Motion and Title: Staff recommends motion to approve: Contract with Lanzo Lining Services, Inc. - Florida for the Glades Utility Authority (GUA) City of Belle Glade Inflow and Infiltration Improvements Project in an amount of $1,281,845, contingent upon approval by the Florida Department of Economic Opportunity and the Federal Economic Development Administration.

Summary: On October 11, 2011, two (2) bids were received for the GUA City of Belle Glade Inflow and Infiltration Improvements Project. Lanzo Lining Services, Inc. - Florida was the lowest responsive responsible bidder in the amount of $1,281,845. Palm Beach County Water Utilities Department (WUD) is implementing this project under its Management & Operations Contract with GUA. The project is funded by the State of Florida Department of Economic Opportunity (DEO) through the Disaster Recovery Initiative Program (ORI). The project is subject to a 22.4% minority participation goal and a 6.9% female participation goal for trades rather than the County's SBE goals. This contract with Lanzo Lining Services, Inc. - Florida provides for 27.57% minority participation and 0.00% female participation. Staff recommends award to Lanzo Lining Services, Inc.- Florida contingent upon DEO approval of good faith efforts participation goals. Local Preference Ordinance is not applicable to this ORI funded project. Lanzo Lining Services, Inc. - Florida is a Broward County based firm. This project is contingent upon final approval by the DEO and the Economic Development Administration (EDA) because part of the cost of the project will contribute to matching funds for an approved EDA grant (EDA Reward No. 04-79-06327). These are DRI Program funds and require no local match. (WUD Project No. 12-041) District 6 (JM)

Background and Justification: The DEO has appropriated funds for the rehabilitation of the City of Belle Glade's wastewater infrastructure through the ORI Program.

On October 11, 2012, two (2) bids were received with American Infrastructure Technologies Corporation submitting the lowest bid in the amount of $1,177,225. The lowest bid was rejected due to a major bidding irregularity. WUD staff reviewed the bids and determined that the second low bidder, Lanzo Lining Services, Inc. - Florida was responsive and made good faith efforts toward the M/WBE goal. Staff recommends award to Lanzo Lining Services, Inc. -Florida in the amount of $1,281,845. There were no minor/major irregularities with Lanzo Lining Services, Inc. - Florida bid documents. There is no bid protest associated with this item.

The bid opening for the above referenced project was held on Thursday, October 11, 2012. Proposals were received from two (2) contractors: The complete Bid Tabulation is attached. The engineer's opinion of probable construction cost was $1,200,000 for the base bid comprising Bid Item Numbers 1 through 38. The low bidder, American Infrastructure Technologies Corporation, was rejected due to a major bidding irregularity. An evaluation of the second low bid by Lanzo Lining Services, Inc. is as follows:

1. The Bid Form provided in the Contract Documents was properly executed.

2. Bid security equal to 5% of the total base bid was enclosed with the bid.

3. M/WBE Schedules #1 and #2 were provided. The bid documents state a 22.4% minority participation goal and a 6.9% female participation goal established by the Florida Department of Economic Opportunity (DEO) and Economic Development Administration (EDA) for grant funded projects. (Bid Line Items 1-12 and 21-38 are EDA Grant - Matching Funds). The goal is in terms of the Contractor's aggregate workforce in each trade on all construction work. Lanzo Lining Services, Inc. provided 22.57% participation utilizing a M/WBE certified subcontractor (Flotech Environmental, LLC.). Flotech Environmental, LLC. is a state certified MBE subcontractor. As per DEO and EDA requirements M/WBE companies may have state or certification in other

counties to meet the M/WBE goal. Therefore, the overall MWBE participation is 27.57%. Lanzo Lining Services, Inc. has provided a Good Faith Effort form.

4. The second low responsive bidder acknowledged the three (3) addenda.

5. The Contractor holds a valid state contractor's license. A copy of the license information is included. The Local Preference Ordinance is not applicable to this Department of Economic Sustainability (DES) funded project.

6. The second low responsive bidder, Lanzo Lining Services, Inc., has over 30 years of experience with sewer system rehabilitation and will be the prime for that portion of the Contract. The Contractor has listed Flotech Environmental, LLC. as the subcontractor who will perform the work involving, pre-construction video, smoke testing of gravity sewer lines and manhole rehabilitation.

Based on their bid results, the completeness of their bid package, and the responses of their references the Contract award is recommended to the second lowest responsive bidder, Lanzo Lining Services, Inc., in the amount not to exceed $1,281,845.00 for the base bid, subject to DES and EDA review and formal approval by the DEO and the PBC Board of County Commissioners. A copy of this notice has been posted at the bid opening location and will be left there for a minimum of frve (5) business days.

List of Minor/Major Irregularities

The two (2) bids received for the Glades Utility Authority - City of Belle Glade Inflow and Infiltration Improvements project have been reviewed. The errors, omissions or irregularities found in one of the two bids have been noted below.

American Infrastructure Technologies Corp.

1. "TBD" was indicated on Schedule 1 - List of Proposed M/WBE and/or Prime Subcontractor Participation (Bid Form-11), instead of specifying M/WBE subcontractors.

2. Attachment No.5 - Trench Safety Affidavit (Bid Form-15) was not properly completed. "N/A" was indicated under Schedule Item on the form.
