Environmental Assessment (OP/BP 4.01): potential environmental impacts of the

subproject includes those relevant to land acquisition, vegetation cover loss, impact

to terrestrial ecosystem, air pollution by dust, exhaust gases, noise from

construction activities, impact of surface water quality, water usage in downstream,

aquatic bio-diversity as well as impact of landslide, erosion, sedimentation etc.

1. INTRODUCTION

1.1. Project background

Ban Ang Hydropower project is invested by Nam Mo-Nam Non hydropower

joint stock Company. It is located on the Nam Mo River of Song Ca system,

flowing through the territory of Luu Kien, Xa Luong communes, Tuong Duong

district, Nghe An province.

Nam Mo River originates from the high mountain with 2.250m elevation in

Xieng Khoang province - People's Democratic Republic of Lao, pours into Ca river

of Xa Luong commune, near the town of Hoa Binh, Tuong Duong district, Nghe An

province. The Ca River is a major river system of the central region in general and

Nghe An province in particular. The river pours into the sea at the mouth of Hoi –

the border of Nghe An and Ha Tinh. The river has two main branches Nam Mo

River and Nam Non River. Ban Ang Hydropower is located on Nam Mo River and

it is the downstream of the Nam Mo Hydropower. Hydropower Khe Bo is located

on Ca River which is downstream of both Ban Ang and Ban Ve hydropower

projects.

The headwork of the project is around 4 km far from the confluence of the

Nam Mo River and Ca River. The distance from project’s headwork to Nam Mo

hydropower plant and Khe Bo hydropower plant is 40 km and 10 km, respectively.

It is only 100 m far from the National No. 7 in the direction of Dien Chau junction

to Tuong Duong and is 10 km far from Hoa Binh town, Tuong Duong district. The

entire reservoir and headwork of Ban Ang hydropower project lay in Luu Kien, Xa

Luong communes, Tuong Duong district, Nghe An province.

Ban Ang hydropower installed capacity of 17 MW, average power output is

about 68.51 million, which are open-type horizontal mill dam, reservoir regulator.

The main parameters: catchment area: 3,829 km2, normal water level: 85 meters,

dead water: 83 m, the entire reservoir capacity: 2,977 million m3, the area of the

reservoir corresponding to the normal water level: 0.481 km2, spillway length:

122m, dam elevation of 90.5 m; maximum flow rate: Qmax 187 m3/s, assurance flow

Qdb 29.23 m3/s, 35 kV distribution station in open style.

Ban Ang Hydropower project is in the master plan of small hydropower of

Nghe An province and it was allowed to be prepared the investment report by the

provincial People's Committee

1.2. Project Sponsor and Participating Bank

The project is expected to be refinanced from REDP funded by WB through

the Bank of Vietnam Foreign Commercial (Vietcombank), Nghe An branch.

1.3. The objectives of the project

The main objective of the project is generating electricity with average

output of 68.51 million kWh, in addition to contributing to improving infrastructure,

creating revenues for local budget, restructuring the economy and promoting social

and economic development locally.

Project design Consultancy: Consulting and Investments power

development Joint Stock Company

The Investor has assigned Ban Ang hydroelectric project management

Board, Nam Mo - Nam Non hydropower Joint Stock Company to manage and

monitor the project. Project Management Board has appointed social-environmental

staff to perform tasks related to environmental protection of the project.

Under the provisions of the World Bank: The investor is responsible for the

preparation and implementation of environmental management plan. Environmental

consultant supports the investor to prepare the Environmental Management Plan in

accordance with the policy framework for environmental safety in the REDP which

has been approved by Ministry of Industry and Trade and ratified by World Bank .

Under the provisions of Vietnam: The project has a capacity of 2,977 million

m3 reservoir, so the investor has made report of environmental impact assessment

and Nghe An Province People's Committee has approved under certificate No. 5006/QĐ-UBND dated October 7, 2014

PROJECT DESCRIPTION

2.1. Project Location

Ban Ang Hydropower is located in Nam Mo River, belongs to Kien Luu, Xa

Luong communes, Tuong Duong district, Nghe An province. The work position

coordinates 19 ° 15'21.7 'North latitude, 104 ° 24'01.5 "East longitude. Project

Location is distant with the confluence of Nam Mo River and Nam Non River

approximately 4 kilometers and the national road No. 7 from junction of Dien Chau

to Tuong Duong about 150 meters away, Hoa Binh town ofTuong Duong district

about 10 km, from Vinh city about 200 km to the northwest. Ban Ang hydropower

is under the Ca hydropower cascade with the upstream is the Nam Mo Hydropower

project, the downstream is Khe Bo hydropower.

The major work items include the headwork and energy route. The headwork

includes spillway, sand discharging sewer. The energy route consists of the intakes,

hydroelectric power plant, discharged canal, switchyard. The reservoir is located in

Luu Kien and all items are located on the Xa Luong commune, Tuong Duong

district, Nghe An Province.

The headwork is contiguous to 30 households of Ban Ang hamlet to the

SouthEast with the nearest distance of 350 m. The construction site does not have

households and public works; however the project is distant only 150m with the

National road No. 7 in the direction from Dien Chau to Tuong Duong. The project

area does not lie within the range of natural protected areas and national parks. It is

distant 11km to the north with protection zone of Pu Mat National Park , 59km to

the west with protection zone of Pu Huong Nature Reserve .

2.3. Construction method

Material, equipment:

Nam Mo-Nam Non Hydropower Joint Stock Company will hire contractors to build

main work items such as dam, sand discharged drain, intake, powerhouse, canal,

switchyard, transmission line and access-internal roads. The contractors will purchase

construction materials such as cement, steel, oil ... from the dealers in the town of

Hoa Binh, Tuong Duong district which are 15 km far from the project site. Rock is

mined at the mine that is nearby the Ban Ve hydropower toward to downstream Nam

Mo River and distant 15 km with Ban Ang dam or can be purchased at the quarries

currently operates locally. Sand is mined from the Nam Mo River downstream sand

Basin, transport distance to work from 1 to 20 km. Cohesive soils are mined from

mine at left shoulder of dam. Fresh concrete is taken from concrete mixing station at

Cua Rao bridge which is 10 km far from project site. The volume of materials to be

transported by batch in accordance with the construction schedule. With the

construction materials (soil, rock) the investor will make licensing procedures in

place to exploit.

Transportation:

Access road: Access road of project is very convenient because it is only distant 410

m with the National road No.7 towards from Dien Chau junction to Tuong Duong, in

the Xa Luong commune, Tuong Duong district. The investor must open and upgrade

0.41 kilometer of this road as access road.

Internal road: the investor ought to build newly 0.75 km internal road. In addition,

they must build temporary bridges (55m) through Nam Mo River to the downstream

of the project.

Switchyard and transmission lines:

Electricity supply system for construction will be taken from 35 kV voltages

transmission line at Xa Luong commune. The 35/0.4 kV transformers are provided at

construction/auxiliary areas.

The Ban Ang hydropower plant is expected to be conectad to pole of 373 of

110/35/6.3kV Hoa Binh transformar which suplid electricista to Ky Son District in

AC-120 single circuit line, the expected length is about 200m.

Construction organization:

The Ban Ang hydropower project is expected to take 2.5 years to completion of

construction phase. Activities of excavation/backfilling of soil/rock at all project

components, placing large grain size concrete at dam, placing concrete at spillway

are done in dry season while steel reinforcement, on-site formwork at powerhouse

and penstock is implemented in rainy season

Water supply: Water for construction is taken from Nam Mo river. Domestic water

is taken from wells then filtered by man-made tanks

Campsites and auxiliary facilities:

At peak times there are about 300 workers on site. 3 campsites with the area of

about 2,500 m2 are arranged at the right bank, downstream of headword. These

camps are to be installed solidly and have drilling wells, water filtration tanks and

septic toilets. The auxiliary facility with area of 3,000 m2 which is arranged at the

right bank consists of steel shuttering, form-work shop, water-electric base ,

specialized hydraulic laboratories, rock reused storage. The auxiliary facility in left

bank with area of 7,700 m2 includes explosive storage (200 m2), 02 disposals

grounds (7,000 m2), rock reused storage (500 m2).

2 Landslide, erosion

and sedimentation

� Cause of landslide/erosion

- Activities of excavation/backfilling of rock/soil at the main

components of headwork such as spillway, intake,

powerhouse, switchyard during construction phase lead to

risk of landslide/erosion

- Construction of dam and storage water in reservoir will

impulse landslide especially at unstable ground. Moreover,

in case of long, heavy rain, water level rises; the new land is

submerged leading to partial landslide

- The process of discharging water through the spillway will

be capable of causing flood and partial landslide in the area,

� Project features

- The project region is a part of the South West wing of Ca

river structural belt, belongs to the Viet Nam - Lao uốn nếp

domain

- The position of the headwork is located at the South,

Southeast - North, Northeast V-shaped twist of Nam Mo

River. The entire area of dam is lower mountain terrain, no

forest, mainly bush, rare big trees.

- The river is 116m wide, which has almost disclosed stone ,

the continuous flow of water is close to the right bank with

32m width, deeper than reefs about 14m

- Right shoulder of the dam’s route is thin, but terrain is steep,

under the impact shock when blasting or excavation gravity

imbalance, there may arise new landslide blocks. So it

should pay attention during the construction. Left shoulder

terrain is not sloping, therefore it is unlikely to happen slide

slip.

- 30 residential houses in Ban Ang hamlet are contiguous to

the headwork to the southeast, the distance to the nearest

house is estimated to be 350m. 21 residential houses in Ban

Kien hamlet are contiguous to reservoir's protected areas

corridor to the northwest . Due to the location distance risks

to landslide to the local households are relatively close

compared to other hydropower projects therefore the

landslide processes can affect the life and property of local

3 Impacts on surface

water quality

� The main reasons cause to water surface pollution in the

construction phase:

- Domestic waste water from 310 workers in project site (at

peak time).

- This type of waste water contains BOD5, residue, TSS

organic substance

- In average, each worker uses 31 water litters per day. If the

domestic waste is 80% to the provided water, the average

sewage of 310 workers will be 24,8m3 per day.

- To wash vehicles, machines, manufacturing equipment,

concrete maintenance, road cleaning, ... at peak time uses a

relatively large amount of water (about 62.58m3/day).

Because the wastewater from these activities (mainly from

aggregate washing station, vehicle- washing machine, road

washing and a portion of the concrete maintenance) are often

highly alkaline. If they directly discharge, it can increase the

alkalinity of Nam Mo river water and nearby streams

- Run-off water: rainfall runoff over the entire surface of the

work will entrain impurities, especially splattered grease and

dirt from the construction activities and work items,

especially the work of embankment cofferdam, excavation

construction spillway, energy route.

- Stormwater runoff often sweeps under a large amount of dirt,

concrete spillage, garbage, ...so it has high concentration of

solids and other impurities. As a consequence, it increases

turbidity in Nam Mo River downstream, causes sediment

deposition in streams in the region, affects the lives of

aquatic plants in streams and Nam Mo river downstream. If

spilled gasoline, solid waste and construction activities are

not properly managed, these type of waste will negatively

affect to surface water when workers directly discharge

waste to streams and reservoir...

- Organic waste from the decomposition of animal and plant

when storing water of the reservoir.

� Impacts of surface water pollution

household. Therefore, the above effects do not greatly affect

the life and health of the people.

- The decline in Nam Mo river water quality affects to

farming, aquaculture operations of people in downstream

area, However, this effect is only temporary during the

construction period and can be minimized

4 Air pollution � Sources of pollution, the level and objects influenced from

excavation, leveling, construction activities

- Dust and exhaust gases emitted from the excavation,

leveling, transport of materials used in construction,

construction activities and operation of construction

machinery and equipment

- According to calculation, the level of dust generated by soil

and rock excavation exceeds the permission standards from

3.3 to 11.5 times

- However the size of dust generated in this process mostly is

big so the capable of spreading is low. Moreover, the

excavation operation often interrupt, mainly in the

construction area, which is far away from residential area

and campsites, the space are free, so the impact is not

considerable

- The vehicle operators, workers directly involved in the field

of construction, some households in Ban Ang (when leveling

the building of PMU) are mainly affected.

� Sources of pollution, and the level of objects affected by

drilling activities, blasting

- The amount of dust and exhaust gas which is emitted during

blasting is relatively massive. However, by the time it is

blasting, construction equipment must be evacuated safely

out of explosive range (R = 300-400m safety). The amount

of dust and gas does not spread far, mainly 1-3m and

deposited into the ground. In addition, each time landmine

explosion is usually short, the construction area space is

wide open away from residential area therefore dust

exposure level is reduced considerably. The domain impact

is the blasting construction area and quarries. Workers who

� Source of pollution, the extent and objects affected by land

and materials transport processes:

- Total volume of materials used in construction of Ban Ang

hydropower are approximately 258,676.88 tons. In

particular, covering and reinforcing roof rocks are mined in

place, the volume of materials to be transported from other

places are 141, 056 tones. The distance of transport is 30km

(construction materials are purchased in the town of Hoa

Binh)

- The scattered households along the transport route (from

Hoa Binh town to the project area) and the transportative

participants through the project area are the main affected

object

- Scope of impact: 50m from the source.

- The material gathering mostly disrupt, emission gas rapidly

diffuses into space and these effects can be minimized

5 Noise pollution � The level and objects influenced by noise due to blasting

operations

- Instantaneous intensity of blasting noise is up to 95-100dBA

which significantly take effect on the health and life of

workers and residential people.

- Construction workers, people in the surrounding areas, the

species of animals and wild animals living in the forest

nearby blasting area are the core affected objects. However,

blasting activity takes place in a short time (about 0,25s),

usually in the range from 11h30-12h30 and 16h30-17h30

when other construction activities were paused.

� The level and objects influenced by noise due to the

operation of construction machinery

- In a number of areas under construction, noise of working

devices can work up to 80-90 dBA.

- Although the project area have large space, trees, vegetation

will absorb or reflect a portion of noise, but because of the

high workload, the number of machines involved in the

construction are the relatively large so that when the

machinery operation occur simultaneously, resonance noise

will take place

- If there is no noise mitigation measures it will directly affect

the health of employees, reduce the focus ability, increase

energy loss due to physical factors, minimize workers'

reflexion . When the workers expose to high-intense noise in

the long time they will suffer from hearing reduced,

- Workers who directly participate in the construction,

foresters, traffic participants through the construction area

and the animals living in there are the objects of noise

impact. In regard to Ban Ang households due to the distance

of about 300m to the construction area so the level of noise

impact is not remarkable.

6 Solid waste pollution � Generated source, the intensity and the impact of

construction waste

- The amount of rock excavation is 66.56x103m3. According

to statistics, the volume of solid waste generated from

construction activities such as soil and rock mining, leveling,

excavation and construction work items are accounted for

approximately 0.1% of the total volume of earthworks

execution project (equivalent to 66.56 m3 or 116.48 tons).

- Rocks from disposal areas, storage yards, the construction,

demolition of cofferdam will be entrained flow down Nam

Mo river that increase turbidity and sediment the flow,

decline water quality of Nam Mo River . This is unavoidable

impacts during construction of hydropower projects

- Mostly all households in the Ang and Kien vilages do not

use Nam Mo River water to serve daily activities. Therefore,

the affected object is Nam Mo river water quality and

aquatic ecosystem of this area.

- There are also the leftovers of building materials such as

brick, stucco, metal, dead concrete, packages, plastic, waste

rock, crushed aggregate phase, ... to be estimated as 15 kg /

day. This waste is essentially inert to the environment.

However, if they are not collected, they will cause the area to

lose aesthetic and obstruct river and stream traffic flow in the

region

� The generated source, intensity and impacts of solid waste:

- Generated from the activities of 310 workers ( at peak time),

the main components are: organic matter, plastics, paper,

cardboard, rags, scrap, nylon, plastic bottles, cans…The

amount of waste in rural areas is estimated at 0.3 kg / person

/ night this stage, the total daily emissions are about 93kg /

person/night

- The amount of domestic waste is capable of rapidly

biodegradable, so that it causes unpleasant stench. So if there

is no reasonable measures to collect, it will be the source of

environmental pollution, source of disease for workers,

farmers and animal life surrounding areas.

� Generated sources, and the degree of impact of hazardous

� The project construction will lose vegetation, reduce the

number of plant species. The vegetation of the project area is

mainly regeneration forest, tree density is quite thick but

perennials are less, forest reserves are not large, forest

quality is not high (ferns, lichens, wild banana, cement, ...),

grass shrubs, in addition to a number of areas and crops such

as rice, corn ...

� Dust which generates from the leveling, blasting, foundation

and access road construction, material transportation will

deposit on leaf leading to reduce photosynthesis capability

of trees in project area.

� Because of project feature temporary land area of auxiliary

facilities is not large. Construction period only lasted 2.5

years. The vegetation will be restored after the construction

phase

8 Impacts of mining

(sand, quarry etc) for

construction project

� Rocks are mined near Ban Ve hydropower, at the

downstream of Nam Mo River, which are distant with Ban

Ang dam about 15km. Because this is an open pit so it is

exploited by surface blasting. Opencast quarrying by surface

blasting need to use industrial explosives, if it does not

comply with safety measures, it will lead to collapsed mine,

affect the lives and property of residents and workers in the

neighborhood

� Sand is mined from the sandbank in Nam Mo River

downstream, transport distance to work is from 1 to 20 km.

Mining method is using pumps to soak directly into the yard

and then transport it to the project site by trucks. If sand

extraction by directly soaked pumps is not authorized and

supervised by local authorities, it will lead to sand depletion,

about 1.16 kilometers access and internal road; 0.2 km 35kV

transmission line to connect from the project to the national

16 Change of flow in

downstream

� Ban Ang hydropower is within Ca hydropower cascade

which is downstream of Nam Mo Hydropower therefore Ban

Ang hydropower operation mode depends on Nam Mo

procedure

� Because of the type plant project located adjacent to the

dam's foot; hence water used for power generation will be

returned immediately to mainstream dams so that there will

be no influence released from cutting off the flow diversion.

� In the upstream of the dam, hydrological regime of the river

is replaced by the hydrological regime of the reservoir. The

flow rate of water flowing into the reservoir is slower from

the natural flow of Nam Mo River. The water level is higher

than water level of Nam Mo River when there is no reservoir

from 8-10m according to design of the normal water level

and death water level. Thanks to the abundant water

resources, drought and water shortage in the region's dry

season has been partly improved

� In the downstream of the dam, the flow rate, the water level

of Nam Mo river depend on the flow discharge of the dam.

power generation during peak hours so the Nam Mo River

dam section will be in short in off-peak hours. In flood

season, when the daily average water flow is greater than the

electricity generation, excess water will be spilled over the

dam so that water level in downstream of the dam will be

lower than natural water level in the flood season of Nam

Mo river, hence it partly limits downstream flooding.

17 Impairment on water

quality

� If solid waste activities, workers’ domestic sewage,

industrial wastewater containing grease generated from

greasy operations, machinery and equipment maintenance

are not managed well, it will cause Nam Mo river water

pollution. However, this effect is not remarkable and can be

minimized.

� According to EIA’s calculation, total biomass remaining in

the reservoir is estimated to be 90 tons, while storing water,

this biomass will be arsorbed leading to reduced level of DO,

increasing level of BOD5 , degrading water quality, affecting

life of underwater flora and fauna. This effect can be

minimized if the investor makes good clearance work.

18 Impacts on flora � The formation of the reservoir, water srorage for Ban Ang

hydroelectric power will contribute to improve the

microclimate conditions of the area in a positive way. Along

with the formation of the reservoir, air humidity of the area

also increases, the air temperature is well conditioned than

when there is no reservoir, create good conditions for

vegetation, trees grow.

19 Impacts on fauna � After the formation of a stable reservoir, small animals

(civets, weasels, foxes, mice ...), birds, reptiles and

amphibians ... tend to go back to living in the area near the

reservoir.

aquatic ecology reservoir will form new fauna and flora.

noise is not considerable (about 80 dB at 1 m position) . This

will meet QCVN 26: 2010/BTNMT national noise technical

standard

22 EMF � Power Plant: Operation of electrical equipment such as

generators, transformers will generate an electromagnetic

field. Electromagnetic field affects only the workers

operating the equipment if they do not comply with adequate

procedures and regulations for operating electrical

equipment. Effects of electromagnetic fields do not affect the

community as people stay away from the plant and these

impacts could be reduced

� Transmission Line: If the line operation does not comply

with the regulations for the power grid safety corridors, it

will affect public health due to the influence of magnetic

field lines, especially the one who live or work below the

wire in unsafe distance. The statistics show that with the

power grid safety corridors, electromagnetic field intensity

will be less than 5kV/m, which meets WHO standards.

Moreover, the transmission line is 200 meters long and there

is no people live or work under this line so the influence is

insignificant

23 Emergency case � Dam break incident: Flow and the tide of flood exceeds the

maximum water level according to design (P = 1%); Because

flood forecasting is not accuracy so the plant operation is not

prompt when flood happen; earthquake excitation, but this

possibility is not high. Upon the occurrence of a break in the

total amount of water stored in dams (2,977 million m3) will

5. MITIGATION MEASURES FOR NEGATIVE IMPACTS

During construction phase, the contracts will be signed between developer and

contractors who construct internal roads, switchyard and transmission line, main

components such as dam, powerhouse etc. These contractors will sign the subcontracts

with the sub-contractors who provide material/equipment. The responsibilities of

developer/contractors/subcontractors who must comply with mitigation are presented in

Table 5.1.

The mitigation measures must be put into the bid documents/contracts by

developer/contractors as requested conditions to the material provided/constructed

contractors. The Nam Mo-Nam Non hydropower company also signs contract to

construction supervision consultant. The CSC is responsible for monitoring EMP

implementation of contractors. The TOR for CSC is presented in the Annex 2. Nam Mo-

Nam Non hydro power joint stock Company is responsible for joining EMP into detail

technical design and construction biding contractor. The Nam Mo-Nam Non hydropower

joint stock Company assigned one staff who is in charged in environmental management of

Ban Ang hydropower project. The environmental management staff presides and

coordinates to the relevant agencies to: (i) Monitoring the implementation of mitigation

measures following EMP and EIA; (ii) Supervising, suggesting measures to deal with

negative impacts on environment (if any); (iii) Making report on environmental

management implementation and submit to the district’s Department of Natural resource

and Environment and leaders of Nam Mo-Nam Non JSCo, Vietcombank (Nghe An

branch); (iv) Participating courses on environmental management which are held by GDoE

PMB and WB.

� The dam route is located at wide bed of river. The headwork is arranged at South,

Southeast - North, Northeast V-shaped twist of Nam Mo River. The right shoulder is

nearly abrupt with the rock cave nearby the water edge so it creates the negative wall.

The left shoulder slopes gently with the slope less 300. The river bed is 116 m width

which has almost disclosed stone, the continuous flow of water is close to the right

bank with 32m width, deeper than reefs about 14m. The terrain facilitates to put the

powerhouse at the running water side (low altitude) and spillway at flat rock ground.

� The allocation under this scheme will make use of the existing conditions of nature,

limit the volume of dug crop land. At the same time, the transport connection

between the plant and National road No. 7 (all located on the right bank) is easy and

convenient. Plus, on a flat rock there is a small creek in the middle which is low

altitude and very suitable for placement diversion structure construction.

Chance finds procedures

If the Contractor discovers archeological/historical sites, monuments and objects,

including graveyards and / or individual graves unearthed during construction, the

contractor will be responsible for:

� To stop the construction activities in the chance find area.

� To delineate the location or found area.

� To protect the area to prevent the object from being damage and lost. For artifacts or

remains, the night guard will be allocated directly until the local government has the

responsibility or the Department of Culture and Information takeover.

� Inform the Investor to notify for the local government or the nations undertaking the

cultural heritage of Viet Nam (within 24 hours)

Relevant local/central authorities will be responsible for the area protection and

conservation before providing the decision on the later appropriate procedures. Then

they will implement the preliminary evaluation on the excavated findings. The

significance and importance of these findings should be evaluated according to various

criteria relevant to cultural heritage, including aesthetic value, historical or scientific

research, economic and social values

The decision of findings treatment will be made by the responsible agency. This

decision covers the layout (such as in case of detecting the rest of the cultural or

archeological importance cannot be moved) conservation, preservation, restoration and

salvage.

If the cultural area and/or heritage evaluated by the experts and the Cultural Relics

Management agency’s regulation are valuable and should be preserved, the developer

have to change the design in accordance with the required conservation of the area

7. COMPLAINATION ON ENVIRONMENT AND PENALTY

While monitoring the scene if supervising/monitoring environmental officers discover

that there is non-compliance with regulations on the implementation of measures to

minimize environmental impacts mentioned in EMP then monitoring construction

staff/ environmental supervisor shall make the records and report the investor .The

investor will stop paying that month expense for the contractor until the contractor

performed adequate measures to minimize environmental effects. The contractor will

be extended one time (due to the construction supervision consultant / supervisor of

environmental regulate) to correct this violation. If the contractor performs the repairs

within the time extension he will not be penalized. However, if the contractor does not

conduct the repairs needed in the extension period, the contractor will have to pay for a

third party to repair the damage (this cost will be taken from retained). Investors must

make provisions for compliance and sanctions for environmental violations in the

contract with the contractor.

In case supervision staff / monitoring environmental officers find non-compliance with

the environmental regulations of the contractor, the contractor shall have to pay the

cost to repair the violation.

The investor is responsible for monitoring and implementing the EMP effectively. If

he does not fulfill the implementation of the EMP, the slow disbursement from the

project to the investors will happen

Environmental offices of the contractor will be the place to receive complaints from

citizens against environmental influences such as dust, noise, traffic safety, The

Contractor’s Chief Engineer and Personnel Assistant with the safety and environment

officers will be responsible for carrying out or giving solutions to handle the above

issues. Officer safety and environmental construction supervision consultant (or team

management environment of the investor) will be provided with copies of the

complaints of the people and must confirm that the problems are properly resolved by

the contractor in a similar incidents were discovered when examining at site.

8. ENVIRONMENTAL MANAGEMENT CAPACITY BUILDING PLAN

8.1. In the preparation phase:

Developer will send staffs who are assigned to manage environmental

protection of project to participate the WB/GDoE training courses on preparation of

EMP and public consultation.

8.2. In the construction and operation phases:

The assigned staffs shall participate the training courses on WB’s safeguard

policies under REDP. The developer will appoint 1-2 environmental staffs to attend

the short-term training courses on environment which are held by the local authorities.

Additionally, book, papers and documents will be bought by developer so that they

could update the environmental protection information

10. PUBLIC CONSULTATION AND DISCLOSURE

10.1. Public consultation

In the preparation phase, Nam Mo-Nam Non JSCo carried out the following

tasks

1. The feasibility study report and investment report of the project were submitted to

communal People Committees of Luu Kien, Xa Luong. Based on the comments

from above local authorities on locations of the main components, the developer can

revise promptly project documents to get effective investment and mitigate

compensation, migration, resettlement and impacts on environment and

communities.

2. Social survey by interview directly representatives of local authorities and affected

households was done by developer. Results from these investigations show that

almost households and local authorities support to construction of project since it

provides benefits for local residents. Project also facilitates for local traffic from

internal roads.

3. Survey and statistic of environmental impacts as well as affected households were

done.

4. Preparing EMP report

5. Consultation meetings on EMP report and other related issues were held at the

offices of Communal People Committees of affected communes included Xa Luong,

Luu Kien from 18-19 August, 2014. Participants consist of representatives from

developer, local authorities and households of Luu Kien, Xa Luong communes, EMP,

EP, RP consultants, (Minute of meetings and list of participants are presented in the

Annex 3). The main content of consultation meetings as below:

Developer presented the main information of project

� Ban Ang small hydropower project has the capacity of 17 MW, annual average

power output is 68,51 million kWh, is categorized as impoundment, regulated

by reservoir. Catchment area: 3,829 km2 normal water level 85 m, dead water

level: 83m; reservoir capacity: 2,977 million m3 . Reservoir area corresponding

to normal water level: 0,481 km2; the dam length is 122m, the dam climax placed at 90.5 m altitute ; Maximum flow: 145.56 m3/s; ensured flow 16.3 m3/s.

Ban Ang hydropower project is under small hydropower master plan that was

approved by Nghe An provincial people committee.

� Construction of Ban Ang small hydropower project as the same other ones will

cause some negative/positive impacts to environment and social and these

negative impacts are unavoidable. EMP is prepared following to the World

Bank safeguard policies and commits to complying to mitigation measures so

that the negative impacts could limit. Developer also develops CDM for Ban

Ang hydropower project and hope to have support from local authorities as well

as residents for project

Environmental consultant presented generally the environmental

negative/positive impacts and mitigation measures which will be applied by developer

during project implementation as below:

Positive impacts:

� When finishing, project will supply stable power with high quality for the local

people. It will support to development of industrial, handicraft and traditional

sectors in the locality

� During construction and operation phases, project creates jobs for local people

� After formation of reservoir, climate in the project area becomes cooler with

higher humidity that facilitates for development of vegetation cover, trees and

reservoir aquatic species such as fish, snail, shrimp etc. The reservoir could

allow aquaculture to develop in the future which provides new jobs and income

for local residents

� Income from tax of water resource usage which is provided from project will be

added to provincial budget

� Project has installed capacity of 30 MW with annual electricity production of

68,51 million kWh. Project also applied CDM and as estimated the certification

emission reduction is received around 42000 ton of CO2 per year

Negative impact:

Construction and operation of project must block river, storage water, build the

main components such as dam, penstock, powerhouse, switchyard, transmission line

etc that cause some unavoidable impacts as below:

� 78 ha land will be appropriated permanently for building components of

headwork and 6 ha land will be acquired temporary for auxiliary facilities

� Construction activities of components of headwork such as dam, spillway,

intake, penstock, powerhouse and swichyard have to excavation of soil/rock

that cause landslide/erosion at these sites

� Process of blocking river, constructing dam bringing about increasing turbidity

and reduction of water quality of Nam Mo river.

� Activities such as blasting, excavation of foundation, quarry, leveling soil and

rock, material transportation, rock grind, concrete mixing, operation of

constructed machines, construction etc will impact to environment causing air

pollution in case the mitigation measures are not applies.

� In the construction phase, the operation of constructed/transported facilities,

concrete mixing, rock grind, blasting, using driller etc will create noise that

disturb to local residents

� Constructed and domestic solid waste that discharged from workers will cause

pollution of air and Water River if it is not well controlled

� In the construction phase, the aquatic species may lose temporary living

condition due to reduction of surface water quality that cause by random

spilling or rain sweeping away concrete, petrol, oil, gear, soil, rock etc.

However, this is only temporary and negligible impacts. They may be mitigated

because project has small scale and the construction time takes only 2.5 year.

� Storage of water in the reservoir as well as operation of Ban Ang hydropower

plant will cause changing of Nam Mo river flow regime from behind dam to

downstream of powerhouse. In the project site, rive flow regime will replace by

reservoir hydrography regime that performs by fluctuation of water level. In the

operation phase, the reservoir has negative impacts to aquatic species and fishs

which have habit of emigration. This affect is unavoidable when construction

and operation of hydropower projects

Some key main measures to mitigate negative impacts

Environmental consultant presented briefly draft EMP which will be complied by

developer to mitigate negative impacts with some key measures as below:

� The permanent and temporary acquired land due to project construction will be

compensated following compensation plan which is approved by local

authorities. During construction phase, cultivate and public transportation

acquired land for campsites, transmission line and auxiliary facilities will be

limited by contractors

� The contractors are responsible for inform to local authorities and residents on

blasting time so that they do not travel or release cattle in the blasting areas.

� Disposals have to meet criteria: far from surface water at lease 100m, do not

affect to surface water, cultivate land, do not locate on the risk of erosion,

should locate on the hollow sites to mitigate sweep away by runoff water.

� To establish the worker code at construction site containing regulations such as

prohibiting workers to discard domestic/construction waste into surrounding

areas, river, stream or places which may sweep away to surface water.

� Do not allow to burn solid waste to mitigate risks of forest fire.

� After construction phase, the mine, borrow pits or disposals etc must be

restored by leveling ground then planting trees to prevent erosion.

� Planting trees and controlling vegetation cover at reservoir surrounding area

especially in the places of semi-flooding, main components for more stability of

ground

Developer commits to comply with EMP with the main issues presented above

Questions and answers are summarized as below:

Luu Kien commune:

Questions from representatives of local authorities and affected households

Chairman of Luu Kien PPC committee: Support to develop Ban Ang project. Beside

the positive impacts the project also has some negative impacts such as landslide at

river bank (breakwater in front of PPC commune office was constructed already). The

landslide will be impulse when formation of reservoir. Request to promote process of

compensation for affected households.

Mr. Toan, the chairman of Kien village: Questions about measuring flood level

(elevation) the slot region Nam Mo River water which will flood hydroelectric

impoundment lake and the land and crops of residents in coastal areas but that slots are

not counted therefore he requires the investor and land officers measure and

recalculate that area. The inventory of land and assets on land of people are still

missing, hence he requires counting again. He also asks to provide information on

compensation rates for residents. It is necessary to consider the problem of landslides

in crop positions in coastal areas when hydro lakes formed

Mr. Long: Taking into consideration the issue of resettlement and manufacturing

sector, he requires to create jobs and according to statistics there are 62 affected

households and moreover the defining issues as immigration and resettlement ,

problems with local inhabitants: flooding can cause erosion and he ask to create

bulkheads to prevent erosion

Mr. Phu: He agrees with the construction of hydropower Ban Ang, he asks about the

impact of flooding by hydroelectric power (in flood season water does not flow down

into low areas due to dams in the area of plant hence reservoir of hydropower's water

level will rise higher then inundate people in the region). The regional waste of Luu

Kien commune conventionally disposed in this river now will be dammed and stuck in

communal areas.

Others: Questions about problems to coastal inundation level of hydropower reservoir,

landslide problems and safety corridors of reservoir area, the identification of flooded

land and compensation requiring the appearance of village's leader.

Reply from developer and consultant:

Regarding the erosion concern: the construction of hydroelectric projects inevitably

creates erosion. In EMP report, it is proposed the measures to minimize erosion, and

the developer undertakes to comply.

Regarding the idea of compensation level and time: the investor has built the

compensation plan passed by the local government. Moreover, during the demarcation

process of determining compensation, local government also participate in. The level

of compensation is performed according to regulations of the state. If there are

complaints about the tests, the investor will coordinate with communal authorities and

the affected households to tackle. For information about compensation rates, developer

will provide it to the affected households through local government

Regarding issues related to creating jobs for people: the developer would like to

acknowledge and try to arrange jobs for locals in the permitted conditions. Issues

related to stability of life for affected people, the developer has built compensation and

resettlement reports, and commit to comply.

Regarding waste issues: the developer has proposed measures to manage and minimize

the effects of waste during construction and operation of the plant. He commits to

adhere to mitigate this impact.

Xa Luong commune:

Communal authorities and people's opinion: Chairman of Xa Luong commune: The

project occupies an area of about 15-16 hectares of Xa Luonng commune's area.

Occupied land has three main purposes: forest land, livelihood land and agricultural

land in which agricultural land accounts for about 4-5 ha. Ban Ang hydropower project

will not affect remarkably the coastal areas and a few grazing households. The

appearance of workers has a positive impact (trading activities, the exchange of goods,

creating jobs in place for local people, contributing partly to regulate the flow and

reduce flood,). However it also creates negative effects (rising social evils and garbage

and construction waste) to the social economic and environment of the commune.

Opinion of communist party secretary of Xa Luong commune: He agrees with the

principle of building Ban Ang hydropower plant. Project might affect crops, grazing,

and fishing of people in the region. Compensation schedule will stretch as other

hydropower projects

Mrs. Thin (land official): requires the investor to make environmental claims.

Moreover, she wants to know about: Transportation of concrete, materials in the

bridge area is far about 5km from the project affects Highway 7 and arise dust to

people in the roadside. Waste dumping in concrete areas affects region of Nam Mo

River. The discharge of hydropower plant affects the area below the Nam Mo River .

Questions regarding the land compensation rates in the upstream and downstream

project area under the 2013 land law

Mr. Luong Van Chau agrees with the construction of Ban Ang hydropower and states

some impact on the lives of people as the problem of drug addiction and social evils. H

e also represents about : Impacts on the fishing in the area of Xa Luong commune,

people in the reservoir area due to water discharge at the dam area. He asks questions

about measuring the level of flood area in the project area, determining the elevation,

and developer needs to provide information on issues of land and land assets

compensation

Mr. Luyen: Regarding the issue of construction of Ban Ang Hydro Power Plant:

protect Ban Ang relics, satisfactorily resolve the issue of compensation for land and

assets on land (pressing concerns about slow settling compensation in Khe Bo

hydropower)

Reply from developer and consultant:

Regarding comments relevant to the social evils caused by high concentration of

workers, the developer acknowledges and has mitigation measures outlined in the

EMP and will commit to manage workers carefully to limit this impact.

Regarding the impact on grazing of a number of households, investors have taken

measures to minimize such as prescribe blasting time, build the signposts to inform the

construction area, avoid grazing livestock into the project area, therefore he hopes that

local people show empathy and cooperate with the developer to ensure no unfortunate

accident.

Regarding the compensation level and schedule: The developer have established

compensation project based on the regulation of the State and accepted by the

communal authority

Regarding comments related to fishing downstream of the plant as well as the

environmental impact during the construction phase, the developer would like to

acknowlegde and establish mitigation measures and commit to comply with EMP to

minimize those impacts.

communal government in the community consultation meeting as well as in the

investigation of affected households.

Annex 2: Responsibility of construction supervision consultant

The Target

The CSC supports the EMP efficiently during the Ban Ang hydropower construction

To achieve the target of diminishing the environmental negative impacts of the project,

the contractor needs to comply with this management plan. Therefore, implementing

him environmental management plan will relate to the following units:

The safe and environmental supervising officers of the contractor are responsible for

supervising the EMP and problems about safety and environment of the construction

The safe and environmental supervising officers of CSC is responsible for the

construction inspection and guarantee that the contractor will comply with the requests

in the contract and EMP

Tasks:

Overall responsibilities of the safe and environmental supervising officers including

supervision and inspection of construction activities to ensure that the mitigation

measures are implemented as appropriate in the plan so that environmental

management and the negative impact of the project on the environment is diminished.

The contractor is responsible for ensuring compliance with the environmental

management plan of the project and the contract conditions during construction under

the supervision of safety and the environment officer. Therefore, safety and the

environment officer is an independent supervisory personnel to ensure compliance

with the environmental management plan and ensure the full implementation of the

contractor for environmental issues

Personnel monitoring and environmental safety will examine monitor and implement

the environmental review for tenders and contracts for road construction. Supervisors

on safety and the environment have much knowledge and experience in monitoring

and verification of environmental issues and advise investors on implementation issues

of the project environment project. Personnel monitoring and environmental safety

should be familiar with the project work through the review of relevant reports,

including the report on environmental impact assessment (EIA) Trung Thu

hydropower project, environmental Management plan as well as the relevant technical

standards and contract documents.

Being a part of the construction examiner group, safety and environmental staff is

obliged to the following tasks

Phase 1: Preparation

The objective of Phase I is taking foundation for successful implementation of the

project. During this period, supervisors, safety and environment must: (i) consider the

DTM, environmental management plan, project design and technical standards to

assert not to miss these mitigation measures ; (ii) prepare guidelines for contractors in

the implementation of Environmental Management Plan; and (iv) develop and

implement training programs for activities related to construction.

Main tasks for this phase are:

Desk study: supervisors on safety and the environment will review the DTM,

environmental management plan, project design and technical standards and certify in

writing expressly not to omit any mitigation measures. If problems arise, safety and

environment officers propose to the investor for additional updates in the

environmental management plan, project design and technical standards of this issue.

When the Investors, Board of Management and the World Bank project GDoE ratify,

personnel monitoring and environmental safety will conduct additional updates

environmental management plan

Environmental supervision directory: The safety and environment officers need to

create an examination directory during the construction for supervising the

implementation of the contractor. This includes the core issue of the project, the

requested mitigation measures and implementation plan

Diary: safety and environment supervising staff of the Contractor shall keep diaries to

record events or changes possibly implicate the assessment of environmental impact

and non-compliance attached to the proposals. Diaries must be always ready to serve

when the supervisory staff support as mentioned in the environmental management

plan and contract suggest. Safety and environment staff of the investor will verify this

diary.

Environmental training : Environmental safety staff of the investors are obliged to

design and implement a comprehensive training program for the Supervision Engineer,

Owner, environmental safety officers of the contractor (and workers as part of training

for supervisors, safety and environment), the environmental requirements of the

project and methods for monitoring and evaluation, especially should pay attention to:

Environmental management plan: the requirements of the Environmental Management

Plan, approved check list in supervising environmental, environmental sample

monitoring and processing methods for non-compliance with the management plan

environment and all the issues will be mentioned. Special attention should be paid to

the specific terms of the contract emphasized on compliance with the environmental

management plan

Health and safety: Health and safety requirements of the project must be apparently

verified and coordinated to the contractors and the investor (included in the technical

standard environment for the contractors

At the end of training, the contractor will sign a confirmation through training grasp of

environmental regulations, the environmental management plan and compliance

framework, on the health and safety obligations. Construction supervisors must sign

the certification through training understand the oversight responsibilities.

Phase 2 Construction activities supervision

Safety and environment officer of the investors will represent the Owner and

monitoring Chief Engineer:

� Examining and monitoring independently the implementation of the

Environmental management plan

� Performing random checks and review the profiles of environmental safety staff

of the Contractor

� Proceeding the inspection frequently in the building section

� Reviewing the implementation of the mitigation measures is not right with the

environmental management plan and contract documents

� Reviewing the effectiveness of the mitigation measures and the implementation

of environmental problems;

� Reviewing the terms acceptable environmental construction methodology

(including temporary works and permanent works), designs and related

submissions. If necessary, staff safety and the environment have to research and

propose solutions to the environmental impacts discussed with the designers,

contractors and Investors

� Verifying survey cases of non-compliance of environmental quality and

effectiveness of the remedial measures;

� Providing feedback to the Owner and Chief Engineer under the supervision of

the process of non-compliance with the Environmental Management Plan;

� Organizing training programs, including team environmental safety staff of the

contractors, evaluating issues identified an improve environmental compliance

method;

� To conduct the contractors to repairs within the prescribed time, conducting

additional monitoring, if required, in accordance with the provisions of the

contract and procedures in case of non-compliance and complaints

� To conduct the contractor to take measures to minimize the impact and comply

with the environmental management process required in the case of non-

compliance and inconsistency

� To conduct the contractor to stop the construction activities which can cause

negative effects, and / or if the contractor fails to perform the requirements of

the Environmental Management Plan / not conduct operations as directed the

supervisor of environmental safety.

Review of the plan at site: To ensure the consistency throughout the project, safety

and the environment staff must consider the entire plan could affect the environment.

These plans include, but are not limited to: plan pits and dumps. Supervisors on safety

and the environment will be considered and approved the environmental management

of the project and plans to restore the landscape of the contractor. What parts of the

plan does not comply with the environmental management plan, environmental impact

assessment, personnel and environmental safety of the investors will work with the

Chief Engineer and the Contractor to take appropriate measures.

Health and Safety: To ensure consistency throughout the project, the environmental

safety officer must consider the entire safety plan of the contractor, and on the basis of

this plan, with the data of the investor's input, to create a comprehensive plan for

safety projects. Comprehensive Plan about project safety must include processes such

as blast management and safety in the construction process, preventing landslides / soil

erosion during the rainy season, these plans must be reviewed on an annual basis and

must be updated as necessary.

The supervisors on safety and the environment must ensure compliance with the

provisions of health and safety in the contract documents. This Compliance includes,

but is not limited to: (i) the construction activities; (ii) dissemination of education on

HIV / AIDS; (iii) comply with the labor law of Vietnam; and (iv) traffic safety. For the

prevention of HIV / AIDS, not only focusing on the construction site, but also pay

attention to the nearby communities.

In case of violation in the requirements of technical standards, or contractual

conditions or non-compliance with the environmental management plan, safety and the

environment monitor immediately notify to the Chief Engineer of the Contractor ,

Chief Engineer supervision and investor. Safety and the environment supervisors must

also report violations to the Investor as part of the monthly report.

Diary of safety and the environment staff must always be ready to provide, upon

request by the support team of project management

Safety and the environment supervisors have to regularly review records of the

Contractor to ensure that all records are updated in accordance with reality and meet

the requirements of the Environmental Management Plan (etc the records of

complaints about environmental issues).

The unintended effect: In case of the incident which was not anticipated in the

environmental management plan and DTM, safety and the environment monitors must

be closely coordinated with the investor, the contractor and the project manager to

confirm that the problem has been resolved. Safety and the environment supervisors

must update Environmental Management Plan and implement guidelines, based on

that training for contractor personnel

Monthly Payment: safety and the environment monitoring officer must certify the

monthly payment for activities related to the environment as proposed by the

Monitoring Officer safety and the environment to the investor.

Roadwork’s and landscaping restore: safety and the environment monitoring

officer must closely monitor the operation to restore the site and landscaping in areas

such as land mines, quarries, wash stations vehicles, to ensure that activities are carried

out according to acceptable standards. Safety and the environment supervisors must be

consistent with the contractor about the recovery plan which should be implemented

before the end of construction activities.

Human Resource for the Project: safety and environmental supervisors and building

monitors group is expected to be mobilized 1 month prior to construction

commencement. In January, the safety and environmental monitor will be familiar

with the project, project design, specifications, contract documents, environment

protection commitment, environment management plan and other reports and

documents related to the project. Based on the review, monitoring officer safety and

the environment will report a summary of the issues that may arise in the process of

implementing the environmental management plan and the conditions of the contract

the recommend the Manager the best option to improve the process of implementing

the environmental management plan.

Supervisors and safety are expected to be mobilized in the early stages of the contract

to prepare the guidelines, documentation, training,
