SERVICE LEVEL CHARTER Austr·alian Government Security Vetting Agency and Customer_s______
Term
1. This Service Level Charter (the Charter) will commenc from 1 July 2014 or on the
date of execution, whichever is the latter and will continue until 30 July 2015 (or until the
A SVA terminates , revokes , amends or r places this Chalier).
2. On 1 0 cember 2009 the Au tralian (Jovenunent announced thal Commonwealth
security vetting processe would be centralised in the Department of De~ nee. This central
vetting unit. known as the Australian 0\1 rnment Security Vetting Agency (AGSVA), wi II
conduct , curity v tting for all Commonwealth agencies (excluding exempt agencies) and ,
if requ sted for State and Territory agencies. Clearances grant d by AG V A have
whole-of-gov rnl11ent effect.
Parties
3. Thi Charter is between the GSVA and all agencies using th AG V 's erVlces.
Agencies are omlnoll\vealth State or Territory entities that are eligibl to sponsor a
Inember of ·tafT to undergo a securit clearance assessment.
4. The AG V A is responsible for granting revalidating and re-evaluating security
clearanc s for the 01nn10nwealth (excluding exelnpt agencies) in compliance with
Australian Government protective security policies. The AGSVA promote' overnment
national 'ecurity objectives by assessing the eligibility and suitability of pe pIe v ho require
access to security protected or oth r sensitive official infonnation or assets to do their work.
Purpose
5. The purp c of this harter is to describe agreed etting service ex pectation. It
documents:
• the services to be pro ided ;
• the re pon i ilities of Agencies ;
• tandards for service delivery ;
• the fees payable for the services;
• relevant point· of contact; and
• governance arrangements.

Services
6. Security vetting is conducted by a designated authority to en ure that a clearance
subject is both ligible and suitable to be granted , as well as maintain, a security clearance.

7. The A SVA conducts security tting for the COlnn10nwealth Gov rnment
(excluding exelnpt agencies) and, wh n reque ted for State and rl erritory Go erI1lu nt
agencle .
The J\GSV 1\ \ 'ill l11~kc decisions Lo grant or deny a secu ri ty c carancc in accorc ance
with the Australian Goverrun nt Protective Security Policy Framework (PSPF). It is
Governm nt policy that the nUlnber of people requiring security clearances to perforn1 their
duties i kept to a minimUln. Agencies hould therefore give careful consideration to
whether a eCllrity clearance is nece 'ary and what level of ace i required.
9. I he AGSVA will conduct a tandardi ed process for as 'e ing and granting
clearances in order to 111aximise efficiency reduce costs and provide a security clearance
that is recogni ed across Governn1ent, including the exempt ag ncies and is consistent v ith
th PSPF.
10. The AGSVA provides erVlce to the Agencie a outlined at A ttachment 1. The 'e
ervice are provided under a fe -for-service model (Attachment 2).
11. As pali of evaluating clearance subjects for employment, genCle n1ay wi 'h to
conduct additional checks speci fic to individual agency rcquirem nt . The AGSVA \ ill not
conduct ch cks that exceed, or are not required, for a ecurity cl at'ance as prescribed by th
PSPF.
12. Any \ ariation . to thi Charter will be in accordance with the process out] in d in
paragraphs 52-55 .
13. The AGSVA will make a detennination on the uitability of a clearance ubject to
hold a security clearance. he Agencies acknowledge that the AGSVA is r pon ible G r
deciding whether to grant~ continue, deny or revoke a clearance ubject ' curit
clearance.
14, Agenc i are to en ur clearance ubj cts hav acc s to computer and inte rnet
facilitie to enable the completion and electronic ubn1i sion of their security clearance

application. The Agencies are to advise external clearance subjects (for exan1ple
contractors) that they will require access to a con1puter and internet facilities to enable the
c0111pletion and electronic subn1ission of their security clearance application.
15. The AGSV A will respect the privacy of information supplied for the security
clearance process. The AGSVA will act in accordance with all applicable legislation
relating to privacy including the Privacy Act 1988 and the Freedom ofInformation Act
1982.
16. Where an agency has concerns about the suitability of an individual to hold an
Austral ia 1 Government security clearance and to access offi cial or classified Australian
Govenm1ent resources, the agency nlay, in accordance with the PSPF, request that the
AGSV A share personal info1111ation it holds of relevance to these concerns.
17. Where the AGSVA becon1es aware of credible infonnation which is of direct
relevance to a clearance subject's suitability to hold an Australian Governnlent security
clearance and to access official or classified Australian Govenunent resources, the AGSVA
will in accordance with its obligations under the PSPF, share this personal information with
the agency.
18. All personal infonnation shared between the AGSVA and agency security personnel
is to be handled with sensitivity, and in accordance with the need-to-know principle and
Australian Privac.y Principles.
19. The Agencies are required to annually provide the AGSVA with advance notice of
the estimated nun1ber and level of clearances required for each nlonth. [his forecasting is to
include routine clearances and any 111ajor projects requiring additional clearances.
Key Performance Indicators
20. Table 2 shows the AGSV A ' s Key Perfornlance Indicators.

Timeframes
21. The AGSVA aims to finalise all security clearances within the agreed benchmark
tilnes and is cOlm11itted to cOlnpleting thenl faster where possible, subject to maintaining
the integrity of the vetting processes, PSPF cOlnpliance, and tilnely suppoli from external
agencies. Benchn1ark tilnes are:
• Baseline Vetting: One month
• Negative Vetting 1: our n10nths
• Negative Vetting 2: Six n10nths
• Positive Vetting: Six 111011ths
22. The benchlnark tinles comlnence when the AGSVA receives a fully conlpleted
vetting pack, including supporting docUlnentation fron1 the clearance subject.
23. Agencies acknowledge that the ability of the AGSVA to complete clearance actions
within these tinlefrmnes tnay be affected by (but not lilnited to):
• the accurate completion and subn1ission of supporting docun1ents and inforn1ation
by the clearance subject;
• Agencies not completing required citizenship checks at recruitn1ent;
• the rnal1agement of additional checks for non-Australian citizens ;
• the managenlent of additional checks for clearance subjects with backgrounds that
are difficult to verify ;
• the availability, degree of cooperation and tinleliness of the clearance subject and
referees in providing inforn1ation;
• the tinlelinss of response of third-party organisations (for exalnple the Australian
Security Intell igence Organisation) ; and
• the volun1e of clearance requests that the AGSVA is processing.
Fees
24. Agencies will pay the AGSVA in accordance with the fee schedule in Attacl1l11ent 2.
Charges will also apply if a pack has be n subn1itted by a clearance subject and is then
cancelled before completion.

Billing and Payment
25. The AGSVA will invoice Agencies monthly for all finalised security clearances.
Payment is due within 30 days of the date of receipt of the invoice.
Representatives
26. Agencies are to be represented by their respective Security Officer or delegate on
issues relating to security vetting. Agencies should nOlninate a primary and secondary point
of contact. Agencies are responsible for informing the AGSV A in writing about personnel
changes relating to the Security Officer) appointed delegates or points of contact. Agency
Security Officers (or delegate(s) as notified in writing to the AGSVA) will be responsible
for rece iving and coordinating the response to an queries, notices or requests sent by the
AGSVA.
27. The first point of contact for all Agencies is the Customer Relationship Managenlent
(CRM) teanl.
28. Clearances subjects should firstly liaise with their designated Security Officer for
any questions or concerns, and then ifrequired call the AGSVA Client Service Centre.
Contact details for the AGSVA) including those of the Customer Relationship Managenlent
teanl and the Client Service Centre, are listed in Attachnlent 3.
AGSVA Reporting
29. The AGSV A will report to Agencies Inonthly on the:
• number of security clearance applications requested;
• status of security clearance appl ications;
• nutnber of security clearances cOll1pleted; and
• average lnonthly completion tinle for each clearance type across all agencies.
Review and Appeals Process
30. If the AGSVA identifies any suitability concerns during the vetting process which
hinder the granting of a security clearance, a Procedural airness Letter will be issued,
offering the clearance subject an opportunity to mitigate security concerns.
31. A sealed copy of the Procedural Fairness Letter will be provided to the clearance
subject via the Agency ' s n0l11inated representative. An explanatory letter to the Agency' s
nominated repre entative will accompany the Procedural Fairness Letter.
32. The clearance subject \vill be given 14 days (elate specified in the letter) to respond
to the AGSVA' s concerns and correct any information. The AGSVA will then consider the

response fron1 the clearance subject and Inake a final recOl11111endation to the delegate to
grant or deny the clearance.
33. If the clearance subject does not r spond to the Procedural Fairness Letter within 14
days of the date specified in the letter, and does not request an extension, the AGSVA will
provide a reC0111nlendation to the delegate to deny the clearance.
34. If, after this stage the AGSVA delegate denies the security clearance, the clearance
subj ect and the Agency ' s nominated representative will be notified and advised of the
clearance subject ' s right to seek a review or appeal , as well as their avenues of appeal.
35. Agencies should notify the AGSVA if informed that a clearance subject has, or
indicates, an intention to subnlit, seek or initiate an appeal , redress of grievance, review or
legal proceedings in relation to services provided by the AGSVA.
Aftercare
36. Agencies are to 111onitor and impleillent any specific aftercare requirelnents that are
specified by the AGSVA.
37. Clearance subjects are responsible for informing the AGSVA of any changes in
circumstances that may affect their security clearance, both during the assessment process
and once a clearance is granted. The AGSVA' s contact details are listed at Attachment 3.
38 . Sin1ilarly, Agencies have a responsibility to inform the AGSVA of any changes of
circunlstances that nlay have bearing on a clearance subject' s (including contracted staff)
continuing suitability to hold an Australian Government security clearance.
39. If an agency has doubt about a clearance subject's suitability to maintain a security
clearance, the agency is responsible for notifying the AGSVA and requesting a Review for
Cause. The AGSVA will consider the CirCUlTIstances and decide whether the Revie\\T for
Cause is required. A Rev icw for Cause will only bc conducted where genuine security
concerns are identified. The agency is also responsible for 111anaging the clearance holder in
the workplace while the AGSVA undertakes the Review for Cause.
Revalidations and Re-evaluations
40. A revalidation is a periodic review conducted to ensure that an individual is sti II
suitable to hold a security clearance at the granted level. The purpose of the revalidation is
to identify the need to ll1aintain the current security clearance and assess the accuracy and
currency of inforn1ation about the individual. Revalidations for security clearances are

41. The AGSVA will initiate all re-evaluations and revalidation ' . It is the re pon ibility
of Agencies to en 'ure that their clearance holders comply with having their security
clearances revalidated or re-evaluated within the above tinlefrmnes. here are potentia l
security risk to an Agency when its cl earance holder do not complete revalidation
proces e . Without revalidations the AGSV A cannot a e s the continued suitability of
clearance holders to maintain security clearances. I f a clearance subject does not comply
with revalidation proc the AGSVA will cancel the clearance and notify both th gency
and the clearance holder.
Changes in Clearance Level
42. In the event that an Agency need to change an individual s current clearance level ,
the Agency should cOlnplete th appropriate form on the AGSV1\ website.
Cancellation of Sponsorship during the vetting process
41. In the event that an Agency cancels spon 'orship of a clearance subject's cl at'ance

Separation
42, In the event that an indi vidual (e ither an employee or contractor) eparates from an
Agency after a clearance ha been granted , the Agency must advis th GSVA, b
completing and subrnitting the appropriate form from the A V A website.

Dispute Resolution
43 . The AGSVA is committed to resolving disputes and compla int r la ting to serv ice
prov ided by the AGSVA. Agencie and the AGSV A agree that any di spute and/or
complaints between the Parties re la ting to the C harter or AGSV A se r ice ' will be re olved
in a cooperati ve maruler.
44. The process for escalation of i ue ra ised by either Party will be :
• A ll communication sho uld initi a ll y be exchanged between the AGS VA Customer
Relationship Management TemTI and the Agency 's Security O fficer (or de legate as
no ti fied by writing to the AGSV A).
• In the event of an issue ari s ing) the Party with the issue n1U t arrange a meeting
with the other Party to discuss th issue . T his should be done within two weeks of
the i ue be ing identified.
• If the issue cannot be resolved to the a ti faction of the insti ga ting Party
conc 111 d then the issue must be set out in writing and forwarded to the other
Party . hi s must be done within two weeks of the initial m eeting taking place .
• The respond ing Party must then forward a written respon e to the insti gating Part y
in di spute addressing the probl ms raised and outlining a way forward. ~ hi 111 list

Agency-Specific Rcquirenlcnts
45 . Agency-specifi c t rm depal1ing from , o r in ad di ti n to. the C harter wi ll only be

to the GSVA j u ti fying th requirenlent s for the changes. The business case should
include a risk anal is d m n tra ting the need for the proposed change.
46 . Where agency-specific te rm s departing f rom or in additi on to, the Charter are
req uested by any agency the relevant Agency Head w ill w rite to the AGSVA reque ti ng
the va riati on and nominating a point o f contact w ithin the ir ag -ncy. The GS V will then
ente r into negotiation v ith th agency to produce a draft otice o f A mendment.

Governance
48. The A i tant Secretary Vetting i responsible for the day-to-day managem nt of
the Charter with re ponsible Agency representatives. A Stakehold r ngagement Forum
will recomn1end any changes to the Serv ic ve l Charter to the Chief Security Officer.
49. The Stakeholder Engagement I~ orum will be chaired by the Defence hief ecurity
Offic r and in III e Senior Ex cuti S 1'vi (. ,S) lev I rexesentation from the Attorn ey-
General' Department, Departrnent of Finance, ASIO, The Department of Prime Minister
and abinet , three large agencies and a representative of smaller agencie '. he takeholder
ngagement Forum will n1eet three times each year and will ensure the con ideration and
protection of takeholder interests in the AGS VA' s business strateg . Th takeholder

51 The AGSVA wi II pre ent an Annual Report to the Secretaries COlTIlnittee on
ational Security in October each year.
Variations to the Charter Including Terrnination, Revocation, Amendlnent or
Replacement
52. The AGSV A, by written notice, may terminate, revoke amend or replace the
harter at any time. T hi s will only occur after con ultation with takeholders . with the
agre n1ent ot the n1elnb r of the Stakeholder ngagen1ent Forum and with the concurrence
of the Secretary of 0 fence.
53. In the even t of terminat ion of the Charter, the AG V A will , unl ess Agencies
instruct otherwise, complete al l e rvice underway at the date of t rmination. The Agenci

54. In the event of revocation of the harter the AGSVA v ilL unl es ' Agencies in truct
otherwi e cease any fUl1her a - ment of applications and the Agency vvill pay the fees for
tho cerv ices already conducted in accordance with xtant AGSVA fee and charges.
~ 5. In the event of an1 'ndment or replacen1ent of the harter the AGSV A \vill advis
Agenci in writing of the date that the harter will be amended or replaced , and the date
that any changes the updated harter introduces will come into effect.

Reporting against the Charter
56. he AGSVA will publish a statement of performance against the Charter on the
AGSVA web ite. The AGSYAwill conduct an internal review of the Charter annually.

AGSV A SERVICES
1. The ervices provided by the GSVA will c0111ply with th InlnImUm tandards and procedures in the Australian Govern111ent Protective S curity Policy Framework (PSPF).
2. Ag ncy- p cific terms departing from or in addition to the 'harter will only be consider d where they are consistent with the PSPF and the agency submits a business case justifying the requirenlents for the change. An agreed change to the Charter must b fornlali ed by the execution of a Notice of Amendn1ent.

SERVICE ESPONSIBILITY
INITIATE SERVICE An agency agrees to the condition as record d in the Chart r, except where a Notice of Alnendnlent has been formalised by both Parti s.
To initiate a clearance process the agency repr entativ will review the level of clearance required and subnlit a r quest to the

The AGSV A will follow up on the return of security packs.
The clearance subject will receive up to three relninders to return the security pack. The agency will be notified of any indi idual" non-compliance to complete the ecurit pack.

requests the AGSVA will notify the agency of the n011conlpliance. At this point the agency will have 14 days to arrange compliance by the clearance subject. Non-compliance will result in the cancellation of the clearance process and in the case of revalidations non-compliance will result in the cancellation of the clearance.
Timeframes The AGSVA ailns to finalise clearances within the following timeframes:

• the accurate completion and submission of supporting documents and infonnation by the clearance subject;
• agencies not conlpleting required citizenship checks at recruitlnent ;
• the manage111ent of additional checks for non-Australian citizens;
• the 111anagelnent of additional checks for clearance subjects with backgrounds that are difficult to verity;
• the availability, degree of cooperation and tinleliness of the clearance subject and referees in providing further infonnation;

Vetting The AG SV A will liaise with the clearance subject and conduct any necessary interviews after the conlpleted package is received.

The AG V determination is based on all relevant information available at the time the services ar perfonned.
The AGSVA may 111ake a determination to grant provisional acces ' at the agency ' s request, subject to providing full justification and review of the clearance subject's con1pleted
ecurity pack. This must be endorsed at the SES Band 2 level \ ithin the requesting age ncy. This ervice attracts no extra charge.

Review and Appeals Process
Clearance ubjects are able to seek a review or appeal the outcOln of a d cision. If a clearance ubject i unhappy with the security clearanc a s S111ent they should contact the Client Service Centr for advice on ho\\' to initiat a re iew or appeal.
The agency agree to notify the AGSVA if it i . infonned that a clearance subject ha , or indicates, an intention to submit, seek or initiate any appeal grievance, review or legal proceedings in relation to ecurity vetting undertaken by the AGSVA .
