WHEREAS, the Energy Regulatory Commission ids and AwardsCommittee (ERC-BAC) received from Planning and Pu lie InformationService- Management Information System Division Purch se Request No.2019-03-044, requesting for the procurement of "Tr ndMicro PortalProtect for Microsoft Share Point" with an estimated total cost of SeventyFive Thousand Pesos (PhP75,000.00), VATInclusi e;

WHEREAS, based on the Annual Procurement P an for FY 2019,which was approved by the Head of the Procuring Enti on 29 January2019, the said goods is to be procured through the Alter ative Method ofProcurement of Shopping, with an Approved Budget for th Contract (ABC)in the amount of Seventy Five Thousand Pesos (PhP75,00 .00);

WHEREAS, on 09 March 2019, the ERC-BAC po ted Request forQuotation (RFQ) No. 2019-03-018 at the Philippine Gover ment ElectronicProcurement System (PhilGEPS) website, at the ERC ebsite, and onbulletin boards within the ERC's premises specifically eserved for thepurpose;

WHEREAS, in compliance with the Consolidated uidelines for theAlternative Methods of Procurement (Annex "H") of t e 2016 RevisedImplementing Rules and Regulations (IRR) of Republi Act No. 9184,which states that "[tlhe BAC shall send the RFQs/RFPs to t least three (3)suppliers of known qualifications, and at least three (3 price quotationmust be obtained. This, notwithstanding, those who re onded throughany of the required postings shall be allowed to participa e", the ERC-BACissued RFQs to seven (7) prospective bidders, namel : (1) MannasoftTechnology Corporation; (2) Trisphere Media Technolog es Inc.; (3) AnyNetwork Systems, Inc.; (4) Degtek Information Technolo y Solutions; (5)Advance Solutions Inc.; (6) Terabit Computer System Cor oration; and (7)Next Innovation, Inc.;

WHEREAS, on 25 March 2019, after due con uct of biddingactivities, on 25 March 2019, the ERC-BAC issued BAC R solution No. 20,Series of 2019 AM, declaring the first bidding for the "P ocurement ofTrendMicro Portal Protect for Microsoft Share oint" as failuredue to insufficient quotations received, despite extendin the deadline ofthe submission of bids twice;

WHEREAS, on 22 April 2019, the ERC-BACissue BACResolutionNo. 31, Series of 2019 AM, declaring the second idding for the"Procurement of TrendMicro Portal Protect for MOcrosoft SharePoint" as failure again as only two (2) bids were received which includedsending of RFQ's to eight (8) bidders and extending the d adline again forthree (3) times;

WHEREAS, on 08 May 2019, the ERC-BAC post d a third (grd)Request for Quotation (RFQ) No. 2019-05-045 at the PhilippineGovernment Electronic Procurement System (PhiIGEPS) website, at theERC website, and on bulletin boards within the ERC pre ises specificallyreserved for the purpose;

WHEREAS, the ERC-BAC again issued RFQs to fifteen (15)prospective bidders, namely: (1) Netrust Phils., Corp.; ( ) CTI ColumbiaTechnologies, Inc.; (3) My Busy Bee, Inc.; (4) CT Link S stems, Inc.; (5)Maximum Solutions, Corporation; (6) ePartners Solution, Inc.; (7) 9dotsSystems, Inc.; (8) First Datacorp; (9) Degtek Informa ion TechnologySolutions; (10) rteq Providers, Inc.; (11) EG Systems, Inc. (12) PowercraftPhilippines; (13) AG Datacom, Phils.; (14) Tiger Consu ting & SoftwareDev't., Inc.; and (15)Advance Solutions, Corp.;

WHEREAS, in response to the RFQs issued, only 0 e (1) bidder, CTLink Systems, Inc. timely submitted its sealed bid/ quot tion on 14 May2019;

WHEREAS, before the deadline for submission of uotations on 14May 2019, the ERC-BAC issued Bulletin No. 22, Series f 2019 (BulletinNo. 22), extending the deadline of submission of quotatio s for the subjectprocurement project to 17 May 2019 at five o'clock in the afternoon (5:00P.M.);

WHEREAS, in response to Bulletin No. 22 issue, one (1) bidder,Maximum Solutions Corporation timely submitted its seal d bid/quotationon 17May 2019;

WHEREAS, before the extended deadline for submission ofquotations under Bulletin No. 22, on 17 May 2019, the RC-BAC issuedBulletin No. 25, Series of 2019 (Bulletin No. 25), extendi g anew the saiddeadline to 21May 2019 at 5:00 P.M.;

WHEREAS, in response to Bulletin No. 25 issue, one (1) bidder,ePartners Solutions, Inc. timely submitted its sealed bid quotation on 21May 2019;

WHEREAS, on 23 May 2019, the ERC-BAC, together with theTechnical Working Group (TWG) and BAC Secretariat, convened for theopening of bids submitted for the "Procurement Qe TrendMicroPortal Protect for Microsoft Share Point";

WHEREAS, during the bid opening, the TWG fou ad that all three(3) bidders passed and complied with the eligibility docum ents specified inthe RFQ;

WHEREAS, the result of the bid opening are as folIcws:

WHEREAS, after due evaluation, the ERC-BAC four d that the bid ofePartners Solutions, Inc. in the amount of Twenty Eight thousand FiveHundred Fifty Pesos (PhP28,550.00), VAT Inclusrve is lowestamong all bidders and is within the ABC. Consequently, the ERC-BACdirected the TWG to conduct post-qualification evaluation;

WHEREAS, on 24 May 2019, the TWG submitted its Post-Qualification Evaluation Report, finding that ePartners Soh tions, Inc. is notcompliant with the specifications indicated in the RFQ, thus, making it afailed bid;

WHEREAS, on 27 May 2019, the ERC-BAC sent eP irtners SolutionsInc. a letter, informing the latter that, based on tl e TWG's post-qualification, it failed to comply with the specifications as stated in the RFQ;

WHEREAS, on 30 May 2019, the TWG sub itted its Post-Qualification Evaluation Report, finding that Maxi urn SolutionsCorporation, has met all the requirements of the subj ct procurementproject, thereby making its bid the Lowest Calculated R sponsive Bid;

WHEREAS, the ERC-BAC reviewed the Report an concurred withthe TWG's findings;
