BOARD OF EDUCATION MONTGOMERY COUNTY, OHIO

AUGUST 28, 2020

A RESOLUTION TO APPROVE A MEMORANDUM OF UNDERSTANDING

REGARDING A TEMPORARY REDUCTION IN FORCE DURING THE REMOTE LEARNING PERIOD

WHEREAS , due to the continued effects of the Coronavirus, the Board of Education has

implemented a plan for remote learning during the first semester of the 2020-2021 school year; and

WHEREAS , as a result of remote learning, there is a lack of work resulting in the need

for the District to reduce its workforce; and WHEREAS , the Board of Education desires to approve a Memorandum of

Understanding with the Dayton Education Association to implement temporary reductions in force without pay in lieu of layoffs and suspension of contracts (“Temporary RIF”) for certain employees; and

WHEREAS , the affected employees will be placed on unpaid status due to Temporary

RIF Effective September 14, 2020. During the term of the Temporary RIF, affected employees will not work or receive pay, except employees may exhaust or use any accrued and unused personal leave, except for sick leave. The District will pay 100% of the employee contribution to health insurance premiums for affected employees during the Temporary RIF.

NOW, THEREFORE, BE IT RESOLVED by the Dayton Public Schools Board of

Education hereby approves the Memorandum of Understanding between the District and the Dayton Education Association, which is attached as Exhibit A .

BE IT FURTHER RESOLVED , the Superintendent is directed to provide written notification of this action to the affected employees and to take all actions as are necessary or appropriate to implement the Memorandum of Understanding.

BE IT FURTHER RESOLVED, that it is found and determined that all formal actions

of this Board concerning and relating to the adoption of this Resolution were adopted in an open meeting of this Board, and that all deliberations of this Board and of any of its committees that

resulted in these formal actions were in meetings open to the public and in compliance with the law.
