. Vacuum and carpeted areas.

RESIDENCE CLUB CLEANING SCHEDULE

Kitchens !

Kitchens to include: Ocotillo Kitchen !A. Nightly Cleaning

1. Glass: Spot clean all interior door and wall glass.

2. Walls, Pillars, Ceiling Tiles: Spot clean to remove, spills, splatters, scuffs and streaks.

3. Sinks: Clean and rinse. Clean drains.

4. Floor Drains: Remove and clean covers and screens. Clean debris. Flush with hot water.

5. Floors: Sweep, deck scrub with degreaser, vacuum waster water and dry all kitchen, bar and

passage way flooring.

6. Floor mats: Collect and remove to designated area. Clean and degrease. Allow to drip dry.

Replace.

7. Doors: Spot clean to remove fingerprints and scuff marks.

8. S/S Tables and Shelving: Clean open and unobstructed surfaces and wipe dry. Clean tops, sides

and edges.

9. Fixtures/Dispensers: Spot clean to remove dust, fingerprints, spills, splatters and residue.

10. Vents: Check daily for dust build up. Clean if needed.

11. Trash Cans: Empty and clean exterior of cans. (Only trash generated after 11 PM.) (All liners for

facility to be furnished by CLIENT.)

12. Refrigerator/Coolers: Clean exterior surfaces only.

13. Hoods: Clean and degrease exterior of all hoods daily.

14. Stoves, Ovens, Broilers, Grills, Flat Tops, Salamander, etc: Clean burners. Clean all surfaces

inside, outside, sides and rear if possible. Remove grease drippings, carbon deposits and residue.

Remove and clean drip pans and racks. Clean burner holes. Replace foil if needed.

15. Deck Ovens: Clean all surfaces inside and out. Remove and clean racks. Clean pilot light drawers

of drippings and residue. Replace foil.

16. Convention Oven: Clean all surfaces inside and out. Remove and clean racks.

17. Deep Fryers: Clean exterior surfaces. Clean inside door. Clean inside of kettle only if emptied by

hotel staff.

18. Tilt Kettle and Steam Kettle: Clean all exterior surfaces daily. Clean inside of kettle only if

emptied by hotel staff.

19. Hot Water Food Warmers/Steamers: Clean inside and out. Remove and clean racks.

20. Slicers, Mixers, Band Saws, Rollers, Griddles: Clean external surfaces. Clean stands top to floor.

!B. Weekly Cleaning

1. Wash clean wall tiles with mild degreaser and wipe dry.

2. Clean exhaust hood filters and air vents.

3. Polish copper pipes.
