I INTRODUCTION

The purpose of this booklet is to explain to Aura-Soma students the benefits of registering with the Academy as an Aura-Soma Practitioner or an Aura-Soma Colour Care Consultant, and the legal obligations incumbent upon them when they join the register. The Aura-Soma-Colour-Care-System® is supervised by the Art and Science International Academy of Colour Technologies (otherwise known as ̀AS I ACT’ or ̀The Academy’) and this booklet explains the role and functions of the Academy and provides the student with a code of ethics to work from.

When you sign the Student Registration Agreement (sometimes called the Student Agreement) or the Practitioner Registration Agreement (sometimes called the Practitioner Agreement) or the Colour Care Consultant Registration Agreement (sometimes called the Colour Care Consultant Agreement or CCC Agreement) it will state that you will need to read and understand this booklet because it is legally binding upon you. If any of these obligations are not clear please contact the Academy using the contact information on the back page of this document.

Through the use of colour we are able to communicate with each other at a much deeper level than can often be reached merely by using language. The tools we need to be able to work with the system and offer it to others arerevealed in the courses leading up to and including the Level 4 course which culminates in the completion of the basic Aura-Soma Colour System training programme. After the completion of the Level 4 course, it is possible to register with the Academy as an Aura-Soma Colour Care Consultant.

In the process of training to become an Aura-Soma Colour Care Consultant it is also possible to register with the Academy to become an Aura-Soma Practitioner. The Academy recognises that direct experience is the best way to develop consultation ability, in conjunction with the further courses in the Aura-Soma Colour System training programme.

All of the guidelines pertaining to working with the public and the benefits you can expect to receive are outlined in this booklet. Please note that some countries have rules which may not be reflected in this ‘Aura-Soma Practitionerand Aura-Soma Colour Care Consultant Guide’. Please check with your local authorities to ensure that you observe any local rules and regulations when you begin practising. Joining the worldwide register of Aura-Soma Practitioners and Colour Care Consultants gives you THE RIGHT TO PRACTISE the Aura-Soma colour system methodology and to do this you must have completed the relevant pre-requisites of the Aura-Soma colour system training. Once the pre-requisites are met, you are eligible to apply for an Aura-Soma PRACTISING CERTIFICATE which, once received gives you the right to call yourself an Aura-Soma Practitioner. If you have completed the Aura-Soma Level 4 course, you may register as an Aura-Soma Colour Care Consultant.

* Important: Anyone wishing to give an Aura-Soma Consultation to the public is required to have a currentregistered Aura-Soma Practitioner Certificate or registered Aura-Soma Colour Care Consultant Certificate which must be displayed at your place of work. If you offer Aura-Soma consultations in locations other than your own place of practice please take your Aura-Soma Practising Certificate with you and display it where your client can see it, so that they are aware of your credentials.

Registering for a Certificate: Please complete and return the relevant Registration Agreement, noting that in so doing you are entering a legal agreement to comply with the practises and conditions as set out in this document and in the Student Registration Agreement. Please note: a revised Aura-Soma Practising Certificate will be issued each time you complete a further level of the Aura-Soma Training. The Aura-Soma Practising Certificate can be renewed annually or biennially and is dependent on the appropriate number of training renewal hours being accrued.

DEFINITION OF A REGISTERED AURA-SOMA PRACTITIONER AND AN AURA-SOMA COLOUR CARE CONSULTANT (effective for all people starting their Level 1 training after 1st January 2009)

A Registered Aura-Soma Practitioner can be described as a student who has completed their required level of training within the Aura-Soma colour care system. They have completed their Registration document and have received and are displaying their Practising Certificate in their place of Practice.

A Registered Aura-Soma Colour Care Consultant has satisfactorily completed the required levels of training within the Aura-Soma-Colour-Care-System to be able to register as an Aura-Soma Colour Care Consultant. They have submitted their registration document to the Academy and they have received an Aura-Soma Colour Care Consultant certificate which they display in their place of practice.

II BENEFITS

BENEFITS OF REGISTERING AS AN AURA-SOMA PRACTITIONER

There are many benefits associated with joining and being registered as an Aura-Soma Practitioner. Firstly, joining informs us of your continuing interest in developments in the world of colour. It opens up an avenue of communication and information that you would not receive in other circumstances including an Academy Newsletter at regular intervals during the year.

Joining the system is not solely about working with the public. As a member there is no requirement to do so, but if you wish to work with the public you will need to register first. Although there is a cost involved in joining and maintaining membership of the Aura-Soma community, it is easily outweighed by the price reduction in products and the value of the information in the guide.

Only the holder of a current Aura-Soma Practising Certificate can describe themselves as an Aura-Soma Registered Practitioner and offer Aura-Soma Consultations to the public.

Registered Practitioners are entitled to use the ‘Aura-Soma Laurel Leaf’ Practitioner Logo in connection with advertising their status as registered Aura-Soma Practitioners. Please refer to Page 8 for the Use of Trademarks.

You will be able to give Aura-Soma colour system consultations to the general public at a reduced fee (as a guideline, a reduced fee can be interpreted as 50% of the cost of a Colour Care Consultant in your area).

You will receive an introductory package which includes your:1. Practising certificate2. The latest Academy Newsletter3. Aura-Soma Consultation Record Pad4. Up to date laminated guidelines5. Laurel leaf logo6. Your photo ID card with student number

If you authorise the Academy to publicise your personal information by ticking the appropriate box on the Practitioner Registration Agreement, the Academy will include your name on the Academy website which will include your Personal contact details, skills and interests.

Members receive The Academy Newsletter The content keeps you informed of the latest developments in the development and evolution of the Aura-Soma colour system. Articles on colour, ancient wisdoms, the subtle anatomy and others deepen our knowledge on these topics. We are happy to receive your articles on related topics for publication in the Academy Newsletter. Please send articles to enquiries@asiact.org.

You will become part of the Aura-Soma practitioner system which has a clear set of practices and principles as set out in this‘Practitioner and Colour Care Consultant Guide’.

The Aura-Soma Practitioner and Aura-Soma Colour Care Consultant register upholds the integrity and professionalism of the Aura-Soma Colour system setting standards and practices consistent worldwide.

Becoming a member and displaying the Registered Practitioner Certificate will help clients to feel confident in the quality of your consultation.

Practitioners receive immediate notification of new products made by Aura-Soma Products Limited and first thoughts on them. This could be via promotional e-mails or letters.

You will have an opportunity to support research into the implications of colour and consciousness – beneficial in the future as the understanding of the research filters into the material disseminated through the Academy.

BENEFITS OF BECOMING AN AURA-SOMA COLOUR CARE CONSULTANT

Once you are fully and registered as an Aura-Soma Colour Care Consultant you will receive everything that a Registered Practitioner receives as well as the extra benefits listed below:

Only the holder of a current Aura-Soma Colour Care Consultant Certificate can describe themselves as an Aura-Soma Colour Care Consultant.

As a Registered Aura-Soma Colour Care Consultant it is possible to charge the full rate for Consultations.

A Registered Aura-Soma Colour Care Consultant Membership card will be issued to you with the appropriate wave form and pyramid logo to show your clients. Please refer to Page 8 for the use of Trademarks.

The Aura-Soma Colour Care Consultant may use the Wave Form and Pyramid Logo in their literature to advertise their Consulting Practice, but not for other uses.

The AS I ACT website will be upgraded to show that you are now an Aura-Soma Colour Care Consultant.

Your information can be passed on at exhibitions where the Academy is present if you consent to this and any relevant telephone enquiries will be forwarded to you if they are from your area.

You will be able to request permitted copyright images from the Academy website to advertise your services.

III AURA-SOMA PRACTITIONER AND AURA-SOMA CONSULTANTS’ RIGHTS TO PRACTISE

* Only the holder of a current Aura-Soma Practising Certificate or an Aura-Soma Colour Care Consultant Certificate can describe themselves as an Aura-Soma Practitioner or an Aura-Soma Colour Care Consultant and offer Aura-Soma Consultations to the public.

There are no restrictions on the number of Aura-Soma Colour Care Consultants or Aura-Soma Practitioners working within the same geographical area as we believe that a network of individuals working within the same area brings the opportunity for sharing and support. We encourage and expect respect and co-operation between all Aura-Soma Practitioners and Aura-Soma Colour Care Consultants. If you are moving to a new location please refer to the Academy website (www.asiact.org) for local contacts, Aura-Soma Practitioners, Aura-Soma Colour Care Consultants and Aura-Soma Teachers with whom to connect.

Note: In countries where the training is recognised by other organisations in addition to the Academy, there may be further requirements that need to be fulfilled before an Aura-Soma Practising Certificate may be applied for.

IV THE AURA-SOMA COLOUR-CARE-SYSTEM PRACTISES

Below are the practises and specific code of ethics that the Aura-Soma Practitioner and the Aura-Soma Colour Care Consultant must comply with when working with the Aura-Soma colour system. Remember that by completing and signing the relevant Registration Agreement you have entered into a legally binding agreement with the Academy to comply with these practises. It is only by registering that it is possible to use the name ‘Aura-Soma’ or any of the Aura-Soma logosapproved for use at your level of training.

A. 15 AURA-SOMA CONSULTATION PRACTISES

The Academy recognises that the Aura-Soma student needs to begin to gain practise in public consultations whilst completing their training towards Level 4 and Registering as a Colour Care Consultant. These are the practises that must be strictly followed in order for the consultation to be described as an Aura-Soma consultation. Each practise is given a number and aheading for ease of reference. A short statement in bold italics follows and this statement defines the practise.

1. Bottle SelectionInvite the client to select their four colour combinations from a displayed collection of Aura-Soma Equilibrium bottles.

2. Activity of ConsultationVerbally explore the colour selection with the client.

3. No Other ProductsUse only Aura-Soma Products Ltd products in the Aura-Soma Consultation.

4. Support Your ClientSupport your client to take responsibility for themselves, and to discover their own guidance and intuition.

5. Aura-Soma Practitioner and Aura-Soma Colour Care Consultant ResponsibilityBe responsible for your own words and actions.

6. Connect Themes to Aura-Soma Equilibrium Bottles SelectedConnect what you say to the Aura-Soma Equilibrium bottles selected.

7. No Fortune-TellingDo not make predictions of future events or engage in fortune-telling.

8. Demonstrate Product UsageDemonstrate the use of the Aura-Soma products in accordance with the methods taught in the Aura-Soma Training.

9. Respect Client’s ChoiceYou may make recommendations, but your client must be encouraged to make their own decision on what to use, including when, where, how and how often to use it.

10. No Claims To Diagnose And/Or HealDo not make claims that the products can be used to diagnose or treat any physical or psychological conditions during the Aura-Soma Consultation.

11. ReferralsRefer your client to a professional if treatment or diagnosis of a physical or psychological condition is requested.

12. Aura-Soma Consultation Record and Information SheetGive your client an Aura-Soma Consultation Record and Information Sheet at each Aura-Soma Consultation.

13. Client RecordsKeep proper client Consultation records for a minimum of six years.

14. Post-Consultation supportBe reasonably available to give your client post Aura-Soma Consultation support.

15. Client ConfidentialityObserve and maintain client confidentiality unless disclosure is required by law.

B. 10 AURA-SOMA GENERAL PRACTISES

The 10 General Aura-Soma Practises relate to the general business of being An Aura-Soma Practitioner or Aura-Soma Colour Care Consultant. Each practise is given a number and a heading for ease of reference. Note that in applying for an Aura-Soma Practising Certificate or Aura-Soma Colour Care Consultant Certificate you enter a legal agreement to comply with these Aura-Soma practises.

1. Public AwarenessDisplay your Aura-Soma Practising Certificate or Aura-Soma Colour Care Consultant Certificate in your consultation room or place of work where it is easily visible.

2. StatusDo not advertise or represent that you can practise as an Aura-Soma Practitioner or Aura-Soma Colour Care Consultant outside of the limits of your present level of Aura-Soma training.

3. Use and Respect of the Aura-Soma productsPreserve the integrity of the Aura-Soma products.

4. LawsComply with laws (including local laws) that affect your right to practise.

5. Assist the AcademyAssist the Academy to become aware of any activities that may harm the reputation of the Academy or may be in breach of the conditions of this Aura-Soma Practitioner and Aura-Soma Colour Care Consultant Guide.

6. Observe Copyright lawsDo not copy, adapt or translate the Academy Course Materials or this Aura-Soma Practitioner/Aura-Soma Colour Care Consultant information without the Academy’s written permission.

7. Public talksDo not give short talks on the Aura-Soma colour system until you have completed the PERSONAL PRESENTATION SKILLS course. Only give Public Talks after the BRIDGE course. Only approach the Media after the Bridge course.

8. Inform the Academy if your name or address changes

9. Relationship with AcademyDo not represent the Academy or the Product Supplier or enter into any agreement or arrangement on their behalf, nor disclose any confidential information concerning the Academy or the Product Supplier.

10. OthersDo not intentionally do anything that may directly or indirectly result in another person breaching the conditions of the’ Student Agreement’ or this ‘Aura-Soma Practitioner and Colour Care Consultant Guide’.

V TRADE MARKS

A. Use of Trade Marks

Each of the trademarks mentioned below can only be used on the following terms and conditions stated.

1. * Registered Aura-Soma Practitioners may only use the Aura-Soma Laurel Leaf logo.

The Aura-Soma Laurel Device (see above) is a registered trademark. This is the original logo and has been used since 1984. You may only use the Aura-Soma Laurel Device to advertise yourself as an Aura-Soma Practitioner once you havecompleted the appropriate training and have a current Aura-Soma Practising Certificate. You may not use this trademark for any other purpose than as permitted by this paragraph. You may not alter this trademark. You may not claim any rights to the trademark. You must immediately cease using it either on written notice from the trademark owner or if you do not hold a current valid Aura-Soma Practising Certificate. If you use the Aura-Soma Laurel Device as part of an article, press release or other form of advertising then, at the end of the article press release or other form of advertising (or some other appropriate place), the following text should be inserted: “The Aura-Soma Laurel Device is a registered trademark of Aura-Soma Products Limited”. It must therefore always be followed by ® the first time it is used in a publication.

2. * Registered Aura – Soma Colour Care Consultants and Registered Distributors may use the Aura-Soma PyramidWaveform and name logo.

The Aura-Soma Pyramid and Waveform logo and Aura-Soma word (see above) are two registered trademarks. You should always use the Aura-Soma Pyramid and Waveform logo together with the Aura-Soma word trademark. You may only use the two trademarks to advertise yourself as an Aura-Soma Colour Care Consultant once you have completed the appropriate training and you have a current Aura-Soma Colour Care Consultant Certificate. You may not use this trademark for any other purpose than as permitted by this paragraph. You may not alter this trademark. You may not claim any rights to the trademark. You must immediately cease using it either on written notice from the trademark owner or if you do not hold a current valid Aura-Soma Colour Care Consultant Certificate. If you use the Aura-Soma Pyramid and Waveform logo and the Aura-Soma word trademark in an article, press release or other form of advertising then, at the end of the article, press release or other form of advertising (or some other appropriate place), the following text should be inserted: “The Aura-Soma Pyramid and Waveform logo and the Aura-Soma word trademark are registered trademarks of Aura-Soma Products Limited”. They must therefore always be followed by ® the first time they are used in a publication.

3. * Only AS I ACT can use the AS I ACT Logo.

The AS I ACT logo (see above) is a registered trademark. Only AS I ACT can use the trademark. You may not claim any rights to the trademark or any derivative of it.

4. Use of the Name ‘Aura-Soma’ trademark.

AURA-SOMA®

The name “Aura-Soma” (see above) is also a registered trademark. It must therefore always be followed by ® the first time it is used in a publication. While you are in possession of a current Practising Certificate or Colour Care Consultant Certificate you may use these words in the phrases Aura-Soma Practitioner or Aura-Soma Colour Care Consultant to describe yourself, depending on your level of training. You may use these words in the phrase Aura-Soma Consultation to describe the service you offer. You may not use this trademark for any other purpose than as permitted by this paragraph. You may not alter this trademark. You may not claim any rights to the trademark. You must immediately cease using it either on written notice from the trademark owner or if you do not hold a current valid Aura-Soma Practising Certificate or Aura-Soma Colour Care Consultant Certificate. If you use the Aura-Soma word trademark in an article, press release or other form of advertising then, at the end of the article, press release or other form of advertising (or some appropriate place), the following text should be inserted: “The Aura-Soma word trademark is a registered trademark of Aura-Soma Products Limited”.

You may not use these copyright works for any other purpose than as permitted by this paragraph. You may not alter the copyright works. You may not claim any rights to the copyright. You must immediately cease using it either on written notice from the copyright owner or if you do not hold a current valid Aura-Soma Practising Certificate or Aura-Soma Colour Care Consultant Certificate. These images are available in digital format from the Academy. Others may become available from time to time.

6. Other Trademarks and Logos

Aura-Soma Practitioners and Aura-Soma Colour Care Consultants are not entitled to use the following names and logos associated with Aura-Soma Products Limited. No consent for their use is given by this document or by the Aura-Soma Practising Certificate. Any unauthorised use of these names and logos will constitute a breach of your agreement with the Academy. They are shown here purely for the purposes of recognition.

7. A Guide to Logo Usage

The list below may help to guide you to ensure that the logos are used in the correct manner:

B. How To Use Trade Marks

It is necessary to use the trademarks in the correct manner. Some of the trademarks referred to above are registered trademarks and some are not registered, however both types of trademarks are legally protected. Your permitted use of the respective trademarks is set out above, however, there are certain rules which have to be followed when using trademarks. For example all registered trademarks (such as the “Aura-Soma” registered trademark) must therefore always be followed by the symbol ® which denotes it is a registered trademark. However for unregistered trademarks such as “The Academy” should be followed by the letters ̀tm’ which denote it is a trademark.

While you are in possession of a current Aura-Soma Practising Certificate or Aura-Soma Colour Care Consultant Certificate you should use the `Aura-Soma’ trademark as an adjective before the words such as ̀Practitioner’(Aura-Soma Practitioner) or `Colour Care Consultant’ (Aura-Soma Colour Care Consultant) and C̀onsultation’ (Aura-Soma Consultation) to describe yourself and the service you offer. However the words “Aura-Soma” may not be used in any other way as a title, name or logo. For example you may not call something The Aura-Soma Shop or The Aura-Soma Centre as this would be in breach of your agreement with the Academy and the Academy’s agreement with the owner of the trademark. Any such use must be authorised with the securing of a written licence from Aura-Soma Products Limited.

The following provides an insight into how an Aura-Soma Practitioner should aim to use the Aura-Soma trademark:AURA-SOMA®

Remember that trademarks are special words which should always be used as adjectives that modify nouns and never as possessive nouns. If you are in doubt whether you have used the trademark as an adjective, try removing the trademark from the sentence. If the sentence still makes sense, you have probably used the trademark correctly. Examples:Aura-Soma’s products provide an innovative approach to wellbeing – WRONGAura-Soma products provide an innovative approach to wellbeing – RIGHT

Aura-Soma is non-intrusive and self selective – WRONGAura-Soma practice is non-intrusive and self selective – RIGHT

It is possible to use the words “Aura-Soma colour system” when writing about the system or your work in articles and leaflets. In this case the ® need appear only after the first use of the name Aura-Soma and then, at the end of the article or some other appropriate place, the following text should be inserted: “Aura-Soma is a registered trademark of Aura-Soma Products Limited”.

These logos and the name “Aura-Soma” are legally protected. They may not be used, adapted or changed in any way except as expressly permitted by this Guide.

You may use the trademarks and the logos indicated above on these conditions only: to describe the Aura-Soma range of products to describe the officially approved Aura-Soma courses to describe the officially approved Aura-Soma material to indicate that you hold a current Aura-Soma Practising Certificate or Aura-Soma Colour Care Consultant

Certificate. Your right to use the trademarks and the logos will be automatically revoked if you do not hold an Aura-Soma Practising Certificate or Aura-Soma Colour Care Consultant Certificate. ( See: Termination of the Right to Practise)

C. RESTRICTIONS ON USE OF TRADEMARKS

Only use trademarks and logos to which you are entitled (as described above) and only to advertise the Aura-Soma Consultation. Due to the versatility of the Aura-Soma products they may easily be integrated into sessions of other disciplines, but such sessions should not be described as Aura-Soma Consultations.

For example if someone were to offer a massage using the Aura-Soma products this could not be described as an Aura-Soma massage. It could however be described as a massage using Aura-Soma products. This same principle applies to all situations where Aura-Soma products are used in a supportive way to another discipline, and also to any session offered which is not of any one specific discipline but offered from a variety of skills that the Aura-Soma Practitioner or Aura-Soma Colour Care Consultant has acquired.

VI MAINTAINING AURA-SOMA PRACTITIONER & AURA-SOMA COLOUR CARE CONSULTANT STATUS

As the Aura-Soma colour system and the understanding of it are continually evolving it is important that Aura-Soma Practitioners and Aura-Soma Colour Care Consultants maintain their connection with the Academy on a regular basis in order to benefit from new developments that can be passed on to the public during the Aura-Soma consultation process. This has motivated the Academy to develop the Aura-Soma Renewal Process. The Aura-Soma Renewal Process is seen as an opportunity to keep Aura-Soma Practitioners and Aura-Soma Colour Care Consultants in touch with the development of the Aura-Soma colour system and to nurture consultation skills.

A. THE AURA-SOMA RENEWAL PROCESS TRAINING

Aura-Soma Practitioners and Aura-Soma Colour Care Consultants who wish to renew their Aura-Soma Practising certificates must participate in at least 6 hours annually or 12 hours over two years of activities defined as part of the Aura-Soma Renewal Process. The benefit of this is that clients will feel confident that their Aura-Soma Practitioner/Aura-Soma Colour Care Consultant will be up to date with the evolution of the Aura-Soma colour system.Please refer to the Academy to ensure that your course is a certified Aura-Soma Renewal Course.

On completion of an Aura-Soma Renewal course you will receive an Aura-Soma Renewal Certificate, signed by yourTeacher. Copies of The Academy’s Renewal Certificates will be accepted by the Academy as evidence of your participation in the Aura-Soma Renewal Process. Please ensure a copy accompanies your application to renew your Aura-Soma Practising Certificate.

TO MAINTAIN AURA-SOMA PRACTITIONER REGISTRATION

We anticipate that all Aura-Soma Practitioners who wish to work in the Aura-Soma colour system with the public will complete the full Aura-Soma training programme to become an Aura-Soma Colour Care Consultant.

It is highly recommended that the next level of the training is attended for the Aura-Soma Renewal requirement. This leads towards becoming an Aura-Soma Colour Care Consultant.

The aim of these Aura-Soma Sharing Days is to keep Aura-Soma Practitioners in touch with the spirit and potential of the Aura-Soma colour system and to inform them about new developments in the Aura-Soma colour system and the content of the Aura-Soma Training. Thus each Aura-Soma Sharing Day will vary in content and format as the Aura-Soma colour system continues to evolve. On completion of the Aura-Soma Sharing Day, you will need to have your Aura-Soma Sharing Day Record Sheet signed and dated by the Aura-Soma Teacher. As with Level 1, 2 and 3 Aura-Soma courses, your Aura-Soma Sharing Day teacher will send us details of your participation, however please also keep your own record.

Participate in other courses that are authorised by the Academy to be supportive of the development of the Aura-Soma Practitioner. It is recommended that these are from within the Aura-Soma Faculty. A full list featuring the courses that the Academy recognises and accepts as part of the Aura-Soma Renewal Process may be obtained from the Academy upon request. The decision as to which courses are recognised as part of the Aura-Soma Renewal Process remains with the Academy. If you have any question on this please contact the Academy.

Once you have satisfactorily completed the Aura-Soma Level 4 work and your Aura-Soma Practising Certificate has been upgraded you can apply for an Aura-Soma Colour Care Consultant Certificate and then describe yourself as a registered Aura-Soma Colour Care Consultant.

The decision as to which courses are recognised as part of the Aura-Soma Renewal Process remains with the Academy. If you have any question on this please contact the Academy.

The Aura-Soma Renewal Process will be reviewed by the Academy regularly in order to achieve the best possibleAura-Soma Colour Care Consultant education, support and public benefit. You will be advised of any changes or developments.

B. RENEWING YOUR CERTIFICATE AS AN AURA-SOMA PRACTITIONER OR AN AURA-SOMA COLOUR CARE CONSULTANT

The Aura-Soma Certificates for both Aura-Soma Practitioners and Aura-Soma Colour Care Consultants are valid for either one or two years depending upon whether you pay for a one year renewal or a two year renewal. Aura-Soma Practitioners and Aura-Soma Colour Care Consultants must renew their relevant Aura-Soma certificate if they wish to continue working with the public beyond the expiry of their Aura-Soma Certificate. This may be done by applying for renewal on the prescribed application form.

The renewal fee is used to keep Aura-Soma Practitioners/Aura-Soma Colour Care Consultants up to date with the latest developments through the Aura-Soma Academy Newsletter, mailings etc, and it is also used to cover the costs of issuing the Aura-Soma Certificates, the staffing and administration of the system, and to help cover the legal costs involved in protecting the system. The fee is intended to be nominal only, and will be reviewed from time to timeand you can obtain details of the fee from the Academy.

The Aura-Soma Practitioner/Aura-Soma Colour Care Consultant who completes a further level of training before their current certificate has expired will receive a replacement certificate featuring the new level reached in the Aura-Soma training. The replacement certificate will be issued free of charge but will expire on the same date as the existing one would have. At this point the Aura-Soma Practitioner/Colour Care Consultant must renew their certificate if they wish to continue to offer Consultations and to continue describing themselves as an Aura-Soma Practitioner/Aura-Soma Colour Care Consultant.

You may not renew if:

the Academy is aware that you, or any person in whom you have a material interest is in breach of your legal obligations set out in this document, or the Student Agreement, or you have not participated in at least 6 hours per year of activity (or minimum 12 hours over 2 years) as defined in the section of this document on the Aura-Soma Renewal Process.

VII DISCIPLINARY PROCEDURE *

The Academy has a Review Board which has been established to investigate, on behalf of the Academy any legitimate complaint made against any Aura-Soma Practitioner or Aura-Soma Colour Care Consultant. The Review Board will consist of a minimum of three impartial, independent members appointed by the Trustees of the Academy from the body of Teachersand such other people of good standing whom they consider appropriate. The Review Board will act quickly, fairly and impartially. Membership of the Review Board will be limited to two years. The Review Board will make its decisions by majority vote.

If the Academy receives a complaint about an Aura-Soma Practitioner or Aura-Soma Colour Care Consultant then they may investigate it. The Review Board may appoint either a single person or a panel of people to investigate the complaint and, as part of the investigation, the Aura-Soma Practitioner or Aura-Soma Colour Care Consultant will be contacted, invited to respond to the complaint - either verbally or in writing, and, if relevant to the investigation and with the client’s permission, share any appropriate consultation records. The Academy will act impartially, quickly and fairly. If the Review Boardbelieves that the complaint is justified then it will notify the Academy of its decision and recommendations and the Academy will act according to the review board’s advice.

1. * Notifying the Aura-Soma Practitioner/ Aura-Soma Colour Care Consultant of the Decision

Once The Academy has made its decision, but before taking any action, the Academy will notify the relevant Aura-Soma Practitioner or Aura-Soma Colour Care Consultant of the decision and the Academy’s intended action. That notification will be in writing.

2. *Appeal Procedure

Once the Academy has made its decision, and the Aura-Soma Practitioner or Aura Soma Colour Care Consultant has received confirmation in writing of the Academy’s intended action, the Aura-Soma Practitioner or Aura Soma Colour Care Consultant has the right to appeal against this decision. An appeal should be made in writing for the Attention of Mike Booth within 14 days of receiving the notification from the Academy. The decision by Mike Booth will be final.

2. * Termination or Suspension of Right to Practise

If the Aura-Soma Practitioner or Aura-Soma Colour Care Consultant breaches any of his or her legal obligations and agreements contained in this document or in his or her Aura-Soma Student Agreement or elsewhere, the Academy is entitled to take action against the Aura-Soma Practitioner or Aura-Soma Colour Care Consultant. Usually, taking serious action would be a last resort. The Academy would generally wish to give appropriate support to the Aura-Soma Practitioner or Aura-Soma Colour Care Consultant and give the Aura-Soma Practitioner or Aura-Soma Colour Care Consultant an opportunity to remedy the breach, if it can be remedied.

The Academy may terminate, suspend for a period of time or impose further conditions on the Aura-Soma Practitioner or Aura-Soma Colour Care Consultant’s right to practise if any of the following occur:

the Aura-Soma Practitioner or Aura-Soma Colour Care Consultant breaches any of his or her legal obligations and agreements contained in this document or in his or her Aura-Soma Student Agreement or elsewhere.

in the opinion of the Academy, the continuation of the Aura-Soma Practitioner or Aura-Soma Colour Care Consultant’s practice is likely to breach a law of the country in which they practise or is likely to affect the right of the Academy or the Product Supplier to carry on their activities in that country.

the Academy reasonably considers that the Aura-Soma Practitioner or Aura-Soma Colour Care Consultant is not a suitable person to hold an Aura-Soma Certificate because they have been convicted of a criminal offence, or they have engaged in conduct which is deceptive or misleading in relation to Aura-Soma Products Limited or harmful to the reputation of the Academy.

If the Aura-Soma Practitioner or Aura-Soma Colour Care Consultant’s right to practise is terminated, their Aura-Soma Practising Certificate or Aura-Soma Colour Care Consultant Certificate will be cancelled and they must immediately return it to the Academy and cease to practise as an Aura-Soma Practitioner or Aura-Soma Colour Care Consultant, and cease to use the relevant trademarks in their advertising material. Any termination or suspension of the Aura-Soma Practitioner or Aura-Soma Colour Care Consultant’s Right to Practise does not affect their obligations to the Academy. If the Aura-Soma Practitioner or Aura-Soma Colour Care Consultant breaches any of his or her legal obligations and agreements contained in this document or in his or her Aura-Soma Student Agreement or elsewhere the Academy may choose not to take action or delay taking action, but this does not prevent it from taking action if the Aura-Soma Practitioner or Aura-Soma Colour Care Consultant commits a further breach.

Note: An Aura-Soma Practising Certificate is only necessary for those who wish to offer Aura-Soma colour system consultations to the public. Students who attend one or more courses purely for their own benefit and who thereafter do not work with the public do not need to hold an Aura-Soma Practising Certificate or participate in the Aura-Soma Renewal Process. If such Students however wish to start practising the Aura-Soma colour system they are required to apply for an Aura-Soma Practising Certificate and wait to receive it prior to commencing work with the public. Aura-Soma students who have not participated in the Aura-Soma Training in the two years prior to their application will also be required to participate in the Aura-Soma Renewal Process before they receive their Aura-Soma Practising Certificate.

VIII * ENTIRE AGREEMENT

1. * Entire Agreement

The entire legal agreement between the Academy and the student in relation to the Aura-Soma colour system consists of this Aura-Soma Practitioner and Aura-Soma Colour Care Consultant Guide, the Aura-Soma Student Agreement, and any Application Form for an Aura-Soma Practising or Aura-Soma Colour Care Consultant Certificate. These documents replace any previous agreement or arrangement.

2. * Changes to this Aura-Soma Practitioner and Aura-Soma Colour Care Consultant Guide

This Aura-Soma Practitioner and Aura-Soma Colour Care Consultant Guide may be varied by the Academy from time to time and you will be notified when Amendments have been made to it. The variation will not affect you unless you agree to it, but it will bind you when you apply to renew your Practising Certificate or Colour Care Consultant Certificate.

3. * Severability

If any part of this Aura-Soma Practitioner and Aura-Soma Colour Care Consultant Guide or the Aura-Soma Student Agreement or an Aura-Soma Application Form for an Aura-Soma Practising or Aura-Soma Colour Care Consultant Certificate is unenforceable or invalid in any country’s legal system, then the unenforceable or invalid part will be taken to be modified in that country so that it has the intended effect. If it cannot be modified then that part will be struck out of the relevant document but the remainder of the document will still be enforceable.

4. * Jurisdiction

The law of England shall apply to this Aura-Soma Practitioner and Aura-Soma Colour Care Consultant Guide, the Aura-Soma Student Agreement and the Aura-Soma Application for an Aura-Soma Practising or Aura-Soma Colour Care Consultant Certificate unless otherwise agreed in writing between the Academy and the student.

5. * Authentic Text

This Agreement may be translated into a language other than English but it must be interpreted by reference only to the English text.

6. * Transfer of Rights

The Academy may transfer any of its rights under this Aura-Soma Practitioner and Aura-Soma Colour Care Consultant Guide to any new body created to continue or further the work of the Academy or the Aura-Soma Training. If that happens Aura-Soma Practitioners and Aura-Soma Colour Care Consultants can enforce their rights under this Aura-Soma Practitioner and Aura-Soma Colour Care Consultant Guide against that body. Aura-Soma Practitioners and Aura Soma Colour Care Consultants always remain personally liable for their obligations under this Aura-Soma Practitioner and Aura-Soma Colour Care Consultant Guide.

7. * Headings & Interpretation in Aura-Soma Practitioner and Aura-Soma Colour Care Consultant Guide

Headings are for ease of reference and do not affect the interpretation of this Aura-Soma Practitioner and Aura-Soma Colour Care Consultant Guide. A word referring to the singular includes the plural and vice versa and reference to gender includes all genders.

8. * Compliance with Conditions

If you want to present yourself as an Aura-Soma Practitioner or Aura-Soma Colour Care Consultant offering Aura-Soma consultations then you must comply with all the legally binding practices and conditions set out in this Aura-Soma Practitioner and Aura-Soma Colour Care Consultant Guide, the Aura-Soma Student Agreement and any Application Form for an Aura-Soma Practising or Aura-Soma Colour Care Consultant Certificate.

The Academy may exercise any right or discretion set out in this Aura-Soma Practitioner and Aura-Soma Colour Care Consultant Guide at any time and in any manner if, in good faith, it considers it reasonable to do so.

BridgeThe Aura-Soma Bridge Course is a pre-requisite to the Aura-Soma Teacher Training Program. Completion of this course qualifies Aura-Soma Colour Care Consultants to present Public Talks and hold one day Experiential Events on the Aura-Soma colour system.
