1. Consideration of a motion to grant an off premise beer permit to Rameshbhai Brahmania for Shri Yogi, LLC d/b/a Super Stop Market, 743 W. Lamar Alexander Pkwy., Maryville.

A) Introduction: This is a new business and the owner has applied for an off premise beer permit. The background investigation revealed that the applicant meets all requirements.

B) Proposed Action:

The Beer Board is requested to consider a motion to grant said permit.

C) Financial Impact of Action:

The City would realize additional revenue from personal property tax, business licenses, sales tax, and beer tax and permit fees.

D) Impact of Action on Other Departments/Agencies:

No additional impact other than the enforcement of the beer laws.

E) Staff Recommendation:

Staff recommends consideration based on the information provided.

AND REGULAR MEETING

The City Council of the City of Maryville met for a Public Hearing on December

2, 2014 at the Maryville Municipal Center at 6:30 p.m. Attorney David Black called the meeting

to order and administered the oaths of office to newly elected Council Members Fred Metz,

Tommy Hunt, and Andy White. It was then moved by Councilman Hunt and seconded by

Councilman Metz to elect Tom Taylor as Mayor by acclamation. All voted aye. It was then moved

by Councilman Metz and seconded by Councilman Hunt to elect Andy White as Vice-Mayor by

acclamation. All voted aye.

Thereupon, the Mayor declared the Council in session for a Public Hearing at 6:41

p.m. in regard to the consideration of an ordinance to vacate unneeded right-of-way at the

intersection of Foothills Mall Drive, Howard Jones Road and Westside Drive. There were no

comments so the Mayor declared the hearing closed.

Thereupon, the Mayor declared the Council in session for a Public Hearing at 6:42

p.m. in regard to the consideration of an ordinance to authorize the abandonment of a portion of

Thereupon, Council convened for regular business at 7:00 p.m. when the following

members were present and answered roll call: Mayor Tom Taylor presiding, Councilmen Tommy

Hunt, Fred Metz, and Andy White. Also present were City Manager Greg McClain, City Recorder

Deborah P. Caughron, and City Attorney David Black. Councilman Joe Swann was absent. The

Mayor declared a quorum to be present.

Thereupon, it was moved by Councilman White and seconded by Councilman Hunt

to approve the minutes from the November 4, 2014, Council Meeting. On roll call the vote was

unanimous.

AN ORDINANCE TO AUTHORIZE THE

ABANDONMENT OF AN ALLEY THAT RUNS OFF RULE STREET BETWEEN MONROE

AVENUE AND IRWIN AVENUE, IDENTIFIED AS ALLEY #355 ON THE BLOUNT COUNTY GIS

MAP

WHEREAS, the City of Maryville has determined that it is in the best interest of the city to close all unneeded alleys in Maryville, Tennessee; and,

WHEREAS, the Maryville Regional Planning Commission has reviewed the

proposed closure of the portion of this alley that runs off Rule Street between Monroe Avenue and Irwin Avenue and is identified as Alley #355 on the Blount County GIS map in Maryville, Tennessee; and,

WHEREAS, the planning commission has determined that closure of the right-of-

way will not be detrimental to the general public; and, WHEREAS, the Council of the City of Maryville conducted a public hearing

regarding this matter on the 2nd day of December 2014; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY

OF MARYVILLE, TENNESSEE, that: SECTION 1. That the following described alley be closed subject to the retention by the City of Maryville of public utilities easements extending over, across, through, and under the entire property stated herein. BEGINNING at a point being the southwestern right-of-way of Rule Street and the eastern corner of Parcel 14 as shown on Blount County Tax Map 047I Group “E”; then following the right-of-way of Rule Street in a southeasterly direction 16 feet, +, to a point being the northeastern corner of the alley and the northern corner of Parcel 15; then following the eastern right-of-way of Alley #355 in a southwesterly direction 525 feet, +, to a point being the northwestern corner of Parcel 21 and the northeastern corner of Alley #354; then following the common right-of-way of Alley #354 and Alley #355 in a northwesterly direction 16 feet, +, to a point being the northwest corner of Alley #354 and the southwest corner of Alley #355; then following the western right-of-way of Alley #355 in a northeasterly direction 525 feet, +, to the point of BEGINNING. SECTION 2. This ordinance shall be effective from and after its final passage, the public welfare requiring it.

A RESOLUTION AMENDING THE POSITION CLASSIFICATION-COMPENSATION PLAN OF THE CITY OF MARYVILLE, TENNESSEE.

WHEREAS, it is the responsibility of the City Council of the City of Maryville, Tennessee to maintain the position classification-compensation system, and;

WHEREAS, it is now necessary to make certain changes to the position classification-compensation plan.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF MARYVILLE, TENNESSEE, the following;

SECTION 1. That in accordance with Title 4, Chapter 2, Section 201 of the City of Maryville Municipal Code, the position classification-compensation plan of the City of Maryville is hereby amended by the creation of the position of Engineering and Operations Superintendent.

SECTION 2. That the position of Engineering and Operations Superintendent is added

to Skill Level 20.

SECTION 3. That this resolution become effective immediately upon its adoption.
