(1) the disbursement of escrowed funds heretofore deposited with the Board's Escrow Agent(s)attributable to Tract(s) 2, 3, and portion of Tr. 6 as depicted upon the annexed Table; and (2)authorization to begin paying royalties directly to Charles W. & Laura Perkins, Curby R. Perkinsand Sharlett Quillen.

a. Charles W. & Laura Perkins, Curby R. Perkins and Sharlett Quillen are the gas claimants in

Tract(s) 2, 3 and portion of Tr. 6. As such Charles W. & Laura Perkins, Curby R. Perkins andSharlett Quillen are entitled to 100'lo of the CBM royalties attributable to their gas claims that arenow in escrow and as may be hereafter payable. See Va. Code Ann. 5 45.1-361.22:2.A.b. That CNX Gas Company LLC has previously given the notice(s) required by g 45.1-361.22:2.Ato all conflicting coal claimants identified in the above referenced pooling Order and anysupplemental Orders pertaining thereto.c. That when the Board granted Petitioner's Miscellaneous Petition in VGOB 05-1213-1547-01, it

dismissed the coal claimant Swords Creek Coal & Coke Corp. as a Respondent to theseproceedings. Accordingly, Island Creek Coal Company was not provided further notice under 545.1-361.19and 22 of the hearing set on this Petition.d. That a detailed accounting in accordance with the applicable provisions of 5 45.1-361.22 issubmitted herewith and identified as Exhibit J.e. That an Exhibit identified as Table 1 is annexed hereto, and it specifies how the disbursement(s) is to be calculated and paid by the escrow agent.f. That Va. Code Ann. g 45.1-361.22:2.A.further provides that the Operator shall pay suchroyalties as may hereafter be payable directly to the gas claimant Charles W. & Laura Perkins,Curby R. This new law requires the Virginia Gas and Oil Board to disburse monies placedin escrow because of conflicting claims (between coal owners and oil and gas owners)to coalbed methane gas royalties to the oil and gas owners of the tracts in this Unit.
