It was moved by Mr. Rummonds, seconded by Mr. Mitchell, and unanimously carried, that Mrs. Helen Staley be elected Vice President for the 1974-75 Fiscal Year.
It was moved by Mr. Mitchell, seconded by Mrs. Sta ley, and unanimously carried, that Mr. John McFadden be elected Clerk of the Board for the 1974-75 Fiscal Year.
It moved by Mr. Rummonds, seconded by Mr. McFadden, and unanimously carried, that Dr. Fern Stout be elected Secretary of the Board for the 1974-75 Fiscal Year.
It was moved by Mr. Mitchell, seconded by Mr. Rummonds, and unanimously carried, that Mr. John McFadden be named Representative to the County Committee for the 1974-75 Fiscal Year.
It was moved by Mrs. Staley, seconded by Mr. McFadden, and carried, that regular meetings be scheduled as follows: Third Thursday, 8:00 p.m., May through October; 7:30 p.m. November through April. Exception: August 7. Place: College of the Desert Board Room, Palm Desert, except October Meeting on Hi Desert campus.

Mitchell, and carried, that the following positions be declared Hanageria1 for purposes of the Dent Bill: Superintendent/President; Dean of Business Services; Dean of Students; Dean of Instruction; Coordinator of Continuing Education, Coordinator of Occupational Education, Coordinator of Community Services, and Coordinator of Hi Desert Campus.

Please. note the following:
Net Beginning Balance •. JUlll! 197 II, The sbeab Ie increase is due to receivables for projects together with last minute incOme derived from the Predischarge Education Program (PREP). PREP checks in the approximate amoont of $122,000. were deposited during the last week in 1973-74.
Economic Opportml1ty ~ - 'fork Study. We received a sizeable reduction in our Federal allocation for Work-Study funds. The reduction in the amount of $32,922. has been treated as a budget revision (Revision No. 13).
Unsecured Ta~ Receipts. 'The budget estimate is based upon an unsecured valuation ~$74,702,29l., a collection factor of .97 and the 1973-74 tax rate of $.633.
Secure~ Tax Receipts. The budget estimate includes $3,323,486. as an ndjusted secur~d tax lavy requirement plus $264,245. related to the $.05 levy for COtmlunity Services.
The increase in the adjusted requirement is due to a further recomputation of all 1973-74 factors particularly with respect to Average Daily Attendance. Senate Bill 6 (Chapter 209) requires a recomputation of all 1973-74 factors as a part of filting the secured tax levy requirement for 19711-75.
Based upon an estimated secured valuation of $562,824,722. the gross general purpo3e tax rate for 197,.-75 is esthnated to be $.6782. The estimated tax rate for bond interest .'L'1d redemption purpose" iB $.086.

It appears that the Budget Hearing and Adoption of the Budget will be the most important item of business. Since there are no budget revisions, we are recommending no changes from the publication budget.
You will again note that we are asking a near-maximum tax. This seems to be sound in view of various unknown factors. Not only will the added Undistributed Reserve funds provide for any emergency which could arise, it also provides for a form of leavening in the event enrollments decline. (You will recall that our taxing power is based on estimated ADA of the succeeding year.) There is check and balance in the law also, which requires Board approval of expenditures from the Undistributed Reserve.
Two additional items are worthy of consideration: 1) Our ability to hold the line in the expenditure column has been demonstrated, and 2) I believe we are in a stronger position in a tax override request if we continue taxing to the nearmaximum. Otherwise, citizens may wonder why we are asking for more taxing power when we have failed to utilize the power we have.
The enclosed memo from Dr. Ellerbroek along with a representative decision of the court and the Attorney General's opinion clarifies the question of legality in regard to the Board's decision to purchase health and accident insurance for all eligible College employees.
Mr. Clark's letter of July 30 is a bold reflection of our plight in dealing with inflationary costs. If you authorize bidding and ultimately construction, it appears that the construction plus necessary equipment will reach a total outlay of $700,000. This expenditure plus the cost of the parking lot to be completed this month and sewer and gas line installation already authorized (a total of approximately $90,000,) will decrease our present building fund of $930,000 to approximately $130,000. However, the Heavy Equipment Facility is our No.1 priority and costs continue to rise. The balance remaining in the building fund after completion of these projects will provide a little "wiggle" room in case of the need for capital outlay items in the near future. Additionally, it may be more advantageous to have little capital funds on hand than a husky fund when we ask the citizens for more money.

Working drawings and specifications have been forwarded to you under separate cover. These have also been submitted to Community Colleges and to the State Office of Architecture & Construction for approval. OAC approval can be expected toward the end of September, at which time the plans could be issued for bidding. This is in accordance with our Planning and Construction Time Schedule of February 21, 1974, leading to completion of the building on August 1, 1975.
During the preparation of the final drawings it has been impossible to keep up with rising costs, and in spite of many economies, the total budset cost has gone from the $500 000 authorized by the Board to ~600 000. Of the total increase, $30000 is the result of raising the roof height to accommodate bridge crane clearances, as explained in our letter to you dated April 15, 1974.
Items deleted from the program consist of improvements that could be made directly by the purchasing office or by maintenance personnel, all of which could be eliminated or at least deferred without seriously affecting the program. These include elimination of all interior painting except in classrooms and locker shower rooms, folding partitions between classrooms, welding power outlets in Heavy Equipment Shop (power supply to shop provided), earthwork and grading by department personnel, compressed air outlets in shops (air supply to shops provided), floodl ighting of exterior concrete work aprons (security lighting provided), thermal insulation of exterior overhead doors in shops, partitions and other finishes in office section, wall mounted work benches in shops, 1 i ght i ng in storage rooms by mai ntenance personnel (wi 11 depend on shelving locations), and storage room shelving.

CHRISTIAN, J.-Appellants are teachers employed by the Salinas Union High School District; feeling aggrieved by the decision of the district governing board to purchase group health insurance benefits for district employees under Government Code, section 53202 et seq.,' appellants petitioned for a writ of mandate to compel a revision of the district salary schedule. The appeal is from a judgment of dismissal entered after the court sustained respondent board members' general demurrer.
Appellants' basic complaint is that the particular group health insurance

plan which the district board decided to purchase for its employees is more yaluable to teachers who have dependents covered under the plan than to those who have no dependents. The petition alleged that part of the cash salaries of teachers was "directed toward the purchase of health insurance pursuant to an order of the [r)espondents." That allegation is incorrect as a matter of law; it was properly pointed out to the court by respondents (and is now conceded by appellants) that the health insurance benefit in question was not paid for out of payroll deductions; the plan was purchased by the district out of district funds, pursuant to Government Code, section 5:1202 et seq.
Under Education Code, section 13502, the salaries of the district's teachers are fixed by the governing board. It is true, as appellants point out, that Education Code section 13501' prohibits wage discrimination on the basis of sex and that section 13506," in allowing salary differential on the basis of "years of training and . . . years of service" does not specifically authorize any other kind of differential such as differences in the value of employment-related benefits. Nevertheless, appellants' contentions amount on I)' to the assertion that if a district board· chooses to purchase for its employees a group health plan, which under Government Code section 5.1202 it has "determined to be in the best interests of the [district) and the officers ancl employees electing to receive the benefits," it must, if a ~roup plan providing benefits for family members is selected, somehow equalize the cash equivalent of the plan for all employees. It is not clear how thi, would be done: perhaps by ascertaining the cash yalue of the health I'l:!n to the district employee with the largest number of covered dependents, then computing the cash value of coverage as to every other employee, t",ing account of the number of his dependents, if any, ancl paying equal;/ing cash benefits in varying amounts to all employees other than the one ,,\ ith the largest number of dependents.

1. Does Article 1 (commencing with section 53200) of Chapter 2 of Title 5 of Division 2 of the Government Code enable the governing board of a school district to authorize payment, on behalf of its employees, of the charges of' an unlimited number of health and welfare plans?
2. If the number of such plans is limited, what are the nature and extent of the limits?

Cost of individual health and benefit programs will vary, with those programs ,offering the greater number of services usually being the more expensive. Some . probl='might, arise if an agency were to undertake the payment of the entire premiUJll.asit may under Sections ,53200 et seq., where there is a choice of several programs, the cost of which might vary greatly. If, however, the district will pay only a fixed amount for each employee regardless of the COSt of the plan, these difficulties would be obviated.
3. There is no requirement that the plans approved offer substantially similar benefits. Subdivision (d) of section 53200 provides: "Health and welfare benefits

means anyone or more of the following: hospital, medical, surgical, disability, or related benefits, whether provided on an insurance or a service basis, aqd includes group life insurance as deEned in subdivision (b) of this section."
As the statute indicates, some plans offer reimbursement or partial-' reim· bursement for hOspital expenses; others offer reimbursement or partial reimburse-ment for other expenses incurred by reason of illness; some offer a combination of . both. As there is specific authorization for plans offering different services, it necessarily follows that the beneEts offered need nOt be similar. Likewise, the distinctiori between health insurance which offers reimbursement for COSts incurred by reason of illness and "service" type programs which furnish medical and/or hospital services directly to participants in the program is equaUy well known. Authorization for both insurance and service .type plans is also indicative of the fact that the approved plans need not offer substantially similar benefits.
4. The fourth inquiry can be answered by refetence to section 53202 which provides that a plan may be approved by the local agency aCting on its own morion or after considering the preferences of its employees. In short, the agency may consult or take notice of its employees' desires with respect. to the approval" of the medical.benefir plan, but it is not obliged to do so.
5. Section 53202.1 provides: "In apptoving a plan or plans of health and welfare 'benefits the
local agency may approve policies of life, health and accident insurance, or any of them, from an 'admitted insurer or from a nonprofif member· ship corporation (as defined in Section 1157 of this code), wherein a bona fide association, as defined in Section 1157.1 of this code, is the policyholder or contract-holder, for the benefit of the agency and the officers and employees authorizing the purchase."
Section 1157.1 which is referred to in section 63202 defines a bona fide employee association,
It is a usual feature of group insurance offered by an employee organization that membership in the organization is a condition to obtainit~g or retaining coverage in the group's insurance program. In authorizing approval of an insnrance program sponsored by a bona fide employee organization, secrion 53202.1 implicitly, at least, gives sanction to a program which is limited in its coverage to members of an employee organization. TIle agency, then, in considering approval of health benefit plans is not precluded from designating as acceptable some plan which is limited to members of an employee organization. It is assumed that jf an organization plan is approved there will also be available an open plan, that is, one which will accept all employees whether members of an organization or nOt.
6. Section 53202.1 specifically provides for the approval of plans whete the employee organization is the policy holder or contract hC?lder, that is, where the organization holds the maSter contract and, as stated in the reply above to the fifth inquiry, section 53202.1 permits approval of employee plans, even though' participation in sllch plans may be restricted to members of the employee or· ganization.

SUBJECT, Veteran's Representative on Campus
The Veteran's Administration has offered to have a Veteran's Representative to be placed on each college campus to help serve and solve the many problems involved in returning veterans. This individual will work closely with the Veteran's Counselor that we now have on our campus, in attempting to answer complex questions relating to veterans educational assistance benefits. He will attempt to secure faster action to resolve individual payments to veterans from the Veteran's Regional Office. This service will be provided by the Veteran's Administration at no cost to College of the Desert. The college of course will have to provide office space and normal office equipment such as a desk, chairs and files.
An agreement must be entered into between the Coachella Valley Community College District and the San Diego Veteran's Administration Regional Office. This agreement outlines both the distric~s responsibilities as well as the duties of the Veteran's Representative.
It should be noted that this agreement could be terminated at any time upon the request of either party. The term of this agreement is from August 1, 1974 to June 30, 1975. Mr. Matt Monica, Veteran's Counselor and I have studied this proposal at great length and recommend to you that it be presented to the Board of Trustees for their approval.
